I am not an attorney, but my personal opinion is that it won't lead to denial. People are lot more understanding once you explain the situation clearly and they see no fraud. In the worst case, if USCIS has an concerns, they will send you another RFE. Straight denial seems impossible to me. Here are some responses from the attorneys

What is more important is not to sit on your RFE, respond ASAP, so that you can get approval ASAP and get out of other people's way who are waiting for a long time.

Hello Guys,

Today I got the notice in my mail from USCIS returning my 485J, saying "Your I-485 Supplement J, is returned to you because it is not needed or one or more of the following required elements are missing: *The Supplement J is not needed when a Form I-485 is filed with a Form I-140 and your are the principle beneficiary or if the I-485 is already approved/denied/admin closed."


I concurrently filed I-140 and I-485 in December downgrading from EB2 to EB3. Is this okay or anything to be concerned about.?

My PD is: 12/11/2012
RD is: 12/21/2020
Service Center is: Nebraska, received all the receipts with LIN (No Update on any cases except on I-485 with an update that Fingerprint fee was received on February 26)

As it is clearly stated, you don’t need a 485J when 485 filed with a 140. You don’t need to worry but your attorney should have known this basic thing.

I submitted the 485, EAD and AP documents in Oct and finger printing done in Mar.
I got a letter says I-797C Notice of Action, and Case was showing as I-485J - Confirmation of Bona Fide Job Offer or Request for Job Portability INA SEC204(J).
Does it mean I need to submit the 485J or this is just a notice?
It is not clear if I need to take an action!

In the new format I-485 application, I-485 Supp J is required as part of I-485. Please note that I-485 J has dual purposes. When you submited with I-485 it is meant for confirmation of bonafide job offer. When submitted separately (standalone), it is for job portability (or AC21). Usually USCIS does not issue a separate receipt number for I-485 J when submitted with I-485. It is considered as a part of I-485 (because you need a genuine job offer for approval of GC). However, in the recent rush, it looks like lockbox issued separate receipt notices for I-485J that were part of I-485. The receipt number does not mean a thing when submitted with I485. Maybe USCIS is trying to claim victory by counting the number of receipt notices they had processed.

You don't need to do anything. You got a receipt notice, which has little meaning. Without the approval of I485J, I485 will not be approved (because it is a part of an application). In your case, when GC is approved, your I485J will also be approved. Don't know how they will handle it if PD retrogress. Hope this Helps.

Smaller company information is good enough. Since it is LLC i am assuming that it has its own Legal, P/L and can show the revenues etc. Also, is your offer letter when you joined the job, is in the name of the smaller company.

Thanks Idliman, the part is my PD is Sep/2010 and I was expecting the dates will be current in the coming bulletin for Final Action Dates. So not sure what this means and was thinking would get the EAD or so in a couple of months.

I don't think so. In my case, since 140 and 485 were filed concurrently and I am the principle beneficiary, the 485J was not required. I did not know this until I got it returned.1781

Since - 485 is your own application - you should always receive a copy regardless whether you used somebody to represent you. You should register online for case status so that you receive emails and texts ASAP directly from USCIS.

To my understanding interviews were never mandatory for for people who applied after 2017. That was enforced as part of the previous administration and with the pandemic we may see the norm to change and interviews count reduced.
That will speed up the approvals and release some resources, hopefully allowing more of the spillover Visas to be used rather than going wasted.

It’s actually the other way around. Interviews are not mandatory for people applied BEFORE 2017.

That’s what we have been seeing as a new norm due to the pandemic. We have seen this consistently in EB1 and ROW EB2/3 approvals, though it is not their official position.

I got all excited when I received a USCIS alert. It was just my H1 renewal :D. Waiting to see if they will approve the I-485 sometime soon.

My dates are close to yours and haven't seen any updates so far since my date got current in March. So hoping that there's some light at the end of the tunnel after all! Did you get any RFE in the recent past or was it straight approval?

I had used congressman query on the sidelines. Either that made it happen or case approved in normal processing. Some people with PDs around my date are either getting approvals or RFEs in TSC. Still not 100% sure how it happened. I may be one of the top 20% earlier approvals in TSC.

You certainly are! Generally, as per data in Trackitt, things are painfully slow in TSC and they are still processing August/September 2009 cases for the most part. But your case was certainly a low hanging fruit and helps explain the quick turnaround.

I wonder whether the delays are exclusive to TSC. My July 09 case--filed in Aug 2020 at NBC--remains under review. My congresswoman's office said they'd request an update for me (but warned me that they may get back nothing substantive from USCIS). I am waiting to hear.

I believe USCIS' stated policy has always been to process cases in the order they were received, i.e., FIFO, so given that your application was filed in 2020, it is taking additional time, however, for folks that filed back in 2012, NSC/NBC center are moving way faster than TSC, probably due to the fact that TSC was heavily inundated with all the EB2>3 downgrades from last October.

Have been a silent reader on this forum and I would like to say a big thank you to Q, Spec, Idliman and other gurus who have been helping so many of us.

I have a unique situation and not sure what to do next.

I was employed by Company A since 2011, filed 485 on 10/21/2020 in EB2 with PD June, 2010. Submitted medicals, I944 and 485J along with my 485 application. On 11/3/2020, our company announced that it will be acquired by company B from 1/1/2021. Company B updated the public access record and established successor in interest for H1-B through a notary paperwork, they did not do H1-B amendment nor transferred my H1-B. I am on company B?s paystubs from Jan 1st 2021.

For GC, company B?s lawyer said we can file 485J after completing 180 days as Company A?s federal tax ID is still active. Tried to convince her to file I-140 to establish successor in interest but could not succeed. Gave my fingerprints on 3/22/21.

Fast forward, I completed 180 days on 4/19/2021 and company B prepared new 485J and mailed it on 4/30/2021. I was hoping that it might trigger something as my pd was current in May. Irony is I got receipt for old 485J on 5/1/2021.

My 485 application got approved on 5/11 and today I see that old 485J got approved as well. Reached out to the lawyer and she mentioned that worst case, my 485 case could be reopened to process the new 485J. Since we have proof that a new 485J was submitted prior to the approval in case any question may arise.
Approval has not sunk it yet as it all happened in such small span of time.

Don?t want to sound negative but being in backlog for the last 11 years makes me think of all possible scenarios.
1) Dependent?s H1-B is up for renewal in Sept, 2021. If we do not proceed with his H1-B renewal and 485 case is reopened, can he continue to work given our EAD and AP cases are in pending status?
2) Can this have any impact down the line when I apply for Citizenship?

Congrats! Just keep all the documentation of the company acquisition, and records of sending I-485J (package tracking history, since it goes away), a copy of I-485J, your correspondence with the lawyer regarding filing it etc. in a safe place. At the time of naturalization they look whether you actually intended to work for the employer who filed for I-485 or not. With all this documentation it'll be a cakewalk in the worst case. Even in case there are issues, you can file a lawsuit and almost any judge will laugh the USCIS out of the court. I would stop worrying and enjoy the GC.

