Right now the RFE's are sent only to EB3-I until December. No news about EB2-I at all.

I still retain some hope that USCIS will publish a Memo of some kind regarding Medical Examinations, otherwise they might as well start sending out RFEs to the 2012 filers up to a certain PD. If there is a Memo, I don't think it will be a simple one year extension, but rather setting a fixed validity of maybe 3-5 years. It's getting so late now, that maybe it is just wishful thinking. If there is no Memo, I think it is a very unfortunate (to avoid using stronger language) decision.
My priority date is EB2I 8/5/2008 (no porting) with I485 filed on 02/2012. Today I received RFE asking for EVL, employment authorization after filing I485 and fresh I693 saying that the validity of the submitted along with the application will expire on 5/31/2014. There are two other trackitt users who received RFE in similar line. One of them has priority day 8/2008 and the other with 1/2008 (porting case).
Does this mean all 2012 filers will have to get medical done once again? BTW, although I got the RFE in hand but I485 online status does not mention RFE and still shows status "Initial Review".

Hi Guys, some one posted on trackit forum that he got an RFE for EB2I july 21 2008 priority date for medicals and EVL.
Are we expecting something that is predicted above?

I have seen no movement online (Oct 2008) and nothing in the mail either. I will however proactively call the TSC and ask if an RFE has been sent out. Mostly everyone is reporting that there is no online indication, although I believe it is temporary and the online statuses should soon start changing.
sportsfan33, our priority dates are almost identical, how would you rate our chances this year?

If we do end up getting an RFE, I hope it happens sooner rather than later. Good luck sportsfan, I just saw on Trackitt that someone with a Sep 2008 got an RFE, EB2 could be this year's best blockbuster (for those of us who are close to the finish line). I wonder if we could see some movement in the next bulletin. The dates will land in Aug/Sep 2008 either in July or August bulletin, followed by a move into early 2009.

Just wanted to let you all know that I got an RFE today for EVL and 693 (Medicals). My wife (dependent) got one for 693 only. My PD is Aug 2008.

I just got RFE mail today asking about EVL, I-94 cards, EAD approval notices and I-693 Medicals for dependents asking only I-693(Medicals) only. My PD is 29th July 2008.

Yes its official, they have started sending RFE's for this year.
My PD is June 24, 2008 and i just received RFE for EVL and Medicals....
Note:- I'd moved to a new employer using EAD last year..

Quick question - I'll move this post when I get the answer.
My wife is on EAD / AP (so am I but I have a H1 too). We just realized, when we entered the country using AP last July, they stamped her I94 for 1 year so valid until this July. Does she need to leave the country and re-enter ?
Also, I don't have a H1 visa stamped on my passport. I travel on AP too but still working with my original employer using H1. Do I need to leave and re-enter ?
This will impact my RFE response time .. urgh!

Yes. I believe every primary applicant is getting the same thing

You can check ur address change at the online case status. Atleast for me the last update said "address changed" - something like that.

If that's the case, we should see more RFEs coming for folks up to early 2009.

I hope so, it would really suck to have to wait another year. Looks like no RFE after September, and if nothing happens then we just have to hope we get lucky. I thought we would at least run through 2008 this year - but there's hope, even Spec's conservative prediction holds the line at Nov 2008!

I'm sure most of you will already have seen this.
5/28/2014: Expiring Medical Report on File and Policy of RFE for New Medical Report
According to the USCIS HQ and AILA teleconference which has just been released, those whose I-693 medical records are pending for over one year will have to wait until they receive RFE from the agency. The RFEs for new medical examinations will only be issued shortly before it is anticipated that the case can be adjudicated to completion. Accordingly, those whose I-485 have been pending for a short period of time may not receive such RFE unless the USCIS will be ready to adjudicate them considering the immigrant visa number availability. Accordingly, those whose priority dates are a way behind the forthcoming Visa Bulletins are not likely to receive such RFEs and will not have to worry about their expired or expiring I-693 until they receive the RFE from the USCIS. Please stay tuned for the forthcoming USCIS release of the new policy.

I am getting very worried now. My priority date is EB2I 2nd July 2008. Two years back I was not lucky enough to get GC when some very lucky ones with 2008 priority dates got their GC. Last year it just stopped 17 days earlier (it was 15th June 2008). If I do not get GC this year due to any reason, like delays due to RFE or anything else, it will be very depressing for me. I really want the GC this year. I keep thinking about a nightmare scenario -they look at my file when the dates are current, and issue a RFE, then it takes some time for the RFE to reach me, and again some more time for the reply to reach the USCIS. By that time, if the quota for the year is over, then what happens? Do I have to wait another year?

Can some one post a sample RFE letter (may be black out name, SRC and other number references)? Knowing we will get one similar will help get ready by the time we actually receive one.

This is what is mentioned in the released memo for medicals by USCIS. Does this mean that irrespective of when the medicals are completed, the date of expiry for one year starts from when the form is received by USCIS..? (based on point1)

Were the RFEs sent out in one week or were they sent out gradually over a period of one month ?
If they were sent out in batches then what did the batches look like. Some thing like 1st batch included PDs until June 2007, second until Jan 2008 ?

