I have a question which I hope someone can answer:
My PD is June 2010. I applied for I-485 in Oct 2020 and have received our EAD/AP combo card in Jan 2021 with one year validity so its valid until Jan 2022.
My H1B is valid until June 2021 (as is my drivers license) and my company still has not filed for an extension as we are waiting for the next bulletin to see where the Final Action Date lands. Hoping that it crosses June 2010.

We are in Texas. Do you know what documents the DOT will need to renew our license in June? Will the EAD/AP card be ok? If anyone of you is in Texas what have you done to renew TX drivers license?

You can renew with EAD. I've been renewing my license in DFW area for 8 years now. Take your passport, EAD and I-94 if u have. Here are couple of scenarios that happened to me/wife.
1. EAD valid - License renewed till expiration of EAD, around 2 years, since my EAD was renewed each time for 2 years.
2. EAD expired, but didn't take I94 to the DPS - Lewisville DPS checked online for I94 and triggered a secondary verification, got a letter that I can go back to the DPS with that letter to renew my license. Got a 1 yr extension.
3. EAD expired, took I94 to DPS - Carrolton DPS looked at I94, passport and EAD, triggered a secondary verification, then after receiving letter, got 1 yr extension.

Just in case wondering, my last 2 EAD renewals took 5-6 months, and i applied 4 months earlier.

Oh, why are you not sending updated medicals? I am hearing people say wait for RFE before sending. But sending proactively the medicals might help your case. All you need is flu vaccination as all other previous ones would be valid?
Took a leave of absence from the forum for a week. TSC is simply not approving any GCs. Bad they are not even issuing RFEs. A few people with Jul / Aug 2009 just got their RFEs. If you follow the excel tracking spreadsheets, as of today NSC had sent 82% RFEs and about 30% approval. TSC has sent about 10% RFEs with 1% approval (1 out of 104). My service request got closed without saying any timeframe or saying file is with AO. Congressman inquiry came with a reply that my PD is not current and that only May 22, 2009 is current in March 2021 bulletin. I am overwhelmed on what to do and how to react.

At this rate, I don't know how they are going to approve GCs. TSC in my opinion is taking 6 months to approve GCs after PDs become current. So anyone becoming current in April will be luckly to get GCs before the end of year. They are going to waste historic number of GCs this year. TSC is simply refusing to give any answer to anyone (you, me or congressman). If you are in NSC you will surely get a GC within a month of PD being current or after RFE. If you are TSC, forget it and work on mainitaing status by renewing H1B and EAD/APs. Thats all the input I have as of now.

So sending medical or I485J, do anything that you have to do to bring attention. I don't know if that is going to help or not. Wish there is some insider info on TSC. How can TSC be a polar opposite of NCS. Anyone know what's going on?

This doesn't make sense to me. If dates are advanced without visas getting processed, then there is a big risk of a scenario where some people with earlier priority dates might get backlogged and retrogressed while some people with much newer priority dates get greened. I guess this scenario is better than wasted visas but might be in the mind of CO.

This scenario is not new and has happened in the past when dates moved forward rapidly for EB-2I to May 2010 and lot of folks with later PD (2010) got greened while many from 2009 are still lurking around. LIN has been pretty good with processing but with the slow TSC center, I do not see them processing many 485's that were filed in 2020. This may lead to small retrogression as CO may not apply the spillover at the start of the next FY but dates should move pretty consistently every month. Chances for folks that have sent their medicals during the initial filing last year and those who have received the RFE already and who will promptly respond are pretty good to get greened this year as they will be the low hanging fruit for USCIS to pick.

I feel your pain and those stuck in TSC . Looks like you have tried everything you could , I can't think of anything else . I am sorry .
When I wrote to my congresswoman on the dates not moving back Jan (when DT moved dates by 2 working days) , her office got back in a couple of weeks with a few Qs. by the second week of feb they said that they had spoken to the USCIS about the issue and will get back in the first week of march . My dates went current late feb and they mailed that as I was current they will wait for 30 days . If there was no activity by April on my case to contact them . After my approval last weekend , sent them a thank you note which her office acknowledged . Looks like there is a wait time of 30 days for them to do any follow ups because they said that if the card is not mailed in 30 days they can follow up . I received an email that my card was posted yesterday . I guess the USCIS tracking number will be issued today .

Can others in TSC try to reach out to their congresswoman/men . Maybe there is someone who will help .

Looks like all the attempts being done to wake up TSC have failed. Only hope would be if they transferred the cases to other service centers.

I suspect TSC is prioritizing 2020 downgrade and EB1 applications over anything else at this moment.

Hi all, quick question. Can someone explain how cases are processed based on what service center they at. My receipt is MSC so I know its at NBC, but NBC does not adjudicate 485 right? They only provide EAD and AP based on 765 and 131 forms? So the people that have SRC (Texas) and LIN (Nebraska) service centers, are these service centers allowed to adjudicate 485? Does NBC reroute to local USCIS office for adjutication?

It looks to me like there is a very deliberate attempt to not do load balancing by transferring cases or send RFEs. Can only hope and pray things get better. I see the odd one to 3 cases a day trickling in for approvals on trackitt, but seems like those people are not updating their profiles on trackitt itself to begin with.

