Apparently, flu shot is a requirement if you do your medical tests between Oct 1 and March 31 (during the flu season). The RFE response (if you get one) should be pretty straightforward. You get the shot, the civil surgeon will note that and seal it in the USCIS envelope. You put the packet together and send it off to USCIS. In all, it should not take more than 2-3 days to fix this after receiving the RFE letter.

Does that mean we'll have to shell out again for the civil surgeon?
BTW, it will not make any sense to get the shot, if you get the RFE after March anywayz...

I'm sorry to hear that. I was wondering the same thing and I saw on trackitt that someone got RFE notification on Feb 1 and they had to wait until Feb 9 to actually get the RFE notice. That's a long painful wait. I hope yours is not as long. Good luck!

Guys,
I received RFE emails on my wife's and my 485 application. Our EAD/AP were approved, however, my wife got her EAD card whereas I did not. Hoping to receive the RFE next week and also hoping that it is a straight forward RFE.
Any clue what the RFE might be when they issue it to both husband & wife? Any chance that it could be because we did not get Influenza vaccine? Any similar cases that you are aware of? Thanks in advance folks.

Hey Polapragada,
I had reported some of these cases on trackit. If trackitt adds the "member since" field to the trackers it would facilitate filtering of these cases. Dont know how I can make this request on trackitt.
Lot of these Dec, 2011 approvals with After OCT, 2007 PDs doesn't sound right to me. I have a strong feeling that some idiot creating dummy IDs and posting these approvals.

I called the civil surgeons office and they told me that flu vaccine is mandatory for anyone above 50 and optional for everyone else. They typically put not age appropriate and never had anyone come back for flu shots. It would be interesting to see if the most recent rfe's where both got rfes are for the same reason.
I wish I had known. We shall see.

I agree. As far as I can tell, there has been only 1 confirmed case (http://www.qesehmk.org/forums/showthread.php?238-Post-485-Filing&p=20853#post20853) where RFE was due to missed flu shot. I do not expect Oct filers to get RFEs for this as most (if not all) of them would have got their medical examinations done in September. And according to USCIS policity Oct 1 - Mar 31 is considered flu season. Anyway, when folks start getting the actual RFE notices, we'll get a better picture. All the best for everyone.

Flu shot is absolutely important. Because I get free flu shots at work, I had to present a letter from HR to the civil surgeon that stated I had received the flu shot. Because my spouse had not taken hers at work, she had to get it at the Civil surgeon's office.
My Civil Surgeon marked "not age appropriate" too...even though I got the flu vaccine and showed him the proof...now?
Ditto. I had flu shots already, but the surgeon still marked it as 'not age appropriate'. I had looked at it and asked the civil surgeon why she'd done that and she told me that the flu shot wasn't required.
Who was the person that got the flu shot RFE? Was this person > 50?
PS:- Congrats to soggadu and the others who got their green cards, best of luck to Teddy and the others who are next in line.

My husband and I went to different civil surgeons and both of us were given the flu shot. I had gotten my shots from a USCIS deputed Dr in Chennai (for the case of CP) and she was the one that gave me the Flu shot saying it is mandatory.
We have a loong way to get to 50 :)

Well, my lawyer cost me a good two weeks. I guess my civil surgeon is entitled to cause me another couple of weeks. Such is life.
Did you need to go back to the civil surgeon to certify the flu shots or did you just respond to the RFE with proof of the shots? Please keep copious notes on what you sent back. I'm just going to keep the response ready and send it back as soon as I receive my RFE.

For MC - they might want a copy for each application, if u haven't sent already. It's like they don't want to use their own xerox.
I have feeling it might be the flu shot. I had read abt someone getting an RFE for that . Not sure if it was NSC or TSC.

I think it will be about the Flu Vac. I have not taken it either and am expecting an RFE for it. It seems it used to be optional and many Civil Surgeons are not aware that it is mandatory now. BTW - how much time does USCIS allow for the reply to an RFE at this stage?