For our benefit, can you share your I-485 Received date and the USCIS service center that processed your I-485 so fast?

Wow. Never heard of this before. The good thing is successor in interest, so you are working for the same employer for 180 days after filing I-485. Your I-140 was already approved with Company A. You filed I-485 with Company A. You have been working with Company A then on Company B wilth Successor in Interest. So I think you are good. I am not formally educated in law, so don't know if I am missing any fineprints.

The good thing about GC is that the day GC is approved you are a permanent resident. Whether you like it or not, you are already a permanant resident. Also you cannot move to nonimmigrant visa status after GC is issued. You may have to do USCIS form I-407 to abandon GC (LPR) status. You need to provide a reason for it. Whatever you have stated above is not a proper reason that will be accepted by USCIS. Also you should not think about giving up GC or not using GC. You did everything by book including I-485 J. Even if someone losees their job in the 4th month and sends their I-485 J after 180 days, they are still good to meet AC21 requirements. The only way one will get in trouble is if USCIS sends a RFE before 180 days and they are required to respond before 180 days. So you are golden in my book. I think you are unnecessarily worrying my friend. An attorney firm filed I-485 J for you right. They should know the inner points. Maybe you can ask them if there are any issues.

When USCIS looks at I-485 Supp J, they will find out that the GC is approved. At that time because 180 days has crossed, they can look for only "same or similar" justification. As you are in same job across company A or B, you don't have an issue with I-485 Supp J. The only other thing USCIS can do is revoke your I-140 for cause after 180 days. That happens only if there is fraud, background, or other scenarios that involve cheating.

For Citizenship, you are required to work with the company for a "reasonable time". Reasonable is usually 6 months after GC. There will not be any issues in your case. You will fill company A d.b.a. Company B as employer. You can also save a copy of successor in interest for future reference.

I would also advise you to pay for a 30 minute discussion with Murthy or other reputable law firms for an independent consultation. That way you will have a peace of mind and any fineprints sorted out.

Long story short, you are in a good shape. No need to worry! Don't apply for H1-B, etc. for your dependent. Enjoy your green life. As others have suggested, keep documentation of everything that happened just in case there are any questions in future (you should always keep documentation of everything anyways). Most likely, USCIS will approve your new 485J when they eventually get to it, OR you will never hear back from them again.

New Supp J has the exact same responsibilities and same office location as old Supp J.
Currently working with both company A lawyer and company B lawyer, both are clueless and have suggested to wait it out and see if USCIS decides to re-open 485 to process the new Supp J.
I will save all the emails, paperwork tied to the new Supp J. Planning to reach out to my husband's company lawyer or another lawyer.

Your Supp J was submitted after 180 days and the job description (portability) is exactly the same. They might just ignore the I-485 J or they might process it and approve it internally. Either way you are not going to hear from USCIS again.

For N-400, work in the GC job for a "reasonable" time or 6 months. They look at the history for the last 5 years before N-400. In the worst case, you can delay submitting N-400 by another 6 months. But in your case you need not worry.

If you have any male kids in the age group of 18 to 26 they need to register for selective service. Otherwise they might have issues with N-400 and have to wait till they are 30 to apply for Citizenship.

If this question doesn't belong here then please let me know so that I can move it to appropriate thread.

Asking this for a friend:
Friend works for a local construction company as a direct hire since 2009 here in Michigan. GC filed in 11/2012, EB2. I140 approved in 2013.
Employer did not support him to downgrade to EB3 when the opportunity came along in Oct 2020.
Recently my friend was asked to sign a non-compete/NDA (which states that he cannot join a competitor or start his own business within 60 miles radius if he voluntarily leaves the company). Which my friend is reluctant to sign because he does have plan to start his own operations once he gets his GC.
He was told that if he doesn't sign then he will most likely lose his job.
Considering construction field is a tight market (also he already has bought a house locally), finding a new job with H1 sponsor in 60 days (before he has to leave the country) might be an uphill task. In which case he's willing to move back to India.

Questions:
1. If he decides to leave for India then what happens to his underlying GC application? Is it null and void or remains unaffected?
2. Assuming his current PD and I140 remains unaffected, if he leaves for India and few months down the line he finds a new employer here, instead of coming through H1, can this new employer directly start a GC process for him and use his current I140 to port the PD after the new PERM is approved (assuming by this time his 2012 date will be current) and once GC is approved (through CP?) he can enter the country using that?

After 180 days have passed since receipt date,an employee accepts new employment on EAD using AC21 protections. After that If the previous employer withdraws I-140 and H1B , will that affect his AOS , 485 application in any way ?

No, that's what means to be protected by AC21. You can safely cut any ties with the old employer. Just file the 485J supplement and you are good.

In addition to the other reply, it's 180 days from received date, not receipt date. Also, the risk is higher for people that concurrently file with new or amended I-140 and it hasn't been 180 days from I-140 approval.

I had sent I-485 Supp J (job portability) proactively in April 2019; By the time USCIS processed it and sent RFEs, it was Oct 2019. So My medicals, G-325A, Supp J are all up-to-date and current. I am working in H1B with the same employer in I-485 J. So it was approved without any RFEs.

I had used congressman query on the sidelines. Either that made it happen or case approved in normal processing. Some people with PDs around my date are either getting approvals or RFEs in TSC. Still not 100% sure how it happened. I may be one of the top 20% earlier approvals in TSC.

I am perfectly fine waiting 6-8 month after getting current (having waited 11 years already) but I am so glad someone in the same bucket getting greened! Must have been a pleasant surprise to you!

It indeed was a surprise, couldn't believe it for couple of hours and thought USCIS changed the status of my case instead of some other case. Good luck with your journey and I really hope you get your approval soon.

I'm guessing Series 45 is MSC219045* on the I-485 receipt. By that count, you are Series 50.

I wouldn't check case status once I had my card in my hand. I guess you should receive it literally any day now.

Same thing happened for my derivative.

We applied in October, 2020.
Both of us had our biometrics done in December 2020 and our dates are current since March, 2021.

I got code 3 biometrics for both 765 and 485.

But my spouse got only code 2 for 765.

He has not yet received another code 3 biometrics notice for code 3.

But, I had read many posts of Trackitt, with many saying that they got another code 3 biometrics notice later.

Don't know when that will happen for us!

Update on Biometrics for us:

I (primary) did code 3 biometrics for 485 and 765.

My spouse (derivative) received only code 2 for 765 for December 2, 2020.

He got a second biometrics notice , this time code 3 for both 485 and 765 and completed it on May 17, 2021.

So essentially his first bio was waste of time!

We also received a medical RFE and responded to it in April. We had not submitted the medical RFE when we filed in October, 2020.

We have been current since March, 2021.

So the wait continues!!

I want the 180 day clock(AOS pending) to be started ASAP, and I also have a straight I140 ( NO Downgrade) to be filed as well. I wanted to know if it's okay not to send the medicals now.

In my understanding, it shouldn't take more than a week for you to get your medical done (depending on the availability/appointments with doctors).