We have some traction finally. PD Aug 2008. Got an RFE letter saying emp verification + updated Medical required. The RFE also said something about the case being pre-adjudicated, but need the emp form and the medicals.
1. Do I just reach out to the same Dr and get the I 639 form alone done and a new TB test or do I need vaccinations again?
2. My husband's company has been acquired by a much bigger MNC. Would this cause issues? Also, does the job title has to be the same? What if he got promoted in the last two years and acquired newer skills in addition to the ones he had?

I did spot at least two applicants with Oct 08 PD who have got RFE. I think there were maybe two with 09 PD, not sure though but it augurs well for the near future for people with PD in that range. I just hope USCIS doesn't make a mess of it, but they've made a good start by issuing RFE early on for priority dates with a sure chance of being approved, within the Jan-Sep 2008 range.

If you have records of the vaccinations, you won't need to get them again. But they will do the blood test and TB test (PPD) again.

There is no AC21 form per se. If the RFE asks for an EVL it will specify details needed.

I didn't have any electronic notification and the RFE came to me. So I can't comment on your question. My guess is it's no more than a week as really it's putting the letter in the mail and having usps deliver it.

I received RFE today. By that I mean, the status is showing as RFE in USCIS website. Also I received email and text message on my phone today. I have not received the actual RFE letter, so I don't know what all they asked for - only medical or something else also. The RFE is for myself, my spouse and kid. Example : initial evl said SAP BI and now it says SAP SD. What if I got promoted and my salary and title role changed? But within the same company y.
My company also got acquired by a bigger company recently and all letter heads would reflect the new company name. What supporting documentation should my ployer provide

Internal promotions are not a big deal. I would have the EVL say something like "currently a SAP SD and was promoted from SAP BI in 20xx". Also, about the acquisition. I would include a statement saying that the applying company was acquired on xxxx date and maybe include a formal announcement of the acquisition. I'm sure your company has something that was sent to your customers informing them of the acquisition (or perhaps a news clipping from the WSJ or some renowned local paper e.g. NY Times, Chicago Tribune, Post, SF Chronicle, etc.). Most public libraries have access to older issues of newspapers.
Again remember that you need to show proof of future employment so as long as your company is willing to say that you have a job and this is your role, etc. you shouldn't have issues.

At my company, after acquisition; they filed a new I-140 for Successor in Interest; even though original I-140 was approved. The new I-140 was eventually approved.

The HR or company attorneys did not request any addnl info from me except medicals.
I checked with another co worker who is on h1 b. He said that the company taxid is still the same and will remain so until2015. So he said he had not had to fill in any SPL.paperwork either. May be that's why the HR or atgor ey did not ask for any info except I 693.

You have mentioned about the change of letter head in the new name and simultaneously maintaining their old tax-ID, just make sure they are maintaining the old letter head too.
I suggest you to document your doubts with the HR/Law firm. Its worth it.

I am wondering the same thing. My PD is 08/04/2008. i got an RFE back in April for EVL and Marriage bonafides, but no medical rfe yet.
I finally got a status update email today regarding RFE for both me and my wife's application.
I replied to first RFE in Arpil. Did address change on Monday (for which i got status update that it has been changed yesterday) and today got RFE status update emails.
I just hope that this is medical rfe and not something complicated.

- 3 confirmed RFEs in Feb 2009 on trackitt. Also confirmed RFEs in Nov/Dec 2008. In my view, this is conclusive.
- I just called and spoke to an L2. I was first told that my case was under review and is currently assigned. That's it. I however kept probing her. I asked if my case was preadjudicated and if I would simply receive the GC when the date is current for me. She said that as of now, no notes had been made on my case and that everything was good and if there are no further notes the day it is current, then yes, I will get a GC. This means my case seems preadjudicated (my own conclusion).
I am wondering if all of us are going to get medical RFEs at some point. If the date is scheduled to move in July, then we better start getting that RFE now.

... and there was a time when receiving RFE on a 485 application was considered inauspicious !!! :)
Don't worry too much LA guy, you may get GC directly... always remember the immortal truth : USCIS works in weird ways !

I received the email from USCIS for myself and my wife regarding request for evidence. My priority date is July 21, 2008. I called USCIS and they told me that I need to wait for the letter to find out about the requested evidence. On the phone, automated system said something about I-797. I hope this evidence review and processing will not end up taking more than 3 months for us. Anyone from 2008 already received RFE, any idea on what most of the folks are getting for RFE.

If they follow the rule to the T, then yes - everyone with an expired 693 will get a RFE. But with the USCIS - who knows... some folks might just breeze straight through.

I got a text from USCIS about an RFE for me and my dependents. My PD is December 5 2008. I don't have the actual details for the RFE yet. But I am thinking its for the expired medicals. Do I need to get my medicals again from the same practitioner as before?

I just received a text from USCIS about an RFE for me and my wife. My PD is Oct 9 2008. I filed my 485 when i was in CA and in 2012 Jan I got my EAD. Recently moved to texas for a good oppurtunity and didn't file for AC21. So my question is will they send the RFE to my current address or california address (AR11 filed a week back and it is approved). Little bit nervous as what would be the RFE for :(

I just received a text from USCIS about an RFE for me and my wife. My PD is Oct 9 2008. I filed my 485 when i was in CA and in 2012 Jan I got my EAD. Recently moved to texas for a good oppurtunity and didn't file for AC21. So my question is will they send the RFE to my current address or california address (AR11 filed a week back and it is approved). Little bit nervous as what would be the RFE for :(
The RFE must be for I-693 and maybe EVL - is your case NSC/TSC, seems like NSC has started trickling in. I hope their approval rate is as fast as last year.
Great to see RFE for Oct/Nov/Dec! Good times are finally ahead after a long and dreadful wait.
I hope it moves to Nov 2008 in July!