Don't worry... as you know, in the March bulletin, the cutoff date moved to 1st May 2010. That means the dates cannot retrogress until at least April 1st (even that might not happen). You have plenty of time.

I tend to agree with this thought. Myself and one of my colleague with MS in CS have got RFE's and one of my colleague with BS + 5 years exp has got I-485 approvals. Not sure what would be the reason, but I think most of the apps filed by people who came on H1 were relatively straight forward when compared to F1 to H1 and processing of F1 to H1 apps might take more time.

Some facts about me:
Don't have MS, F1 rejected 3 times back in 1999.
Was in UK for a year in 2001
Had L1, B1, H1 visa multiple times, was employed India for first 8 years.
same employer for past 5 years,About 100 employee consultancy.
Wife had earlier H1, B1 visas. Both work for same employer.
Cool thanks for sharing your background. Mine is almost similar to you but you are senior to me. I came to US first in 2002 on a short business visit when my company gave me an opportunity to lead a team of 5 people, got an admit without aid for MS for the 2003 session but at that time my company gave me a bigger role to lead a team of 25 people and then deputed me to UK for a year. Finally after 7 yrs of working In India I came to US and on H1 and since then working as a consultant with a 100 - 125 people consulting company. Hopefully GC will follow just like you soon :).

Good news! Happy for you, Teddy.
RFE can be anything like you mentioned. My wife's RFE was to resubmit Identification docs! Sent passport and driver's license copies last week. Now waiting again.
Thanks if you can share some timelines like how many days after the initial notification were RFE received and time to respond. I heard that the applicant also has to sign on the RFE again. Did you see a status update like evidence received by USCIS. Mostly the turnaround by them after the evidence is quick.

Guys and Gals,
I stumbled upon this site this past year and have grown to be a big fan of it. The biggest advantage from my perspective is that if I have any pressing questions, I can get very reliable answers (should say better than my lawyer's and free of cost :)). I am so used to the site now that my F5 key is almost not working anymore :)
It has been a looong journey from my F1 days. Though I work as an FTE for one of the top Financial Co., since my PD is in early 2008 and Atlanta SC, my PERM took more than 2 years to clear audit. Mid 2008 - 2010 was especially hard to even survive (which now corroborates well with the demand destruction). I did not even expect to be current until later this year.
I personally want to thank every single person who contributed(s) to this forum. It is not only the gurus but even some freshmen whose posts clarify some of the basic questions that maybe very specific to an individual. Special thanks to Veni, Nishant, and Grnwtg for answering my PMs and Q, Spec, T and the rest of the gurus for all their insights! I know that all of you do it probono but still take the time and effort to do it right!
Thank you all for making this journey memorable!
P.S. I am still waiting for the approval but have my winner's speech prepared and could not wait to deliver it! Now I just wish to get the approvals and cards soon. :D

Just an update:
3 of my friends became current along with me in November. We all went to the same Civil Surgeon and so, I'd think that the civil surgeon marked "age not appropriate" against Influenza vaccine for all of us. We all have the same priority dates. 2 of us have RD Nov 1; one has RD Nov 4 and the other has RD Nov 8.
The person with RD Nov 8 just got greened (got emails earlier today). My friend with RD Nov 1 got RFEs for both himself and his wife couple of days back (don't know the reason yet). I (RD Nov 1) and my other friend with RD Nov 4 are still waiting for some kind of activity.
The 4 of us have pretty much identical profiles. Came to US in 2002 to do Masters (same major, same university). Started working as contractor at the same company in 2005. Got hired as Full-Time regulars at the same company in 2007. And, the lawyers sent the same list of documents (http://goo.gl/rwgXt) for all of us.
Lets see how this plays out.

My first H1 to US was filed in 2000, I was in UK, converting Sterlings to Rs was too good , In 2001 Nortel/Motorola competing to lay off people( Nortel laid off 40K in 2001 June).Like you, my firsttrip was short, just for 3 weeks,It was on Jan 25th 2002, through HCL Tech, chennai.
You have earned a lot of good Karma on all GC forums. Your posts reflect your maturity and and patience. When the things were too bad back in 2008 and 2009, you were the one who helped everybody keep spirits high. You'll get the card in few days.