Worst-case scenario, add one more week and you might be able to file 140/485 along with medicals by the 2nd week of June. I would definitely submit medicals with 485 instead of waiting for an RFE.

I don't think so it does. Mine is "series 08", RD of 10/6/20. Biometrics was done on 2/18/21 and still nothing. No EAD/AP yet. I saw one guy on Trackit tracker today, who applied on January 21 and received his card in April. His PD is much later than mine. This tells me that the series doesn't necessarily give you an insight into processing times.

I have also seen cases approved on the second day of completing Biometrics. I just can't wrap my head around how USCIS is processing cases.

I got my "Welcome to USA" letter along with my wife. Then CPO came. USPS online status showed "Out for Delivery" in 3 business days. When the post-woman came to deliver card package on Friday, I was waiting at the mailbox. Strangely my card envelope was missing. Wife got her card envelope. I know my mail lady for many years. I politely inquired. She replied, why would I not give something to you. I know you for so long and there is no other mail in your name. I got a little tensed, checked USPS status again, it was still showing out for delivery. So decided to wait for one more day. Saturday came and the delivery lady came at 11:30AM and she said there is no mail for you. I told her that I am waiting for an important piece of mail from the Govt. She told me that she will keep an eye and ask around the "Company". I wanted to immediately drive to USPS, but it closes at 12PM on Saturday. So, I couldn?t make it on time. I was a little impatient on Saturday and Sunday and felt something is definitely wrong by Saturday itself. We have seen this movie too many times, was the feeling I had. My immediate impression was it is lost in transit and I need to watch my identity.

Monday morning, I was at USPS at the opening time and had the both (primary and dependent) tracking information in hand. First a person at the counter helped me. He went around the post office looking for the piece of mail and finally had a tracking information printout in hand. He told me that you better talk to the main lady. I told post master, why I was there and such and such person at the counter had tried to help me today. I had already met her few years ago for a USPS / USCIS EAD card issue and I asked her if she recognizes me. She did not acknowledge. She immediately looked at the internal tracking and told me that your tracking number is sent to an invalid address. There is a typo in my street address and that address does not exist in my zip. I told her that I got USPS informed delivery notification on Saturday morning. She told me that it cannot be and asked me to show the email. Once I checked the tracking info closely, she and I realized that I got informed delivery notification for a mail already delivered previous day (my wife?s card). She went in for her part, searched around and came back and told me that she cannot give the mail to me. The mail is not to your property and it is not yours. Even though I know that you have a unique name and I know you well, I cannot help you anymore. I thanked her for helping me and the service she is doing for helping folks.

I came home and immediately looked at the "Welcome Notice" and it also had the address typo. However, it was delivered to me. I told myself if only they delivered the card and not the delivery notice, that would have been great. My immediate suspicion was the G-28. I looked at the G-28 sent to attorney and it was fine. I had corrected some things in G-28 sent by the attorneys and was thinking there are two possibilities: a) Attorney office messed up while assembling package and inserted only my signature page OR b) USCIS made a typo error in data entry. If it is attorney error, then someone still has to pay the $420 to USCIS. At that moment of rage, I told myself I am not going to pay if it is attorney error.
I sent an email to HR, attorneys 1 &2 and the managing partner of that law firm. Got a reply from the partner that they had checked their records for the last RFE (I-485 Supp J) and address is fine. They told me that they will invoice so much for contacting USCIS on my behalf. I asked about AR-11 and attorneys told me I should not file it as I had not moved. HR wanted me to try on my own before paying law firm. I called USCIS level 1 rep and was advised that I should do an AR-11 and wait for the mail to be returned back to the USCIS. I replied back to the attorney email chain and now HR had a reason to let the attorney?s handle it. I did not want to get involved because I was afraid that the error is on application side and not USCIS. Then you have to do a I-90, wait 2 months and so on.

Attorneys emailed back saying that they had a discussion and AR-11 is the right way to go. They did an AR-11 form and sent the confirmation. They specifically mentioned USCIS error on the AR-11. The next day the AR-11 was reviewed by USCIS and was approved. I was tracking USPS and suddenly it showed mail is in local post office. When I looked at the tracking info, I noticed that the mail came via main distribution center, then to local post office, went back to main distribution center and then it came back to local post office. It was should scheduled for delivery on that day. I was watching the entire day for mail and the delivery truck came at 5PM. It was not the regular person. It was a contractor. As usual I was standing at the post box. He took out the mail and I could see priority mail envelope with its bright red, white and black colors. It was unbelievable for me. It was the GC envelope, I smiled, thanked and came inside. I called my wife and she said it?s a lucky day. Strange that unluckiness in address mess up results in a lucky outcome. Someone had crossed my incorrect address and wrote the correct address. There was also a special note saying deliver to "THIS" address.

The "Gods must be Crazy". Life is a game and everything shall pass. Happiness and sadness are not permanent. Everything is a phase in life and time definitely fades away everything.

I have an interesting update - that frankly has got me worried sick.

I got RFE notification for our 485s last week, still waiting for physical copies. Today, my I140 got a status update after 10 years. The case went from approval to initial review and had the status 'Case was transferred and New Office has Jurisdiction'. I have changed jobs in 2012 after 180 days were up, so I don't think i'll ever get to see that copy. I also remember that my 140 case was moved from TSC to NSC for processing, while my 485 has stayed at TSC all along.

Has anybody else seen this kind of status update recently? What could be the cause and is this something i should be worried about?

Today I just received a receipt notice for I-485J, Confirmation of Bona Fide Job Offer or Request for Job Portability Under INA Section 204(j). It says "Fees Were Waived"

Could someone explains what is this mean to me ? I have applied and received all 485,EAD,AP receipts in Oct/nov 2020. I am a full time employee with fortune 500 company and so far no intention to move to another company.

I came home and immediately looked at the "Welcome Notice" and it also had the address typo. However, it was delivered to me. I told myself if only they delivered the card and not the delivery notice, that would have been great. My immediate suspicion was the G-28. I looked at the G-28 sent to attorney and it was fine. I had corrected some things in G-28 sent by the attorneys and was thinking there are two possibilities: a) Attorney office messed up while assembling package and inserted only my signature page OR b) USCIS made a typo error in data entry. If it is attorney error, then someone still has to pay the $420 to USCIS. At that moment of rage, I told myself I am not going to pay if it is attorney error.
I sent an email to HR, attorneys 1 &2 and the managing partner of that law firm. Got a reply from the partner that they had checked their records for the last RFE (I-485 Supp J) and address is fine. They told me that they will invoice so much for contacting USCIS on my behalf. I asked about AR-11 and attorneys told me I should not file it as I had not moved. HR wanted me to try on my own before paying law firm. I called USCIS level 1 rep and was advised that I should do an AR-11 and wait for the mail to be returned back to the USCIS. I replied back to the attorney email chain and now HR had a reason to let the attorney?s handle it. I did not want to get involved because I was afraid that the error is on application side and not USCIS. Then you have to do a I-90, wait 2 months and so on.

