man I have got zilch nada zero null undefined void 0 shunya. no FP, no EAD/AP. Since last summer, my life has been on edge, first living month to month for each VB, and now living day to day for that USPS mail, or email or sms.

You are right. One of the additional reasons which i can think off is that they are delaying on the FP could be because of the fact they are not able to find a suitable time slot at the nearest ASC based on the applicant address. in these cases they are issuing EAD / AP without fingerprint....

I went in for the FP today (early walk-in). Based on my understanding from my experience if you receive only 485 on the FP notice ( and there is no mention of 765) you should still be good. They did code 2 and code 3.

I filled for my 485 and I'm working with consulting company and working for end client.
My end client location will change to next block, just a 100ft away from the existing building.
Do I need to update the new client address to USCIS or any agency ?
Do I've to prepare any paperwork like amendment ?

I would say ask your GC lawyer... s/he would be the right person for this question along with ur employer...

It is not unusual to get the receipts after 2 weeks of filing. My receipt date is Nov 1st, but the receipts on Nov 18th, so does all of my colleagues. You might be getting them by end of jan.

A friend of mine with the same PD & RD as mine got EAD approval notification yesterday night. So, looks like there are a few cases with early NOV RDs which are getting delayed for some reason. Just bad luck. Don't worry, you should get your approvals soon.

I'm in the same boat. I wouldn't worry about it yet... it's still within the processing time frame for TSC... there were also several holidays in Dec and Jan, so that could have delayed things more.

Today my company (desi consulting co.) send me email stating that "company came to know that my priority dates are current and company will file GC (I485) for me. Before company file my GC (I485) I have to sign a contract with them (they have email me 19 page legal (lawyer) contract). Company GC contract state that if I leave company in 18 months after filing my I485 than I have to pay $25,000/- (cost for filing my I485) to company and other bla..bla..bla.."

I was luck to know all this kind of things from senior(old) H1B friends. Taking there advice I had filed my I485 by my own lawyer without letting company know.

Reason I am posting this here is my other friend working for desi consulting also received similar letter from his company.

Below are my details. Filed 485 for both me & my spouse at the same time 12/1/2011. I received EAD/AP approval email last night but spouse's online EAD/AP status still shows Initial Review. Is this usual.. anyone else in a similar situation?

I don't know such "bond" even valid or not, but for me it is another way to suck blood from employee.

AC21 rule (180 days rule) make more sense to me. I am going to invoke AC21 rule on 181 days of filing 485 and will be free from any obligations.

18 months is way too long. 6 months post GC is the longest credible recommendation I have seen (search the murthy forum, this has been beaten to death there). This is a clear attempt by your employer to keep you an extra year. I recommend that you ask your employer to reimburse your expenses with the promise to pay them back if you quit pre-18 months.

When I spoke to a cr she told me I can open a cr if the EAD is not received with in 75 days and I asked her to open a CR.

Filing date - Jan 5th
RD - Jan 9th

More than 10 trackitt users who filed in Nov 2011 got EAD/AP approvals yesterday. This is the good part. Only 2 trackitt users who filed in OCT 2011 received GC approval emails.

I am no expert by any means compared to folks on this form. Looks like EAD/AP is pretty much assured before 90 days, GC... god only knows.

I am in the same boat as you. My case status still shows "not found".

I did a research and found out that
- SRC applications above SRC1290067724 are updated online.
- Between SRC1290067725 to SRC1290069271, the case status shows "not found"
- Above SRC1290069271, all case status are showing online.

So it seems like we are the unlucky bunch to fall between SRC1290067725 & **6971and are unable to view our statuses online. This group had a RD of Dec 7th and a ND of Dec 9th.

I called USCIS, got a Chinese speaking agent, who was in a hurry to get me off the phone, and said that she has put in a request to update my number online. I don't think it is going to happen.

The most recent case SRC1290120059 with a RD of January 18th was updated online.

An interesting thing I noticed that all December filing with RD of Dec1st to Dec 31st were from sRC1290061XXX to SRC1290094XXX....so about 33000 receipts, which roughly equals around 11,000 applicants at TSC. This includes the universe of all EB applicants and other asylees and refugees. If one speculates that more than 70% of these applications are EB2-IC, which would mean that there are about 7700 EB2 I/C applicants in December.

Adding to what Q said, same thing just happened to me. I got EAD approval email only and not AP approval email (AP SRC# also has no case status change). I haven't got the EAD CPO email yet.

No, I did not open any SR. But, called USCIS customer service twice (once last week of Dec, and last week). I am not sure if those calls had anything to do with the approvals at all.

I have a serious question:

My PD is Apr-08 and I am filing for my 485 this month. Documentation is done and application will go out early next week. My 140 is approved.

Our upper management changed few days back and there are rumors about reshuffle including layoffs. There is no need to assume that my position is safe if they decide to get rid of entire division in restructuring.

What will be my options, god forbid, if my position is eliminated? It is possible that company keeps my 140 alive if this happens.

I guess than there will be less trouble if this happens after 180 days of 485 file date.