Thanks four your kind words. Yes in those days GBP was strong and even the Rupee was doing better, now both are down compared to the dollar. UK immigration used to be much simpler though now things are becoming tough there as well. IT job market and opportunities in US are far better than UK though. Again congrats on your GC now you can explore the US market better like a free bird.

1. Text and Email: Jan 27th. I was excited to see the text. Previous day I and my kid was approved. Bit of an anti climax looking at RFE :(
2. Attorney received letter: Feb 3rd. She asked to send her passport and driver's license copies. I did not receive RFE letter, forget even to sign it! Sent copies to Attorney on the Feb 4th (at her home office in person)
3. Text and Email: Feb 6th - evidence received and RFE initial review.
4. CPO: hopefully within next 2 weeks.

guess we can't call TSC - Tortoise Service Center any more.
I am still waiting for my file to be touched.Hoping to see either approval/rfe next week.
btw, guys I got this weird doubt - I know there are couple guys(one of them is my friend) with the same first name & last name as mine, though they didn't apply for 485 in November, they applied in later months.
Do you think that will delay my gc processing as 'Name Check' process hits couple of matches ?
Teddy- goodluck with rfe, gotta be a easy one..
Good luck too all still waiting...

USCIS sends the whole medical test report back to you. Take it to the civil surgeon without opening the envelope. Show him the proof that you took the flu shot. We took the shot from the same physician. He will make a note of that on the 693, and reseal it back in the new envelope that USCIS provides. You mail that packet out to CIS. It is pretty straightforward.

Well, the only thing I could think that is different between the friend that got greened and the rest of us is that he has a son who was born in US (an thereby a citizen). However, I don't know if that has any bearing on this.

Refer to the following instructions for I485 - http://www.uscis.gov/files/form/i-485instr.pdf. On Page 3 there is a section called initial evidence, I believe that this should correspond to the initial evidence RFE while everything else should be additional evidence. It may well be a small thing for you like pay stubs / tax return, DL copy etc.

We never had flu shots.I checked Medicals form now, it is marked "not age appropriate". My TB skin test was positive and X-ray was normal. It is marked so in the form.
It looks like it largely depends on who picks the file and how the officer interprets the rules.

Thanks if you can share some timelines like how many days after the initial notification were RFE received and time to respond. I heard that the applicant also has to sign on the RFE again. Did you see a status update like evidence received by USCIS. Mostly the turnaround by them after the evidence is quick.
One of my colleague received RFE for Birth Certificate and time to respond is 84 days. I received RFE, on 02/07 and till now, my attorney doesn't know what the RFE is about and in couple of days I am returning to US. I hope everybody gets simple RFE's in case if they get (I don't want to say stupid RFE's even though most of us look at them in that way).

Cool MJ Totally normal. You will get your notice by this week. You will get notices by USPS for everyone at home that filed along with you. You will get finger printing notice about 2 weeks from your ND, again by USPS for everyone you filed for. As someone else says, check your bank to see if checks are cashed.
Thanks Kanmani,
My wife is a dependent on the application. Will she be getting the physical notice at home address? Will the Lawyer getting my receipts? Sorry for asking such ignorant questions:)

My PD got current in Feb 2012, my lawyer submitted papers on 3rd Feb. No receipt notice from USCIS yet. Is it normal delay? How much time it usually takes? I have seen some Feb filers updating their profiles with RDs & NDs so just wanted to check.
Thanks!
It took about 2 weeks for me to get it. You will get it soon.

Hey guys, just wanted to reiterate this forum rocks!
I was getting a little nervous thinking about what happened to my application as I didn't receive any notice from USCIS or my Lawyer.
But after getting so many reassuring messages and stories from you all, feeling better.
I will sit tight and wait another week or so.

