HI

I am on H1B Started from October 1st 2013. As I did not have job during filing of my H1B Petition ,my H1B has been filed at my Employer location under Masters Quota.My H1b Got Approved.

So my Employer is insisting me on filing the amendment petition.

So my question is:

Do I need to file My H1B amendment petition with the documents provided during my initial process,if so I am ready to file but do I need to provide Masters Degree and other documents.( I have All my Documents like Client and vendor letter with required pay stubs etc....)

Or

Can I Just provide my Bachelors Degree other documents.Will it be ok?

The reason I am asking you this question As I have Master Degree from University Of Northern Virginia.

If I Apply with Master Degree will there be any problem ,if so what are the questions they may ask me/?

or Can I apply with Bachelors Degree....Will there be any question even here.

So I request you to give me best possible option for filing an H1B Amendment petition.

Welcome to the forum Vijay. I don't think I understand your question. You have a Master's degree - why do you not want to provide that information?

What is the amendment for?

Give us some more details. Why do you need an amendment? Employment location different from the original application ?

Thanks for your quick response!!!!,

Yes , my employment location is different than original application.But my employer is same.
My client location has been changed, as I got a new job offer.

From many of them I got to know that , to go for stamping I need an amenment.

Reading between the lines, you obtained your initial H1B approval under the FY2014 Masters Cap.

The approval was a USCIS error, since UNVA was a For-Profit University and the Masters Cap is applicable only to accredited Public and Non-Profit Universities.

In addition, it seems that UNVA was not accredited after 08/06/2008 (according to DOE) and on July 16, 2013, the State Council of Higher Education for Virginia (SCHEV) revoked the University of Northern Virginia’s Certificate to Operate pursuant to 8 VAC 40-31-180 (B)(2)(c). According to council’s action, the University of Northern Virginia must cease operations immediately as a postsecondary institution of the Commonwealth of Virginia.


I can't answer your questions, but that might help other people who can.

Certainly, if USCIS realize their error, the H1B approval will be revoked and you would have to reapply under the regular Cap, if my assumptions are correct.
