2011 feb 14 pd eb3, new perm approved, i140 in premium applying i485 next. employee in va, employer located in ohio. which service center it goes to for 485 and will the date stay Jan 2012 for eb3 for this year? filing medicals along with 485

I am sure there are many in general. But on this forum is there anyone in 2009, 2010 still waiting for GC? My PD is Nov 2010, EB2. I am not sure what to make out of this latest VB and when I will be getting my GC. I had enough of this roller coaster! I want to get off of it!

I am not sure if there are folks here with that date range. There may be, I don?t know but I have a close friend who has Nov 2009 priority date and still waiting. Has been on EAD since 2012 I believe. His case is with the Texas Service Center and been current since March 2021 with no end in sight.

Yes, it sucks. Our common friends had dates from 2011 and 2012(myself included) and got greened during August - September this year. We filed for I-485 only in Oct 2020. He has created SR, followed up with Senators, Congressional Reps everything. I have a feeling USCIS may have lost his petition.

Just once again feel cheated by the whole system: employers, lawyers, USCIS and politicians. It almost feels like they are all working together to make sure that we remain shackled and dependent on these prison walls (plugging a shawshank redemption quote : "These walls are funny. First you hate 'em, then you get used to 'em. Enough time passes, you get so you depend on them. That's institutionalized.").
My story is probably not unique and there are thousand others like me who came so close to getting adjudicated and now face retrogression. I am talking to my employer to see if they can allow me to file another I-485 EB2 AOS petition while EB3 downgrade is still pending (without withdrawing current petition). My HR manager has probably never dealt with all these tricky plays and any recommendation he makes will scale by thousands so he is not willing to allow me to file EB2 I-485, even though I said I can cover legal fee and you just need to sign the paperwork to allow use of approved EB2 I-140.
Waiting in retrogressed EB3 at Nebraska Service Center is not going to do any good, I can keep filing interfile requests, keep raising SRs, congressional inquiries and USCIS will just shake them off like a dog with bad case of fleas. Feel so hopeless and helpless.
I hear you.! I am in the same boat, same center with PD in December 2012, right when I was thinking that being current for 4 months is a good thing, the dates retrogressed.! I have EB2 i140 approved but I am thinking to stay put for at least another couple of bulletins to see how the dates are moving. With SO not accounted yet for, I am faintly hoping for EB3 to move well into 2013 this Fiscal.. I am equally frustrated but there is nothing much we can do except to hope for this eternal wait to get over..
Any input from Gurus on this would be helpful.

Sep 2010 here; Filed my 485 in May end and waiting.
Was EB2 but started my perm in 2019 as EB3 category, so 485 is filed with EB3

So far that has been the trend. MSC has been the fastest for folks who had applied for I485 in OCT-NOV 2020. Most of those cases have been for 485 petitions where I-140 was approved quite some time ago. Timeframe to receive GC has been 8-12 months. However, there are still 2020 filed applications with MSC which have not been approved. So although there is a general trend there is no guarantee this will continue.
I can agree with you. Among the group of 15 people who filed in October 2020 only 3 of us are still waiting for the GC including me.

Last feed taken from USCIS (1,5 month back) still has ~3k 2009 applications from SRC. LIN seems to have few of them.

Only 1 downgrade case TSC, and he is pending with me. All of us are 2010/11 filers. Patiently waiting on, and as an added bonus no EAD/AP for my kid, opened up multiple SR's, no response to any of them, requested for L2 officer connect, was told you will get a call back in 30 days, it is already 20 days. Both my petition and spouses 5 months since RFE response received. SR opened multiple times, request closed with the information, the application is with an officer.
Absolute silence with no action.

Birth certificate for me and Marriage Certificate for my spouse. My original BC did not have my name on it, the marriage certificate was originally included only with my application and not my spouses. I had responded to this back in May.