But this is not factually accurate, your priority date as per your signature is current as of March 2021 VB, so can you not seek further clarification from your congressman?

I have spoken to a Level 2 officer with regards to my case and the only thing he could do was to create a service order number for me and pass it on to TSC with a timeline of 30 days. All this is very disappointing. EB2/3 India has already been treated like a foster child, and now they are discriminating against us based on which service center your application landed!

yea, that is why I am not sure. Maybe the case only gets bounced to your local field office when an interview needs to be scheduled. Does anyone else know how it works?

Yes. Sometimes we have think a few moves ahead. My congresman liason is new and young. He had helped us before and we have buit a good relationship. I don't have issue with congressman, they will just relay what we say. Just thinking how to corner USCIS. If we make a move, how are they going to counter. They have made a mistake and sent a wrong information. That's a good start.


At this time there are no visas available for your constituent under their current classification and priority date of November 23, 2009. According to the Department of State (DOS) March 2021 Visa Bulletin, visas in this category are available for those persons born in India having approved petitions with a priority date of May 22, 2009, or earlier. Visa availability cannot be expedited due to numerical limitations set by statute.
They sent the correct link for VB to Congressman. If you click, you will know that what they are saying is not true. Just don't know what's the USCIS strategy.

wonder what the chance is that they bounce the application to the service center that has the least load at this time and is processing more. In this case that would be NSC of course. I thought that the primary role of the local field office was just interviews so if interviews were indeed being waived, maybe its approved elsewhere.

NSC is in Jan 2010 now . So raise an SR , no harm . I am in Dec and Should get the card in hand by Monday. My Friend is end Dec and already got his on tuesday .
Wait for a couple of weeks or three after SR before approaching members of congress.

While the things are little better at NSC the approvals have been not consistent with any pattern. There seem to be only few officers approving the cases (as per trackitt data) and many more with PD Sep/Oct/Nov 2009 are still waiting 2-3 months after responding RFE. In the past few days approvals have dried up (specifically this week).

In the RFE letter they have mentioned that if you don't get response 60 days after RFER date then you can call them.

Hello everyone,

I have been a silent observer for several years but here is my situation.

My PD is August 28,2009.
EB2I

I did not file I485 in 2012.

I filed I485 in 2020.

Got my EAD, AP and done with biometrics

Do I wait for RFE and interview as I have not filed before 2017?

are these from the 2012 batch or those who applied recently . It could be that the pre adjudicated cases are only being approved . I am not where what the bottle neck is .

People who applied in 2012 and replied to RFE in Dec/Jan. I would be surprised if these cases are not pre adjudicated already (at least majority of them). It's like a blackhole.

I recently checked with manager and he confirmed there won't be salary raise after i get GC :) , my bank told me mortgage would be the same :) and my wife is planning to visit India at least twice a year (instead of once a year) once we have GC. So there is that. :) :)

This might be a stupid question for many. How do I know whether my case will be processed at field office or service center?

Choosing I-485 on https://egov.uscis.gov/processing-times/home, I see a dropdown for SC and field office. What do I choose? My SC is MSC i.e. NBC.

My PD is August, 2009.
EB2 I.

I couldn?t file in 2012

I filed in October 2020 and got my EAD and AP.

How do I find out if my local office is processing which year and month applications?

Also-could you tell me what is my next step? Just wait?

How will a person will come to know if his application has gone to TSC or NSC? For e.g. my application for AOS has gone to Texax(SRC). When my PD will be current in future, how will I come to know if application has gone to TSC or NSC?

Your receipt will have "LIN" if NSC - Stands for Lincoln, Nebraska .

Many(lot) of my co-workers have already received finger print/biometrics notice. I still havent. Are there others here in the same boat? Any suggestion? Not even talking about getting the GC yet. It seems the delay there is 13-27 months. It still feels like a good bet to get GC as an illegal (even after being current) then through legitimate means. We are really being treated like shit.

Hang in there buddy. My RD is 10/29 with NBC (receipts start with MSC). I got my biometrics on Friday for 4/15. I?m sure yours are with USPS.

RD 10/29 for me and my friend. We both haven't gotten fp, biometric notices yet. Waiting patiently.

My RD is 11/02 with NBC. Yet to receive bio-metrics notices for me and my kid. However we did get my wife's bio-metric notice 2 days back for 4/12 as we filed an expedite request for her citing job loss. Hopefully i should get it in a couple of weeks.

There is no update on my 485 application. I applied for EAD/AP in Jan, and biometrics appt update came with that. Funny thing is, I received 2 biometric appt (same day same time), one for my ead and one for my 485.

If you have applied for your ead and received a receipt notice, sign up for uscis online case tracker. Online case status (for ead/AP) updated a week earlier than the physical receipt notice. Still no change to my aos online status.

I am also from Dallas location and RD 10/29 with NBC. I have not received biometric notice yet. I heard it depends ASC availability but not sure how long its going to take for BM notice.