I got a text from USCIS about an RFE for me and my dependents. My PD is December 5 2008. I don't have the actual details for the RFE yet. But I am thinking its for the expired medicals. Do I need to get my medicals again from the same practitioner as before?

If they follow the rule to the T, then yes - everyone with an expired 693 will get a RFE. But with the USCIS - who knows... some folks might just breeze straight through.
I doubt everyone will get an RFE, don't have to look too far back for evidence. Sports had pointed out how after a certain date in Jan/March 2008 nobody got an RFE. One things that's different this year are the Medicals but I still think quite a few will be approved minus the paperwork.

Anish, as Zenmaster mentioned above this RFE is auspicious. Those who have not gotten an RFE could get temp worries.
Are you aware of the following facts.
I-693 Medical Report submitted along with our I-485 has expired and recently USCIS has decided not to renew its validity automatically. Henceforth every I-485 applicant is required to submit valid medical report at the time GC finalization of our applications, i.e., at the time of FINAL ADJUDICATION of I485. If already submitted medicals are valid, no need to worry.
As per Fragomen Law Firm, the Head of Visa Department Charles Oppenheim has hinted that the EB2I dates may move to summer of 2009 at the end of this FY2014.

My wife and I've completed our medicals and the report is with us right now. My attorney is drafting the EVL for my employer to sign.
Other than that I'm sending copies of my:
- i94 (physical card that i received when i entered using AP last year and CBP's online version),
- I797 approval notice of my last H1B
- two EAD cards.
For my wife its just the Medical report as her RFE didn't say anything.
Anything else, comments/suggestions?

Send either the physical I94 copy OR the online version. Don't send both - adds no value and may confuse the issue.

My PD is Jan 28,2009. I just checked my case on the USCIS site and the status has moved to "Request For Evidence" with the standard messaging "On June 6, 2014, we mailed a notice requesting additional evidence or information in this case I485 APPLICATION TO REGISTER PERMANENT RESIDENCE OR TO ADJUST STATUS."
My wife, dependent on my 485, also has the same status online.
Here's wishing everyone expecting to be current this year a smooth RFE process.
Couple of updates:
- 3 confirmed RFEs in Feb 2009 on trackitt. Also confirmed RFEs in Nov/Dec 2008. In my view, this is conclusive.
- I just called and spoke to an L2. I was first told that my case was under review and is currently assigned. That's it. I however kept probing her. I asked if my case was preadjudicated and if I would simply receive the GC when the date is current for me. She said that as of now, no notes had been made on my case and that everything was good and if there are no further notes the day it is current, then yes, I will get a GC. This means my case seems preadjudicated (my own conclusion).
I am wondering if all of us are going to get medical RFEs at some point. If the date is scheduled to move in July, then we better start getting that RFE now.

You will need to get a blood test and TB test done again. If you tested positive for TB (PPD test) and needed an x-ray, your doctor could waive the PPD test and order the X-ray straight away.
There are 2 circumstances where you'll need to do vaccines again -
1) If you don't have proof of vaccinations (previous 693, if you have a copy or the doc has one, serves as proof of vaccines for your doctor).
2) If the blood tests come back with a low level of anti-bodies for any particular disease (e.g. if you have low antibodies for malaria, you will need to take the MMR again).

If i were you i would do AR11 immediately to address B because they are sending out RFE's for early 2009 priority dates. You don't want to rely on USPS to forward the all important RFE letter. I've heard they don't forward GOVT communications like SSN card, DL, EAD etc.
Are you represented by an Attorney? if that is the case they generally receive a copy of RFE in which case you will be saved.
Once you move to C then do AR11 again.
Check with your attorney too!!!

What I got from USPS last, they do not forward mails from USC
I would suggest to file AR11 from A to C. It will not delay your processing as that is simple update to system happening automatically.

AR 11 is a simple process. At some point while filling out the online form, it asks if you have pending applications. Make sure you select 485 and put in the Receipt number (or A number). If you have EAD renewals, H1 renewals or any other open cases, select those too.
Also,make sure you call a week or so after you submit the form online. My close friend moved and filed an AR11. But only his wife's address was updated and not his. So just follow up and make sure it happens.
USPS does not forward government documentation and definitely not USCIS mail.

hulimari welcome to forum.
First of all one is required by DHS to file an AR-11 until one becomes "CITIZEN". I dont think it is a serious crime though. It is just a requirement.
If I were you I would fill out AR-11 ASAP for the latest address only. I wouldn't want to confuse USCIS by filing multiple AR-11. USPS and USCIS are two different things. You can still do your regular mail forward.

