Since I did not see a thread to discuss, Q & A for people who filed 485, waiting for/completed FP etc. I thought of opening one.

Any way to track our application past FP?

I am not there yet, but am guessing if your time is past the advertised processing time for the service center your application is at,you can call customer service to ask if your case is pre-adjudicated?

Leo, we can do the following as we have limited visibility.
- Create an account on USCIS.GOV case status.
- Check email & sms notifications for all the cases. These only come for major changes also referred to as HLUD (Hard Last Update Change).
- There are various other changes happening on the application like after FP, for these only the date will change there are referred to as SLUD (Soft Last Update Change).
This is what I could learn by reading at all places. If anyone has details please post for the benefit of all.
My attorney just confirmed that finally mine and my wife's I485's were dispatched.

Good to hear that your dispatched your paper work.
I registered with cis already. trying to see if there are any other ways.

Leo, we can do the following as we have limited visibility.

Just an FYI: My dates became current on Nov 1 (PD: Sep 07). My lawyers sent our forms on Oct 31 (Texas Service Center) . I just got (on Nov 7) scanned copies of our receipt notices from my lawyer. So, those who sent forms around Nov 1 can expect to receive notices soon if you have not received them already. Good luck!

As per my lawyer, they applied for me on 31st but my lawyer asked me to send him a copy of receipt once I receive it.
In your case looks like the receipt went to lawyer.

So, I don't expect to receive receipts directly. I haven't checked my (snail) mail the last few days. So, maybe I got the receipts too. But I find it odd that they'd send multiple receipts (1 for applicant and 1 for lawyer) for an application. I'll check my mail when I get home and will update in case I received a receipt too.

My case is same like yours. Lawyer's office sent the forms on 10/31.
Have not received anything in snail mail today. I will check with lawyer if I will get the receipts directly or they will get it or both.

I take that back. I did receive receipts directly by snail mail as well. So, they are sending receipts to both the lawyer and the applicant.

My cheques have been encashed just saw them in clearing today morning. My attorney will be receiving the receipts; they are always very slow with things and things don’t come to me directly, I will let the group know as soon as I see further progress.

Note - why on the earth we don't call the postal mail as mail or postal mail, and call the emails as emails.

My PD is 1/22/2008.

My company is failing and also the CEO was never nice to me. He delayed my process for 2 years and now I am not sure whether he wants to file 485 or not because he used me and now it's time to dump me. But he didn't know I didn't do shit for this company after 2007.
QBF ... hang in there buddy .. I worked for a similar company and wasted 3 yrs. Not all are bad though .. hopefully you won't have to change jobs before you are greened, but even if you do, you will find a good place and will be able to port your PD .. you are too close to just give up now .. ! just my 0.2 cents !

My PD is May 24 and My lawyer mailed documents on 10/24(Slacker lawer.. Dont know if I can post the name here.Please let me know if I can )

I recieved reciept on Nov 1st and FP notice on Nov 3 rd.. These people are Super fast . hope they will continue the pace.

YOU DO NOT NEED YOUR EMPLOYER TO FILE 485.

YOU OWN 485. So if you become current just file it on your own.



My PD is 1/22/2008.

My company is failing and also the CEO was never nice to me. He delayed my process for 2 years and now I am not sure whether he wants to file 485 or not because he used me and now it's time to dump me. But he didn't know I didn't do shit for this company after 2007.

485 receipts will reach the applicant. But, 765 and 131 receipts will depend on what your attorney entered as 'your' address. In my case, they reached my attorney and I did not receive a copy.

My PD is current in Nov. My company lawyer informed me that they filed my I-485 (along with EAD/AP apps) today. The lawyer said that they will provide a receipt number once they receive it...so i am assuming i won't get one at my address directly.

One question I have is how do I know which service center will process my application (I am in Michigan). Of course, I can ask my lawyer, but is processing service center decided by which state you live in?

My lawyer also sent the docs on 10/31 (PD Sep 2007). Havent heard back from lawyer yet or received the notices over snail mail. Will inform u guys if I get an update this week.

You can verify that on your receipts or checks, whichever comes first :)

Same with me. You will get AOS receipts. because you OWN them and not the company. Until 140 stage, company owns all your petitions so you did not receive those receipts.

