I haven't received my FP notice and also no EAD/AP only received receipt notices for 485,EAD/AP from NSC.
NSC PD : 03-OCT-07,RD:14-NOV-2011,ND:25-NOV-2011,FP ND:??,FP AD:??,EAD/AP:??
I am kind of getting worried due to no FP Notice yet ...guys from NSC ..is this normal ...what should I do?? how long should i just wait before I contact USCIS?

Hi Soggadu - I would like to update but nothing yet for me :). Its very dissapointing to keep checking my SMS / mail every 30 min. My guess we should expect EAD /AP approval only Next year due to Holiday season. what do you think?.

Between - Any NSC in our forum who is waiting for EAD/AP

And also I would to add that getting an RFE is not necessarily a bad thing, they tell you exactly specifically what they want, the same letter can ask for multiple things, and that basically are the only things stopping you from an approval, and as soon as you get back to them, within a matter of days at times, depending on the period that is current and visa number availability, such cases are approved. A file which gets response to an RFE is taken back to the top of the pile by the officer. The RFE response is directly sent to the service center, and once its scanned in (you put the RFE letter on top of response), it gets back into the file with the officer. This is as per my attorney.

In our receipt it says you will get FP in 30 days. You have passed the 30 days rule why dont you call up them quickly to get an update

my aunty got her GC in mail today. after filing her I485 it took exact 4 months.

Applied Sep 22, Received GC Dec 22. Isn't that just 3 months. What am I missing?

Friends finally some good news from my side, just received emails & texts that AP approval notices were mailed today and card production has been ordered for EAD. Following are my details thus far.
TSC (PD -07/24/2007) - RD - 11/02, ND - 11/07, FP - 11/25, EAD / AP Approval - 12/22.

I also rcvd EAD/AP approval/CPO email on 12/22. Good luck all.

I'd say bad luck. Don't worry too much about it. Leo who's ND is ~Oct 06 got his EAD approval only yesterday. I don't think there is any specific order in which the applications are processed. Seems random. So, just be patient. Hopefully you'll get good news soon. All the best!

I am in the same boat as you. Seems like 2 months is totally normal. These people got their EAD/AP early :)

I'd give them another week or two. But, I do think it'll be approved next week though. Until then Have Fun. EAD/AP is a routine paper work for them, probably short on resources during the holiday season. if it makes any difference, mine got approved after waiting 71 days. I can understand the anxiety, nothing much we can do until we receive the cards. So, you have a merry Christmas and a wonderful New year.

Oh gr8. Atleast i see some one with me. Just that you are east and i am west. (I meant you are TSC and i am NSC). Lets pray.

I would always keep them extented as possible and not mix with 485 .... also apply for EAD/AP soon... what is stopping you to do that? it can be done along with 485 app...

I hope he really got it.
But I got the same message from USCIS and its usually a 'address' issue or some issue they want clarified.
There is no way one can get a GC approved without Biometrics done.

Also there are two kinds of messages you see.....

'Card production ordered' and usually that means GC is approved.
But if the mail says ' A document has been mailed' then its some other issue.....

Didnt mean to dampen your spirits but having got the same message i was momentarily happy but a quick google search got me into many trackitt threads who had the same mail and its usually some clarification USCIS wants.....

Yep comes in the mail.
Got to take the original on day of appointment as they scan the bar code with it.Has all your information there.

Not sure if there is a LUD.

Actually, our lawyer missed applying for EADs while filing for AOS and we were not aware of the fact until they asked us to file for our H1B extension. So we are left with an option to apply now.

My spouse is the primary applicant on our 485/EAD/AP application. The application is pending with USCIS. However, there is a funeral and she needs to travel to India within next 48 hours. I know that one should not travel on a pending AP due to risk of abandonment but she has a H1 stamped (validity till 2013). From what I have heard one can re-enter US if you a have a valid H1 even if you have a pending AOS/AP, etc.

Does someone know about it?

Main thing to worry is GC getting approved while outside without AP.
How long is your application pending? If you read in the previous page one guy got GC approved within 2 months without FingerPrinting.

The PD is in March 2008. You are right. It would take more time for her turn to come. My concern was whether she can re-enter on her valid H1 without abandoning the AOS. From the links you had mentioned (thank you for that too), it seems in case of H and L visa the re-entry does not abandon the status.