There are some companies who get the BC for you from India, if you provide fees for their service.
If there is no birth certificate, you need to have both Certificate of Non-availability and secondary evidence.
Secondary evidence will be accepted only if it is submitted together with a Certificate of Non-availability.
Certificates of Non-availability issued by Government Agencies and state that no birth information is available.
In my case, it was an incomplete birth certificate, without my name. I had attorneys mentioning that I should have written my name in Pencil to the certificate.

QQ - Does SRC process EAD's? Both my wife and my EAD applications went to MSC (Receipt Date: Jan 18th 2021). In chatting with a live agent, I am being told that the EAD application was transferred to SRC. Both our cases are almost outside of processing time (per the USCIS processing times listed for MSC).
I cannot find a EAD application processing time (based on a pending I-485 application c(9)) in the drop-down under SRC.
Was the live agent just wrong?
Just FYI - both my wife and my I-485 applications have been transferred to SRC and that's what confused the live agent?
Also out of curiosity when a case is outside normal processing times and a SR is raised, any idea how soon it gets resolved?

Need some advice here.
I filed for my 485 in October 2021 and received the physical receipt notices in the mail yesterday. The Priority Date mentioned on the receipt notice is incorrect. It is mentioned as April 2011 instead of November 2011 which is my actual PD. I have not mentioned the incorrect PD anywhere in the application.
Looks like this is a USCIS typo error to me. Should I raise a SR to get this corrected or leave it alone ? I am just worried that opening up a SR to get this corrected might take it in a different direction and add months to my timeline.
If I don't do anything, will it cause any issues at a later point in time ?

It is unfortunate, and you have to get it corrected. Rest assured you will not have to struggle like many filers in 2020 who had to go through hell, with the limits on filers this should be fast.

Yeah, you can let the lawyers and your employer know that you will be responding the the RFE and ask for any directions in compiling the package (if you need any ie). It's just mailing the medical sealed envelopes along with the USCIS notice. Easy enough.

Seriously there are very few ways you can go wrong for responding to medical RFE. Just pay attention if the letter is asking for copy of the original or the original letter itself to be attached with the packet you get from civil surgeon. Depending on that send a copy or a keep the copy of original letter with you. Clip (and don't staple) RFE letter (or copy) to the envelope from civil surgeon and that's it. You don't need to send anything else (no cover letter or anything else). Send it to PO box address mentioned on the letter, to keep it simple. You can either send your dependent's RFE response in the same carrier envelope or use two different envelopes from shipping carrier (it doesn't matter). Use USPS overnight (only USPS delivers to PO box) and then start waiting for the next step which could be a couple of weeks to couple of months. Good luck.

I did exactly same as stated above. I see my package was delivered 2 days back but no online status update for my case.
while sending package to FO, do we need mentioned attention "FO Officer Name"?. I did not, may be thinking that's why it is taking time.

I got a letter from USCIS stating" Preliminary review is complete and application has been transferred to National Benefits Center from Nebraska Service Center" .I understand that USCIS transfers for load balancing etc, but would it cause additional delay? Anyone in a similar situation?

Think should be good news as NBC is faster compared to NSC/TSC . Btw , did you downgrade to EB3 since your case was at Nebraska ?

Thanks for your response.I didn't downgrade..Had to file a I140 amendment due to company name change.Thats why the application was sent to NSC.
I tried asking EMMA about the what the preliminary review meant. They could not explain in detail what it entailed.I am just concerned about retrogression in EB2 due to interfiling.Hopefully my application should be processed before retrogression..fingers crossed.

I have not done any analysis about numbers and retrogression.My concern is mainly due to Eb2 moving ahead by leaps and bounds(similar to the progression of eb3 last year)

I agree that such jump will bring retrogression in future . But fact of the matter is that EB2 and EB3 got to be in equilibrium - you cant swing the pendulum to one extreme end and keep it there for long time and its bound to come back to a middle ground . So considering all this , EB2 and EB3 cant be too much away from each other for long time and hence i think your PD should be safe from retrogression (even if it happens)

I have a situation. I have a derivative 485 ready to be approved but we are separating at this Point. Have received Initial RFE and do not know what is in the RFE. Lawyer refuses to answer my queries as I am not the primary applicant.
Also I am out of USA at this point and do not have all the necessary documents to renew H4.
Any suggestions from Gurus about next steps to get to kids in USA. Sincerely look forward to inputs.

