Do we get 485-J approval before getting GC ? Did anyone get 485-J approval or Just the receipt notice with "Fees Were Waived" then got direct 485 approval ?

On a quick note, a light year is a measure of distance, and not a measure of time, so your statement is not accurate ; -). A more appropriate analogy would be general relativity - the 1 week movements previously were like the PD's were near a black hole where the time slowed down, and now with the spillover the PD's are more in earth's orbit.

With the aggressive advancing I think eb3 2015 may become current in FY 2022 (atleast the filing dates). Beyond FY 2022 is an unknown but I really am optimistic in the next year or two there will be legislative change that will reduce the backlogs ( I know folks are generally very cynical about any legislative change)

Lol ..True true... And I totally missed that part about light year.. where time is still a year.. but my mind was all considering it only as a big number .That many years... :D

Per my understanding: Yes there is a I485-J approval. That usually happens in conjunction with your 485 approval. Usually the officer that will approve you 485 will also approve the 485J.. disclaimer- thats my understanding..

@krnashvom8 - Thanks, its a great piece of information to know. At least it is not a stopper like FP or RFE Medicals for 485 approval.

The underlying I-485 Supp J has to be approved before I-485 is approved. However, one may or may not receive a separate approval notice for I-485 Supp J.

I became current in July bulletin in EB2. My receipt date is Oct 08, 2020 and I responded to medical RFE in March 2021. I joined a new company on May 03, 2021 after transferring H1B. No EAD so far. Should I file I-485J supplement to avoid any questions during N-400 that I didn't stay with the petitioning company for a reasonable time? After filing I-485 J supplement, my current company will become petitioning company where I am going to stay for longer time anyway. I want to know experts' thoughts on this.
GC is for a future FT job promised by the company and accepted by you. So if you had moved to a new company availing AC21, you need to file a I-485 Supp J immediately. Any USCIS AO that looks at your case closely, send you a NOID or RFE. So it is better to proactively file I-485 J as you are FA current. In rare cases, you may get a GC without doing anything. In a bad situation, USCIS may claim that they approved the GC in error.

Attorneys may advise you to wait for RFE. That will delay your GC approval by a few months.

Friends,

I've a new job offer and it's been 180 days since I filed my 485 & my PD is current.

1. If I take up the new offer should I file I-485J immediately or after the RFE?
2. What if I join the new company and GC gets approved without i-485J RFE?

USCIS should not approve GC before getting a new I-485 Supp J. They will send you a NOID or RFE. As you are FA current, you should file I-485 Supp J proactively. Waiting for RFE will only delay your approval by a few months.

As per my knowledge USCIS doesn't know whether you are with same employer or new employer after filing 485. They will send RFE for 485J only if past more than 2 years after filing 485.

@idli - Good seeing you back. I will also add that your local FO typically green lights your application before a visa number is used and the final approval happens. I checked with Emma a couple days back and they said now my local FO is handling the case and NBC assists them as needed apparently.

As per my knowledge USCIS doesn't know whether you are with same employer or new employer after filing 485. They will send RFE for 485J only if past more than 2 years after filing 485.

It depends on the circumstances. In my RFE, they asked for paystubs along with medicals. So they'll know my employer is different from the one that petitioned I-140. Planning to send Supp-J as part of the RFE response package.

I found out today that biometrics have been reused for me and my spouse's GC EAD application.Can they ask for new biometrics for I485? or am I done with biometrics as they reused old biometrics?

I am current.I am planning to wait till my I-140 is approved.Also my lawyer didnot send my pics with my original application..so I am expecting a RFE for photos.If your I140 is approved and you are done with biometrics, theres no harm in interfiling.

Is it mandatory that all the applications will got to FO? For e.g. my applications is at SRC(Texas Service Center) and once my app is document ready... will they send to local FO?

Hi - Due to certain personal reasons I was not able to focus on immigration or GC related matters back in Oct-Nov timeframe. My priority date is EB2 Jan 2012. So I missed filing my EB3 downgrade application and I485; with all the predictions now and recent updates from Charlie does it make sense to just wait and file my I485 directly in EB2 when the final action dates or filing dates are current. From all that I have read and understood there seems to be a good chance of my EB2 date being current in FAD itself later this fiscal year or early next fiscal year.

Just wanted few other educated opinions on if there's any reason I should downgrade to EB3 when filing dates or final action dates in that category allow me to? Why add the extra EB3 I140 downgrade application step to my situation now; again this is very specific to my priority date of EB2 Jan 2012 and how I was not able to downgrade back in Oct last year. Appreciate any inputs.

True. But happened to read online that if am applying for new EB3 140 at the same service center as the old EB2 center then they are likely to accept the premium processing request. As they should have the old PERM. Have to confirm this with my lawyer. But if that's true then I could get in the queue sooner than Oct.

I was able to get my EB3 140 approved with PP when the 140 application was not accompanied with original PERM. I was lucky to get it approved in the first attempt but I have heard in some cases USCIS denied the PP but asked to resubmit after 30 days.(They attempt to track the PERM during that time.) And after 30 days PP was accepted.
My employer's lawyer was adamant that PP will not be accepted and strongly discouraged but I still took the chance.

I485 J : approved on 6/11/2021
Medicals RFE: No (Waiting)

Interesting part is 12 year old child's I-485 status shows approved.

Anyone seen dependent children getting approved without medicals

For 485, biometrics will not be reused. You will be called in to give biometrics for 485.

Folks ,

AOS/H4 EAD.

Filed I-485/I-765 on 10/30/2020 with TSC (PD 04/2012 in EB3.I-140 approved.) still waiting for EAD/fingerprinting.
My spouse needs work authorization for a new job.(Was on H1B before).
We tried to expedite EAD but USCIS denied it without requesting an evidence. Reached out to the local congresswoman and her office
made the inquiry with USCIS over a week ago. No response yet.
My H1B is up for renewal. I was under the impression that I can file H1 in premium with H4 petition and H4 EAD application and
USCIS processes it together in the PP time frame but I hear that policy changed sometime back and H4 applications much longer.

Question -
1. Is there another avenue we can explore to get AOS EAD expedited?
2. H4 EAD - Anyone had success getting H4 EAD processed in the PP time period recently. If we include the job offer(and any additional explanation) with the H1B/H4 application, any chance USCIS will consider it ?

Appreciate any suggestions.


Singh, I think your best bet is to request (and keep requesting) expedited processing of I485 EAD. H4 EADs still are taking a long time. If you look at threads on Trackitt quite a few people have had success getting 485 EAD expedited after making repeated attempts (3rd or 4th time). You have a genuine reason citing the impact on your spouse's job. That my opinion, others can chime in too.