Any help is appreciated.

Guys , i filed as a dependant with the receipt of spouse primary for 485.

When primary gets 485 approval will my dependant file automatically get picked at TSC although primary gets approved at NSC.

My problem is since both of ourcases went to different service centers , heard TSC is being given most of the cases for processing due to load sharing .

My case is also same. Spouse NSC and mine wen to TSC . I spoke with my attorney's office and it seems the lock box locations are forwarding to the service centers based on the work load. I was told that althought it went to different SCs it does not make any difference with the approvals . Infact now , most of the cases are apparently forwarded to the TSC irrespective of your living location since it is better equipped to handle big work loads...again this is what I gathered from my research and also on trackit I found many such smilar cases that confirms the trend...I think you are cool ..your daughter should get approvals ...now I'm just guessing TSC might delay by a few days compared to NSC ...my curiosity has been with 2 different service centers means 2 different IO's handling the cases ...will the dependents file get picked at the sametime as the primary or will it be treated as different entities altogether ...I believe at 485 approval stage the primary and dependents are tagged together ...hope this helps.

Sogaddu bhai the game has really started. Besides RD , ND, PD luck will play a rule. We have seen very few Nov filers being approved so basically you have to be a low hanging fruit and drop into an officers mouth hopefully he will have it open :) and if he likes you then he will eat you :) and then might presss the approval button :).
Abhi Dili dikh rahi hai lekin door hai. Peene ka maza leejiye kyuki dard hi dard hai is intezaar mei jeene mei :). Nov filers ka approval abhi shayad 1 - 6 mahine lega depending on all factors and available numbers (So Chillorama and hope for the best).

I ordered a cocktail for myself, thought I will enjoy a drink to drown my misery. 15 minutes later I had got up to ask the waitress why no bread butter out yet (for some reason, I look forward to the free bread butter more than the actual food), and at that time I got four text messages, one after the other. All I remember seeing was LINxxxxxxxx some numbers. Then I checked case status online and saw updates. I swear I have never enjoyed a drink more than that time.

Me & my wife both had legal name changes. The new name won't be there on any of my other documents. its only on the court order. I think they want to check the Biometrics before they issue EAD. so my FP is scheduled on 1/30/2012. I might get ead after the FP and name check. Lets see.

Guys did you observe on Trackitt lot of OCT filers are getting RFEs for simple reasons?? I saw some nov filers too got RFEs.

hey dude... congratulations on becoming current... TSC is very good with notices, so dont worry. My FP notices came in 10 days after receipt notices... So expect something similar... they dont send FP notices or for that matter EAD/AP according to PD. They just follow PD only for the GC... hope this helps...

If your lawyer has filed G-28, then he will also get an attorney copy.

You will always get via postal mail to ur home address regardless of G-28.

I will be current in Feb 2011 (PD : Oct09). I have a planned visit back to India in March/April for my Dad's medical condition. From what I have read, If I apply for my EAD/AP, then I will probably have to wait for 3-4 months(till I get my EAD) before I can leave the country. In this situation, does it make sense not to apply for AP?

In that case will it be possible for me to still go back home and return on my valid H1B visa, when my EAD is being processed?

If you have a valid H1 visa you can come back using the visa and EAD/AP processing can go on while you are away. The only condition is you need to be in US when your application is filed. After it is filed you can leave the country and come back on a valid H or L visa.

I have exact situation as yours. I again got text messages last night. we had our FP completed yesterday and thought may be it prompted for the second set of approval messages. I was also thinking the same that we might get two set of cards one with FP & other with out. :)

As long as you have a valid H1b visa + papers, you are good for travel. File your EAD & AP in parallel. They are not mutually exclusive. So, even if you file for AP, you can continue to use H1b for travel.

I had the same question as you. What Nishant told me is that..The applicant will receive a copy of the receipts irrespective of the G 28 form that you have filled in authorizing your attorneys to get copies of the same.

The processing times haven't been updated since mid November. It's been over 2 months since they updated the processing times. Looks like TSC in general is lagging behind roughly by 1.5 to 2 months for 485 related approvals. However, several October filers got their 485 approvals within 4 months.

It all depends on what you fill in the application. We gave our address in the form. So, expecting the cards to our home address. If your company's policy is for the lawyer to get the EAD card, then that is probably what the lawyer would do too.

She can use EAD/AP safely as long as you are the primary...in worst case if 485 goes bad, then she might have to look into other options as EAD will go down with 485...

I asked this to Ron Gotcher for myself and he says that is fairly common to use and is okay. Again, I do not know the details of your case, no 2 cases are the same to make a generic statement. Email your lawyer to confirm. This is immigration. You should seek professional advice.

I got myself a H4 stamping although since I wished to maintain status.

That is the safest bet even if something were to happen to your job. Once you choose to go on EAD, then you have to have your AP in hand to return to the states.

No offence to anyone, but all H1 B visas are being extremely scrutinized in Indian consulates. You have nothing to worry if the company is in good standing, pays you well and your pay is not too low. Ditto for H4.