Dear Gurus,
We discovered we had a denial on the dependent visa on entering USA from India. The reason was that we had not responded to an RFE which neither us nor the lawyer has received from USCIS. (Also, our company changed lawyers in the middle year after application and receipt of denial). We managed to get in a MTR through the new lawyer within the 30 days time 6 months ago but are still waiting for a response from USCIS. At this time the dependent is able to work using the old EAD as the status on I-485 suggests Acceptance rather than Decision.
My questions to you are these - and please let me know what your experience has been:
1. If our PD becomes current given the latest Fragomen update, should I reapply for I-485 for the dependent?
2. If there is a question on "prior application" on the application form, would USCIS refer to the old receipt number and deny us again?
3. Does the dependent denial harm any chance of the primary and other dependents GC approval and realization?

USPS will not forward any federal letters - they usually have a no-forward stipulation since you are supposed to be staying at the address you provided to USCIS. So you should file AR-11 immediately. Its online and its pain free. I would not put an AR-11 for C right now since you don't live there currently so presumably you can't receive your mail there - so if they send something for you then you will not receive it. Since you live at B right now, file an AR-11 for B - and then the day you move to C, file AR-11 for C. AR-11 should not cause any delays.

it's always better to meet the mailman in person let them know your/family member's full name and you are residing at the current/new address. Also make sure that you write all the family members full name inside the mail box. You might need to meet more than one guy to do this. one of my friend's and family's GC they send it back saying undeliverable, luckily he was tracking with the tracking no# and he went after, to fight with them to get it back, as they sounds like they don't have much idea about the mail at that time and keep telling that it's returned but after so much back and forth they delivered it on next day.
Similarly I moved from Address A to Address B and filed AR11, I received the AR11 receipt/acknowledgement notice delivered at address B. But when I filed EAD renewal, they(mailman) send it back telling address undeliverable, then I had to call at post office supervisor and let them know that I'm staying there, meet mail man in person too. Called in USCIS stating that I'm staying there and made sure address is updated in there system, I got my new EAD but not the receipt notice.

Slightly different scenario. Last years EVL mass RFE was at the discretion of the officer. Medicals RFE is a mandatory thing (or so it seems). So issuing a RFE for Medicals knowing that a new 693 would expire in a year would be weird. Ofcourse the posts are from a friend of a poster who doesn't know what the RFE is for.
The other thing that doesn't make sense is that not everyone has got a RFE - atleast not yet. Strange stuff.

What is usually the Time it takes from issue of RFE to actual postal mail. I was issued RFE on June 4th (PD Aug 2008) and have not received RFE in postal mail yet (as of June 10th).
I had moved in OCT 2013 and had sent AR-11 form then to reflect that change. How can I check if the current address with USCIS is correct?
My lawyer has also not received a copy as well.
it's always better to meet the mailman in person let them know your/family member's full name and you are residing at the current/new address. Also make sure that you write all the family members full name inside the mail box. You might need to meet more than one guy to do this. one of my friend's and family's GC they send it back saying undeliverable, luckily he was tracking with the tracking no# and he went after, to fight with them to get it back, as they sounds like they don't have much idea about the mail at that time and keep telling that it's returned but after so much back and forth they delivered it on next day.
Similarly I moved from Address A to Address B and filed AR11, I received the AR11 receipt/acknowledgement notice delivered at address B. But when I filed EAD renewal, they(mailman) send it back telling address undeliverable, then I had to call at post office supervisor and let them know that I'm staying there, meet mail man in person too. Called in USCIS stating that I'm staying there and made sure address is updated in there system, I got my new EAD but not the receipt notice.

Just wanted to update that I had received RFE (text and email) this morning for both me and dependent. PD 04/14/2009; TSC. Hope there would be lot more RFE's that reaches well into 2009!

2) We cannot treat the occurrence of an RFE in a particular month as the high watermark for the date movement because the USCIS can simply reuse the medicals next year the same way they will reuse the expired medicals this year.
Wasn't there a memo saying USCIS will only issue medical RFEs if they believe PDs are going to be current in near future?

Thanks Q and other members for the answers. I filed my AR11 today and keeping my fingers crossed. Lot of great things happening in my life this year(our first house and second child ;-) ) and I would love if GC adds to the list too!

First of all one is required by DHS to file an AR-11 until one becomes "CITIZEN". I dont think it is a serious crime though. It is just a requirement.
If I were you I would fill out AR-11 ASAP for the latest address only. I wouldn't want to confuse USCIS by filing multiple AR-11. USPS and USCIS are two different things. You can still do your regular mail forward.

My case status changed Online to Initial Review, just got the message. Not sure what it is about but I'm guessing an RFE will follow sometime soon and it should most likely pertain to medical and EVL. At least I know they've touched the case, so this is good news! My PD is Oct 17 2008 and NSC is the processing center.

Get it translated in English. Notarize it and if parents' names are there in translated version, according to my lawyer, you are all set.

Nija - Everybody is getting RFE - so nothing to worry. It would most probably be about EVL and Medical - send the response asap and it shouldn't delay your case at all.

There are several folks waiting for an RFE. Give it a bit of time. You will not be current until Aug-1st at the earliest - so there is still some time left.

I did an AC 21 and filed g28 to change my lawyer to this law firm about 4 months back. Can I respond to the RFE through another lawyer now , just to make sure it gets done right ( I dont want to take any chances after all these years of waiting) ? Would it affect my case if I file another g28 along with my rfe response? or should I just stay on top of the fragomen guys as much as I can and let them file the response for me?