I don't think you need to be dressed in a suit for finger printing. Just the regular shirt & trouser/jeans that you would normally wear to work should be just fine.

Formal wear with tie would be a good idea. 1) Experience in this office would be nice and you want to look better, 2) One thing in this whole process with no tension is finger printing.

Thanks you, u too RC.
I have seen some posts that said even EAD card had the foto taken during finger printing, so i assumed if not EAD the new foto will be used for GC. If thats not the case i will go with simple formals.

Teddy, I guess it should be your EVL. If I am right your attorney used the same letter that was used for I-140. My guess is IO is looking for a most recent one. I am sure it will be an easy one. Goodluck and hold your faith.
Sogaddu bhai...you are a good man.
As long as you are employed with the same company (which has to be true :-) and submit the latest pay stubs - you should be good wrt EVL. I just submitted the last three paystubs for AOS filing.

Get dressed how you want yourself to look in your greencard pic. Even your ethnic dress should be ok. Mainly they want your clear face view.
Your pic in GC won't be colurful. So doesn't matter much which color you wear.
I went in a regular t-shirt/jeans. Major pic portion in my GC shows the face and little shoulder portion. Plus I didn't have a clean shave that day.

You deserve it. Congratulations. We have all waited too long.
btw about the RFE's being discussed. Initial evidence generally time given is 30 days. You can see instructions for form I-485 where it lists down initial evidence. And yes as per instructions itself, even EVL is an initial evidence, although it's not being treated as such by few lawyers.
Additional evidence which may be present in USA itself, is 30 to 60 days. Example is W2, tax returns.
Additional evidence which needs records not from USA is generally 84 days. Example is birth certificate.

Sirisha, I feel that the Masters/PhD in USA and fulltime position, fortune 500 all that is good for 2 month low hanging fruit approvals. After 3-4 months time frame, it don't matter.
Now with consulting, only thing is various location and end client changes, and how much the IO wants to sync up with your G-325 history, H1 history, LCA history and so on.

You are, statistically speaking, an outlier :D , and buddy, so am I. I myself have bachelors in engineering from reputed university in India, two masters in Electrical and Computer Engineering from reputed universities in USA, I made my file reach first day of opening itself. Everything done from my side. I see March 2008 getting approved, while you and me are sitting twiddling thumbs :)
And this not a rule, I am just saying if file comes into hand, IO might forgive few discrepancies and scrutiny and bless it faster, to meet the visa utilization goals. There will be very few 2 month approvals, and if you have this criteria satisifed, you serve better chance of being part of that 2 month approval. That's all I maintain.
Nothing can be said with certainty or rule, only observations.

Count me in as an outlier as well. Working for Fortune 500 for last 7 years with Masters degree. I think now our cases become statistically significant :-). So there is probably some other reason. I agree, I think it's mostly related to the officer who is handling your case & background checks.

My humble opinion - lets not please read too much on RFEs unless it's serious issues like missing RFE response due to address change, criminal records minor though,
messed up while on H1 - example not filing H1 amendment and all ..again IMHO

Been in US since 1997.... working mostly in startups doing core embedded development.... never bothered about GC - until wife was diagnosed with cancer and had to continue staying here for her treatment! (In between moved back to India and the docs (best of the breed :-) declared she was completely cured.... Came here for second opinion and they still found it in her!!!). These are my RFE details
1. Evidence that you tried to find the birth certificate and was unable. (Should be from govt stating that BC was not available and why it is not available).
2. Copy of I-94 that was issued in May 2005, if have it. (I don't have it).
3. Any employment authorization documents that were issued for my benefit. (What I have is an OPT card before applying for I485)
Can some one suggest me what can I do to get the I-94 card that was issued long time ago.
I have had 3 to 4 H1's issued after that.

Nishant, you'll get your GC approval before 2/25 :) I dont have Soggadu's and IndiaEB2 baba's clairvoyance...just a gut feeling.
thanks buddy. It does fall into 3 weeks from FP sweet spot. I can't think about anything else now, all the time only thinking of this, checking sms, email, case status for any LUD, even at night.