It depends on what you fill in G-28. By the time you are at this stage, you are outside company's policies. It's your application from this point on. Most attorney's prefer their address as it makes their life easier.

USCIS mails do not get forwarded to new address. I suggest you to change your address at USCIS.

KD thanks for posting this link. As far as I can understand there target is to get a maximum of 18K applications because the probably know that 10-12K SOFAD is burnt already. There is no duration qualified in what range this is expected and there is no date on the document to judge when they have these thoughts. For sure atleast by the Feb bulletin they have crossed the line by double even if one believes in demand destruction. By most estimates the intakes till 01-JAN-2010 would range between 35-40K. It’s a clear case of low demand interpreted as qualified or documentarily qualified is being used to advance the VB's. It’s good for all our friends waiting to file their 485's I sincerely hope this party continues but this could come crumbling down like a pack of cards anytime based on numbers. Also I wonder based on the link you posted earlier EB5 consumption is almost matching the cap thus far and EB1 is moving really fast on Trackitt, so our only hope this year is EB2 ROW which is the only category moving slower as of now.

From trackitt, no one form India or China have received any approvals this week. Only ROW cases approvals in past 2 days. They might have approved all cases filed in OCT (which is highly unlikely). Or... visas have been exhausted (I hope this is not the case). Just my two cents. I am no expert by any means.

This is for GC, so if ones case is filed after that date we cannot call them for status. Several cases after this date have been approved though.

Now, as per TSC, processing time is in March 2011, so if you are TSC, it's really unfortunate, you can try your luck after 4 months, if a senator/congressmen agrees. Mostly you will just get a letter from USCIS saying it's within processing times and your file is in review. If you are TSC, maybe you can just take infopass after 4 months, saying you want information on status of your case with higher level officer. The officers do give useful information like your file is with an officer, or is not with an officer yet, like you have passed all background checks etc.

But with NSC, if 4 months gone, I don't see why you cannot contact senator.

The processing times were just updated NSC is 4 months and TSC is still in Mar 2011 so effectively we cannot follow up since we are in processing times. belmontboy reported his approval on ** he is a Nov filer.

For I-140, TSC says October 2, 2007, seems almost unbelievable. For I-140, NSC says 4 months.

If we read the below extract
"If the office is processing a particular type of application in less time than our processing goal, you will see the processing times expressed in months (for example, if the office is processing naturalization applications in less than our 5 month goal, the processing time will state "Five Months"). However, if that office is taking longer than our processing goal to handle the form type in question, you will see the filing date (e.g., "April 10, 2003") of the last case we processed on the date the website chart was last updated. The charts are updated on or about the 15th day of each month."

Looking at the chart TSC is not meeting the national standards in terms of completion of application. most of the Oct and Nov filers have already received their EAD and AP's which should not have been the case as they are still processing August 2011 cases based on this update

I guess this dates signifies two things
1) The oldest case which was say worked on in the I765 Department @ TSC on the day of publishing this was Aug 11, 2011. Since this case lies outside the national average of 4 months so they have mentioned this date for I140 which does not mean they are not working on the new cases.

2) This also gives them the opportunity to stay away from Queries for the cases which are later then the date mentioned on the website. Although this gives an opportunity for the earlier cases to follow up

We all know people with RD in OCT have received their GC and EAD and AP' are also coming along smoothly.

EAD/AP no difference, but GC cannot be obtained without FP.

I saw my friend's EAD, and his starting date was the date of approval of EAD, not the RD.

March 2011 is just too backlogged compared to NSC. What I'm worried about is my case being a dependent went to TSC and tied to a primary that went to NSC. It is driving me crazy with such backlog with TSC , how much longer the wait may be for the file to get picked at TSC.

friend, can you elaborate on this a bit, what exactly did the L2 officer say. I am very curious as I am myself not got FP, almost two months its been.

Like I said before, our receipt numbers were not recognized in the system earlier. So, we were redirected to L2 officer. When I asked for status for biometrics appointment, he said NSC scheduling is pretty backed up(lot of people in the Queue). He said you are good because you are in the queue to be scheduled.

Did you ask about biometric status when you called?

On trackitt at least 10 EB2 Indians got 485 approved in this afternoon. All of them filed in NSC!!!One guy filed before Thanksgiving and got GC approved in 2 months!!! Unbelievable!

i guess one of the things that matter is - when did the applicant last enter in to the US... if the entry was 6 years ago then IO has to go through applicants history and make sure applicant was never out of status. if the applicant entered in to the US recently then it makes IO's task easier to approve the case...

Good case would mean where all processes and checks are completed. Most likely an officer would not be spending more than an hour on a case and if his / her support staff have flagged everything as ok. Now even though all service centers have their processing times some officers and some cases are always ahead.
Also some things do help like a) outstanding qualifications there are people with double masters and PhD also stuck up in EB2 b) People who have fewer job changes or lesser status changes to verify c) Filing is complete with all information (No need to issue RFE) d) cases where the sponsor is a larger company. I work for an IT consulting company for sure will invite higher scrutiny.