However USCIS said there is nothing that can be done other than the immigration counsel calling in to sort it out

Sorry to hear about your situation. There is a column on your I485 receipt notice that clearly says priority date and there is a date below that. This seems to be a genuine situation for your immigration counsel to help sort out, especially after they are being paid for their services. They are clearly not working in your best interests. Might be good idea to change counsel to Murthy or another reputed attorney to sort this out. If its company appointed counsel, then I understand its probably not feasible to change attorneys, since your employer may decline to support you. Wishing you good luck and prayers.

I think @Idliman also got a similar response. Maybe a glitch in the software or the person responding to SR didn't know where to look? Can you resubmit the SR?Or do you need to wait for sometime before reapplying? Assuming you applied in 2012, you probably have a EADs approved by now, so the overall system should be okay?

It means that you provided wrong information while creating service request. Did you provide correct A# for your receipt number? I got the same reply once and I realized that instead of providing my wife's A#, I provided my A# by mistake.

I provided the correct information, but don’t know what is wrong and in the response it has all the information I provided and double checked it, I don’t see anything wrong. Surprisingly it brought up attorneys name and information in the response. I sent the SR response to HR to see if they can check with Attorneys and create an SR for me.

In that case, I suggest that you talk to Emma and ask for "Live Agent Chat". Tier 1 agent might be able to help you - tell them you are the applicant and provided correct information in the SR and request them to escalate the request.

I think @Idliman also got a similar response. Maybe a glitch in the software or the person responding to SR didn't know where to look? Can you resubmit the SR?Or do you need to wait for sometime before reapplying? Assuming you applied in 2012, you probably have a EADs approved by now, so the overall system should be okay?

I think you should pursue this as a error / mistake from USCIS. You might get better response then. But you want to be delicate and not piss them off in process. I don't have positive results yet. So whatever I am saying is all a theory till it is proven.

Looks like we all have to cross seven seas and seven mountains like Sindbad to get a GC.

Did you open the SR yourself via website or you had called the 800 number and an agent opened it on your behalf?

I did it via phone. They will not open a SR unless all info checks out. So my guess is you did it yourself via the web portal and something got missed up behind the scenes.

I think you should use this and demand an audience with Level 2 agent. Keep pursuing. Tell them that the system cannot accept a SR unless it verifies your identity. Blame it on some computer issue. Keep on pulling the tread. You just got a hand and it is a genuine reason to speak to a L2 agent. Honestly, I don't know what is going on with TSC.

The one place I see a FAD of May 22, 2009 for EB2I is March 2020 bulletin. Is it possible that TSC is still referring to a pre-pandemic bulletin?

Thank you very much. I guess that explains the date and the response from USCIS. Might be a genuine user error from the person who had sent a response. Somewhat silly considering that dealing with VB is bread and butter job for them. I had already sent a counter to them without knowing this. I will have to wait for a reply.

My intent now is to get a 45 or 60 day commitment from them first. Right now I (along with other TSC folks) have no idea as many people with earlier 2009 PDs are still waiting for some action.

The telegram group that was shared within Trackitt also has a few such cases where an incorrect priority date was quoted in the response. There as well the I-140 receipt date is being quoted as the priority date. Hoping there is ineptitude and not malice from USCIS in such SR responses. If its more widespread, speculating whether that is the cause for lack of TSC movement.

From April 2021 onward, the October filers will gradually be eligible for AC 21 and H1B transfer. Will these new petitions impact EAD/GC processing speed?
Not sure if the same USCIS manpower is allocated to process all kinds of applications.

Is this the same workforce working on H1 and I-485? This happens every year with H1 season in April so obviously not a new thing.

The difference is .. this time USCIS has visa number available to process massive EB 485 applications and minimize visa wastage. This was not the case earlier when the date movement was not so aggressive and USCIS didn't have a visa number to allocate.

As much as I try to keep my emotions checked, I often find myself feeling exactly the way you described USCIS and its incorrigible staff. And, I heard all about the "COVID causing delays" excuse earlier this morning when I spoke to the service rep. It's such a jaded worn out response...but it's either that or it's some form of micro-aggression.

I feel that they don't give a rat's a** about wasting away visas no matter the consequences to the thousands that pay for their budget....

The answer is complicated but I will try to represent my angle.

The main reason attorneys say wait for RFE is that the RFE has a barcode on the front that helps the lockbox to direct the new material to your file. When you are filing I-485 Supp J by itself there is no barcode. However, I-485J has A#, I-485 Receipt Number and I-140 Receipt Number. USCIS has an established process for I-485 Supp J. So I am pretty sure that they can link the standalone I-485J to your file. USCIS should have improved from the age of Dinosaurs. So that's the positive argument for sending I-485J proactively. If you are doing that then submit I-693 and G-325A along with it. You need to watchout for the validity of I-693 and timeline expiry and such from the date surgeon signs it to the day USCIS receives it.

When I did I-485J before pandemic, I sent it in March and by October my RFE response was accepted. I delayed the I-693 and took it to the last 15 days as my FA was not current. So thats an intentional 2.5 month delay. The normal response time now is about 2 months for I-485 Supp J. My guess is that it may be 2 to 4 months now. If the attoney or yourself write a covering letter saying FA is current and request adjudication, I think you will be good. Even if they lose the I-693, my guess is you will lose about $800 max for one primary and one dependent. I would still take the shot.