Attorneys emailed back saying that they had a discussion and AR-11 is the right way to go. They did an AR-11 form and sent the confirmation. They specifically mentioned USCIS error on the AR-11. The next day the AR-11 was reviewed by USCIS and was approved. I was tracking USPS and suddenly it showed mail is in local post office. When I looked at the tracking info, I noticed that the mail came via main distribution center, then to local post office, went back to main distribution center and then it came back to local post office. It was should scheduled for delivery on that day. I was watching the entire day for mail and the delivery truck came at 5PM. It was not the regular person. It was a contractor. As usual I was standing at the post box. He took out the mail and I could see priority mail envelope with its bright red, white and black colors. It was unbelievable for me. It was the GC envelope, I smiled, thanked and came inside. I called my wife and she said it?s a lucky day. Strange that unluckiness in address mess up results in a lucky outcome. Someone had crossed my incorrect address and wrote the correct address. There was also a special note saying deliver to "THIS" address.

The "Gods must be Crazy". Life is a game and everything shall pass. Happiness and sadness are not permanent. Everything is a phase in life and time definitely fades away everything.

Perseverance personafied. And what a well-written piece. You should moonlight as a writer, putting that newly acquired card to good use :). Congrats, Idliman!

Folks - I am in a unique situation and need some advise. I have been with my current employer for over 15 years. I was able to file my 485 last year in Oct 2020 in EB2 category (haven't received 485j receipt yet). I completed biometrics and have already received EAD/AP in Feb 2021. I now have another FT offer from a new employer. Since my 485 has been pending for more than 180 days, the new employer is ready to submit new 485j portability request and wants me to start asap. For personal reasons, I am not ready to leave current employer. Can I instead switch to AOS pending status, start using my EAD and work for both current employer and new employer simultaneously? The new employer will proceed with submitting 485j portability asap. Once GC is approved, I will then continue to work for new employer only. Do you all foresee any issues/risks with this approach? Can this mess up my current process?

You can contact the local SSA office and ask them to reissue the card without the "Not valid for work without INS authorization" printed on it (unrestricted SSN) and provide the Green Card copy as proof.

Thanks is it mandatory to do this? Being a little paranoid, I want to avoid the risk of having the social security office screw up something on my current ssn.

It is not mandatory. Your GC is the proof of unrestricted authorization. The only reason I say to update it is if you join a new job and they do the I-9 compliance, if they see the SSN with restricted authorization, they are supposed to note it and all that so might as well take care of it. Most local offices will print a new card within a week or so and send it to you.

I am not sure on what to expect next and would appreciate any information or experience someone could share.

Today, I received 2 updates in quick succession. One saying Card/Document Production, and another a short while after that saying Post Decision Activity with content as follows:

we reopened your Form I485, APPLICATION TO REGISTER PERMANENT RESIDENCE OR ADJUST STATUS, Receipt Number XXXXXXXXX, and are reconsidering our earlier decision. We sent you a notice that describes how we will process your case.

We had responded in early May to a RFE request for I-485j and medicals. There were changes in job code as compared to the original PERM from 2009. I am not really sure whether that is causing a problem. My spouse's I-485 and most recent EAD/AP renewal application remains pending and there are no updates on that one.

Folks, I have a question regarding the paystubs they’re asking for in the RFE.

I applied I-485 in Oct 2020 together with the I-485J for confirmation of job offer with the I-140 petitioning employer. The supp J is still pending. After completing 180-days with this employer, in May 2021, I moved on to a new full-time job in same/similar category. The new company filed my H1-B. However, I haven’t yet filed another I-485J to use AC21 portability – since the new employer is where I intend to work once I get the GC.

Now that they are asking for the recent paystubs in the rfe, which would be with the new employer, what would be the likelihood of this triggering another rfe for supp J? Should I just file another suppJ….wait for few days….and then respond to the rfe with medicals + RFE?

Appreciate if @idliman, Q, or other gurus could chime in.

You should respond with cover letter saying that you had availed AC21 job portability and are working for a new employer (attorneys know this). Send a new I-485 Supp J for current job. In addition provide them everything else already asked in RFE.

There is no way to hide where you are working. GC is based on a future FT job. Unless this contract is clear to USCIS, they will not issue GC. Also put effort to make sure that "same or similar" justification is as good as it can be.

Six months at a minimum and six to tweleve months is adviced by most attorneys. Law expects you to stay in your GC FT job for a "reasonable" time.

My 2 cents, Don't worry if the H4-EAD gets approved. Just take a deep breath and be relieved. We try to find a method to the USCIS madness but there is none. It's a govt entity with all the inefficiencies and flaws baked in to the organization. Just make sure your spouse attends the BM appointment on the 28th of June. Don't try and read too much into it. It's a USCIS decision and you are not on the hook for any of its decisions. The approval could just be the result of Biometrics cancellations for H4 and L2 EADs since May 17th. But to be safe it's better to honor the appointment anyway.

This is beyond belief but that is where it stands as of now. As you suggested, we still plan to visit the local ASC and have her appear for fingerprinting and would leave it upto the local ASC and officer to determine. I do not know or understand if we should be doing anything else.

Are your SOC codes same and the job titles similar? That is more than 50% match in my book. If so, you can DIY. If the SOC classifications are different then you may be better off going with an attorney. And put in serious effort to match every single word or skill in PERM.

Thanks for the quick response. To clarify, the new company lawyer is working with the employer and me to fill out the J Supp. However the RFE, which doesn't ask for Supp J, is something I'm considering responding myself. The Supp J will just be part of the package. The SOC codes are the same. I have the PERM job description and trying to ensure Supp J matches with that. The titles sound different but in reality they are the same.

My RFE response is going to uscis field office.....not lockbox or service center. Not sure if this changes anything. Thanks for the tip on post-its and other things related to the organization.

I know it's frustrating you may want to retry PP for EB3 i140. If you want to sleep better at night and don't mind spending money, then may be it's better to file a brand new 485 application for EB2. Interfiling may not be an option for you as the underlying i140 petition of your current 485 is not yet approved. Even if it were an option, interfiling is a different beast in itself. You will never get any confirmations from USCIS as to whether your interfiling was accepted/processed. So you will be in a limbo, till you get your GC one fine day. I am sure you DO NOT want to be in this limbo while your son's future hangs in the balance. Filing a new 485 may not speed up your GC on the contrary it may slow it down because of confusion caused by multiple petitions, but it could help save your son from ageing out.

Circling Back on this. My wife did appear for her 539 fingerprinting yesterday and her status changed from "case was approved" to "Case was updated to show that fingerprints were taken".. smh in disbelief on how inefficient this system is, we have received the physical copy of approval too..

I will be current in next 2 days and with everything submitted along with applications, I am hoping for no more such surprises..

Agree totally with you here. I also appreciate your suggestion of expediting EAD. I have a job offer but no EAD yet. The job offer is contingent on me getting EAD or GC. You never know what turn market might take 6 months after GC approval. The employers financial situation might change, or they might fill the position with someone else.