Yeah my close friend managed to get his ER approved on third attempt after getting shot down twice by live chat agents. He spoke to a person on USCIS phone line, used somber voice, described his story, managing house household on a single paycheck, paying mortgage, bills, sending two kids to day care etc. Nothing he spoke was untrue but sometimes you establish a personal connection if you speak 1:1 vs chat. He received EAD for his wife (not for him though) within 45 days of ER being opened.

Called USCIS to request expedited processing of EAD the second time. The person I spoke to said that we have to wait for 30 days before expedite request be considered again.
When I quoted the genuine job loss and resulting financial loss ,I was told that it's in the petition that the primary applicant has the means to support the family financially, so this cannot be considered a financial loss.
I am wondering if I just retry after a few days for wait for 30 days. My wife cannot hold on to the job offer for long.

Oh man! so the wait continues for me :( no biometrics till now...

If biometrics are not reused, does that mean than everyone who completed biometrics for EAD/AP will have to redo biometrics for i485?

My biometrics were not reused and after the appointment, they were applied for EAD/AP and I-485. So could be the opposite holds good, if they do reuse biometrics for EAD/AP, you will be called separately for the I-485 biometrics.

Hello -

I`m new to the forums. I have a PD of 12/2012 under EB2. Unfortunately, the company I work for did not downgrade my application from EB2 to EB3 due to reasons beyond my control - I wasn`t able to convince them either. If they had done it I would have been current this Visa Bulletin. But, let bygones be bygones.

Here are my questions -
Based on my understanding on how things are moving with EB2 - and hopefully they will move in a similar fashion - Can I hope/expect my date to be current around Feb 2022. Is that a reasonable projection?

I can wait for that amount of time. Do you see the pattern changing? Do you folks have a different prediction for EB2 PD 12/2012?

Might be better. Gives CO an additional 10 days to get any updates from USCIS and provide a more accurate input on date movements for next month and after (though he's been very accurate so far anyway).

Its not a question of 'If I send Medicals right away' - you should. Also, without BioMetrics (BM), your case will not go through the FBI check. But you never know with USCIS and they might expedite your case for BM so that you can be greened in this fiscal.

You may want to look up the 485 processing times in the USCIS website. I don't mean to disparage you, but some of the 2012 filers are still waiting for their GC. And they have been FAD current since Oct 2020.

I have seen 2009 applicants greened in 2014 while lot of applicants from 2008 got greened in 2018. Even now lot of 2010 applicants are reporting greened, and 2009 applicants filed in 2012 waiting.

The only logical explanation that I have for this is that it's been 9 years since they filed and chances are NOT bright that the initial batch of officers who were assigned those cases are still working in USCIS. The result could be that their files are assigned to a different officer and ended up in the bottom of the pile. Just a theory, I have. Do I have proof, NO.

I have seen people who submitted 3 weeks after me with a later PD get an earlier Notice Date and get greened.

Are you still planning to join the lawsuit then? I am still on the fence. My downgrade application is in TSC (RD 11/4) and so far no action or FP appointment yet. I have been following on Trackitt and there aren't many TSC cases with movement.

I can add something more to that. Had there been no filing date/final date introduction in 2015, CO would have advanced final dates for them in last quarter of 2016 or 2017 and all of them would have been greened before 2018. The non submission of medicals appears to be a big time visa waster this year. Last quarter and dates exceeded to what is being predicted for Eb2 and very close to December 2020 filing date.

I am a longtime visitor of this forum, and say that i gained immense knowledge on EB immigration from best of the minds out here.
Discussions from this forum gave me confidence and necessary pointers to file AoS by myself.

Here is my timeline,

1. Applied for AoS in EB2 during Oct 2020 without medicals for self and family ( I filed 485/EAD/AP all my myself along with Sup J provided by employer). April 2011 priority.
2. Got receipt notices & FP notices on time.
3. Received EAD/AP approval by end of Jan 2021. I am preparing EAD/AP renewal documentation to submit during first week of August 2021.
4. Post 180 days started looking for job, and got a good offer.
5. Will be joining the new employer by end of June 2021 on EAD
6. Shared copy of PERM, I140 application/approval with new employer. They are working on the information i need to file 485 sup J.


7. Collected Vaccination records from primary care physicians for our family. Provided those docs to USCIS approved physician along with form I 693.
Luckily all shots are covered, nothing was missing and the report will be ready by mid of next week. I am yet to get medical RFE but planning to submit it along with 485 sup J.

Now the questions,

1. I believe sending medicals (without rfe) along with Sup J has high chance of acceptance than sending it alone. What do you guys think?
2. Where to send 485 Sup J(without rfe)? - My original 485 AoS was sent to Phoenix lockbox. So i guess i need to send it to the same address. Do you see anything i am missing?

Excerpts from USCIS site,

and the fun part -

I am part of Siskind's lawsuit now, and during 2015 as well. Fooled twice? May be yes, May be no. 2k USD will not make me poor but few months of delayed GC will.

I have a job offer handy with me, but this aggressive final action date moment, where 2013 is current in EB3 ( which I thought would not be current for next 50-60 years ) do you think Nov 2016 EB3 might be in Date of filling by oct 2021 visa bulletin. I am really hesitant to take up the new job offer where I have to go through PERM and that would take 10-14 months and I might miss the opportunity.
As we only have two more visa bulletins ( Aug, Sep ) do you think are there any chances for Nov 2016 EB3 applicant in DOF with this momentum.

Also, do you think the visa wastage for FY2021 will decide the Date of filling for FY2022? Any thoughts on how much would be the wastage with this current situation. Why would DOL move the DOF if they think there might be wastage for FY2021.

I have an approved PERM and EB2 I-140 (from 2012). My Priority Date became current in EB3 recently, so my company filed a concurrent EB3 downgrade and AOS. We filed for premium processing once the downgrade EB3 I-140 receipt was generated. We have since received a RFE ��. It?s a routine RFE requesting Employment Verification Letters (EVL) (which I would have thought they already had). In any case, while preparing the response, my lawyers told me that the start date for my last job on the approved PERM and my EVL is off by a few days. I didn?t think this would have been an issue considering it?s only a few days and that too straddling a National holiday. But as part of the RFE response, along with the EVLs, my company lawyers want to submit an affidavit stating that the date on the PERM was a typo, and that the start date on my EVL is correct (and that there are no other changes to the PERM). I?m wary that all this would bring even more attention to the start date typo, which might otherwise not have been a big issue - and as a worst case may result in the approved PERM being reviewed again and reversed !. I might be overthinking it, but after many false starts, and waiting a really, really long time to get this close, I just don?t want to jeopardize anything!

I would suggest you to take multiple pages and write Pros and Cons for each. It is not simple. Each points can have multiple paths

For your dates when do you think you are going to get GC if you stay with the same company? The earliest you can see the actual GC from our 2020-21 experience is after July 2022. If the job change worth enough to make a difference if you get your GC after 2023?

If you want to check in the past, what was your expectation same time a 18 months back?