Now you are in TSC. As you know TSC timeframes are all over the place. You need to watch the excel tracking spreadsheets for the last few months (from Oct) and get a sense of response times from TSC for I485J. Then you decide whether it is worth it to send I-485 Supp J proactively.

The manager at USCIS center tried to lookup but did not get any information but said that USCIS might use 485 fingerprints.

Anyone else in this situation?

We gave fingerprinting done on Mar 22nd. When can we expect EAD/AP? Our case is being processed in NBC.

Don't wait for anything. Just start the renewal process and send in renewal at the start of 180 day clock. Don't take chances. I am sure your GC will get approved. But it is not worth it to sweat about it at the last weeks.

Wow 5 weeks to just get a receipt? Good that I applied more than 5 months before expiry ! Mine expires end of August. Has your spouse gotten their EAD approval yet? How long are you waiting?

She has not received her combo card yet and her present one is expiring in few days. Don't worry, you will receive yours on time. You still have plenty of time left. Even my wife's employer is unaware of 180 day extension and her DL is also expiring. This entire thing is so frustrating and time consuming.

Absolutely no inquiries from me or my attorney, I had low expectations considering they would have started looking from tomorrow. Also this is my first ever RFE since filing in 2012. And I am a primary applicant with no dependents.

Well actually I did give a heads up to my attorney as soon as the visa bulletin was released saying I would be current beginning April 2021. They just told me that they would wait for the RFE paperwork to come and let me know.

I got the similar one. My (primary) biometric appointment letter had 485 and EAD but my wife's had only 485.
Both of our EAD got applied the biomentric and approved at the same time.

I did my last medical with my 485 filing in 2012, so cannot recall what was done as it was many moons ago. Do the drs know what tests and vaccinations to recommend the applicant take or does it get specified in the RFE?

Since your last medicals were back in 2012 your DTAP shots will need to be redone as thats valid for 5 years only. the other shots should be ok and if you have proof or go to the same doctor they'll be able to pull up hopefully from their database. Bloodwork will be redone.. I will most probably do the full spectrum of tests and shots again because I frankly cannot recall which dr I went to way back in 2012. And how long does it take for the drs to have results ready for me to mail to the uscis ? Also I keep reading about 60 day validity of drs signature for the medical exams? What is the 60 day validity for?

I was told by my the doctor who did my medicals that TDAP is valid for 10 years.

TDAP is mandated .

Flu shot is not needed from today till the next flue season starts.

The results of the blood work should come back within 7 to 10 days .

As far as I know, the 60 day validity is: USCIS should receive the sealed i693 form within 60 days of the date the doctor signs the form.

You can look up the list of doctors near you on the USCIS website . I would maybe call at least 2 or 3 near you to get an idea about their charges and so forth.

Also you need to be updated on Flu vaccine. These two will be covered by insurace. So you can take it now itself. But keep the proof of the shots to submit to the surgeon signing I-693.

Use USCIS website to find approved civil surgeon. Also you can shop around to see the costs. Visit trackitt or other forums or google to recommendations for Drs in your area. If the Dr says, it is required for USCIS, insurance will not cover it. So it is better to take vaccines separately from your primary physician office.

There are new blood tests for TB and STDs. Things have changed since 2012.

If you go to the same Dr, they will have proof or last medical forms. So it will just be a continuation. Our Clinic gave us copies of everything in 2012 which was helpful in 2019. If you go to a new Dr, they might ask you to provide proof or retake some vaccines again. It is just a matter of money. Good Luck.

For some immunizations your are not sure of , they also do a blood test to determine if there is a presence of antibodies from what I recall . TB test is now a blood test which is a relief . We took immunizations with our regular GP and the insurance paid for it as it is a preventive . But we paid like 500 for each application . Documentation charges :mad: they claim, but then they gave us the forms in 4 days . Everything is expensive these days.

There are a lot of folks like me from TSC who are still waiting for RFE since becoming current six months ago.

Hi, I received the physical RFE letter by postal mail. It only asks for supplement J, G325a and medicals. Does the supplement j replace what used to be an employment letter requested as evidence or did we need to send an employment letter also even though the RFE does not request it?

Yes. I-485J replaces and formalizes the process of AC21 letter. G-325A is just biographic form. Make sure that you provide your last residence address in India (even if it is 20 years old). They are looking for completeness of the form. This is a standard RFE. Just ask attorneys to take care of it. You should not have any issues. Good Luck.

@idliman - did you receive any RFE? I saw a couple of cases (filed in 2012 with PD in late 2009 AND never received any RFE) that received RFE from TSC this week. Isn't that strange - what could it be suggesting? What order are they following and how are they processing cases? This seems to be getting more intriguing by the minute.

As i have seen in other forums like trackitt, it seems some folks have raised an ombudsman request. Not really sure how it works though. Reaching out to Congressman and Senator (either one of them) really could help. Opening multiple SR's could be counter productive. As I understand, when you open an SR it is assigned to one immigration official at the service center and it will be in his pile. As it moves up (assuming that they work their cases in an order) they will get to the SR. But opening a second one again, will move it to another official and the process will repeat. It may never get to see the light.