EAD,AP & 485 receipts belong solely to you. However attorney's tend to put their addresses to be on the safer side. Because they don't want to be responsible for things that could go wrong on your side, like address-change or neighbor stealing your mail etc :)

99.9% corporate attorneys are good. Put your trust and stay happy.

I think folks who filed on Nov 1st got the receipts. It might take another week or two to get Biometrics notice. My applications was dispatched yesterday by lawyers (11/08).

My checks were drawn with ACH.. so I don't see any image or receipt number.. is it different for others ?

SRC - Texas Service center
EAC - Vermont (if I remember correctly)..

My PD (02/22/2008) is likely to get current on Dec. 1st. I have completed the medicals and I believe I have all the documents in place to ensure that my docs reach USCIS by Dec. 1st.

I will be going on a vacation within the US between Dec. 15 -Dec. 26th. There is noway I can be available for the appointment if it is in this date range. Is there any reason I should delay/cancel my vacation??

From my understanding it will take atleast 3 weeks for you to get the biometrics notice. And as per USCIS here.. (http://www.immihelp.com/directory/application-support-centers.jsp)

We may schedule an appointment at an ASC as we process your case. It is important that you make every effort to make that appointment. Not appearing will at least delay your case. It may mean certain processing steps will have to be repeated. It may also affect eligibility for benefits, and could mean we will have to deny the application or petition.

Our appointment notice will explain alternatives if you cannot make your appointment.

Here is the quote from my status update for I485 from USCIS website (My Case Status).. I haven't received the FP notice yet.. but they will give you atleast 14 days notice for FP..

If you have filed an I-485, I-589, I-751, N-400, I-90, I-821, I-131 or I-765, you can expect to receive an appointment notice to appear at an Application Support Center to have your fingerprints and/or photographs taken. The timing of your appointment is determined by the number of applicants ahead of you that also need a biometric appointment. We try to schedule biometric appointments as quickly as possible and in most cases you will receive your appointment notice within 30 days of submitting your application. We will send your appointment notice approximately 14 days ahead of your scheduled appointment. It is important that you keep this appointment. If absolutely necessary, you can request that your appointment be rescheduled however, please be aware that rescheduling may delay the processing of your application. Please follow the instructions on your appointment notice if you need to reschedule. Occasionally, you may receive an appointment notice to appear at an Application Support Center to have your fingerprints taken when you have filed a form other than those listed above. In these situations, you may receive your appointment notice more than 30 days after submitting your application or petition.

Congratulations to all who are current!

I am current too and have a couple of questions. My lawyer is usually slow to respond and cannot be contacted directly too. So, can any one please provide some inputs?

I am planning to go on my vacation, to India, from Dec-5th to Jan-4th. If I file on Dec-1st,

1. Within how many days will I get my notice for finger printing notice?

See my post above..normally 1 week for receipt and another week for FP..

2. Will it come to my home address? In that case, since I will not be here, is it possible for it to be sent to the lawyer's office so that they can email me the information?
It will come to your home address and AFAIK lawyer can put in his address with you application so he will get it..

3. Will it be possible to postpone my finger printing to after I return (in early Jan)? If not, what is the safe period before when I should return (in Dec)?

Yes it is possible but you need FP notice in hand..

4. If all of this would not really work, is it wise to file in January, after my return, than in December?
NOT AT ALL recommended..

I am PWMB filed on July 1st for me and my wife.....Got receipts in 20days, finger print notice received on aug 1st for aug 30th...got my EAD and AP in 45 days...
during finger printing they said I should receive my GC in another 45 days...

Its been almost 4 months now and status is still in Initial stage...My application is from TCS and there current processing time is Mar 6th...

guys is there way to expedite the processing or we need to wait till processing times to reach till july 1st for them to look at my case...?

Hi Guys,

My PD got current on Dec 2011 bulletin. My wife is on H1B. She will be listed as dependent on my 485.

Her employer applied for her H1B extension. They received RFE recently from USCIS. RFE is more on the lines of Employment verification letter and so on (Consultant H1B). Her employer is working with the client in preparation for the RFE response.