What happened in 2012 when dates moved forward very fast? 80% of the people, who had the chance to file for GC filed in EB2. Apply the same logic here, with the EB3 final dates moving more than 18 months ahead every new person changing job in 2021 is going to apply in EB3 only. So the momentum you are seeing now, may not be there when the country opens up post covid.

Hi, working objectively on the current scenario is prudent action in your case. If you have a good offer i would say go for it. There is still a year atleast for your date to become current and also most importantly, although it may be allowed in FD, USCIS may not accept FD's for some time and only rely on FAD.

You have to take the call based on the pros and cons. If I were in your place, I would wait it out till October bulletin (to be released in mid September) at least to take a decision. Do you think that you will never ever get a good or equivalent job opportunity if you waited the next 4 months instead of accepting the current offer? If the answer to that question is yes, then you should take up that offer. I personally never came across any job opportunity that was worth adding 5-10 years to my GC/GC-EAD wait.

Our immigration needs are always moving targets. Last year around same time, I would have settled for GC EAD in June 2021.

Fast forward one year I don’t have GC EAD yet, but I did not bother to expedite it. I want the actual GC. With the administration change, I am happy staying back in H1 till get the actual GC.

I did not say October 2021 is a one time deal. The covid 19 pandemic is still raging at many parts of the world and it will take some 2-3 years for things to normalize in EB.

On another note this is actually a good time to pass the fairness bill.

Hello Experts,

Looking for some advice.
My PD is May 20,2011 (EB2) and last year in October I filed I-140 in EB3 along with I-485 (EB2-EB3 downgrade) in the Texas service center. I haven't applied for I-140 premium processing yet. I haven't received bio-metrics appointment yet.

As per the July visa bulletin, my priority date is current in EB2 as well. My lawyer suggested that I could think about interfiling and replacing EB3 based I-140 (currently pending) to approved EB2 based I-140 for my pending I-485.

Here are my questions/concerns. Appreciate your inputs:
- If I go with interfiling, what happens to my EB3 based I-140? Do they still process it?- I'm concerned about EB2 dates retrogression. By interfiling I'll lose my spot in the EB3 queue.
- If I don't do interfiling and stay in the EB3 queue, try to get my EB3 I-140 approved in premium processing. Not sure if I that's a faster route to get GC.- Is it possible to submit medicals with this interfiling request?

Aceman, I personally don?t think there will be this huge spillover like FY2022, I?m expecting around 320k-330k visa numbers or even 350k by end of September to be available for EB with all the US consulates closed across the globe for the entire FY2021. I don?t see such huge number unless another pandemic or war. Do you think there are chances for Nov 2016 EB3 for DOF in oct 2021 VB with such huge spillover and very less wastage 30k-50k in FY2021

It's too early to predict how the dates can move. At this point we do not know the visibility CO has to the downgrade numbers and visa numbers allocated by USICS. The less information CO has (especially about the downgrades) may be harmful to EB2 folks and at the same time it will turn out to be a gift to EB3 folks. At this point the situation is still very fluid. If I had to give out an educated guess (with all the disclaimers), I could see EB2 at 1/1/2015 and EB3 at 1/1/2017.

2. Where to send 485 Sup J(without rfe)? - My original 485 AoS was sent to Phoenix lockbox. So i guess i need to send it to the same address. Do you see anything i am missing?


Yes, you can send the I-693 along with new I-485 Supp J. I am somewhat convinced in the theory that interfiling I-693 has no risk. Of course, USCIS might lose your I-693 just like it normally happens with regular filing too. So far we hear only positive outcome about interfiling.
To the service center or local office that processes your I-485. You can ask EMMA for confirmation. Your attorney will also know this.

EB2I FA is at 01JUN11. It should reach 01DEC11 soon. Your PD of 20MAY21 has no chance of retrogressing for 1 to 2 years. You should get GC before that.

Make sure that USCIS has your latest I-693 first. For the folks who did downgrades, I don't think many approvals have come through. Others who are actively following data might be able to advise you on this. Once your FA is current, USCIS goes with I-485 filing date for order of processing. So downgrading or cancelling downgrade request should not impact as long as USCIS has time to process your request. Then you go back to I-485 processing queue.

One can only make educated guesses for your questions. We don't know how they actually work inside. So get as much input and make best decision on the available information.

Like many others, I filed I-485 in Oct 2020(PD - 04/2012 EB3) with Texas service center. Still waiting for EAD/fingerprinting.
I am relocating early next month from Massachusetts to California. I will still continue to work remotely for the same employer.
Employer is filling new LCA/H1B for the new location(home office).
My question is, can the timing of my move have any effect on the I-485 processing ?
If the biometrics appointment is sent around the time of my move , will I be able to reschedule it in the new location ?
As some cases get transferred to FO and if that happens in my case and it's the local Mass FO , will I be able to get that changed after the move?
Once I move and change the address on USCIS website , can that cause unnecessary delays ?
Anything else that I should be concerned of ?

Appreciate any suggestions.

I do not see anything illegal being done by wallstreetbets. They are doing the exact same thing that the big hedge funds do. There have been clips of Jim Cramer in his moments of honesty admitting to hedge funds moving the stocks in a certain direction. The reason the wallstreet is angry is because the little guys are using their own game against them. The lawmakers are angry because their donors are being affected. It falls into the usual category of being legal if rich do it, but illegal if the little man does it.

I am a layman, so excuse me. But cannot understand why EB2's of 2012 would not downgrade to EB3.

EB2 final action date: 1 Jun 11, Filing date: 1 Dec 11
EB3 final action date: 1 Jan 13, Filing date: 1 Feb 14

All 2012 dates are covered by EB3.

Context: PD Feb 2012. Thinking of (a) joining old employer; (b) whether to continue on EB2 or to file EB3 I140.

What is difference between LIN(SC) and LIN(LB) charts? As my luck would have it, I am in LIN2190200001 - 20000 bucket which has the longest blue bar. I believe the data is only for I-485 applications which may be about ~1/4th of all receipt numbers in that 20K bucket.

I remember back to my Mumbai days before electronic vending machines for tickets where there used to be serpentine queues for 6 ticket windows to get on the train. You will have some sly people waiting around milling in the back (me included many times) and suddenly a new window will open and there will be an almighty rush to that one. So it will happen that some guys who were not even in any line will just get their ticket in a few min and go away whistling while others who waited patiently for 45 min in other queues far away from the new counter will just continue waiting staring daggers. ;)

SC = Service Center - I think this is for concurrent I140 + 485 with Premium Processing - they go directly to Service Center
LB = Lockbox - all normal I485 applications

I am in LIN219018**** - just got FP on Friday so you should be getting yours soon hopefully.

Looks like they've started Greening some 2021 filings even though there are a lot of 2020 filings they haven't processed. Maybe these are straight 485 applications instead of downgrades...

Btw, this includes both EB and FB.