Sorry, I do not understand it as I am not following the Excel or Whatsapp or telegram threads. People who have subscribed to that might have a better understanding. I saw that the RFE rates for TSC is up in Excel. But they may be counting people who go RFEs even a few months back. If I figure out how to crack the code, I will definitely share. I have communicated back to USCIS claim that my PD is not current. I am waiting to hear their reply. That's it.

Idliman, Thanks for the response. The attorneys are going to take care of the rfe response. For the G325A, they said provide only history for the last 5 years going back from today. I will double check about the last india address though , which is my case is going back 18 years. Thank you for the tip and praying for all earlier PDs to get their cases adjudicated as well.

I dont think so. TSC is capable of doing all by themselves. I believe it is just that they have a lot of cases that need to work on and seem to be very slow.

The doctor has to fill the I-693. However, some medical practices may ask the applicant to double check or fill the personal details (Name, DOB, A#, address, etc.,). Some may even give you a courtesy copy of the form. But the medical results are confidential and provided in a sealed envelope to you. It should be in sealed condition and only USCIS can unseal it. You will send the I-693 sealed packet along with other things that are requested in the RFE to USCIS.

1) Find a doctor using the link

I found the doctor using the above link and called them first. They knew exactly what needs to be done and I asked them whether they will provide a digital scan of all the pages before sealing it. The doctor office obliged with my request.

2) https://www.uscis.gov/i-693

Downloaded the I-693 from the above link and did not use the one at the doctor's office. To be safe, its always better to use the latest version. Then I filled two applications one for me and wife. I filled as much as I can - the two pages. I didn't sign and date it and left it blank. One nice thing about filling it on the pdf, the header with name and A-number are pre-filled based on what you type in the first page. Then took the printouts and handed it at the front desk.

3) I usually go to Walgreens for my shots and hence went to Walgreens and asked for a report of all my previous vaccines shots and they provided a nice report. I also provided this at the front desk.

4) They went over my immunization record and asked me to take the missing ones and also gave me the list of blood tests to be taken. Usually, they partner with a lab and I called up the lab and scheduled the tests.

5) After, giving the blood test, it took almost a week for the doctor office to receive the results which was negative as its for STDs ;-) After that, scheduled an appointment with the doctor and for the actual appointment. This is my second medicals and every doctor has a different way of doing the physical exams. So don't be surprised if the doc asks you to pull down your pants :-)

6) After two days, I got a call saying my report is ready. I went to the office again and both of us signed and dated the second page. Then I asked them to email me the scanned copy before sealing it. I forwarded it to my lawyer and she OKed it. I'm lucky to have a lawyer who makes sure everything is perfect. I mailed the sealed I-693 to my lawyer instead of USCIS. The lawyer would have received a copy of the RFE as well. So the lawyer fedex the both forms along with the pink RFE document.

Anyways, after two days after my lawyer mailed the package, my case status was updated acknowledging that the USCIS received my I-693.

My PD is FEB 13 2010 applied I-485 J in 2019 got approval and RFE for medical 2019 Feb and submitted, waiting for medical RFE again since it is expired in 2021 Feb I am unlucky guy :)

Yes i have not received it yet. but USCIS works in mysterious ways, in past i have seen H1b extension took like 6-7 months but the approval date was from the filing date. so i was worried if the same thing happens and if we don't file for renewal on time (6 months before expiry) then it will cause issues with work authorization.

this is my first time filing EAD so i do not know what to expect.

Applying for an EAD renewal you have not even received!!!!

Is anyone's I-485 approved without receiving receipts for Supplement J or it's approval? My RFE response was acknowledged by USCIS on 03/26 but not received Supplement J receipts yet. I have been current in April bulletin, so far no updates on case status after acknowledging the RFE response.

Seems like that is possible. But it's a bit convoluted/complicated concept. Could be a potential grey area. But it does not seem pretty useful in situation where 485 is denied as it would be construed as out of status.

I applied PP for my case on 27th of Jan. It was radio silence for a few days and then suddenly my online status changed on 11th of Feb about PP acceptance. Then my PP got approved on 23th of Feb. I know a few folks who had their PP rejected the first time and then it was accepted the second time around when they refiled it. I think the radio silence is because they are taking some time to receipt/acknowledge the request. Once accepted however the approvals or RFEs are coming in within 15 days. This is an anecdotal account based on my and my friends experiences. Not 100% sure if the broader trend is the same.

Thanks for the info. I will just sit tight for now and see what happens.

In case of my friend who also opted for EB2 to 3 downgrade at TSC in Oct 2020, his Law firm Fragomen filed for PP only after getting the receipt and he got his I-140 approval in around 10 days. It could be that your application for PP is lost at the uscis facility.

Possible. I will have to wait for few more days. Since my attorney has already contacted premium processing unit of USCIS, I will have to let him handle the inquiry part of it now. Worst case scenario, if nothing happens by next week, I will tell my employer to send an inquiry through the Senate office and get this process expedited. Thanks for the input.