While preparing the documents for my 485 filing, I sent the H1 extension receipt notice for my wife (dependent in my 485 case) to my lawyer. he happen to see the RFE state and freaked out. He asked abt RFE and asked if its been addressed. I conveyed that her employer is actively working on it. Still he insist on converting her to H4, to be on safer side, so that she is in valid status.

Is this necessary to convert to H4. I seriously doubt. If not needed, is there anything I need to make sure from my wife's H1B extension RFE, before or while applying my 485 on Dec 1'st or so.

On the dependent 485 notice the preference classification is set as blank and the Priority date is shown as the Receipt date, please advise if this is normal.

Teddy - I'm also seeing the 'Received Date' as Priority date on the dependents AOS application. Perhaps, it is normal. Not sure though.

Received all 6 receipts. Here are the dates:
Mailed Date - Nov 1, 2011
Received Date - Nov 3, 2011
Notice Date - Nov 7, 2011

I was able to add my receipt numbers. Did you try it with the three letter region code that prefizes the number?

I dont think so. Our friend "10102007" got them already ( i am assuming his PD is Oct 2007). Could be location based - I am in NJ and maybe it will take some more time to reach me. Where are you based?

Yes, I did use the entire 13 character number. Without those 3 letters it gives an error telling that the number must start with 3 alphabets.


I was able to add my receipt numbers. Did you try it with the three letter region code that prefizes the number?

Based on your location, it will be filed to either Dallas lock box or Phoenix lock box - The lock box folks forward the application to either Texas service center or Nebraska Service center.
I noticed some applications filed at Dallas lock box were forwarded to Nebraska Service center. Not sure what is the criteria...

Receipt notices are sent based on Received Date...

Some experts mentioned that USCIS process applications randomly, meaning For eg- Oct'31st applicant may get GC earlier than applicant with Pd July 16th. In other words, PD seems to be inconsequential once 485 is filed.

The checks were sent by my employer so I dont know whether they were encashed. I didnt want to trouble them with queries just yet. If I dont get the notices on Mon, I will have to start following up.

I didn't follow why your company gets the communication of I-485,EAD+AP, because the address on all the Forms has to be applicant's current address... am I missing something here??

I am not sure who will get the communication directly from USCIS for I485/EAD/AP. I assumed it would be companies' lawyer (Fragomen) because after filing they mentioned that they will let me know the receipt number when they receive it. I am curious if I will get a copy too directly from USCIS.



I didn't follow why your company gets the communication of I-485,EAD+AP, because the address on all the Forms has to be applicant's current address... am I missing something here??

I am not sure who will get the communication directly from USCIS for I485/EAD/AP. I assumed it would be companies' lawyer (Fragomen) because after filing they mentioned that they will let me know the receipt number when they receive it. I am curious if I will get a copy too directly from USCIS.

Both of you will get the receipt notices....

Soggadu bhai, You can probably add cases to your portfolio on USCIS Check status. Make sure all are trackable- showing initial review status. Next step is 'wait for FP Notices' and once rcvd probably should try early walk-in. After that ball will be in USCIS court. Lets pray to god for smooth process without RFEs.

Based on what read, If you sign G-28 form(you are authorizing your lawyer as representative of your case), USCIS will send communications to both the applicant & lawyer. If you didn't sign G-28, it will be just you getting all the communication from USCIS.

I did sign the G28 forms for 485/131/765. So this means I should be looking out for receipts at my address too. My documents were dispatched on 8th Nov, so i am expecting to receive the receipts before Thanksgiving.

Looks like Nebraska is better in most cases.But for EAD/AP i heard TSC has been pretty fast.

USPS stamp says 11/07. It took 5 working days to reach. I guess 5 days is what USPS delivery time is for first class - on the max side.

That would mean that they would not entertain any inquiries for cases filed ahead of this date. I believe that this date will continue to remain backlogged for a while as several new applications are now coming into the system. The date does not truly represent the date they are working on but its more to legally discourage calls and inquiries.

Yes, there is no fee involved for EAD/AP - either you file it along with 485 or file it at a later date. If you are filing at a later date, include a copy of 485 rcpt notice.

That is the date of the last(min) application date they were processing as of September 30th 2011. It doesn't mean that all applications are around that date. Majority of the apps they are processing now could be well in July-August 17th range.