I remember those rainy days in Mumbai about what you mentioned, I was just studying Markov Chains and queuing model and how I would ponder standing on those queues, thinking about M/M/1 queues and what not.

I am working on a Python script to scrape data from USCIS case tracker (I asked few folks on TrackItt who were already doing this for MSC if they can share source code, but didn't get any response). Currently my script takes a few of hours to get data for 20K cases (I am using 'requests' and 'pyquery') which is not very practical. So I need to work out the kinks for diff'ing the data between days using Pandas DF and schedule a crontab or something. I will let you guys know if I get something working in reasonable time.

The whole point of FD is to have a pool of people ready to use the visas in the final quarter of a FY when there are ample number of visas available and to minimize the wastage of visa. This was part of the improvement plan in 2014-15 resulting in the introduction of Filing Date and Final Action Date.

The law allows only for a certain % of visas for each countries for first 3 quarters. In most cases Eb1 visas are processed first in the beginning of the FY, followed by EB2 and finally EB3. It means if a Greece born person applies for EB based GC in March 2021, his petition will be prioritized over an over subscribed applicant who filed in October 2020.

CO is from DOS and he does not have the authority on USCIS work. Last year same CO said USCIS will waste 25,000 visas and when DOS released statistics for FY 2020 USCIS had issued 148K visas of the maximum 156 K visas, a tremendous effort when we had lost 3 months due to covid. I appreciate your efforts in researching and finding the details. Don't take my word for it, you can check for visa statistics in the official sites for yourself.

I was wondering about this post from the lawsuit thread. Does that mean people current this fiscal year that don't get greened this year, will have to wait till Q4 next fiscal year? Does this mean that next year the FADs will retrogress because spillover is only applied in Q4? I thought CO had said they won't retrogress.

Also, I think I read somewhere that USCIS sometimes issues cards into October but pulling from past year's quota. Is that true?

Is this from the MSC thread?

A lot of downgrade I140s that are in regular processing haven't been approved yet. I wonder what will happen to them when USCIS goes through the batches in order of ND.

I think you might end up replicating what the Chinese group on Telegram is doing (see link I sent upthread). Lots of Indians on that Telegram group too. Might make more sense to talk to them and team up with them - they already have all the data for 485 and 765s. They reply on the Telegram channel if you message them.

EDIT: They don't scrape I140s in case you are interested in that.

Both Primary and spouse medicals were submitted within 3 weeks along with 485J RFE response.

Today we received RFE to submit medicals for spouse.

Spouse application is considered as a separate application and didn't linked to the the medicals submitted as part of Primary applicant. I guess i will have to get a new medicals from USCIC doctor and resubmit.

anybody have similar situation ?

Sorry to hear that. You have no other choice than to respond to this RFE now. Respond to it ASAP before they forget your spouse's application again.

In one of my friends' case, he sent the medicals for himself and his spouse to TSC, but meanwhile TSC transferred their cases to the local office and he received the RFEs from the local office. He resubmitted new medicals and is currently waiting to be approved. I think you might end up replicating what the Chinese group on Telegram is doing (see link I sent upthread). Lots of Indians on that Telegram group too. Might make more sense to talk to them and team up with them - they already have all the data for 485 and 765s. They reply on the Telegram channel if you message them.

EDIT: They don't scrape I140s in case you are interested in that.

Yeah i think they have the same data I'd essentially be looking to scrape. It's just that their updates are not as frequent. I guess, I also need to also calm down a bit because there is nothing much I can do, even with access to all that data :).

Yeah, hopefully now they will update daily like they used to in April. Their visualizations are easier to read than the Trackitt data, though I guess that is more granular!

I don't understand how there are so many apps at MSC. I thought MSC is for straight, i.e. no downgrade, EB apps. Do FB apps also go there? Even if so, surely the spurt at MSC in FY21 is mostly EB apps?

I think you can check on USCIS website https://my.uscis.gov/findadoctor. There is nothing like a good civil surgeon. All they do is check your medical history, immunization records and if you don't have per-existing immunization records from India then they order anti-body tests. It's pretty much lab work. The doctors that USCIS has on their website know the drill and all it comes down to is the cost and how much your insurance will cover. Most doctors charge between $200-$300 for the medical test and many employers reimburse that fee too.

I am relocating early next month from Massachusetts to California. I will still continue to work remotely for the same employer.
Employer is filling new LCA/H1B for the new location(home office).
My question is, can the timing of my move have any effect on the I-485 processing ?
If the biometrics appointment is sent around the time of my move , will I be able to reschedule it in the new location ?
As some cases get transferred to FO and if that happens in my case and it's the local Mass FO , will I be able to get that changed after the move?
Once I move and change the address on USCIS website , can that cause unnecessary delays ?
Anything else that I should be concerned of ?

Appreciate any suggestions.

Sorry to hear that. You have no other choice than to respond to this RFE now. Respond to it ASAP before they forget your spouse's application again.

In one of my friends' case, he sent the medicals for himself and his spouse to TSC, but meanwhile TSC transferred their cases to the local office and he received the RFEs from the local office. He resubmitted new medicals and is currently waiting to be approved. He was told that they are waiting for some new documentation from TSC (probably the medicals he previously sent) and can't take the action until the file is complete.

Thanks @vedu . Yes my attorney also recommend to get a new medical for my wife. I am getting current on 1st July so better to hurry up and resubmit the medicals asap.

I am a layman, so excuse me. But cannot understand why EB2's of 2012 would not downgrade to EB3.

EB2 final action date: 1 Jun 11, Filing date: 1 Dec 11
EB3 final action date: 1 Jan 13, Filing date: 1 Feb 14

All 2012 dates are covered by EB3.

Context: PD Feb 2012. Thinking of (a) joining old employer; (b) whether to continue on EB2 or to file EB3 I140.
Charlie's call on 6/28 should provide some clarity

Any thoughts ?

All doctors will follow USCIS guidelines and do the complete process no shortcut. Do your homework to learn the step by step process, vaccination and blood work details, then call up few numbers and ask for the price and timeline then decide where to go for medicals. The complete process will take arround 7 to 10 days or even longer. There are few threads in this forum to refer. search for "I-693" or "I693"

H1-B
H1-B is location and employer specific. So if you are with the same employer and change locations, you need to amend your existing H1-B to reflect the new location. If you are also maintaining H1-B, do the amendment process.

Pending I-485 after 180 days
As you have already made up your mind about relocation, I assume that you already know that you are eligible for AC21 protection. AC21 only requires the job to be in "same or similar classification". So if there is no change in your job title or description or SOC code you are a perfect candidate. AC21 does not require the new job to be in the same geographic location or pay.