Thank you for checking. i am in a weird situation. i am waiting to join the new company(once i complete 180 days) but they don't want to transfer my H1-B because it was not discussed during the offer extension period. so i applied for expedited EAD request and its pending. if EAD is the only thing i am going to use in the future then i am trying to make sure i proactively prepare for renewal. i dont know what others are doing since most of them are hitting the 180 mark. so i was trying to clarify.

Thanks for clarifying your situation. However based on this link,
(https://www.uscis.gov/green-card/green-card-processes-and-procedures/employment-authorization-document) you have no option to apply for renewal of an EAD you have not received.

In case if this helps unlike H4Ead, you can work for 180 days more with an expired GC - EAD.

How do you file a request to expedite EAD ? do you mean you contacted the senator and have their office raise a request ?

Use Emma on USCIS website and chat with a live agent and have them raise the expedite request or you can call the USCIS customer service as well. You will have to provide a reason for requesting expedite processing, so make sure you are able to provide that.

My colleague also got RFE for medicals today along with I-485J receipt. He submitted his application in Oct 2020. PD: EB2I May 2011/ MSC**********. Not sure why he got RFE for medicals this early.

I have heard that sometimes online case status is not updated nor are the text alerts sent out when an RFE is issued. So, you cannot rely on these updates.

No, strangely they did not ask me for any documents. I guess they may have seen on my profile that my H1 is ending and renewal is pending - actually got an RFE on that today which is weird because I have been working at the same place for 13 damn years! :)

My case status got updated today and it a RFE update! My PD is EB2I April, 2010 (TSC). I don't know what the RFE is about, but I guess Medical. So if you ask me, the case status gets updated first.

@Vedu: What is your I-485 "received date". I am curious if TSC is going with the order of the received dates for all those that are current.

Mine is Feb 14, 2010 priority date, with a RD of March 9, 2012. No news so far. I raised an inquiry with my local congressman last week. So far no response from USCIS.

I have provided a copy of my original BC(without my name just parents name) and a notarized affidavit from my mom which indicates my name I made in 2010 when I was filing. My wife also had her original bc with name. She also got an RFE.

Marriage certificate also I provided the copy of original I got .

I read somewhere in trackitt that TSC is bogged down by the downgrades and hence are not focussing on the original 2012 filings. It is also correct that there is no consistency in how they are processing. It almost seems like a stroke of luck.

Same thing happened for my derivative.

We applied in October, 2020.
Both of us had our biometrics done in December 2020 and our dates are current since March, 2021.

I got code 3 biometrics for both 765 and 485.

But my spouse got only code 2 for 765.

He has not yet received another code 3 biometrics notice for code 3.

But, I had read many posts of Trackitt, with many saying that they got another code 3 biometrics notice later.

Don't know when that will happen for us!

I think it may not matter. For my response I signed but then scanned it and sent it over to my attorney who sent the documents to USCIS. So effectively it became black (because of scan).

I understand your excitement but nothing anyone can suggest until you get the actual RFE and reveal the details. Even if someone guess and give you an advise it's going to be of no use for you. Be patient.

No, it was just the I-797C notification stating my I-485J has been received. Still waiting for the RFE mail, either tomorrow or Monday. RFE was showing up for me and my wife.

Strange that you got an RFE even after submitting medicals and Supp J. Did you include a complete birth certificate and if not complete, affidavits etc.? I know some people who got birth certificate RFEs because as is normal a lot of our BCs from the 80s are just bogus with spelling errors and missing parent/last name info etc.

The Lawyers have advised me to always use Black ink . Though once I used Blue and it still went through many years ago.

Recently I met one of my friend who lives in Charlotte and was with TSC before being greened back in 2017. He went through congressman for getting greened after staying current for almost a year and raising multiple SR's. The one key point that he mentioned to me is that each time an SR is raised, it seems the file is moved from one officer to another officer and goes to the bottom of the new pile of files. So the congressman's office advised him to not raise multiple SR's there by risking every time going to the bottom of a new pile. Just heard about it couple of days back. Others may have better experience.

Filing an SR is good as it will show up hopefully on some dashboard about the inefficiency in the TX center. I doubt if it will help trigger an RFE as the SR is for an exception but in the case of TX service center it seems to be a norm. Lets hope things move sometime soon.

That is an interesting viewpoint. So is a Congressperson / Senator enquiry treated as a service request? I would think USCIS would have dedicated liaisons that work with United States Congress.
So should we reach our local representative/senator and raise a SR at the same time or do them one after another?

My USPS informed delivery shows to letters today. I don't think I had this much anticipation anxiety of an unknown before.

Initially I thought it was RFE from TSC but turned out to be receipt notice for the supplement J that I submitted proactively :-(

Our applications were sent to MSC (National Benefits Center - Kansas City). Applied in Oct 2020 and included medicals.
1. Do applications get transferred to another services center - TSC or NSC for I-485 approvals? Or does MSC also approve I485 and issue GC's?
2. Since we had already submitted medicals in October along with the application package should we expect any RFE? I also received our SuppJ receipt sometimes in March.