Welcome to the forum. Your new lawyer can file another G28 that will override the previous G28.
IMHO - there are benefits of being with large, reputed firms like Fragomen. Your RFE is a routine one - so perhaps it would make sense to just hover over their head take until they take care of the RFE response. You will be current on Aug-1st - so you would want your RFE response submitted before that - you have plenty of time for that. Best of luck.

my company uses Fragomen too. they move at glacial speed. I keep bugging them with emails every day or every other day to make sure they are moving on it. My fear is that they do batch processing i.e. get a whole bunch ready and then take it to the actual attorney to get it signed off on. That's what they did when I first filed and ended up filing in the last week of Jan when all the documentation was good to go on the 10th.

Mine was in IR before itself. No change in status. Didn't get a text or email either. The RFE just showed up in my mailbox one day in late May.

Didn't the policy update say that every case (pre-adjudicated or otherwise) will all need a valid medical before being approved? If that's the case I couldn't get greened if I didn't get an RFE?

If the RFE is usual EVL+Medical, you can take care of it in just couple of days. Start by setting up and appointment for medical for next week, ask your HR for EVL today - so that you are ready to respond as soon as you get the letter.

Your/our best chance of getting current is the sep bulletin.
I think you should visit India and also if you can collect all the documents requested or get the medical done before you leave to India, depends on what is requested in the RFE. Good luck.

Dates being current for mid-2009 contradicts many calculations (based on best available data of course). My theory is that any 2009 dates made current will only get RFEs this September. You respond to the RFEs with fresh medicals which are valid through October 2015. So any 2009 dates that are current will be greened in Summer 2015 and not in September/October 2014. This approach also gives CO with a latest set of inventory to deal with next year. This approach is feasible only for 2009 when the PERM filings are low. Even if the 2009 dates are not made current in September 2014, they will to be made current and greened next year; so why not issue the RFE now- the medicals that follow will be valid for one year. Thoughts??
There are many folks with 2009 PDs that have already got their RFEs.

I probably am not getting the logic here. A response to a medical RFE will just reset the clock on the validity of the medicals. It just makes them valid for another year. So technically the GCs for these 2009 data points could arrive a year from now (summer 2015) which would have been the case for 2009 anyway.

Probably not. They did a blood test for me to check for antibodies. If that comes low then you might need to get shots again.

- Responding to the RFE: You can definitely respond in July once you are back from India and I don't think you will lose anything. If it's a standard EVL/medical RFE, it doesn't need a lawyer. You can send the response yourself in a day or 2. You should get yours in Sept if everything is in order.

vizcard thanks for that clarity. This is all under the assumption that the RFEs are for medicals and not for something else. Talked to a friend who received a notice for FP appointment for his son. His PD is May 2009. I think they need a fresh set of FP for him.
Part of the pessimism in my reasoning stems from the disbelief in the date movement without any numbers backing it. Where are the numbers for this coming from? Every category seems to be more or less used with spillovers limited to less than 10,000. For the dates to move to mid-2009, and actually greened, there is a need for at least 20,000 numbers for regular cases and some more for CP cases. Does anyone have a reasonable grasp on where the excess spillover is coming from?

Thanks Viz. The Initial Review message was kind of strange, it referred to an address change and I haven't changed my address in over 4 years, so not sure what's going on. Has this happened to anyone else on the forum? Maybe it is a mistake but I'll just wait it out to see what happens. Can't wait for the long wait to be over, I remember in 2011/12 when Veni and Nishant were on edge waiting for their approval, there was a post every few minutes until they made it through, it is our turn now! You'll be going first in a few weeks.

Wow! I just became a Sensei, not sure that title is fitting, I know nothing about the nitty gritty of the immigration process/calculations.
Looks like RFE's are raining...June, July, August...and now September...October! It's getting crazy! If the dates go that far, CO will be forced to generate new demand sooner than later! Good luck to you imdeng! Give us another RFE soon!!!

Has anyone gone through one of the RFE for medical renewal already? My wife and I had done it more than a year ago. Does the renewal mean the same vaccinations needs to be repeated or does the doc just need to confirm they're still valid? My wife is currently pregnant so she wouldn't be able to them again at this time. Thanks.

There's another thread on Medicals where there might be a more detailed answer.
Basically if you have proof of vaccinations, you don't have to take them again. Your wife should take her pregnancy medical records from her OBGYN to the civil surgeon. If not appropriate, she won't have to take them and the civil surgeon will mark it as "not appropriate". You should do some research or ask her OBGYN on the TB test (PPD) and definitely shouldn't do the chest X-ray.
I cannot stress this enough. Talk to her OBGYN before going to the civil surgeon.

The latest RFE reports are up to Oct 2009. Not sure how far they are planning to go - we will know in next few days if Dec 2009 is part of their plan.

Thanks Vedu. I am thinking what this deluge of RFEs mean. On one hand they wouldn't throw these RFEs out if there wasn't some change of their resolution this FY. OTOH - they can't possibly have enough visa numbers to reach Oct 2009.

Got RFE msg from USCIS, probably medical and EVL, yesterday my status changed to IR and today I got RFE!! This is great, can get it through early and hope for a prompt approval in August (PD OCT 17 2008, NSC)

It took exactly 2 weeks from the day I got my RFE to send the response in. I just got an email from the paralegal that it was sent today.