You have to file AR-11 form to reflect change of address. Once an AR-11 is filed, the USCIS system automatically updates address on all pending applications with your A#. you may get fingerprinting at the new ASC (CA) or old ASC (MA). It all depends on internal USCIS processing, timing of AR-11, system updates and such. Once you file AR-11, the AO might send a RFE for I-485 Supp J, if he or she thinks that you have moved to a different job. Then you have respond with evidence for the RFE. After AR-11, you can request USCIS to reschedule biometric at new ASC location. Delays associated with AR-11 are expected, but depending on a variety of things it may even speedup your biometric in rare situations.

You are looking for specific input for a specific location. Try google as some users might not reply to remain anonymous. It might pop-up some thread somewhere regarding recent experiences at your location.

Other than money and duration (days), this process is standard. You need to use USCIS - Find a Doctor (https://my.uscis.gov/findadoctor) tool to locate approved civil surgeons in your zip code. Then ask questions about what the process is like, what tests, money part and how busy they are. Depending on your "shopping around", you can decide to go with what is convenient for you.

My quick 2 cents - NEVER forget that GC is future employment. So all that your lawyer needs to take care is your move in the short term. Company can continue to say that your future job hasn't changed.

Thanks for your inputs. Lawyer does not have any concern with the move. My H1 is up for renewal and that will be filed for the new location. No change in the job title or description. My concern is the delay this might cause in my I-485 application and EAD and if there is way to avoid that.

Aceman, I personally don?t think there will be this huge spillover like FY2022, I?m expecting around 320k-330k visa numbers or even 350k by end of September to be available for EB with all the US consulates closed across the globe for the entire FY2021. I don?t see such huge number unless another pandemic or war. Do you think there are chances for Nov 2016 EB3 for DOF in oct 2021 VB with such huge spillover and very less wastage 30k-50k in FY2021

Ok, You need to understand what happens when EB3 has a massive movement historically.
Last quarter of 2017 18 months movement. First quarter of 2018 0 months movement. April 2018 - 13 months movement, came all the way up to January 2009 by August 2018. It was the same till Feb 2020.

For FY 2022 we are expecting around 280,000 visas. Since EB1 and Eb2-ROW is current, most of that will get applied to EB2, while EB3 is going to be slow movement for some time.

Hello Friends,

My PD (5/23/2011 EB2-I) is current as per July bulletin. I didn't file for downgrade last year.
I am wondering what the best course of action might be for people who never got to file because DOF was not current or accepted by UCSIS *but* whose dates may be current directly in the FAD chart ( e.g. May 15 to May 30 ).

I have decided to send the medicals along with the I-485. But wasn't sure if I should apply for EAD/AP also with it.

- Is it better to apply without EAD/AP forms ? Any pros/cons with this approach ?
- Any other learning that we could use make the process smoother ?

Just concerned that there will be another flood of applications in Oct '21 and the next couple of months provides a brief window of opportunity

Someone can correct me if I am reading the data incorrectly but between the plotted data from the image shared for NBC earlier and above mentioned number of approved cases, I am seeing:

MSC219 series has roughly 350k-400k cases out of which ~17k cases has been approved...Does this mean these approvals does not include any field office approvals?

Man, this SRC BS feels like another round of disappointment! Almost one year gone and nothing. As an aside, how can I know if my application went to a lockbox or a service center? My papers were sent to Nebraska and received on 11/4. I have all my applications (I-140 for the EB3 downgrade, 485, 765/131) start with an SRC. Got my receipt notices on Feb 11, and nothing else since then.

Total number of approvals at service center facility (where I-140+I-485 concurrent filings go) seem low compared to lock-box facilities. But it could also be due to the fact that prior to Oct-2020 most of the filings were mostly I-485 filings based on previously approved I-140 (for backlogged countries).

I think it does include FO approvals. They are just scraping USCIS case status, which gets updated regardless of where the case gets adjudicated. MSC also has a lot of FB cases probably btw.

Some people suggested sending separate packages but I wonder if that can result in medicals getting applied to one application and not the other.

Total number of approvals at service center facility (where I-140+I-485 concurrent filings go) seem low compared to lock-box facilities. But it could also be due to the fact that prior to Oct-2020 most of the filings were mostly I-485 filings based on previously approved I-140 (for backlogged countries).
Yeah, strange. I think only PP I140+485 filings go to SC btw. Rest go to LB.

Package doesn't need to be marked to anyone. As long as you have your receipt number / alien number marked correctly it will be stapled to your I-485 (in theory that's the expectation but may or may not happen).
Sending it in single package will be better in my opinion, that increases traceability of the paperwork and one cover letter for primary applicant with dependent information (name / receipt / alien numbers etc) should be good enough. Based on primary applicant USCIS adjudication officer can always link the dependents.

Man, this SRC BS feels like another round of disappointment! Almost one year gone and nothing. As an aside, how can I know if my application went to a lockbox or a service center? My papers were sent to Nebraska and received on 11/4. I have all my applications (I-140 for the EB3 downgrade, 485, 765/131) start with an SRC. Got my receipt notices on Feb 11, and nothing else since then.

All applications go to a lockbox for initial processing and then are assigned to a service center. Only lockboxes that I-140 based I-485 applications go to (depending on the State of residence) are Dallas and Phoenix. And *I think* all downgrade applications go to Phoenix. Not sure how yours went to Nebraska. In any case since the receipts starts SRC they are being processed by the Texas Service Center. Anecdotally, it appears SRC is the slowest processing applications so not much to do except wait.

OP says the receipt starts with SRC, so I guess his application is not being processed by Nebraska. If USCIS decides to change the service center OP should get a notice informing him of the change in center.

Huh? Nothing goes to Phoenix. Lincoln, Nebraska or Texas depending on where applicant is located.

That is incorrect information. There is no lockbox in Nebraska. It's a service center. As I said, the applications for employment based I-485's go to a lockbox first. Phoenix, AZ or Lewisville, TX. Third one is in Chicago but I believe it's for different applications.

The lockbox is where the application is mailed and the function of a lockbox is to initially screen the application for completeness and scan and enter the information into the USCIS system. Once the application is in the system it's assigned to a service center for processing. The fact that a receipt is generated (with the serial number) means the application is now with the service center -- which in your case is the Texas Service center. Once the receipt is generated the lockbox has no role to play with the application.

I think the USCIS case status tracker website will tell you if your application is with Lockbox or service center.

Again, all the lockbox is doing is screening and logging in the application. It's not visible in any status updates which only happen when a receipt is generated, and by definition of the receipt number its with a service center at that point.

That would a question for them. I don't know the source or veracity of the data and how its presented and to me it makes no sense. There is no "MSC LB", MSC is only a service center. Similarly for others. I thought the difference between lockboxes and service centers and their functions was common knowledge.