They are probably asking you to pay expenses for your spouse. $1070.00. Normally employers pay only for the employee. EAD/AP is always included in the 485 fee. So, there's nothing extra for those apps. Attorneys also do not charge for these apps.( may be your attorney is different?)

Today I was able to add my cases to MyPortfolio and all the status shows to Initial Review.
So looks like it is taking sometime to update online part.

I tried adding case to my portfolio on USCIS Check status but the system isn't recognizing my Receipt Number.

Thanks! Basically, my point was, CIS could make that into one ALWAYS. Like, Bake the EAD and AP into one irrespective of whether a customer wants AP or EAD or both. It makes everyone's life easy, including CIS's.

- Receipts these days are going both to the applicant and the attorney. Both copies are original and are being designated as customer & attorney copy.
- There is a generic issue of PD not being shown correctly on the dependent receipts.
- These receipts to the applicant take 5 days to come by snail mail from the time of check encashing , check encashing takes 5-6 days from the date of receipt.
- Looks like 7.5 cases will be filed from EB2 I/C alone so things will be a lot slower.
- My own case RD 02/11, ND – 07/11, Checks – 08/11, Receipts – 13/11 (1 missing I had to call USCIS).

My I-485 application was delivered on Nov 8 to the Dallas lock box. Haven't got the receipt yet, but from the rest of the posts, it looks like it is going to take another week at least, so I will bide my time patiently.... I'm a little ticked off at my lawyer. I was trying to push him to file earlier and got the docs to him early, but he still filed a week late. Oh well, better to file it correctly than quickly.... :)

Great. Do some research on the service center that they want you to go for Finger prints. Check if they'd allow a earl walk-in. I haven't seen this early walk-in prove any beneficial in terms of total process time. It'll at least be one thing off your plate.

I have exactly the same case as you. In my case my I485 receipt was missing. I called up USCIS to confirm yes its the number in between & also requested for a duplicate copy, attorney thus far has not received anything. Surprisng that your RD is 01-NOV but ND is 11/10, most people with 11/01 RD have a recent ND.

I was given a fixed date (see signature) and time for biometrics appointment. One thing I'd like to mention is that my appointment time and wife's appointment time are couple of hours apart. But lawyers mentioned that its ok. They allow family members to get fingerprinted at the same time.

Sogaddu bhai, I called USCIS for the missing receipt they confirmed the number and will be sending the info again. Officer was very nice. Everyone will get a date for FP based on the load of the nearest center. Everyone gets 1 date but heard some centers are flexible about walk in.

Which Center in NJ. Check the trackitt threads, I have read some people in NJ go early.

On a lighter note: usually service center folks are not too enthusiastic about people running or jumping or crawling or driving their way into offices. They prefer if people walk in for an appointment

I had Dec'8th appointment. We just walked in @Atlanta ASC and completed biometrics this afternoon. Nobody asked about early walk-in, I also didn't mention about it.The whole process took about 20-25 mins.

Guys, Why do we need to rush in for finger print earlier in case if there is a scheduled appointment received by us?
Forgive me if I am mistaken, but finger printing is only a part of the AOS process, but not a pre-requisite for any steps, which they follow in processing the apps.
We can even get our EAD's and AP's without finger prints..right?

I had Dec'8th appointment. We just walked in @Atlanta ASC and completed biometrics this afternoon. Nobody asked about early walk-in, I also didn't mention about it.The whole process took about 20-25 mins.

@Stemcell- I didn't call the service center in advance, just walked-in. Staff were very nice & friendly at ASC.

Dec'8th appointment doesn't have to be cancelled. I think it will just show up as completed in the system. FP appointment letter is stamped indicating FP processing is completed. We need to save that for future references.

If you are walking-in, avoid Mondays & all mornings. You don't see anyone waiting in the queue after 1PM and is good time for walk-ins. good luck every one.

I have a question - I registered on the USCIS case status system and then tried to log in to my account and I got a message saying my password is invalid. So, I tried again - didn't work. I thought, ok ,maybe I entered it wrong, so I tried to reset the password and got a message saying - can't use the same password that you previously used. ?! So I changed my password and tried to log in again. I'm not able to log in! Has this happened to anyone else? I'm wondering if I got locked out and if I did, will I be able to try again later or do I need to create a new account?