Good. My company also uses Fragomen and I was told 1-2 weeks. Yet to receive the RFE in mail (online status says posted 6th). You should now just sit back and wait - technically your employer and attorney "roles" are over and you should be free to go to whatever else you wanted to do! btw, did Fragomen tell you if the cards would reach you directly or their office?

I sent my documents by UPS overnight yesterday and it should be reaching my Attorney's office today (They are based in NJ). Hopefully it gets sent out either today or tomorrow.
Do you know if your attorney used Fedex/UPS to send it to Texas? The reason I ask is because i've heard that PO BOX (mentioned in the RFE letter) addresses are not covered by Fedex/UPS.

No idea. Whatever they use seems fine. In that respect they know how things work.

Probably not but I don't think it's necessary either. The paralegals I've worked with seem competent and answered my questions in a timely manner. Other than taking time, they so a good job. Perhaps it's speed or thoroughness - can't have both :P

Apparently it was mentioned in USCIS conference call today that EVERYBODY who is about to be current will receive an RFE for I-693. They are still in the process of sending RFEs - and they eventually they will cover everyone.
I am picking this off of trackitt - according to someone who attended the call.

Basically if you have proof of vaccinations, you don't have to take them again. Your wife should take her pregnancy medical records from her OBGYN to the civil surgeon. If not appropriate, she won't have to take them and the civil surgeon will mark it as "not appropriate". You should do some research or ask her OBGYN on the TB test (PPD) and definitely shouldn't do the chest X-ray.
I cannot stress this enough. Talk to her OBGYN before going to the civil surgeon.

I received my notification last Thursday and there is no sign of the letter neither in my mail nor with the attorney and this mysterious delay is killing me. I literaly live within 4 hours away from NSC. Whats taking so long.
I checked with a L2 today that the address in the file is correct. He was very patient and told me that there is a note in my file from Sep 2012 that the case is waiting for a visa number to be available. I guess that means its preadjudicated?

RFEs can take about 10 days to reach - so don't worry. Also - it does seem like you are pre-adjudicated.

Thanks for the wishes and the info :)Please be aware that pregnancy does not provide a waiver from the TB test or chest X-ray, if it is needed.
The person can defer the X-ray until after delivery, but the Civil Surgeon cannot sign the I-693 until it has been completed.

A21. A pregnant applicant should be given the option to have the chest X-ray during her pregnancy or defer the X-ray until after delivery. Based on the CDC’s Tuberculosis Component of Technical Instructions, if the applicant decides to undergo an X-ray during pregnancy, the possible risks of radiation to the fetus should be explained to her, and informed consent should be obtained and confirmed by having the applicant sign a consent form. If the applicant defers the radiograph until after delivery, the civil surgeon cannot sign the medical examination form until the radiograph is performed and interpreted, and treatment for Class A pulmonary TB disease, if needed, is completed. I'm pretty sure there has been no change since then. I have looked on the CDC site and the same instructions are still shown.
The USCIS site has a page about vaccinations requirements (http://www.uscis.gov/news/questions-and-answers/vaccination-requirements) and also references a CDC: Guidelines for Vaccinating Pregnant Women (http://www.cdc.gov/vaccines/pubs/preg-guide.htm) which indicates which vaccines are appropriate and which may be waived.

Seems I got a unfriendly L2 officer. After an hour long wait - on my polite but insistent asking - she just kept repeating "your case is pending, in 'initial review' status. When we need something, we will contact you.".
When I asked some pointed Qs others here have gotten responses to, she just said "you are asking for info that I cannot give you".
Does anybody know if these calls are noted on the file? If not, I can call again and hope to get some info with a friendlier officer!

I still have not received it in my mail as of June 12th.
MY attorney received it on June 11th.
I was also very concerned. I called L2 officer and verified my address is correct since I moved but had filed AR-11 in NOv 2013. L2 said they have recieved new address.
I also contacted my current USPS office and asked what can be done to ensure I recieve mail I spoke to supervisor there who was helping people in line. But he did like me questioning such things and tols that they will deliver what they get and they dont keep anything at USPS incase it mislabelled or something. (I had previously bad experiece with USPS in 2012 when they lost my EAD card).
I also check with my old city USPS but of no use too.
In conclusion, USPS is big brother of ineffiecieny same as USCIS. Nothing can be done about it.
I had my medical appt taken and had my attorney alerted so I got going as soon as I had RFE in attorney mail.

What specifically are up trying to get answered? Also you don't have to wait on the phone. They can call you back.

I had called at exact 8:00 AM. I guess the officer was just in good mood at the start of the day and the wait time was also "only" 18 minutes.
RFEs can take about 10 days to reach - so don't worry. Also - it does seem like you are pre-adjudicated.
Thanks imdeng.... its just that you never know which small thing makes you miss the boat and then you have to wait for whole year to get another shot. So every little thing keeps me on the edge. :)

My mistake - I called after 4 pm, and by the time I spoke to her, it was after 5 pm. Should have thought about it!
Any idea if these calls are noted? Don't want to call a 2nd time so quickly if they are.

So while the conversation is about sending RFEs, I have a question regarding processing of RFEs..
Do we know if they will consider the RFE response received date when they finally adjudicate the case? So if person A with PD 1 Jan 2009 received RFE on July 1 2014 and responded by (receive date) July 25 2014..and if person B with PD 1 Feb 2009 received RFE on July 1 2014 and responded by (receive date) July 15 2014..assuming the dates are current and everything else is fine, would they approve person B first?
Or would they still go by PD?

