AC21 for relocation?

Is AC21 filing optional for intra-company relocation? My lawyer seems to indicate that he will worry about filing AC 21 if I get an RFE for EVL etc. He says AC21 is just a letter stating that you are still legally employed.

My lawyer ( a reputed one in west coast) had the same opinion even when I was moving to a different company. IMO you should not worry about filing AC21 as you are with the same company.