Edit: I was able to log in successfully - it was my mistake.

@10102007 - The RD and ND are on the notice itself. You can check with your attorney when exactly did they mail your packet. The delay is going to be progressively higher, so even if he sent say 5 days late your packet may be looked at 15 days late due to volumes. Don't worry though but best to be on top of things. If you have sent your cheques then check for them. Calling USCIS is very simple all you will need is your A#, do not hesitate to call they are quite courteous.

Further to this, I checked the NSC entries for Oct applicants. High level observation is FP date 4-6 weeks after I-485 receipt ND. The delay compared with TSC doesnt make much sense as the local FP offices wud be common (depending on state/location) for TSC/NSC applicants.

Does anybody know if EAD/AP are processed only after FP? If yes, then I might have to think of early walk-in.

Also, anyone else from NJ area? I believe my FP office would be Newark.

Great. Do some research on the service center that they want you to go for Finger prints. Check if they'd allow a earl walk-in. I haven't seen this early walk-in prove any beneficial in terms of total process time. It'll at least be one thing off your plate.

When we walked in, it was empty and no one was there. I explained that my appointment is actually on Dec 8, but I was in town and wanted to check if I could get it done earlier. The lady in the counter was real nice and said, "sure, you could get it done".

Then, she checked the original FP notice and ID (Drivers License) and handed out forms that we had to fill (the usual bio details, A# and Receipt numbers from notice). Once we filled the forms, we handed them to the counter along with the FP notices and Drivers Licenses. They went in and after couple of minutes took us in 1 after the other to get the finger printing done. They also took a photo once FP was done.

When everything was done, I went to the counter and asked her again if I need to do anything about the actual appointment (like cancel it). And, she said, "Nope, this is it. You are done". So, there shouldn't be any issues because of the advance finger-printing I guess (hopefully).

All the best for everyone waiting for the next step in the AOS process.

Since it's day after Thanksgiving, check with the center if they'd be open or rather have you come early.

I'm not sure if you could find the form somewhere online. It was a 1 page form. But we only had the fill the top half of it. It was quite simple. I've given the actual details that you'll need to fill below:

1. Last Name, First Name, Middle Name (Optional)
2. Date of Birth
3. Phone number
4. Country of Birth
5. Country of Citizenship
6. Height (in Feet & Inches)
7. Weight (in lbs)
8. Color of Eye
9. Color of Hair
10. Alien Number (from FP notice)
11. Receipt Numbers (from FP Notice - AOS applicants will have 2: one for I-485 & the other for I-765)

That's it (hope I didn't forget anything)

FPs are not needed to process EADs.

looking at the CM Blog(link below), there were almost double(more than 19000) the number of applications rcvd at NSC compared TSC during 2011 spill over.
I think this is causing FP notice delays at NSC. I wonder if Lockbox routing the traffice to NSC to get both service centers workload distributed equally.
Though the number indiacates all applications(not just 485s), it will effect the 485s processing speed. just a guess, probably Gurus can shed more light.

Form filling will not take more than 5 mins. The data you need to fill the form will be on FP Notice. In case you are walking in early, I hope you already checked they allow walk-ins.

I'm not sure if this is true. On the FP notice, it says the finger-printing is for both I-485 and I-765. If it is not required for EAD, then I don't see a reason why the FP notice would say that it is for I-765 as well.

Fill in your profile in Trackitt and check the average time. If it's TSC, average time for EAD/AP is 78 days. GC 4-6 months, given everything goes well.

I will be filing 485 for me and wife on Dec1st....b'cos of my job and for vacation, we'll be travelling out of our ASC location "Boston" to San Francisco. in last week of December for 4 weeks. Assuming I get my FP notice in December, can I take that to the ASC in San Francisco or San Jose and get my finger printing done.

I have read some great reviews about the San Francisco ASC on yelp. http://www.yelp.com/biz/uscis-application-support-center-san-francisco

Just not sure if they will allow me to finger print here.

You can do the following.