So I take that your PD is after Mar08. I don't see you getting approved anytime soon. So she should be good travelling on valid H1B.

Very sorry for your loss.

I wanted to know about this too. I asked Ron and he along with some other people mention that it is okay to enter on h1 B stamp if you have not started using the EAD as yet. If you are on EAD, then you have to use AP.

I suggest you check with an attorney and not seek help on forums. There may be information you have not said, or things forum ppl. assume.

I was also told that one can expedite the AP process..But I see you are not there yet.

How do you submit all the docs? My company has a designated law firm for legals and they do all the LCA, H1Bs etc.

Do you fill it online, take prints and mail it to the Lawyer. Then he reviews and mails it to USCIS?

Do you just mail it directly to USCIS?

Do you mail it to your company HR and then he/she sends it to the lawyer?

Do you submit info online (usciszoom.com etc) and lawyer gets and fills and files?

How does this work? Does the company pay for spouse also?

Fill your forms, take printout, verify info, sign it and send it to your lawyer.

Unless you are filling it yourself, meaning you are not taking help of any lawyer.
I think very few people file themselves.

Talk to your company HR- I don't think HR would want to see the docs before sending it to your or company lawyer. Lawyer must be talking to your Hr in case of he/she needs any company info/papers, employment letters etc

Depends on company policy, most desi consulting firms wont pay a dime not even for a primary applicant.

MD - Mailed Date ( This is the date when your attorney mail your application to Lock box)
RD - Received Date ( This is the date when your application is received)
ND - Notice Date ( This is the date where they will send you the copies of receipts)

Hello All,

We have completed our Finger Printing Today. Our actual appt date was 01/03/2012, but decided to do a early walk in and it worked fine.
ASC is located in FortWorth, TX. The entry office asked us why we could not make it next week, we said we have travel plans for the new year, our case was taken up to the ASC manager, he asked the same question, we said we have travel plans and I said I could cancel my plan and be here next week if needed. Manager said that they can do the FP today and did it.

The ASC was very busy and we were rejected in the morning and asked to check back in the afternoon. We went at 2 pm and were accepted for FP.

Now the question I have is, do we need to cancel the original appointment? Do they expect us to be present on the actual appointment day if we do not cancel it? Please suggest.

My FP is scheduled on Jan 9, 2012 and I am planning to on the same date.

Nothing personal against those who go earlier.

Is it really beneficial to go early? Isn't there a reason for USCIS to schedule it for a given date? Don't we give system a perspective in the long run that we are rule breakers?

I do not mean to offend anyone. If I do I apologize upfront but it would be really nice if folks do not abuse the system and folks with true emergency like family death, urgent travel plans, unforeseen events etc actually go and get the adhoc FP.

You raise a good question, but I think we don't have to do any thing, as we have already given the biometrics.

Urgent help please..We are relatively new to this whole thing. The only knowledge we have is a couple of weeks of browsing on this

What should this typically contain?

Husband is Primary applicant. I recently received an Employer Verification letter from my husband's company for my H4 stamping.

It basically says my husband is employed as an XXXXX XXXXX from <dates> and currently working as an XXXX in the client location XXXX and his annual salary is XXX,XXXX. His responsibilities include <bulletted details>

He has an ammended LCA with the above detials.


Or just a letter to state he works with this company and earns $ and <from dates> is enough without specifying client details

Should the job title match the original Perm or I 140? What happens when you gain certain other skills during the course of the Process?

I talked to my wife and she told me that the ACS manager had actually changed our appt date to todays date. So we are all set, nothing needs to be done.


You raise a good question, but I think we don't have to do any thing, as we have already given the biometrics.

Following are the current approvals of Oct Filers on Trackitt, finally new 485 approvals have started.
Starchaser, Abracadabra - NSC PWMB
Superman123 (Spouse only) - TSC
I believe that the approvals especially for Oct filers should pick up next month once fresh numbers for the next quarter are being allocated and current time being holiday season a lot of people maybe on vacation (Its noteworthy that EAD / AP approvals are coming fast). There have been atleast 10K approvals for the Jul 2007 / Pre Oct 01 filers this year. On Trackitt there are a good number of PWMB cases from Aug that have seen approvals. The Oct filers count should be between 2.5 – 3K hopefully most of them will get approved next month; even RD / ND will be significant besides PD.