**Doing a quick search, the one scenario that an application goes directly to a service center is filing I-140 in premium processing. So maybe concurrent I-40/I-485 filings in premium go directly to the service center too? and the data presented using "MSC or LIN LB" and "LIN SC" is being used to distinguish between concurrent premium processing filings and all other regular filings. In any case LIN LB is a misnomer and is misleading.**

How do previous filings have any bearing on an I-485 application? H1-b extensions, I-140's are filed directly to service Centers including Nebraska. And Nebraska is for premium processing applications. It's easy to find "Where to file" for what form on the USCIS website, so it's not really a debatable topic. And I maintain there is no Lockbox data, it's all service center, it may just be a designation used to differentiate between premium processing I-140 applications and all other applications (which are processed by the lockbox first).

It's all a black box in the end, the trick is to just let the process play out.

The receipt numbers don't change when cases are transferred. Most likely your case was submitted to Texas or Arizona lockbox, and then got assigned to Texas Service Center that issued you the receipt number, unless you filed concurrently with premium processing.

Yes, that is correct on the I140+485 PP. They can tell LB or SC based on case reciept number. And LIN/SRC SC is basically just saying I140 PP with 485 at LIN or SRC.

I thought whether the cases get assigned to SRC or NSC had to do with where the applicant lives. Have you moved since your last filing?

I'm planning to take up a new offer using AOS EAD(It's been more than 6 months post I-485 application RD). I just want to make sure I cover all the bases before moving to this new position. New employer is just requesting EAD details and nothing else - is that all needed?

Since your date is current it is recommended that you proactively file I-485 Supp J. Other than that you just need your EAD card. thats my understanding but you can confirm with attorney of new firm if you have access to them.

I believe you need a physical EAD card to move to new firm on EAD. Just a EAD receipt notice will not do. Gurus - pls correct if the understanding is incorrect.

Given projected 250K-290K EB visa availability based on Charlie O's comments, there is a good chance USCIS may extend filing dates for EB2 in Oct-2021 bulletin. However Charlie has mentioned before that that he doesn't have good visibility into downgrade filings. As USCIS gets through approval for Oct/Nov-2020 I-140 downgrade filings, Charlie will have better insight into EB2 and EB3 demand. Just curious, is your employer not willing to downgrade your I-140 to EB3 ? I know a few folks who had this situation and they offered to pay lawyer/USCIS fee, out of their own pocket and eventually their employers were okay.

I don't have personal experience with the process, but yes all you need is the EAD to change employers after the 180-day period of pending I-485 has been completed. The lawyer will file a AC-21 package with USCIS which includes the I-485J. Trackkit has a sample cover letter with the document list to be included for AC-21 (all this the lawyer should know already):

For the I-485J to be applicable, the lawyer/employer needs to confirm that the new job description and responsibilities are similar to the underlying PERM of the original job for which the I-485 was filed. The SOC code match would be ideal but not necessary. Also job title match isn't necessary.

In summary, looks like the employer/lawyer are doing their due diligence. Not much else to do on your end, except reviewing all documents for correctness before they are mailed out to USCIS.

Having a quick question. My PD is EB2-I Nov 16 2011. Since EB3 is current right now my attorney is suggesting to file concurrent 140 downgrade and I-485 (EB2 applied though same employer). Since the attorney is reputed one not sure if it is a good idea to say no.

Is it a good idea to downgrade now instead of waiting till Oct 2021. If filed concurrently will I be eligible to 180 days rule after 485 filing (if no EAD received) if 140 downgrade is still pending. Also is there any rough estimate how long this downgrade process will take.

I believe you should file your EB-3 I-140 with premium right away and have it approved and file your I-485 if u can wait for a month or two based on EB-# 140 approval, that way you slightly speed up your I-485 and subsequent processing

Absolutely. They are afraid I will leave the company, and they need me here. So, it`s a way of control. I did offer to cover their expenses and it fell on deaf ears. At this point, I`m frustrated with their attitude and bitter.

Hello fellow members and gurus,

I need some immediate suggestions about my pending case. My priority date is Jan 21,2010 in EB2 and I have question about G28 as I have changed my job and did not file either AC21 or updated G28 form till now. Recently when USCIS sent notices about the finger prints being applied to my previous attorney and to me. My previous attorney's notice retuned to USICS as non deliverable, and in-turn USCIS sent back to me as a returned document and my case stuck in there!. My question here is, can I ask USCIS to revoke previous G28 and telling the that I will represent my case going forward? or do I need go through the attorney of the present company which will cost me money and more time. Could anyone please advise me? Thank you and I really appreciate your help.

My lawyer once said that s long as the two jobs have some semblance (even vaguely), they will approve. In his experience over many decades, he doesn't remember of an AC21 being denied. He knows of only anecdotes where someone filed to be a school teacher and ended up being a chef training cooks, which was approved after first issuing NOID. He said that they are normally very liberal in interpreting the same or similar job requiremnt.

I would not worry about it. Make sure your employer lists the job duties that are the most similar with the old job first.

Downgrade filings will only help OP. 250K visas + spill down from EB1 (which is current) + all the EB2-EB3 downgrade filings should logically progress the EB-2 dates rapidly. Whether it happens FY 2022 1Q or later (CO suggested in one of the calls that dates will continue progressing rapidly start of FY 2022 and then slow down -- which is sort of contradictory to how spillover is applied which results is dates progressing in 3Q-4Q, but maybe he was talking about FDs and not FADs) it should happen and OP's date should be current sooner rather than later,in EB2.

It's a tricky question and at this point we are all speculating what may happen in future. What we know for a certain fact though, is that you are current in EB3 queue. If possible talk to whoever you need to in your company (go to as higher level possible) and go for EB3 I-140 downgrade + I-485 concurrent filing (and don't forget to attach I-693 medicals along with it). This is a life changing event for you and it's not just about them worried about you quitting. You can give them any verbal assurances to allay their fears (which you can always turn back on).

I`ve thought about it. But, I`m tired - after 15 years, starting all over again is daunting and scary. So, I just have to put my head down and be patient and hope EB2 12/2012 becomes current.

I`m going to try again. I did my level best in Oct 2020. Thanks for the heads up about the I-693. I agree it is life changing. The freedom to take care of your family back home at a moment`s notice with a visit, ending the nonsensical H1B cycle, freedom to pursue other jobs....

I am wondering what the best course of action might be for people who never got to file because DOF was not current or accepted by UCSIS *but* whose dates may be current directly in the FAD chart ( e.g. May 15 to May 30 ).

I have decided to send the medicals along with the I-485. But wasn't sure if I should apply for EAD/AP also with it.

- Is it better to apply without EAD/AP forms ? Any pros/cons with this approach ?
- Any other learning that we could use make the process smoother ?

Just concerned that there will be another flood of applications in Oct '21 and the next couple of months provides a brief window of opportunity

Based on my experience so far:

- Stay away from downgrade based I-485(no PP and that perm pull is like a black hole - See image below)
- EAD /AP filing seems innocuous. You never know when and if you may need it so probably file it anyway. Con is spending money and as some people suggest - increasing workload.
- Sending medicals with 485 filing is a must. Do not miss it!