1) Try to have your lawyer file your application on Day - 1.
2) This way you will received your notices in about 10 days and FP notice in about a week from the notice date.
3) If your FP notice comes before your FP date try doing a walk-in to that center. Some centers ae good they just allow, some would allow with a good reason (You can show your tickets), some won't allow.
4) There are some cases wherein people have done FP at a different center but mostly you ae trying to do it across the country. Some of the Application support centers are franchisees so I don't know if it will work in every case. So maybe you can try in California before your date and see, in the worst case scenaro you can re-schedule your date, this needs to be done before your date by submitting the origibal copy in writing before your appointment date. The FP notice has an annotation that if you miss your appointment you case becomes null & void.

Appreciate your response very much. I think like you said, I'll try doing a walk-in Boston ASC if I get my FP notice before Dec 17th, else will do the walk-in in SF ASC and see if they let me in....worst case, I'll either have to reschedule or fly back to Boston by the FP appointment date.

Will keep this thread posted on what happens with my FP..


You can do the following.

1) Try to have your lawyer file your application on Day - 1.
2) This way you will received your notices in about 10 days and FP notice in about a week from the notice date.
3) If your FP notice comes before your FP date try doing a walk-in to that center. Some centers ae good they just allow, some would allow with a good reason (You can show your tickets), some won't allow.
4) There are some cases wherein people have done FP at a different center but mostly you ae trying to do it across the country. Some of the Application support centers are franchisees so I don't know if it will work in every case. So maybe you can try in California before your date and see, in the worst case scenaro you can re-schedule your date, this needs to be done before your date by submitting the origibal copy in writing before your appointment date. The FP notice has an annotation that if you miss your appointment you case becomes null & void.

Guys yes I had my FP done on the 25th that was the scheduled date, I only had 5 days notice though, receive the notice on the 20th. Question do we see some LUD on the applications after FP? Someone said on Trackitt that after 5 days there is a LUD. Also the time to get EAD / AP post FP for TSC is 1 month, NSC has issued EAD to someone on Trackitt even without FP.

We haven't seen any LUDs on our applications after our FP. It has not been 5 working days since our FP dates though. So, maybe there'll be one in the next few days. I'll keep you posted.

Yes the info is from Trackitt. On the Oct thread someone had commented that people are getting EAD / AP after a month of filing. It may be a different story for us because the Oct batch was just 2.5-3K in size while ours is 7.5-8K so there is definitely more work for them this time. Additionally from Dec 1st another big wave of filers is coming so things would slow down for sure. AFAIK, Leo is the only Oct filer in our forum here. Thanks for the info on the LUD; I guess you are the earliest one to get FP done from our batch.

I believe so. My home address and employer address are in the same area (Washington DC Metro).

However, I am currently vacationing in the Bay Area, CA and just took the appointment notice to the nearest ASC. This saved me from having to reschedule my appointment or altering the vacation plans.

Teddy and others,

PD July 2nd 2007, filed I485, 765 and 131 on Oct 6th, CIS received on 7th, ND on Oct 18th, recd fp on 10/27. Date of FP appointment 11/23, went for walk-in on Nov 1st. There is no LUD on the same. I dont think there will be any on FP, verified with FBI if the prints are processed and are good. Currently waiting for EAD/AP. I have not heard of any who filed at TSC receiving EAD/AP in a month's time. Yes, folks who filed at NSC getting their EAD/AP in 45 days time. TSC is sending FPs quicker than NSC, but EADs are coming through sooner at NSC. I will keep you guys posted as and when I get any updates. thanks.

If we go by trackitt, the avg time is 65 days for EAD / AP approvals and not sure whether it is just the duration between received date and approval date or received date and AP received date. Seems like it is an avg of all service centers.

Hi all, it turns out my lawyer made a mistake in my EVL. The salary that I am supposed to receive upon issuance of the green card was listed incorrectly. He didn't actually admit to making a mistake, he gave me some vague explanation and said that he is going to send a cover letter and the new EVL. What impact is this going to have on my application? Is this going to cause problems or delays? I really hope not :( (just fyi, I just recently filed my application - notice date Nov 9, FP date Dec 15)

Correction the EAD / AP issuance date for some filers is 1 month from the FP date not the filing date. So some folks have been able to get EAD / AP in 2 months time. Right now some Aug filers are getting greened, so minimum of 4 months to GC and looks like minimum 2 months to EAD / AP.