She will loose H4 status only when she use EAD to work but not for SSN. you should be all set and best wishes

I did not receive any email. One fine day, EAD/AP was delivered to my mailbox.

By the way I cannot even access my application status on USCIS.gov using my SRC number. For some reason the website display's my application cannot be find and asked me to call customer service. Called customer service and they say my application is fine in their master database and it's not unusual that I cannot find my application status update on USCIS website.

MD - Mailed Date ( This is the date when your attorney mail your application to Lock box)
RD - Received Date ( This is the date when your application is received)
ND - Notice Date ( This is the date where they will send you the copies of receipts)

Looks like my EAD has arrived earlier this week, may be on Tuesday. I am out of town currently so I can confirm it when I get back next week.
Application Received Date is Nov 1st. PD is Oct 2007. FP appointment date and actual FP given date is Nov 25th.

I noticed this too. Good to see some progress. Approvals are still sparse. Hopefully as Teddy suggested, the pace will pick up next month when the next Q visa numbers get released. Fingers crossed.

You should have received separate receipts for EAD and AP too. So total of six receipts between you and your spouse. I think lawyers receives courtesy copy for all applications if you have filled G28 form for all three apps.

I have come across this in the trackitt forums ( Dependents getting approved sooner, both 485 and EAD/AP).So i dont think its unusual.Yours should follow in the mail very soon.

Are we seeing a delay in getting Receipts in hand each month as the filing window widens?
I have filed only on 12/20 and i know that i should not expect anything this fast
but as Soggadu would say
....Dil hai ke manata naheee.....
Xlate - the heart doesnt listen.
If its not too much trouble if people can add Receipts in Hand date(RIHD or something) that would give and idea. no pressure.

Quick question. I have mailed my 485 packet today 12/30/2011 to USCIS in USPS express mail. I have checked no delivery on week end or holiday, so that it does not get delivered tomorrow 12/31. Also I have written clearly on the packet no week end delivery.

I want it to delivered on 1/3/2012 which is Tuesday as USCIS has holiday on 1/2/2012.

Hope it gets delivered on 1/3/2012. Any one has any experience on Saturday delivery. if we mention it not to deliver some times USPS makes an attempt to delivery. I am worried about that.

One thing I'd like to mention is that the EAD cards had our pictures that were taken during Finger Printing. Also, the cards included our finger-prints on them.

All really depends on the kind of QSP that can be allocated. Now the SOFAD trend is not very encouraging so far, all Nov filers will be approved this FY but the process maybe quite slow. The Oct filers group is only 2K while Nov filer is close to 8K. It will take anywhere from 1 - 6 months for Nov filers approvals. The approvals will be quite random is the dates stay without retrogression, RD & ND will also play a role besides PD and of course NSC is faster than TSC.

if it's your attorney's questionnaire then you can probably ask him directly. I think you can answer as "N/A", since the secondary applicant is already in US and on H4.

RMS, you are welcome. I feel afraid in saying more of my views, as I don't want to give false advice, but my gut feeling is, that it should be fine that you are working in any other country, a person may work remotely or visit periodically etc., at the most you should be prepared to show letter from your overseas employer about employment details and show tax returns of the country in which you paid taxes for that employment. The thing to find out is, is there any tax burden on the applicant in USA if he worked for someone outside of USA.

I also think that the employment history asked for is to verify status and background check information, and if you worked for say something like a nuclear energy company in foreign country, etc, and I would be really hard pressed to believe they would be interested in knowing salary and tax returns of foreign employment. But definitely it gives something to the adjudicator to ponder over if he is scrutinizing.

I think the rule of thumb is:
- If your PD is current when they issue the EAD/AP, it will be given for one year
- If your PD is not current due to retrogression, then they will give for two years

I think the rule of thumb is:
- If your PD is current when they issue the EAD/AP, it will be given for one year
- If your PD is not current due to retrogression, then they will give for two years

hmmm...i m borderline case for GC ...from H1 renewal to EAD renewal...let the extension applications pervail :D

All really depends on the kind of QSP that can be allocated. Now the SOFAD trend is not very encouraging so far, all Nov filers will be approved this FY but the process maybe quite slow. The Oct filers group is only 2K while Nov filer is close to 8K. It will take anywhere from 1 - 6 months for Nov filers approvals. The approvals will be quite random is the dates stay without retrogression, RD & ND will also play a role besides PD and of course NSC is faster than TSC.