My timeline for AP application is also beyond published processing time though EAD is still within the processing time. USCIS received both applications in Jan'21. Can you advise how did you request to expedite the AP, and what was the reason you gave?

In this case i would assume 1) Either two different officers are working separately on EAD/AP and 485 application 2) USCIS thinks they are not ready with our 485 application and may take some more time to approve.

Sorry I should have mentioned that the I-485 files have already been moved to the field office. The EAD/AP approval came directly from MSC.

Sorry I should have mentioned that the I-485 files have already been moved to the field office. The EAD/AP approval came directly from MSC.

My situation is a bit similar but the only diff is I don?t have EAD yet. I Applied for EP stating economic hardship as I was close to bagging a new job, but the officer responded needed more documents. Meantime the job fell thru the cracks. I don?t know if I should respond back to the officer. Any suggestions or advise is highly appreciated

Today we received the notice which basically states "On June 25, 2021, we reopened your Form I-485J, Confirmation of Bona Fide Job Offer or Request for Job Portability Under INA Section 204(j), Receipt Number XXXXX, and mailed you a notice". This doesn't seem to be a RFE or anything just a notice of reopening case that's all.

It does seem to be a strange pattern so wondering if anyone faced similar situation and If so, what does this mean. Any thoughts or feedback is really appreciated. BTW, we are current as of today.

I raised ER for myself on June-17th and received approval for ER on June-28th. No updates since then.
I didn't submitted any documents till now.
Any idea, what will be the next steps? Can they ask for documentation or they will process the cards straightway?

I would call them on 800-375-5283 or char with emma. I have called this number few times before it was not much wait < 5 minutes. while charting with emma just keep typing "technical difficulties" few times, you will be directly connected to live agent.

We have been current since the May bulletin. When I opened an SR for AP, they have approved AP and EAD and did not take any action on the I-485.

Have you received your physical GC card ? In the normal sequence, you get CPO, Case was Approved and then Card was Mailed. Immediately after CPO, the system changes you to a LPR whether you had received the card in hand or not. eVerify will go through.

In 2012, I got a CPO (which was a false system update). So without getting excited, wait till your PD is FA current. Then talk to USCIS to figure out what's going on. Technically if they approved the Card before your FA is current, they can revoke the card. But then they have to reissue it. As your CPO is within 2 weeks of FA current, I am more inclined to believe that as long as you contact them after Jul 1st, they will let you keep the card, if it was actually issued and not a system glitch. But you don't have to bring to their attention that your card was issued before FA current. That's their problem to sort out.

If yours was approved a few months or years before FA current, then this process will be a mess. Probably have to get attorneys invlolved.

Got to know from Emma today that my case has been transferred to the local field office on 6/16 from the national benefits center . Interestingly this happened 2 days after I received the 485J notice which was mailed out on 6/14. My PD 10/08/2010 EB2I. What is the significance of the case reaching the field office?

Just curious how to check with Emma where the case is? Could you please advise?

My wife did it via calling them. She gave the reason that she needs to travel to India to see parents (post covid). While that rep was taking request, he mentioned that they may require some documentation but we did not get any email/mail asking any documents.

That would be a NO. USCIS will straight up see through what you are trying to do here. A child's age is locked when FAD is current. There is no need to approve 485 to help out a child from ageing out. In short they don't need to do anything as what you are claiming is a non issue.

You dont need to expedite. If you are able to file and FAD is current then the child is secured.

Also I think it is entirely in your right to explore all legal avenues available. I am not sure what do you mean by "expedite" but if USCIS has such a path available , by all means try it.

Q, it is absolutely right to explore all the legal avenues. However it also prudent to understand the consequences of actions and why more often than not the immigration lawsuits fail.

The most famous being Kazarian which lawyers tout as a success, where as in reality he lost and the follow up EB1 candidates got more rejections than approval because of USCIS changes implemented as a direct result of lawsuit.

Like Q pointed out, you can try all the avenues available to you like reaching out to congressman etc. But, it's best not to mention the age out situation as your kid is already protected. You don't want the USCIS/congressman to perceive the request as if you are trying to pull a fast one over them. I am pretty sure USCIS has received these kinds of requests before and they may stop giving folks the benefit of doubt (that you were not knowledgeable about the rules) if they see a pattern.

Time Line -

Renewed H1 visa via DropBox in Dec 2019, entered back to US in Jan 2020
Perm approved late April 2021
Submitted all my paper work (Prem 140, 485, 131, 693, 765) late May 2021
Received notices for 485, 131 and 765 around ~10th June 2021
Prem I-140 approval - 13th June

So what should I expect next? Reason for my ask is my colleague who applied same set of paper work Mid May got his finger print notices couple of weeks ago and has appointment this week where as I hear only crickets from USCIS.

Is FP necessary step before GC approval? Does recent renewal of H1 and/or re-entry to US makes FP useless considering USCIS received my 10 print during those events?

I don't expect EAD/AP right now; GC would be nice if I can get it before Oct 1st considering my file is complete and my perm is recently approved.

At this time you should not expect much and just wait. A lot of folks who applied in October and November 2020 are still waiting on fingerprints. Maybe your colleague lucked out. Or maybe for some weird reason USCIS has decided to issue FPs to later applicants. There is no way to know at this time.

Yes, I have not yet come across a single case where 485 was approved without FP. No a lighter note, it's refreshing that even after spending so many years in this country you are so excessively optimistic about the efficiency of USCIS!!! Keep up the spirit!!! I need to inculcate the same spirit in me.

There are quite a few files that are complete but probably will not get the GC by 1st of Oct (all applied last year). A recently approved perm has no bearing on your 485 processing time. Good Luck, and hope you get your GC sooner than later. I would quote what Sri Krishna said to Arjuna. Do your Karma (which you already did) and decouple yourself from the fruits of your Karma. GC will come in due time.

These people are trained to be helpful. So do not ever worry about showing your vulnerability or genuine problem.

The only thing I would caution is - be courteous, respectful and mindful - not out of any fear - but that's what American culture is. After all this is still a favor your are going to ask the congressman's office.

The reason, I caution against the above approach is because there are plenty smart people in USCIS who are constantly changing their approach based on our behavior. For e.g. because of all the folks expediting EAD/AP now the bar from USCIS is set so high that it's become almost impossible to expedite EAD processing even for genuine job loss requests. It's now baked into the cake that you will not get your EAD for at least 8 months since applied. 99% of the congressmen are helpful but unfortunately I do not have much luck in that department either. My district is represented by Michael Burguess one of the few select people who voted against HR 1044 and Ted Cruz (do I need to say anything more than that, LOL!!). I have never received any personalized response from them but only automated messages if I am lucky (not sure if I am doing anything wrong). Coming back to the original point it feels like USCIS is no longer the same organization pre Trump. Looks like now they do not take any accountability so hence my consternation. It almost feels like USCIS is taking punitive action against those who try and hold them accountable.