Opened a SR with TSC in Mar 1st week, that got closed without providing any timeframe. Case needs special something.

2nd attempt:
Congressman request. Came with a reply of PD not current.

3rd attempt:
Congressman opened request again. Got a reply after 25 days. TSC replied that my 60 day window for an action starts today. Had they started the 60 day clock on March 1st week, I would have gotten a RFE by now.

4th attempt:
I have asked my HR to send a request to attorney to call USCIS. Lets see how that goes.

Don't know how many more attempts that I need to push the file through in TSC. I feel defeated for today.

I am in a similar situation, my congressman request is pending for a couple of weeks now.
After being frustrated at no change, I submitted a SR on my own. Just after I had done it, my lawyers sent me a note that they had reached out to USCIS on my behalf !
I am maintaining my own lawyers when I invoked AC21 in 2012 to change jobs.
Adding to all this is my EAD/AP renewals are pending with TSC.
I just hope that one of these arrows hit the mark and TSC picks up my file !

Hang in there Idliman .. I am in the same boat and been current for a 5-6 months now. I got the RFE, but the response got delayed due to various USICS/lawyer/doctor snafus and now finally, my spouse's RFE status didn't get updated at all despite it being a month since USCIS received it. And of course, radio silence all over again from TSC. At this point, to keep my sanity I have reduced my forum checks to once a week or so. Also, lawyer is prepping for yet another H1B renewal in a couple of months .. coz, who knows eh?

I got my Biometrics done (ASC - Kansas City, MO) along with my spouse on 04/16. Status for I-765 application changed to 'Case Is Being Actively Reviewed By USCIS' within couple of hours and it has stayed the same since for both of us.

Any experiences on how long does it take to get to 'Card Produced' from 'Active Review' :)

My I485-J, G-325A and I-693 forms were submitted as part of I-485J done in Oct 2019. They are valid till Oct 2021 (2 years from the signature date of the doctor). However, sending another medical RFE is entirely upto USCIS.

Did you do your 485j as part of a change of job? I ask because, I am planning to change job this week (6 month is done). So, when my new employer sends 485j, can I use that opportunity to send medicals too?

Ofcourse I changed jobs technically (company split - complicated - I stayed in same seat doing the same job on the same computer). The attorneys advised not to proactively file I-485J. I forced it through as the company was facing a layoff situation. My HR was very open and supportive (once I explained the worst case scenario). In that situation a completed I-485 file with current I-693, might buy you additional time even if there is a layoff. Like clockwork, we got RFE for G-325A, and I-693 (primary and dependent) two months after I-485J was submitted. That was in Oct 2019 and before pandemic.

If you are doing it now (proactively), I don't know the recent processing timeframes. You need to analyze if it is going to help you or not. If you are in NSC, they process very fast and proactively send RFEs. If you are in TSC, it is going to be a struggle. It may help you or endup taking the same time. You may need to take a chance. But it is 50/50 either way.

The ideal situation is to wait for I-693 and G-325A RFE 2 or 3 months after sending I-485J. However, if your FA date is current, then I would lobby the attorney to send everything together in one packet. You can take the chance, I believe.

Everyone's situation is unique. So your decisions are based on the current situation. If you need any clarifications, please post or send a private message (if it involves personal data). I always try to say good or bad things as it is without sugar-coating. It may not make everyone happy.

I can provide one data point as I had this discussion with my attorney while filing in Oct. The debate between us was file on Oct 1 without medicals or do it the following week with medicals. She rightfully guessed that USCIS will be so overwhelmed that we may never see the RFE for medicals for months later and our file will lay incomplete. She had also said it's a bad idea to just send medicals without an RFE barcode to associate it with because it can just get lost. Ultimately we filed on Oct 8 with medicals and it worked out for the better.

I did not file my Supp-J when I shifted to my current Job. I received an RFE Late Dec 2020 which stated "If you are not at <company-X>" please send a Supplement J. I sent The Supplement J alng with the Meds. In March , I first got a notice that my employment has moved to my current employer and 2 days later the GC was approved . Even in my previous company (compnay-X) I had not filed the Supp-j . received 2018 RFE during which I send the Supplement -J from Company-X. BAL and Fragomen both adviced me not to send the supp-J proactively . I never faced any issues .

1. You are in the same job and same employer. Note that I-485J can be used for "first time" and also for porting. In your case, USCIS is looking for a version of the form similar to first time I-485 application. Basically they are looking for the "genuine offer" part (1a box).

2. No issues with Blue ink. In fact my office always signs in blue ink.

3. Usually when one changes an attorney, they will do a new G-325A form. The new form will overwrite the previous attorney. You are removing attorney all together. All, I could find for you is the wording from an USCIS memo (https://www.uscis.gov/sites/default/files/document/memos/2015-1117_PM_602-0127_Updated_Form_G-28_Notice_of_Entry_of_Appearance_.pdf).


Withdrawing Legal Representation:To withdraw legal representation altogether, the applicant or legal representative must write to the USCIS office where the case is pending.

In my case, the I485J has a separate receipt number and an approved status online. I did not get any approval. Maybe the attorneys got a copy.