Nothing else specific comes to mind. My friends who were able to do straight filing are in a lot better position so just follow that path and sit tight.

p.s.:
Summing up popular opinions here - there are two main reasons a lot more people from Oct - Nov 2020 batch are not getting greened right now:
- Medicals were not included in Oct,Nov 2020 first time I-485, straight filers
- downgrade I-140s are stuck even after 8 - 9 months


Best to stay away from these two issues.

Yes, you can! I did even better. I paid by my credit card (earning 2% cash back), and then got it reimbursed through HSA account! Every penny counts!

If multivitamins from CVS are covered then why not immigration medical exams. its a legitimate medical expenses. I believe any medicines, medical expenses, lab expenses are eligible for HSA account.

It took about 4 days for the RFE to arrive in the mail. I got the medical started the very next day of getting an email alert. Unfortunately, my lawyers delayed sending the documents out by nearly 3 weeks. I sometimes wonder if I needed them at all. It’s fairly straightforward. Good luck. You should expect them by Friday.

No need to wait for the RFE document. To save time you should start the booking appointment for medicals immediately. if the RFE is for I-693 then well and good. If the RFE is for something else then also you should submit medicals with this RFE response. Doctor don't need the RFE letter, they just need your credit card info.

First time hearing this. You should be getting the RFE letter before Friday. If not try to convince the doctor, this process will take some time about 7 to 10 days, you can provide RFE letter to the doctor later time before collecting the sealed envelop.

When people applied for downgrades from Eb2 to Eb3, how does USCIS count these numbers? Do they count the individual in both Eb2 and Eb3? If so, is it not a duplicate ? How will they be able to properly estimate the demand and move the dates if they count each downgrade application twice ?
Please let me know based on your understanding.

I was just presenting a logical opinion and trying to refrain from making predictions. Too many variables and unknowns to predict anything with certainty and make any recommendations. Speaking of logic, this year's spillover did result in the FAD's for EB2 to move 2 years to 2011. All things being equal, with FY 2022 spillover expected to be as much or greater it would make sense to dates to move another 2 years? The good part about EB2 is that it would be unlikely for the dates to retrogress in the future as long as it stays behind EB3.

Maybe the middle ground is (And this is not a recommendation) to wait till October and then take a call based on the movements? Downgrading to EB3 now will take 6-7 months anyway (if premium isn't accepted). Delaying the decision 3-4 months will push everything back but will also provide more data to make a more informed decision.

Go back to your old employer and file the i485 ASAP, you should be allocated GC visa in next 9 months if not by 30Sep2022.

Ace, even I haven't done the best thing. The most optimal thing to do is to pay the bill from your regular account (with after tax money) and preserve the receipt....to let the HSA money compound tax-free for years (assuming you have invested it properly), and then submit the receipt for reimbursement after 20-25 years. You can get reimbursement any time as long as you preserve the receipts.:)

Another thing many people may not know is that the CARES/pandemic Act that was passed last year made sanitary pads HSA eligible. Can you believe that? You need to have all those receipts though! Here is the link for the news:

FAD for Jun2011 will be moved as early as by Oct2021 and it will be current forever in future.
If I were you I'll take 485J from old employer and file the 485 in Oct2021 and expect to get GC by Jul'22 and plan to join old employer at appropriate time.

My EB2 date (Jan-2011) is current in July, would you advise to hold off and send the RFE response packet next week so that it reaches USCIS as of July 1st or is there no harm in sending it right away/right now? I want to take the approach that would give me a best shot at quicker adjudication. Please advise!

You should send it right away! Don't sit on it for even a day. I even recommend using the next day delivery. That's the only way you can get ahead of hundreds of applicants. I also suggest sending them in separate packages if you are sending for you and your spouse. I did ALL OF THE ABOVE, and got my GC approved within one day of them receiving the response.

Nobody is downgrading eb2 to eb3 that is a wrong analogy. It is like one buying both first class and second class ticket for the train. Goal of the passenger is to board the train. He has made himself eligible in both ways. He can decide which class to use.

As per the train management, they will have the number of tickets sold for each class since they don?t know which class passenger is going to choose, it may not be accurate.

I still think you need to send it right away. It may take a couple of days for it to reach there, then their mailroom may take a couple of days to process it, then there may be a weekend. By the time it reaches the officer's desk, it may already be July 1st. Even if it is not, he/she may clear it and put in the line to be approved on day 1.

Are you afraid that they will approve it before July 1 and then you will be in trouble?

My application is right now handled by the local Field Office and my mail is literally to the same city so it will reach the same day through FEDEX for sure as it is literally 25 miles away from my home. But what you say makes sense. May be I will just send them off today and not over analyze it here. Also, good suggestion on sending separate packages for me and my spouse. I guess you say it because there is twice as much chance someone will start the processing as they see that RFE packet come through, right?

Well...I am not so sure after all :confused:. If you don't want them to accidentally approve it before July 1, then you might as well wait. It's all part of being foolproof. What's a few extra days after waiting for a decade??:)

I will give a generalized response to this as it kind of applies to everyone wanting to join an old employer. At this point all the analysis of how do I get the GC quicker may not be as important as getting your foot in the door. GC will come at it's pace, but you can do certain things like sending in medicals along with the application to speed things up.

1) join old employer ?
It depends on your employment situation and where you are at in the PERM processing. If you are confident that PERM will be approved by Oct/Nov then you can wait it out. If not so confident then going back to your old employer makes sense. In case you are still unable to decide, It's best to make sure your old employer will take you back and then keep monitoring the VISA bulletin. The moment you see the next month's dates retrogress you should file your 485 with your old employer.

2) If joining old employer, go EB2/EB3 route ? EB2 route involves waiting.
There are pros/cons to both. As you pointed out EB2 route involves waiting. I believe next year they will move EB2 more aggressively compared to EB3 on a month by month basis. Don't assume though that in EB3 there is no wait. While you wait in EB2 to file your 485, in EB3 you will wait after filing your 485 for your i140 to be approved. so that's that.

3) Even if EB2 filing action date moves soon to Feb 2012, will EB3 route get me the GC quicker ? As EB3 Final action date is in 2013.
Refer point 2. Unless you have an already approved i140 in EB3 it's best to file in EB2. Filing for i140, waiting for receipts and then getting it approved by upgrading to PP may take about good 3 months if you are lucky. There are quite a few folks for whom the PP was denied 3rd or even the 4th time. Do you want to enter this loop?

All the best!! Whatever approach you use, just keep monitoring the bulletin so that you can act when the tide turns against you. There could be a retrogression end of 2022. If the numbers are properly utilized, the dates should be current at least for folks before 2013. But as you probably may have learnt US immigration is a roller coaster ride... If you think of 485 as a giant wheel then the 2012 filers were allowed a seat in the giant wheel but then the wheel stopped with them on the top for 9 years. They were not allowed to get off the wheel and we were not allowed to get in.

my PD 06/10/2011. my new employer is still in process of filing labor.