I did explore the avenue of expediting my I485 without success. I used financial impact as the reason and used the same commentary that i had used to expedite EAD and AP. While it worked for EAD/AP, it did not for I1485, the officer who examined the request gave a response that "While my situation does indicate urgency it does not fit the bill of extreme/critical nature warranting an expedite approval". I am current as on June 1st 2021. I am contemplating other avenues (Rep / Senator) as next options in the next few days if i dont see a progress on my application.

USCIS has indeed become more anti immigrant and brazen. The way they strong armed DOS over the VB and they way now USCIS is effectively controlling dates is a tell-tale sign of the balance of power.

Unfortunately what you say is correct. I am very sorry for your situation. I used to live in Arizona where despite being a republican late Sen. McCain's office was incredibly gracious in responding to my request. But I can see how Texas may be an entirely different ballgame.

Thanks a lot for the tip Turbulent. I did the same for myself and it seems the AP/EAD was approved the next day itself. I only got to know when i received the approval notices in my mailbox today.

Strange thing is the case status was updated this week but i didn't get any text/notification (i have signed for it) from my USCIS account on status updates.

People who raised the SR on AP, have actually submitted the applications in Oct. So the dates were beyond the processing times of 6 or 8 months and hence the SRs were accepted. Since you AP application was submitted in Mar, you have to wait till the standard processing times listed on the USCIS website for the service center where your application was submitted. Most probably you can submit after Oct.

Question: once the dependents get EAD/AP, how do they get SSN (had selected the option to get SSN on I-765 form)? Do they need to apply for it in SSA office?

In the current version of I-765 form there is an option to request SSN directly from SSA. Read this. (https://www.uscis.gov/sites/default/files/document/flyers/EBE_Flyer_Apply_for_your_Social_Security_Number_Wh ile_Applying_for_Your.pdf) If you or attorney had selected this option, then SSN will come to you. I believe it is 2 or 3 weeks after EAD is approved. Please google on the processing times.

If you did not request SSN along with the EAD application, then you have to go the local SSA office and apply for a SSN. Most of the offices are still in Pandemic mode. So you need to call them first, book an appointment and then submit the application SS-5 Form (https://www.ssa.gov/forms/ss-5.pdf) in person. Check the actual SS-5 form to make sure that you carry all forms of proof's needed.

Without a GC or Citizenship everyone gets only a restricted SS Card. After getting GC, if you want the additional wording "VALID FOR WORK ONLY WITH DHS AUTHORIZATION" removed, you have to submit a new SS-5 form along with GC as evidance. However, if you have kids going to college, I recommend you to update the SS Card status after GC / Citizenship. The college admissions are set to sort applicants on SSN status. They will automatically assume that the kid does not have eligibility for merit scholarships or financial aid. One of my coworkers from Nigeria had his kid face this issue and he had to go to SSA to change the status and it was automatically reflected in the admissions system.

As your derivative I-485 was filed only in Oct 2020, it is within the regular processing time. I am surprised that USCIS even accepted these many service requests. You can interfile medical without waiting for a RFE. That might trigger something.

Alternatively you can try congressional / senatorial route (https://www.qesehmk.org/forums/showthread.php/2945-Overview-of-Congressman-Senator-Inquiry-Process). Your case is strange because they normally approve the derivatives along with primary. Maybe it was not linked properly to the primary before primary was adjudicated. I would push the case as USCIS error saying derivative was not approved along with primary. But before going to congressman interfile and get medical sorted out.

How can you say that may case is in regular processing time?

I raised first SR in APRIL 2021, after 30 days when I saw there was no response I raised another in Jun 2021, which they did replied in 5 days, and now I raised another one on 07/04. I looked at INTERFILE too, it looks more like hit or miss.

I filed my I485 in 2012 and have responded to 4 medical RFE, Spouse I485 was filed in Oct, 2020 first time without Medical RFE (Murthy).

I think, I'll wait them to responded to this SR, if not will go with congressional / senatorial route.

Is there any pattern or reasoning behind case transfers to other service centers - apart from bland reasoning given in notice as "speeding up processing" and such?

My case moved from MSC to TSC just 1 week before my PD became current. I am training my brain to convince itself that case @ TSC and I might end up being a long hauler.

From my findings so far, NBC can not approve i-485 cases and they have to be moved to local FO for final decision. That is what they are trying to do now, moving to FO. Once it reaches FO, the FO will pull the file when its turn come and issue RFE or GC depending on the completeness. You should check with Emma where your case is at - whether moved to FO or still at NBC and then gauge the load at your FO to predict movement.

Thanks delguy. Emma tells me it is in the Chicago field office, processing time of 8 to 15 months, i guess i just have to wait.

That is good, you might get some movement on your case soon. Dobt worry about the processing time. Looks like FO are working overtime to speed up the EB cases.

I reached out to Emma and the agent said the case is looked at and handled by NBC and FO together all the time. And also they shared it is in the queue for Interview. Does that mean Interview is confirmed or they have to decide if the case needs an interview or not and can be approved without an interview?

I actually sent it out in separate envelopes as the RFE letters came from the FO separately. But someone had mentioned that if you were going to send them in the same envelope, then keep 2 smaller envelopes (one for each of you) inside the Fedex envelope and send it out. I did not put any cover letter, just the copy of the RFE and sealed medicals envelope.

Thanks. I am also thinking the same, to send in two different packages as they came in 2 separately.

Most likely yours is still at NBC then. I wont worry too much about the interview part. I think once a case reaches FO, they look at it and decides whether to waive interview or not.

secondary's AP application was lost and hence she has received only EAD ( no AP). We recently created a SR for the AP application which is still under review. The experiences of people getting EAD/AP and GC approval within days gives me hope that as soon as the AP application is touched they will also pick our I-485 application to process as PD is current since May 2021

485 of secondary changed status tp RFE .. no changes on primary application

In the RFE letter that you received, they would have mentioned where you need to send your response to. And if it's a FO, then the address will have name of the FO and it's street address. If no mention of field office is there in the RFE letter, then I think it mostly came from the service center. Other members can correct me if I am wrong...

Hi Gurus,
Question about I-485 processing, I noticed the adjucation/processing is very slow in Bay area (San Francisco ).
Does the actual processing will be done by Field Offices, even though most of communications via National Benefit Center, or NBC can process cases without field offices?
The reason is, people living other locations are getting GCs, they are processed by FOs/NBC.
I checked with USCIS, but they didn't mention my case is transfered to local Office, same with some other folks too.

After submission of RFE, nothing much to do from our side other than waiting :) ... Number of approvals have picked up in July and hope this continues and majority of the available visas are utilized.

My EAD was approved yesterday. I keep getting conflicting information that 485 case was transferred to local field office. Not sure what is going on here. Do local FO adjudicate EAD/AP or do they only work on 485?

This is very nice question to ask "how long it will take to get GC after getting current" . The answer is 2 weeks to 9 years thats what I saw people experiencing in this forum. sorry to make fun of your question but this is true. Now we say "God also don't Know" how USCIS is processing.