Imechanix, there is a thread on Trackitt where someone mentioned that some receipt numbers are not working on case status online. Don't worry about it. When you have the next LUD I guess you numbers will work. I have personally had the same experience with my H1 and I140.

I am facing the same issue. The USCIS website does not recognize the receipt numbers. I guess nothing to be concerned about at this time...

Yes. I received it after 18 days from my I-485 receipt date.

Thanks Teddy & others for the information on USCIS online update status. My only concern is that if the online status update is not resolved and if there is an RFE I would have to depend only on USPS mail.

I was called in very quickly for biometrics where the official captured the fingerprints and photograph. The whole process was over in about 15 minutes.

I was prepared to go to Oakland, San Francisco, Modesto, or Sacramento if San Jose ASC had refused.

I will go as soon as I receive my AP and while coming back both of us will use our AP's.

My question is, I am not sure whether it is ok or not for me to send my wife when she doesn't have H4 visa stamp and before getting AP Approval.

You have to have the AP in hand while exiting the country.Only then will the AP be valid at POE. This topic has been covered elsewhere too.

I agree with stemcell in terms of the law stated. But, my sibling & in-law received their AP while they were abroad & they were able to come back without any problems. But, it's a risk and it all depends upon the immigration officer I guess.


Nayekal, By the way you can apply for emergency AP if your are in such a hurry. There is some provision around that.

My lawyers contacted USCIS today as my SRC number cannot be found on the online update system. Following is USCIS response,

"The applicants case were "in the mainframe" and that the biometrics were received. It takes a while for these cases to get into the system so you can access the information on line.

Nevertheless, he assured that all was well with the applicants cases. He told, for the time being, the only way to get status information is to call the National Customer Service line at 800-375-5283"

I mailed my 485 application on Nov 30th. Fedex tracking confirmed that USCIS received the same on Dec 1st 9:01 AM. Waiting for my receipt notice from my lawyers. My question is when I filed for 485, I did not file for EAD and AP. My lawyers were charging a whole lot for preparing and filing the EAD and AP documents. I have gathered all EAD and AP documents and waiting for 485 receipt notice to file EAD and AP. When I file for EAD and AP, how does finger printing work. Will I get separate finger printing notices for 485 vs EAD/AP. I am assuming once I do my finger printing for 485, that should be it. Can someone confirm?

EAD and AP is free of cost when filed concurrently with I-485. The lawyers must be pretty crooked to charge a lot money for EAD and AP because these 2 in addition to being free are the simplest forms ever. Now you will you have pay USCIS money to file them separately - total $825 per person. Check the link below....

Reg other details :
- Both you and lawyer will receive the receipt notices (you will get it by post in probably 1-3 weeks). The I-485 which you applied included biometrics fee. So you will get the FP notice based on your I-485. Assume 2-4 weeks after I-485 notice date.
- Not sure abt the biometrics associated with AP. You will have to pay the fee in any case but not sure if they will ask you for second FP.

Looking at the USCIS fees details page, it seems the biometrics fee applies only for I-485 and AP. Not sure, but this may be the reason why some ppl receive EAD before FP.


I'm not sure if this is true. On the FP notice, it says the finger-printing is for both I-485 and I-765. If it is not required for EAD, then I don't see a reason why the FP notice would say that it is for I-765 as well.



FPs are not needed to process EADs.

I have couple of question, Gurus/Others please answers and probably it was answered in several times but still for some reason i am confused about the answers
1) After filing I485 and 6 months have passed, we all know we can file AR21 and get new employment using EAD with same job duties and title. And mostly i hear that we need to join GC filing company later after getting GC. If this is the case then why we lawyers and other tell its safe to be with GC filing employer after atleast 6 months even though we have stayed with them more than 6 months after filing I485.
2) If my wife is on Student EAD and after getting EAD if she want to switch to EAD from me for various reasons, should she report this to uscis or some one else?
3) After getting EAD, if i want to switch to EAD what should i do?

No, I did not see any LUD's on my case.

I think the Case Status system is not up to date. I got my FP Notice and completed my Finger Prints and still my my case status didn't have any LUD's for these !!

What happens if I travel using AP & if I receive my GC approval while I'm still in my home
country. Is there any problem when I'm returning back at the Port of Entry?