Thankyou all for your wishes.
Mysati, well said dude! We can't change the past - not sure what the future holds. The best thing we can do is live every moment of the 'present' and make it count! Life is short guys - don't waste it with unnecessary complications.
Nishant, thanks for your advice dude. Could you please share some details/links about such procedure?
Thankyou.
To find the congressional representatives for your region, simply go to these two websites:
http://www.senate.gov/general/contact_information/senators_cfm.cfm#
http://www.house.gov/ (there is a textbox to enter zip code and find your representative)
You can call the office, and many of them have their own website on which they write about immigration how to contact.
for eg: http://www.boxer.senate.gov/en/services/assistance/upload/Boxer-Privacy-Release-Form.pdf
USCIS expedite criteria:
http://www.uscis.gov/portal/site/uscis/menuitem.5af9bb95919f35e66f614176543f6d1a/?vgnextoid=16a6b1be1ce85210VgnVCM100000082ca60aRCR D&vgnextchannel=db029c7755cb9010VgnVCM10000045f3d6a1 RCRD
Basically even before processing time, based on expedite criteria you can contact. I would wait for the processing time, or ask a lawyer if can contact earlier.
A google search, other forums, as well as other users here may have more information about contacting congressmen/senators.

Nayekal,
I am assuming you are from TSC,
Have you not visited abroad since 2005 ?
Your Attorney may have the I-94 records since you have filed H1 after that. Its probably worth a try if you are not able to find it.
Hope you will have quick approval after response to RFE.

I went for early walk-in because I have an upcoming India trip during that time and my husband's official travel schedule. Was plain right refused and it felt kinda humiliating in front of a bunch of ppl with regular appointments. She just told my husband to go to an ASC at the travel location. I really think it is because all the folks are skipping the appointment time and going in early.
Quick update. Things are moving as per schedule. I received all the Receipt Notices today (all six of them) and the checks cleared on last Fri. Now waiting for the FP Appointment Letter. I am planning to do an early walk-in as soon as I get the appointment letter.

I think if they have said, give you if have it, it means its optional, and no need to have headache if can't find it.
I don't think there is any way to obtain old I-94 records, and if there is a way, its for sure going to be very time consuming, as it will involve CBP records.

I-94 is usually taken away by the airline when you depart the US. I do not know how else you can get it but I would assume the closest to that is a departure/arrival record stamped on the passport for that time frame. Talk to your lawyer more about this

Isn't it amazing, USCIS asks us for these records, which we have already given to airport, for the purpose of the various agencies having a record of our entry exit.
I have a compilation of all my A-Z documents in pdf format scanned, and have them on work computer, home computer, online secure document storage, in a thumb drive at home, in a thumb drive in office laptop bag, and also all printed out copies in a briefcase at home. That's what I am paranoid because of such things they ask for.

Formal wear with tie would be a good idea. 1) Experience in this office would be nice and you want to look better, 2) One thing in this whole process with no tension is finger printing.
Don't bother with formal attire. They take a picture of the face, and your tie/other accessories won't be visible. The finger printing office looks like fedex/kinkos :)

I never went out after 2005 until 2012 and I am from NSC.
These attorneys are changing all the time, so I don't think my previous attorney (who did my H1 using I-94 for may 2005) would retain those copies now as he is not working for my company any more.

Nayekal,
The last I-94 that was issued when you entered into US is the "Initial Evidence" proving the legal admittance. All the I-94 [attached to H1 extenstions] are "Secondary Evidence".
So even if its expired, I-94 issued at POE is the most important document that we need to submit with AOS packet.
In your case since IO mentioned "provide, if you have it.." you should be fine IMO, if you cant find it.
I would advise checking your electronic devices to see if you had scanned and saved it somewhere. Good Luck.
Thanks.