Was trying to find out indirectly if I had been pre-adjudicated, as somebody here had earlier been able to (very indirectly, though). But this lady did not budge from "your case is pending, in initial review".
I did get to know that no RFE had been sent (that I may have missed). There was a technical problem with the callback on their side, so I had to wait an hour plus!
Another thing she said, when I asked her if I have to send a new I-693 as I had heard that >1 year RFEs had to be renewed, she responded: "who told you that? You don't have to send anything till we specifically ask for it." I don't know how significant that is, or if that she may just be ignorant.
Are the L2 officers actual USCIS agents or call operators?

I-485 applications are handled by hundreds of different adjudicators and the RFE notice always accompany with a Yellow colored sheet along with the adjudicator's ID so that the reply reaches the same table where our applications sits awaiting approval.
Assuming A and B are handled by the same Adj, B will be approved first.

I called around 9:30 AM EST; talked to tier 1 officer and he opened a service request about my address change confirmation and asked me if I want him to transfer me to next level officer after the call and I said yes :-). He transferred the call but the wait time was 25 minutes and so I chose callback option and received call around 10:45 AM. Yes he said 'pre-adjudicated'. I asked him twice!

I asked him what address does he have in his records and he said he didn't have that information but level 2 officer can answer that and then he asked me if I wanted to be transferred. 'Pre-Adj' discussion happened after L2 officer verified everything and I told him that since dates are moving fast and I don't want to miss any RFE etc. and that's why I want to verify if my address is updated in your systems or not. He checked my case and said you didn't miss anything, case is fine and it is pre-adjudicated.

Pre-adjudication includes completing all required background checks and resolving all eligibility issues except for visa availability. This allows for immediate approval and visa number allocation as visas become available for pre-adjudicated cases."
Please remember pre-adjudicated is not approved.

Just hope Pre-Adjudication means they won't no RFE for medicals, or EVL either - coz i've not got any RFE as of yet and was getting Nervous!

'Pre-Adj' discussion happened after L2 officer verified everything and I told him that since dates are moving fast and I don't want to miss any RFE etc. and that's why I want to verify if my address is updated in your systems or not. He checked my case and said you didn't miss anything, case is fine and it is pre-adjudicated.

It is 1-800-375-5283 and then option #2. Enter your receipt number when asked - SRC******** (On smartphone keypad just enter 772 (SRC) and then your numeric receipt number) it will read the status which you see online and then ask for address related thing. I remember at that point I chose an option which basically says if address is not correct or you moved or something and then it connects you to customer service rep.
Also, at one point he told me that for address related change my file was touched on 10th June (This is the address change request I completed online last year in Aug). I didn't see any changes online though. May be I will get an RFE; next week may be! Who knows!

If the 693 is invalid, by definition one is not "documentarily qualified". While there is a chance that people will get through without a RFE, I would not rely on the term "pre-adjudicated" meaning no more RFEs.

I think there is a fine difference between "Documentarily Qualified" and "Pre-adjudicated". Perhaps Kanmani and Spec and can chime in.

Fully aware of that.
Maybe for various reasons - randomness / incompetence / luck - some folks remained 'pre-adjudicated' (although they should not have) while others are getting RFEs?
Just trying to list possible causes for a small but significant % people who are not receiving RFEs.

A case cannot be approved if the I-693 is no longer valid. Up until May 31, 2014, the I-693 had received validity extensions since 2002. That is no longer the case.
In the teleconference yesterday, it is reported that USCIS confirmed that everyone who is likely to become current in the near future, who would have an I-693 more than one year old, will receive an RFE.

helpful_leo, I just got mine ahead of time. My pd is 7/3/2008 and no RFE yet. My case is at NSC. I see RFE's for folks that are non-NSC. I don't know how this random process of approval works. Going to call up USCIS on Monday to check whether I need to send my I693 or not. I've a lot of things contingent upon getting GC this year including a career change..hope uscis does not screw up this year too.

Yes viz, I'm not sending mine. I just have mine handy. Plan to call them first thing Monday morning. Also from what i've read everywhere NSC folks seem to be affected most, in the sense, we have not got our RFE's.

Hi All
My PD is Jan 5, 2009. EB2I, TSC. No RFE yet. I had filed my I-485 concurrently with I-140 (successor in Interest) in Mar 2012. My I-485 receipt notice listed receipt date as my PD. My lawyer was OK with that since my I-140 approval notice later had correct PD listed.
So i am wondering if one of the reason that my case is not looked at yet (or no RFE issued yet) is this incorrect PD on my Receipt notice. Basically they could be issuing RFE to "simple and straightforward" hassle free cases and people like me who need slightly extra scrutiny (such as I-140 "Successor in Interest" porting PD from original I-140) would be last in the queue and may miss the boat.
Any comments?

Quite amazing to see a confirmed pattern of RFEs all the way up to October.
Now I have started worrying though. PD 10/2008 and no RFE yet. No change in online status, no email/text. I think I am gonna talk to an L2 again tomorrow.
One thing though: they might be going by the RD. I submitted late in March 2012. There might be still time. I can turn around an RFE response in 2 days myself.
Another surprising thing is several people current next month (original filers, not porters too) have not received RFEs. I wonder how their cases will be handled.