My own 2 cents is that your 485 will be approved without problems as long as you are not divorced by the date of approval.
Second - if you are out of USA and not on AP then it is a huge red flag and you may be seen as having abandoned your GC.

At this point in time, if one goes strictly by VB then you should be approved based on when you filed 485 and add 11 months to it. But my judgement is that the FAD is artificially moved forward and so the approvals are really random. We do see approvals from 2010 early to mid 2011 right now. So by stroke of luck you could get greened literally in matter of days or may have to wait 1 year or two.

Hello Gurus,
My PD is Jul 2011, and applied for EAD/GC in Oct'2020 with downgrade to EB3, My application (primary applicant) went to Nebraska service Center, and the applications of my Spouse and daughter went to MSC - National Benefits Service Center.
However, my spouse's application was rejected due to some missing pages in the application. Our attorney resent her application in April'2021, and it again went to MSC center and recently two weeks ago, her I-765 was approved and we received her EAD Card, and there is no progress on her I-485, it is still in MSC.
In the month of May I completed Biometrics along with my daughter, and in Aug my I140 for EB3 was approved.
My daughter?s 765 was approved in Aug and we received her EAD card, and her I-485 has been transferred to Nebraska center in Aug, and till now there is no other update on her i-485.
There is no update on my (primary) I-485 or I-765, it only says Biometrics taken, that?s the last status on my case.
It?s surprising that the I-765 for the dependents is approved, and there is no progress on my case. Is there something I can do to ask USCIS to transfer my wife?s case to Nebraska so that the all our applications are in same service center. Is there anything I can do other than creating a service request for I-765?
Please advise if there is something I can do to get traction to my case?

Hey guys,
We have received our EADs (Aug-2021) and GCs last year (Nov-2021). We had opted to receive an SSN for my child in the I-765 form. However its yet to come. Anyone in a similar situation and any idea how long does SSN take to come?
Is there a way to follow-up or should we just file a new application?

Just call the SSN office and confirm they dont see any application already in place and then get an appointment to go in person and file a new application. Its an easy one page application form with very few details. If they see the application based on i-765 then you can follow-up for its status.
My sons EAD came thru in late oct and we waited for 2 weeks and called ssn office to inquire about the status as we selected for SSN issue in the form. They confirmed they dont see any application submission based on EAD approval. So then, they setup an appointment for in person and we went and showed all the necessary docs like passport, h4 i797, ead card, school id, etc. After 7 days he got his SSN by mail. Now, I have called IRS and asked for appointment to convert ITIN to SSN and will be going there mid of this month.

Trying to get someone on phone from local SSN office for past couple of days, but has been unsuccessful. Will try my luck early in the day.
If not, will simply take an appointment to apply for one in person.

Same situation, trying to reach the local SSA office from January 3rd till yesterday, no luck.
Today reached out to national line and they asked to mail the application form with notarized copy of card. Let me see what happens.

Yes, fortunately (I stress and say fortunately for a reason) my son was 13 and was asked to come in person. If younger than 12, one of the rep during the conversation mentioned we have to drop all the originals in their dropbox and they will mail them back in couple of days after verification. I was totally stunned hearing that part. Yes I know, we do send passports and documents for passport renewals, visa stampings etc., but in this case we have to drop all originals relating to the kid - meaning passport, i-797, EAD, (GC if you have), school ID, etc. I wouldn't want to take that chance.
My experience during Nov-Dec'21 SSN local office calls were the same. I had to call in multiple times, some reps were understanding what I was looking for, some did not have a clue when I mentioned SSN based on EAD. After the call they would have to setup in-person appointment and send an SMS. If you didn't get the SMS within 24 hours, you would have to call again and start the appointment process all over again (terrible I say).
All my calls were with Local SSN office only.