1. Should I go for premium Eb3-I140 with old employer? I applied on Oct 26,2020
2. Or wait for Eb2 become current? its 10 days away/.. and ask old employer to interfile ?

Attorney is suggesting to not to go for premium .. but file new I1485 Eb2 application instead of interfile from eb3-eb2.

My understanding is CO can easily get the count of downgraded applications and subtract that from EB2 numbers. He is most likely going to do it to move the dates. In case he opens the door for more people, he can always retrogress. Here is why I think he is going to do it; when an applicant files 485 then the underlying i140 counts. So if someone downgrades and files for 485, he is essentially asking USCIS to process his application using the EB3 i140. USCIS will not consider EB2 unless the applicant explicitly asks them to use EB2 i140 through interfiling. I believe CO has these scenarios factored in his math.

Possible. But the fact that the field office pulled the case from the shelf before the dates were current probably means they have no intention to shelve it again. Otherwise, they wouldn't have pulled it out considering the dates were not current at that time also.

Hello Experts - My company will be upgrading the I-140 (EB2 to EB3 downgrade filed in Nov 20) to premium processing when the FAD becomes current, which I'm expecting to happen in Aug'21 bulletin. They are charging 1000$ to interfile I-693 medicals along with it which my company will not pay. Do you recommend I bear that expenses and move on?
PS:Neither FP nor BM appointment received medical RFE..GOD knows when.

Thank you, Sivarama. That is exactly my understanding as well. Otherwise, if CO does count an applicant in both the categories, then they are estimating the demand incorrectly. Also, I found one post in a telegram group (not able to post it here), once the downgrade is approved, the immigration bureau will delete the earliest(EB2) request category from state department's inventory request file and then will submit a request for new quota in new (EB3) category.
Now, if applicant wants to process his application in EB2, then that is where interfiling comes into picture, where applicant has to send a request specifically to USCIS to consider his application in EB2.

I totally agree with your post above, EB2 may move faster than EB3 (because of additional spillover from EB1, and thus EB2 having more visa numbers) next fiscal.

Hello Experts - My company will be upgrading the I-140 (EB2 to EB3 downgrade filed in Nov 20) to premium processing when the FAD becomes current, which I'm expecting to happen in Aug'21 bulletin. They are charging 1000$ to interfile I-693 medicals along with it which my company will not pay. Do you recommend I bear that expenses and move on?
PS:Neither FP nor BM appointment received medical RFE..GOD knows when.

You don't need a lawyer to interfile I-693, so save yourself $1000. You can do that on your own. Opinions amongst experts are split whether you should interfile I-693 or if you should wait for medical RFE. The problem is that USCIS case tracker or even live agent on EMMA, may inaccurately report that your case is with the service center while it may be sitting at local field office. In that case if you send your interfile request to wrong office it may just get lost in a black-hole. If you haven't gone through bio-metrics yet then there is a good chance that your case file may still be at service center and in that case you can mail your interfile request to service center.

YMII folks sent an actual person to the municipality office, their fee included the "convenience fee" paid to the local official - and USCIS happily accepted the document that they sent me.

Oh. sorry for that, I didn't use it so never looked into this in detail. $500 is not worth it. Pay Rs 5000 to your friend or relative in India they will do it happily.

I693 and I140 PP request go to separate locations. Send I693 yourself and save money as LightAtEndofTunnel said above. See the medicals thread on this.

I expedited EAD and they approved a combo card. I just raised SR for my wife for AP a couple of weeks back, will let you know if they do the same by approving the combo card.

When you applied AOS with I-765 + I-131, USCIS treats it as a combo card request. AP can also be obtained to be granted entry as a parolee without an EAD. Since you applied for both, SR for one gets you both as its the combo card.

Does anyone have any data for how many EB2->3 downgrades took place last October? And how many of these have filed for PP? I wonder if there are a lot of unapproved I140s in addition to missing medicals. I think most downgrade I140s have not been approved in regular so far.

What is the reason that some lawyers are still not filing with medicals? Are they trying to save the clients doctor's fees in case the dates retrogress and you don't get GC in 2 years and the medicals expire? If the lawyer wasn't an EB immigrant themselves, they wouldn't know that a few hundred dollars are not a big deal for most people working in the US for more than a decade. Don't they know that dates aren't going to retrogress because of new spillover visas this October so almost anyone applying now should get their GC in the next two years before medicals expire.

In the best scenario not sending medicals will cause a delay of at least 3 to 4 months in getting GC, and in the worst (unlikely) scenario people might miss their chance for GC for a very long time in case Congress passes a law to keep FB spillover visas with FB because of Covid.

Or maybe they don't want to send medicals so they can charge more money from the client to respond to the guaranteed RFE.

Unfortunately if they already denied the ER, they will likely not consider it again. Regarding your wife's case, I have heard it explained like this: If you are the primary and try to seek ER for your dependent spouse, then there is no financial loss as you are still gainfully employed. The way I was able to do ER was because my license was expiring and my H1 was pending too so I was in real danger of losing the ability to drive. They did reject my wife's request to expedite EAD/AP as she already has a H1 and does not really need it.

Check processing time/current date at your service center for AP, if it?s beyond your RD then you can submit SR for that.

If you can?t submit SR then keep calling to submit ER for EAD. I was shot down 2 times before getting lucky the 3rd time.

When I tried to ER the second time , I got the same answer from the agent that dependent's job loss is not a financial loss , but I was also told to try again after 30 days.
Some folks suggest to keep trying . I am not sure if anyone has had the success with ER being accepted after the earlier denial.

Our lawyers are from a big law firm known for sluggishness.
Well, their reasoning was that
- Based on my PD, retrogression wouldn't possibly affect me, and I had to get my I140 approved as well.
- Better to wait for medical RFE - as that's what they strictly follow.

Our HR follows lawyers to the T

Our attorney/immigration guy said since it's an EB case and not a FB case, it doesn't matter and I don't need affidavit or anything. Should I be worried?

Just get an affidavit from your parents stating that their name is misspelled in your BC. My parents full names were not present in my BC, and my lawyer just asked to get affidavits stating the same.

I wouldn't worry about it. If you get a RFE, just submit the affidavit, that's what the lawyers will also suggest IMO

Birth certificate question :

On my spouse's birth certificate, the name field is left blank. Can we write her name by hand on the birth certificate ? OR Do we need 2 affidavits for her ? I thought I read somewhere that the name could be written by hand. Does anyone have any personal experience on this scenario ?

My birth certificate was generated recently. It is considered as late registered so attorney suggested to get two affidavit one from parent and one from close relative and a school record that show father's name , date of birth . I got a letter from my school with above details and two affidavit. So far so good. Finger crossed.
