Hi, I have an EB2-I approved I-140, with a priority date of June, 2011. I left the employer in mid 2016. The online status of I-140 shows "Case Was Approved And My Decision Was Emailed". At some point in 2016/2017, I-140s were allowed to remain valid even if the employer requested to withdraw I-140. I have a few questions related to this:
1) In case the employer requests the I-140 to be withdrawn, does anyone know what is status shown online ? I assume I-140 will remain valid, but I am wondering if the status is different. This will allow me to determine if the employer withdrew I-140.
2) Assuming the employer requested withdrawal of EB-2 I-140, since the original I-140 continues to stay valid, can the employer file a fresh I-140 to downgrade to EB-3 ?
3) Assuming the employer requested withdrawal of EB-2 I-140, since the original I-140 continues to stay valid, can it still be used by me to file I-485 (with support from Employer for I-485 supp J) ?