Hi,
My I485 current status is 'Fingerprint Fee Received' and 'Our National Benefits Center location is working on your case'. BM was done on 12/23 and my receipt series is MSC229004****.
Today I chatted with a live agent to know where my application is so I can check the processing times. The Live agent replied that my case is at 'Nebraska' and check Norflok field office for processing times?
Does this mean the case is transferred from NBC to Nebraska? If so, shouldn't it be updated in the Status about the transfer?

I called again at the national line to verify if it is a copy or original. They confirmed it has to be the original GC. I am skeptical of mailing it. Might try and visit the local SSO with my son and see if they can give an appointment

I was finally able to get an appointment (2 months out) at my local SSA office. Keep trying your local SSA office to get an appointment. Not worth mailing it in.
The agent didn't have any clue. I had to explain in detail how my kid was in US all these years without an SSN.

Could not get today too. I reached out another SSN office and they said I need to reach out to the office near me. Phone call is the only option.

I believe you'd have tried already. but still putting it out there. The local office timings are from 9 am - 4 pm. Try close to when office opens or close. Middle of day, there's not much chance. I tried close to 3:30 pm and luckily got connected in 15/20 minutes.

Hi all, New here. I had filed for EB3 downgrade in October 2020 and 140 was approved in September 2021 via premium. My PD is Dec 2012. Now with Feb 22 bulletin my PD is current and looking to interfile back to EB2- same employer. My employer name changed from company america inc to company system inc for tax reasons and also moved 7 miles to a new HQ. I have been promoted many times in the last 10 years but my core duties are the same with ppl management. My attorney ie says I have to amend my 140 since entity, location and job title changed? Interesting thing is at least 7 ppl from my company whose PD was in 2010,11 had the same situation with entity,location and title but they just filed 485j with their Straight application and have received GC. Is an new 140 amendment required to interfile? Thank you for your advise in advance.

The location change is not a problem - again my uneducated guess.
But the job itself is an interesting thing. It all depends on how general your GC job is written down. e.g. if that time when do you did labor 10 years back if the job was 120K and now you are earning 240 or 360K then I would say it is a problem. But I also must say - this is so common now - that so many people have been promoted and becomes executives.
There is a vested interest for the company to keep pushing your application backward. I honestly don't have any advice how to handle that. Amending I-140 could add another year.

Hi all -
I have seen a lot of folks post messages recently on various forums/social media to interfile as USCIS is encouraging(?) people to do so. There is a section in the notice below that tells people how to interfile. My guess is that it is targeted for folks who are not current in EB3, but then I could be wrong.
I was hoping to get advice from this group on whether I should interfile back to EB2. My application is in TSC. EB2 to EB3 downgrade I-140 is approved. FP was done in September. I never submitted the medicals. I have not received EAD/AP yet (14 months and counting). My firm has engaged Fragomen and they will file the interfile request/ I-485J if I ask them to. The question is...
- Will an interfile help me get out of the TSC mess? The USCIS memo advises to send applications to an address in California.
- Does the clock get reset when you interfile? Since I don't have EAD/AP yet, will it be another 6 months then before I get to the 180 day mark to change jobs if I needed to?
Will appreciate advice/perspectives.

Just stay in good books with manager and all the top folks you are exposed to. Be a good soldier. Sky is the limit. GC is peanuts. It is just a matter of time. All the best!

So finally I managed to get to a person who got me an appointment on March last week. Timing was just after 3:00 pm after I made the call around 2:50 pm. Pleasant conversation.
Update : 3/24/2022 Submitted the application, got the standard 2 week notification letter. Hope I can get the SSN before the tax filing.