If a separate receipt number is assigned to the I485J, then it will show approved. The first time I485+I485J applicants should not receive a separate receipt number for Supp J. But a lot of the Oct 2020 filers got it. It is your duty to submit I485J. Don't worry about whether you got a separate approval notice for I485J. It is implied, when GC is approved. So don't worry and enjoy your GC.

It does not list the attorney name. After RFER was submitted by the attorney, the approval letter goes to both applicant and the attorney.

I know there are few outliers who are waiting or months for USCIS to pick their case after PD is current, but is there any metric how long does it usually take USCIS to issue Medical RFE once priority is current?

I would be current in the May 2021, but not sure how agonizingly long the wait still would be for the RFE and adjudication.

I tried to chat with an agent through EMMA to expedite my EAD processing but was shot down twice.

You filed your 485 in October and got your EAD in February but there are hundreds and hundreds of applicants who filed before you but have not received EAD. Reason why I quoted your case is to illustrate how unpredicatable case processing is at this time. I wish you good luck!

I just told them that I will have no valid status as both my I-485 and H1 renewal are pending. I mean strictly speaking I-485 pending is protected status but you can't renew driver license for example in most places and they accepted that reason and did not demand any proof.

If your file is at National Benefits Center (receipt starting with MSC) then per my understanding your file should get transferred to your local field office at some point after your date is current (starting May 01). You can check on greencardly as to which RD's your local field office is currently processing. that site shows average processing times. That gives you some idea.
Others please correct me, but the above is my understanding from what Ive read on the next steps once your FAD is current and your file is at NBC (National Benefits Center).

The processing time for EAD in NBC is 6 to 10 months. So they are not going to open a service request for you. Sometimes, the first level agents might do an expedite request for you over phone. But it is your responsibility to show supporting evidance. Do not open an expedite request, if you don't have evidence to support it. It will be denied without evidance within a week.

Maybe a letter from HR saying that if you do not produce approval withing such a date you will lose job or insurance or something substantial. You need to comeup with one using your creative thinking. In such situations, if you have compelling reason with evidance it is better to approach senator or congressman. With that route you may get a 2 month clock for response. USCIS has stricter standards for expedite requests.

Sorry, I cannot provide you any more support. Personally, my file is stuck in TSC and I am trying my best to figure it out.

I agree. If application is stuck, there is no predictability..i guess average is 13 months after application ( based on the greencardly suggested )

We filed I-485 in October and my husband priority date is Feb 2012(Pending Downgrade to Eb3). We received all receipts and today we have recieved Biometrics appointment in oakland ASC. Both me and my husband have Same time 7 AM appointment and the FP notices clearly say no one else is allowed to be accompanied. Having a US born Kid, what are we supposed to do in such a scenario ? Arent kids not allowed to be accompanied ? What has been the experience of others who have kids and need to go to Fingerprinting appointment which is scheduled for both husband and wife at exactly the same time ?

My family also had the biometrics at the same time too. We are NOT in California ASC. We were allowed to have our US born children inside(less than 10yrs).

I read in another forum about others experience. One parent was allowed to go inside and gave fingerprints while the other waited outside with the kid. They were allowed to take turns for biometrics.

Original EB2 Jul 2011 filer here. I filed for EB2-EB3 downgrade on 29th Oct. Sitting with only receipt notices so far and patiently waiting for any movement(Praise be upon san jose ASC /s).

I was looking for approximately 140 processing times right now(without premium processing). I remember someone posting a data visualization with 140 splits by waiting vs approved for Oct filers. I can not locate that right now.
https://egov.uscis.gov/processing-times/ suggests5 - 8.5 months but can anyone throw some light on what should we expect in terms of 140 processing timelines for Oct / Nov filers?

Has anyone here used interfiling? I have an EB2 (Feb 2011) 485 application pending. It was based on job offer from my previous employer. For past 2 years, I have been with a new employer, who also started GC process about an year ago. my PERM is approved and we are in the process of filing EB3 I-40- petition. Based on my PD, I should be current under EB3 category next month. I have a bit of dilemma whether to file EB3 I-140 in premium right away or wait for a couple of months and see how EB2 progresses. I believe, I can do a new I-140 in EB3 with old employer also. Either way, I will have to bear the cost of new I-140. I absolutely don't mind waiting 2-3 months more and wait for my PD to become current under EB2.

So, if I choose to go with new I-140 (EB3), wanted to know if someone has experience with changing EB category while AOS is pending. How does this work?

Smaller company information is good enough. Since it is LLC i am assuming that it has its own Legal, P/L and can show the revenues etc. Also, is your offer letter when you joined the job, is in the name of the smaller company.

That is correct. Once you have the 485 receipt then it is considered as application pending. EAD/AP are all other privileges because of pending 485 but not mandatory for living in the US.

In this situation, I would send the RFE response myself with a photocopy of the USCIS RFE letter and with a cover letter included that explains the situation in as few sentences as possible. All the best!

It should not. Please do sign at the bottom of the RFE copy and then send. When my attorney responded to my RFE, he didn't even have the original copies as I have gotten them. He only asked me to send scanned copies of RFE with my signature and he used them.