I had a similar experience ,received my finger printing notice in early Jan but the appointment was end of Jan.I tried to do an early walk in but was not allowed to do so by the ASC agent at the centre. One of my friend's tried to do an earlier walk in at the same centre later in the week and was allowed to do so :) . USCIS does not apply the rules uniformly ...pure luck :) and the difference of 3 weeks between an early walk in and FP at appointed time could be the difference in getting a green card now or nerve wracking 2/3 months later. For the ones with later 2008 PD could also mean the difference in getting one before retrogression of dates.
:) Nishanth's post also adds some valuable points.Straightforward cases/Low hanging fruit definitions could be pure random luck based.

I do not agree with the last statement. I do not think a guy with PD Dec 2008 will get GC ahead of April 2008 just coz he got his FP done 3 weeks earlier. No way that will happen. Reason is simple being..as of Feb 2012, only Oct/Nov 2011 cases are being processed. Jan filers cases are not going to be picked up until after March, buy when FP will be done for all Jan Filers. Even if retrogression happens, the 3 weeks delay in FP would not matter

Totally agree with all you said. But there is a line that needs to be followed right :)
Personally I do agree with that..However USCIS keeps on changing the goal posts. All the articles and newsletters are pointing to PD being irrelevant within the short window of processing .March 2008's are getting approved before July 2007 .
RFE's for flu etc etc.... :) There is only thing I have learnt with USCIS (expect the unexpected ) .

I would like to side with gcseeker here, people have done early walk in and got GC in two weeks later, which otherwise would not have happened if they had followed the scheduled date and gone for FP 3 weeks later, and if they had done so, that two weeks would have come five (3 + 2) weeks later, and if dates went back.... Early walk in definitely has its advantages.
I know it feels frustrating, everyone is human, to see someone 4-5 month later PD get approved, while we are sitting waiting, but nothing can be done about it.
Just my opinion RMS. no one knows the real truth!

Not just because of FP. FP is one of the checkboxes for background check. You just saw it happen over the past few days on this forum itself.
March 2008 -4 Cases approved from TSC
July 2007-Dec 2007 tons of us waiting...
There is a nice link on Non immigrants blogspot about irrelevancy of PD at this stage.

Since you already gave your most recent I-94, don't worry about the old ones. Very few people keep copies of old I-94 since it is taken by the Airlines when you leave the country. Only the current I-94 is the mandatory initial evidence.
About other parts of your RFE, did you not include a BC or NABC with your 485? For the third part, you need to provide the copy of the following: I-20 that includes OPT info, copy of the OPT EAD Approval Notice and copy of the actual EAD Card (front and back).
Also - how much time have they given you for responding to the RFE?
Wonder why they ask coz we just gave our most recent I 94s

I am thinking of early walk in for one simple reason. It seems that the FP Appointment is super serious and if you miss that appointment then that is considered as abandonment of 485 petition. Now, all kinds of shit many happen on the day of the appointment (snow, blizzard, traffic, illness, accident, whatever) and I would rather get it done ahead of time. I wonder whether the ASC people would be more amenable to early walk-in if one calls them before and asks them whether one can come by for an early walk-in. If they are super busy then I am sure they will decline but will otherwise be okay with it - makes no difference to them.

Just confirming - when you travel on AP, you would necessarily have to go through Secondary Inspection - is that right? Just the Immigration Counter is not enough? Also I imagine one gets in the non-immigrant line and not the Citizen/Resident-Alien line at the airport - right?
nayekal
If you are currently living within the commutable distance of the same international airport, which issued that specific I-94, you can visit the CBP and request them for a copy of it (Customs and Border protection - where the parolees' are interviewed - not the immigration counter)

this has been mine and my friends' experience who have kids, at the LAX airport. Because of the kid being US citizen, they ask us to go in the US citizen line, which can be considerably shorter than the non immigrant line.