I was in a similar situation till Saturday - when I got the mails/ texts reg. RFE (PD mid Dec 2008, RD Jan 1st week 2012, TSC) and was relieved. You make a good point about RD.
I was also quite annoyed by the randomness of the RFEs - mid 2009s getting it but not 2008ers.
My sense is, you will get it most likely within next 2 weeks, and definitely before the month you are current.
Now I worry about if the RFEs are about something besides I-693 / EVL : )

I saw that people have received RFEs till October 2009 but almost all of the RFEs for PDs beyond May 2009 ( except for a couple of them ) are from NSC.I found it odd. Does that mean anything or will TSC catch up?

Surgeon had no issues. All he needed was $248 :( . Will be picking up my packet today, hopefully. Sports makes a valid point. They might be sending out RFE by RD's. I sent it late Apr'12, so I may not receive it soon.

Not sure if RFE by receive dates add up? My receive date was in January while most of the late 2009's applications become current in March!! I really hope we are missing something here because if everyone needs a RFE prior to getting greened, and the fact that i've not got one yet does not add up at all!! This is soo frustrating for all the folks who will be current in July and don't yet have a RFE while everyone else up until Oct 2009 seem to be getting one!!!!!!!!!

Just call their automated telephone number and listen to the latest update on your case. That's what I did. I did not speak to any CSR. 4 hrs after that I got an SMS. Could be a coincidence, but doesn't hurt to try, right? It is almost assured that you will get an RFE, so getting medicals ready ahead of time is a good idea.

Just finished conversation with L2 officer. He said that my case was pre adjudicated back in march 2012 and at this moment they do not need anything from me. This means they have not touched my case after March 2012 :(. God only knows when will I get RFE ... waiting continues ...

Till recently I was under the assumption that this can be sent directly by us as these are simple enough.
Do lawyers always get the RFEs, and do they need to be involved in responding to them?
2/ We got texts and e-mails last week, and today I got the RFE mail but my wife did not.
Is it common for RFEs sent at same time to same address to not arrive at the same time?

2. Yup - some delivery time discrepancy is fine. Couple days this way or another. If its more than 2 days then see if your lawyer got a copy and if not then get on phone to USCIS.

Your second point seems to be a common occurrence this time around. We received the RFE Email about 2 weeks back and the lawyer received the RGE details for my wife on last Friday, but no sign of my RFE details as yet. Also I have not received anything at all. Not sure if they sent those out to just the attorney or I just haven't received them as yet.

Thanks, that is good to know. If the layer asks for $300 for replying to a new Medical report RFE, I might go ahead and do it myself.
It is enclosing just the sealed report from the civil surgeon with a copy of RFE. Not received the RFE in the mail yet, but hopefully it is only new medicals.

Both my wife and I got letters. Ofcourse neither of us got a text message or email. So it was a complete surprise. The letter was dated May 21 and I got it around May 24th or 25th. I posted it on here the same day so if you go back to my earlier posts you will get the exact date. Also, I also got an acknowledgement of my response the day after it was filed.
As far as your personal situation. I think its possible very likely that your GC will be approved even if your wife's may not. I don't think the primary's GC is held up because of a dependent's application.
Kanmani, Q or Spec can comment more specifically on these rules.

I still have not received it in my mail as of June 18th.
But MY attorney received it on June 11th.
I was also very concerned. I called L2 officer and verified my address is correct since I moved but had filed AR-11 in NOv 2013. L2 said they have recieved new address.
I also contacted my current USPS office and asked what can be done to ensure I recieve mail I spoke to supervisor there who was helping people in line. But he did like me questioning such things and tols that they will deliver what they get and they dont keep anything at USPS incase it mislabelled or something. (I had previously bad experiece with USPS in 2012 when they lost my EAD card).
I also check with my old city USPS but of no use too.
My attorney sent my RFE response on June 16th. BUt I have not received any notification if they received it like what Viz said?

I got texts Saturday (yes) am. Got my physical RFE yesterday (Tuesday).
That was quick - but this was from TSC and we are in TX.

Viz is right here. Primary can be approved and dependends may be delayed. But I think not the other way round. Although postal delays can have dependent GC arrive earlier than primary's GC.

Crap, still no text, online update, or RFE in mail! Did call in, to see if we can get some update but officer wasn't very helpful. They opened up a service ticket for my wife (dependant's case) since it was not even in initial review. I really hope there are a few cases that go through without RFE!
We did go ahead and start doing our medicals in advance just so we are prepared for RFE as/if/when it does come! Very aggravated by the entire unknown! It does appear that they've gone through the list where documents were pending first - instead of the one's where documents had been reviewed already. Such a mess!

Got a text and email with status change. See below. I was told by USCIS that occasionally they have system glitches with the email/text service which is why I didn't get a notification when RFE was issued.

You should expect to receive a written decision or written update within 60 days of the date we received your response unless fingerprint processing or an interview are standard parts of case processing and have not yet been completed, in which case you can use the processing time information on our website to estimate when this case will be done. If you move while this case is pending, please use our Change of Address online tool to update your case with your new address or call our customer service center at 1-800-375-5283.
Once a timely response to the request for evidence is received by USCIS, we review the evidence or information you submitted. If you submitted the requested evidence, we continue with the adjudication of your application or petition in light of the new evidence.