BTW what is yr PD and service center ? USCIS started picking up the speed in 3rd quarter and I saw approvals from different service centers. 2011 people are started getting GC, IMO we all will get this year or early next year if date does not retrogress.

Just look up the 485 processing time for the service center your application is in.

If your application was filed at least a year back and your FAD date is current, I'd say whatever USCIS says cut that time in half and that should be a realistic time period.

As requested by Andhraguy few more details: My application was filed earlier this month (PD 04/21/2011, EB2) and the packet went to Phoenix lockbox not sure which service center it will land at (mostly Nebraska?). I was outside US for a while and justed came back to US, hence the delay. My attorney recommended to send all required docs and told me that we can avoid RFE. So, hoping for the best but I know Oct filer are still waiting. Lets see how things play out.

sjayanthi - Since you have filed recently you can expect as

4 to 8 weeks to get 485 receipt notice
Another 2 weeks to 2-3 months for Biometric appointment
6-8 months from Notice date to get your EAD/AP
Then another 1 month to 6 months to get green card

This is based on my observation from past few months. Time will change based on your luck.

@Aceman, do you know if the bipartisan infrastructure bill that was passed in Senate few minutes ago, does it have any provisions relating to legal immigration/visa usage?
my PD became current April 1st 2021 and received RFE on June 25th replied to RFE on July16th waiting for decision (officer XM0293). I heard he is very slow after 3 months also not approving cases.

PD is 2010 Feb

I am of the opinion that one needs to have a clean I-485 Supp J path for getting a GC. One should not get a GC based on a job that he/she does not intend to work in (or go back to). On the other hand if you are going to the previous job specified in I-485 after GC, then you don't need another I-485J. If USCIS AO, does his/her job correctly they will send you another RFE for I-485 Supp J (if they check your current employment).

I am going to repeat my usual line: A GC is given on the basis of a future job. It is a contract between you and the employer. You agree to work in that job after GC. The employer agrees to give you a genuine FT offer of employment. If you don't work for the company stated in I-485 contract, you are breaking the terms of GC. That's why employer A can file for GC when you are working for employer B (as some here are doing). But by law one has to work for the company specified in GC application after getting GC. USCIS does not have the manpower to enforce this.

You should work with the attorney of the new company and reply to I-693 RFE at the same time file I-485 Supp J (job portability or option b in the form). This will reduce processing time and lead to a faster GC. But make sure that you meet the deadline for I-693 in any case. If you miss the RFE deadline then I-485 will be automatically denied.

Hello, My AP was approved on 07/20 even though i had traveled in December. The law firm (one of the big ones) says that i can use the AP for the approved duration since it has been approved despite travel. I have seen a few posts here on this topic suggesting re-filing of I-131.

Also, i have received medical RFE and am working to get I-693 done. If all goes well; GC might be approved sooner than later.

Since the law firm is not going to re-file I-131, should i do it on my own to be on the safe side if any unforeseen travel comes up before getting the GC.

PS: I will need H1 visa stamping if i travel.

It's better to refile your I-131 again. The attorney's are divided on this issue as to if it's fine to travel or not. Some say, USCIS approved it so you need not worry. Some say USCIS approved by mistake and technically it should have been denied as per law. When in such a situation it is always better to play it safe. Yes, I can see the other side of the argument that you do not need to worry when USCIS approved it. But if you get stopped by immigration at the airport good luck trying to cite the laws to them. Whenever you enter a grey area the law is applied how the person in charge interprets it and not how you want them to interpret it. Sorry that you are in this situation but it's best to reapply and you can do so on your own. You do not need your lawyer. Hope you get your GC sooner and thus making travel on AP moot.

The last update of emergency travel from USCIS was on 11/30/2020. Here are the wordings:


If you file Form I-131, Application for Travel Document, to request an advance parole document and depart the United States without possession of an advance parole document that is valid for the entire time you are abroad, your Form I-131 will be considered abandoned. At times, an individual may have an approved advance parole document while a second one is pending. Individuals may travel on the approved advanced parole document, provided the document is valid for the entire duration of the time abroad. The pending Form I-131 will not be considered abandoned in this situation.

If this is the first AP and you had used H1-B to reenter, then I-131 should not be valid. However, USCIS approved I-131 longtime after you came back to USA. Is it a 1 year or 2 year combo card? I have no opinion on this topic. Could not say whether I will take a chance or not. If you decide to get a new I-131, you can apply for AP renewal yourself by following our template. And there is no fee for AP renewal.

I can share my experience. Coz of job change and delayed perm, I was able to file my I-140 (prem) and I-485 in May. If it helps I got receipt in 6 weeks and still waiting for Biometric appointment. Lawyer sent paper work so don't know where it went but got my receipt with LINxxxxxxxxx number.


Question for grp - My new colleague is getting ready to file for both I-140 in prem and I-485 and asked me for an advice. Based on my own experience I feel getting I-140 approved first and then filing for 485 might be beneficial as his case can be directly sent for Bio-metric. What you guys have seen?

Just my opinion:
You would most likely get GC in next 1 to 2 months (post your RFE response). DO you foresee a need to travel before that? Other point to consider would be, even if you reapply I-131, what would be chances of getting I-131 approved before your GC?

This is my first AP and i came back on H1 back in December. The EAD/AP cards are with law firm and i will receive them shortly but i think they maybe valid for 2 years.

My last year travel was due to a family emergency and currently there is no plan to travel. The circumstances during my last travel were horrible and i don't wish it on anyone. My passport did not have 6 months of validity, my previously stamped H1 visa had one week of validity left when i came back, consulates were partially closed etc. Just because of this experience; i was thinking about refiling the I-131 and keeping it handy if GC approval is delayed for any reason. In case something untoward happens; if i refile there is an option to request emergency AP at FO if GC is not yet approved.

Since USCIS has approved the AP; should i return the card and ask for a new one due to travel. If it's a combo card; i don't know if I have to request another EAD card as well.

Do not return the card and NO you do not have to request for another EAD. Just don't show this card during travel to be safe. You will need to show them "the to be approved AP" during travel.

I'll be current next month (EB3I - PD April 2013 Straight). With same employer and submitted medicals with i-485 back in Nov 2020.

Got Supp J receipt today. Emma agent mentioned that file is with NBC but might move to FO soon. Not sure how reliable is this info and am not reading much into it given its 'Emma'. Fingers crossed!

I got current in May VB and still waiting after applying with medicals in the first week of Oct and giving biometrics in Dec! It certainly looked like the tons of people who applied in Oct 20-30 got picked up first before the Oct 1-15th filers.

I was thinking it has more to do with PD, but maybe the ND has some relevancy as well. Hard to evaluate patterns and draw conclusions. At least the good part is your application is documentarily complete and with the decision being eminent the likelihood of waking up one day and seeing the approval online without any prior notice is high.

Is it possible the delay is from the FO ? I just got my EAD/AP approved after following Turblent's advice. PD EB2-Jun 2010 , RD Oct 29 , Biometrics- 3/30/2021 EAD/AP approved - 7/28/2021. Waiting for medical RFE.