To all those people who got RFEs, hopefully it is something really simple. Hmmm... and then there are Nov filers such as tackle and myself who are still waiting. It was interesting to see Spec's numbers in the predictions thread. Only 30% of Nov filers from NSC and 18% from TSC on trackitt have been approved!!
Essenel - I can understand the pain of waiting.
Hello all,
Just received text and email - CPO for wife. My GC journey is over.
Teddy: you will be greened in a week after replying to RFE.
Nishant: I am sure you will be greened within few days.
Thank you and good luck to everyone!
Congratulations.
My RFE says - Request for 'Initial Evidence' . Additional evidence could be something in addition to initial evidence? ( my guess)
Thanks Leo
Thank God! Finally my journey of green card has come to an end. It was amazing to see the blue symbol & to read "On February 13, 2012, we ordered production of your new card".
I would like to thank Q, Spec, Veni, Teddy, Leo, Nishant & all the other wonderful people of this forum. Although I was not much of a contributor but always felt part of this great community intitated by Q. Thanks for that.
It's been more than 10 years since I have gone back to India & it will be wonderful to see my family back home.
Leo & Teddy,
Don't worry. You will greened pretty soon just like that. I can understand what you are going through.
Thanks again!
Congragulations
Guys... Cannnnnnnnnnnnnnnnnnnnnnnnnnnnnnn't believe.... I think i am greened... received following email and sms for self and spouse

Friends,
I just want to let you know that, one of my friend Received I485 approval today from TSC and His processing date is Dec 2007. This approval processing really frustrating , Don't know how they are approving . I checked the Numbers randomly and Many of them got approved before my Number and after my receipt Number.

Congratulations imechanix .Take the day off and have a blast.
:) cool!
congratulations. 10 years is a long time, enjoy your trip to India.
I just tried to fish around with my lawyer, dropped in an email saying how this wait is so anxious etc, hoping he might enlighten me on some news or some tit bit he has, he just replied with one word: OK.
:D
Congrats and enjoy!
If you have not gone back in 10 years, I would advice for you to be ready for anything as to how life has changed there :) Howmuch ever you prepare yourself, it will fall short of what you witness.
I second that - you are in for a big shock if you are going to India after 10 years. Even two years' gap (which is my usual schedule) seems to be too much as far as changes in everything in India is concerned.
Wow! 10 years is a lifetime. One can't put price on that. I hope you enjoy every single moment when you visit family back home. All the very best for future!
Congratulations
Thanks everyone. It feels great to finally get the approval. It's a real tough process to get through (getting a job, survival during tough times etc) & they really make you earn it. I hope everyone who is waiting get's their GC asap.

Many congratulations, thanks for sharing your wife's timelines. Very helpful for all of us on RFE's.
Now she is in the hands of one of the world's best doc.
I did not expect things to move this fast... so, even if it gets delayed - no worries. In any case, I appreciate your wishes - thankyou.
You and your wife are true winners. When I started my career working in embedded systems was always a dream, never got the right break. Wishig your wife the best of health and hope your GC dreams come true soon.

This is what I notice from approval trends , After generating receipt and approving EAD / AP may be by junior adjudicator case is forwarded to senior adjudicator still not to supervisor ( who can make decision on complex cases ) so senior adjudicators gets cases in RD order but background check can come in any order , as they receive clearance they approve so sometime people with slight later PD get approval faster than other people. Once they receive clearance they can't hold on approval if nothing is missing..
Just 2 cents.

He did go through an attorney. The initial receipts went to both him & the attorney. He got the EAD cards directly. And he got the RFE notice directly. I'm not sure if the lawyers got a copy of the RFE notice as well.

That is a very sound theory, makes complete sense. Many pieces of initial evidence are also common between 485 and EAD/AP, like all I797 approvals, I94, 140 approval copy, marriage certificate for spouse. Also they do initiate IBIS check within 15 days of receipting, as well as G325 name checks, and they wait for max 60 days for positive result to come back else they adjudicate EAD/AP.
I think that the biggest culprit for some has been delayed FP.
Your theory made complete sense to me.

Does EAD/AP come via regular USPS or signed/delivey confirmation USPS?
Can my husband sign for delivery of my EAD also in case I am not at home and vice versa?
What happens if both of us are not at home at the time of delivery? Will it be sent back to USCIS or can I collect it from local post office?