I can share my experience. Coz of job change and delayed perm, I was able to file my I-140 (prem) and I-485 in May. If it helps I got receipt in 6 weeks and still waiting for Biometric appointment. Lawyer sent paper work so don't know where it went but got my receipt with LINxxxxxxxxx number.


Question for grp - My new colleague is getting ready to file for both I-140 in prem and I-485 and asked me for an advice. Based on my own experience I feel getting I-140 approved first and then filing for 485 might be beneficial as his case can be directly sent for Bio-metric. What you guys have seen?

Experts - can at-least one of you chime in your responses for the "Question for grp" mentioned in the QUOTE please? It would be really helpful for the applicants who already have a PD from one of their previous employers and are currently in the process of applying I-140 with a new PERM from their current employer. Thank you!

My EAD got approved today. PD: Nov 2010 EB2I. Does anyone know how much time it takes between EAD and 485 approval? We had sent medicals with the application in Oct. I am not sure why USCIS is approving EADs when they could have just approved 485.

Congratulations!!! You will get your GC in next 7 to 15 days, mostly by August 10th.

Where did you get that number from?! That's not true at all. The timeline goes from 1 day(Cases where some got their GC the very next day after EAD approval) to several months or possibly a year(many people who got their EADs in January are still waiting for their GC).

You should see approval for EAD/AP from the service center

Based on my observation, 2 of my friends got GC with in 10 days of EAD approval from MSC. Per my understanding MSC approves EAD and AP. MSC and FO work together to approve GC.

Congratulations TD !!! This is such a great news. For me the tool doesn't allow me to open SR as my ND is 11/04 and case processing times at LIN are 11 - 17 months for I-485 EB.

Yeah looks like they have now put in a new check for SR based on processing times. You could still contact a Congressional rep to see if they can help. Be sure to explain to them how impractical the processing times are for raising a SR.

Based on reading others? experiences, it usually is to confirm the job offer and confirming duties and responsibilities if AC21 was used. They can also verify your birth/marriage bonafides so take the birth/marriage certificates that was submitted. Of course if there has been any criminal or other legal issues, hopefully those are sorted out before then. You can also take the medicals to the interview if you did not submit one and did not get an RFE. You could also be asked for proof of continual status so make sure you take a copy of all I-94s, I20s and I797s. Don?t put too much pressure on yourself or spouse and go in cool and confident as it should be just a formality.

My friend going through crisis. Need your inputs on this. Please find her details below.
H1B Applied by Company A: 2011
H1b Transferred to Company B: 2013
She did two H1b Extensions with Company B and for third extension she received NOID. This NOID was issued because Employer A filed her petition as in-house project. However she worked on client project. My friend didn't know about all these until she received this NOID response.
Luckily she could able to file I485 through Employer B in Oct 2021 and received EAD/AP. She is thinking to move to EAD/AP by withdrawing her H1B extension.

Question : Whatever her old employer did the fraud and H1b impact does effect I-485? She is really worried as she has a daughter going to college and she will be aged out in another 3 years. She is not aware of what her first employer did with her H1 b extension in spite of proving the client contract. He filed her petition as in-house project. Please provide inputs.

Looking at the critical situation, it may be best to consult an independent attorney. Also lets see what the Guru's have to say on Monday or so.

Just wanted to highlight the awesome insight/wisdom some of the members have here. Few months back some of you repeatedly suggested to include medicals with 485 applications, and also predicted that not including medicals will increase wastage of visa. All coming true now.
I also saw suggestions for interfiling medical, I think it makes sense more now. USCIS seemed to have sent bulk message today to send medicals soon on receiving the.

I got the text message today. My status is EB3 downgrade, I-140 approved, BM done. I did send medical interfile request that reached USCIS on 7/22 but not sure if they will process that. I read from track-it thread (https://www.trackitt.com/usa-discussion-forums/i485-eb/2221897705/text-from-uscis/page/5) that for a couple of ROW EB filers status changed to "RFE sent". But at this point there is no conclusive evidence. Personally for me, my status is stuck at the Notice State (Fingerprint Fee was received) due to bug in USCIS system (I know it's same for a few others who got their BM done this month).

Should happen soon. I first got card production update on Thu and then yesterday my I-485 and I-485Js got approved along with my wife?s I-485. It should ship out on Mon or Tue depending on backlog for that. So yours should also follow the same steps.

Today, I noticed that my I-765 application is showing "concurrent filing" on top of the case status in the myuscis account. I had not seen "concurrent filing" status before. I have not filed a concurrent application. My I-140 was already approved a few years back. I had filed my I-1485 application in Oct'20 and my I-765/I131 application in Jan'21. I-485 application is showing that fingerprints are completed. But I-485 is not an IOE application. So, it does not show all details in the myuscis account.

Has anyone seen this or had any idea what it could be? Is it an error and do I need to check with USCIS?

Waiting4GC - May be case updated by mistake, better to check with USCIS . Chatting with EMMA is the best and fastest option. Here is the trick to get live agent immediately
- keep typing "technical difficulties"
-after 3 times you see options to connect to live agent
- choose don't have a receipt number. that's it

I have been in the country for 15.5 years (wait in Q for about 10 years)... few more months wait won't make a difference. I just wanna get it over with. I do not know how I will react with GC in hand.

However today having the EAD approvals today... did not mean much... there was not even a second where i stopped to ponder what just happened. Few years ago, my family would be rejoicing for days/weeks/months if we got our EAD.

This wait has left a very bad taste about GC and now it has become like this necessity that we do not care about anymore.

(Fortunately I did not put my life on hold - changed jobs, bought several homes, blessed with wonderful family, lived like normal citizens do except for vote).

My PD is Jul 2011, and applied for EAD/GC in Oct'2020. My application went to Nebraska service Center, and the applications of my Spouse and dependent went to MSC - National Benefits Service Center. However, my spouse's application was rejected due to some missing pages in the application. Our attorney's resent her application in April'2021, and recently her biometrics got scheduled for next week. In the meantime the Biometrics for my dependent and I were completed in May. My dependents application has now been transferred to Nebraska Service Center. Recently my I-140 got approved through premium processing. Can someone suggest if having applications in different service centers causes any issues/delays? Do, I need to wait for my spouse's application to be transferred to Nebraska before we can send the medicals for all of us?

I got Canadian PR as a backup a couple of years ago and was all set on going there next year until the spillover happened this year. Then I decided I would prefer to give up Canadian PR and stay here since most of my life has been here. Then I learned about processing backlog and how I might not get GC at all and spillover might be wasted. Ultimately I'd be happy if I get the GC this year and I will stay here, but some days I wonder if I want to stay in a country where I have to beg for GC like this after living here for 15 years instead of going to a country like Canada that welcomes immigrants and where I could have been a citizen by next year and where they just extended work auth for all applicants waiting for PR unlike the idiots here who can't even issue stupid EADs.