Yes. The G325 biographic information form you provide, is used to initiate background checks across agencies like FBI, CIA, overseas consulates, police departments, etc, whatever they deem necessary and applicable to your case. The biggest and most common of all this is the FBI name check. Just wish that no criminal used your name or a name similar to you :)

haha the only thing I know is that we do not have one. Really they ask the Indian Police for each and every case or only when a hit comes in the US agency records? I doubt that Indian police will be contacted at the rate at which they work + the fast rate of GC approvals these days?
I did have a friend whose file was pending with name check from 2004 to 2008. Ultimately he approached the senator and in 2 weeks received the GC

i agree completely, basically i want to be done with this process once and for all, no more renewing EADs every year.
BTW, while TSC being very active last few days, seems like NSC is sleeping ... Nishant, what does your Receipt number data say, have you looked into that lately? I tried doing some i kept on hitting i 90 replacement cards all the time.
Also whats funny is people who have RD earlier than me have receipt number almost 5-6 thousand behind me, may be they assign random numbers !!!
People talk about low hanging fruits, how do they know if it is a low hanging fruit, they have to look at a file, which would result in atleast a soft LUD, my case has not been touched since 12/12/2011.
Can somebody please explain... I am pulling my hair out and wearing out F5 on my key board

I agree on all counts. Same LUD for me. And crazy amount of I-90. seriously what's the deal with I-90s. Seems like NSC's 80% workload is I-90. Why not just getting citizenship after 5 years, instead of keep renewing your GC using I-90, no more hassle of losing GC, name changes, renewing :)
I think NSC will perk it up in the second half of month, right now I see them issuing a lot of EAD/AP.

We tried playing with soundex a long time back in our product. Basically we offer a search by feature at one place, where you could search by name, and we offered a "sounds like" facility in that, but it was only there in research and prototype kind of mode, and it never saw the day of light for actual production.

Not all will qualify. Some will be stuck in RFE, some in background checks, some will be stuck on I-140 approval for concurrently filed, some will slip through the cracks, and so on. And I think some QSP per month also being given by CO, else it would be just 3,600 visas for EB2 each month, not enough for such huge approvals. You are correct though, as soon as huge approval numbers begin hitting DOS, CO might start frowning.
man I hope this year is it for me, so close yet so far, I will die out of craziness.

:) I received all 6 in one shot in the mailbox.
Teddy did not receive one, his own 485 filing receipt, he opened SR for that, and it has still not come to him, though he has already got RFE on his 485.
For EAD/AP, I got approval notices, one combined notice for both EAD and AP, for both me and wife, two notices in total, in one shot.
Then I got wife's EAD/AP card, but not mine. So I called USCIS and obtained tracking number, tracking number said out for delivery by USPS two days back then that day, so I went to USPS and they said they will investigate, and then that evening, magically, my EAD/AP card also showed up in mailbox.
there you have it, all the stuff got from USCIS so far.
One more 'Receipts' question ( sorry Nishant) :)
Y'all received the Receipts one by one or 6 together? Ours is one missing still.
nishant2200
02-14-2012, 08:30 PM
Thank you Nishant. How long do we need to wait to open SR?
I would say wait a week after you got your first five receipts, and then call them and said you have waited a week, and are requesting them to send the filing receipt again.
Interestingly in the case of teddy, he might get his GC before he gets his duplicate filing receipt.

My pd dec 31 2007, NSC. Ead/ap approved and card picked by usps yesterday.
Due to acquisition of comp. an amended i 140 was filed along with 485.
Do u see this as a reason for delay in adjudication. Thanks.

Now, some really good news. We(myself + 3 derivatives) got greened yesterday. We received our I485 approval emails at around 4pm yesterday. This was a pleasant surprise but I would be happier if all the people here receive their green cards soon.
This is end of a journey but the beginning of another one.
Good luck to you all.

N... How do you get the tracking number from USCIS? I would like to get for my cards too.... Please let me know!!!!