I feel afraid in saying more of my views, as I don't want to give false advice, but my gut feeling is, that it should be fine that you are working in any other country, a person may work remotely or visit periodically etc., at the most you should be prepared to show letter from your overseas employer about employment details and show tax returns of the country in which you paid taxes for that employment. The thing to find out is, is there any tax burden on the applicant in USA if he worked for someone outside of USA.

I also think that the employment history asked for is to verify status and background check information, and if you worked for say something like a nuclear energy company in foreign country, etc, and I would be really hard pressed to believe they would be interested in knowing salary and tax returns of foreign employment. But definitely it gives something to the adjudicator to ponder over if he is scrutinizing.

Thus far except for 1 case all approvals have been from NSC, TSC processing time is 6 months while NSC is 4. However irrespective of the processing time I think you should get greened in the next 2 months as most cases get resolved well within the timeline. Your date should also stay current even if there is retrogression. I remember your case since the trip is really long cherished its fine; EAD / AP there are normally no issues. If you have not booked your tickets then if you go after 2 months there is high likelihood that you will go with your GC itself. If there is a RFE your attorney can take care of it and you can correspond via email, you can check the online status hopefully.

I am kind of thinking the same. I don't have any urgency but am thinking if I get GC by Feb and if my company let me work-from home I want to go for 2 months. Don't want to go during hot summer in India.

Thanks Teddy for your quick and useful information. It's been almost 10 years now and want to take a nice long leave. I have not booked my tickets yet. I also talked with my attorney and she also replied along similar lines.

She also said if I go using EAD/AP then I can continue on H1B after my arrival back to US without stamping according to current USCIS policy. This was confusing to me as I thought I cannot reinstate H1B without H1 stamping.

My case status is still showing "not found". I checked all the case number ranges and noticed that, for cases >= SRC1290067724 (TSC) , the status is up to date. However, from case SRC1290067725 and above, the online database has not been updated. For NSC, the LIN numbers are getting updated and cases show up after a week.

Anyone else with a case > SRC1290067724 able to view their case online?

Got my receipts today (AOS only) but there is an issue. trying to see if someone is in the same boat.

There is a potential problem
My priority date is listed correctly.
But on my wife’s receipt her PD is listed as her own PD from her own perm from her company(which is not yet current).
I have seen posts where spouses PD was mentioned as the RD but not sure if i have seen something similar to my case.
I dont know how big or small the problem is all i care is we both get all approvals etc in tandem.

I am on the same boat. I called up USCIS 30 mins back and they told me there is some cleanup activity going on in the online system and the cases should start appearing in 45 days from the date they were filed. My case was filed on Dec 7th, so I am hoping that I would be able to check the status online in the second half of January.

It is now 1 month your AOS package received by (TSC) USCIS. Usually TSC send finger printing within month. I would suggest to you call USCIS customer service center to find out about your FP notice.

That just means that you can work for the current H1B employer with valid approved petition (EAD is not needed) but you do lose the H1B status.
Yes, you will have to leave if 485 get's denied since you entered as Parolee and not H1 holder.

welcome to the group dude... usually in 30 days after mailed date ( more in this case as this is holiday season ) you will get all the notices for TSC and with in 90 days EAD/AP will be approved

All applications are the same when the dates are current and numbers are available. Eb2 I/C special because we are SOFAD dependent to a very large extent, so approvals will be a little restricted compared to every other category for now.

T, was it for a dependent? I believe dependent's will get their AOS apps approved in less time, when compared to primary counterparts.
One of my cousin applied for AOS and after 2 months, went to India, got married and his wife filed 3 months later, but both of them were approved at the same time.
Her approval duration is close to a month.

So does that mean that the EAD card replaces the I-94 or does she have to leave the country and re-enter with a new I-94 ?

NSC is usually slightly slower on issuing FP notices than TSC, but faster for all other purposes. Hang in tight, it ain't gonna make much difference.

Is there a delay in NSC sending out the FP notices? In my case (PD: 02/22/2008), the RD of 12/07 and a ND of 12/13. I was wondering when should I expect the FP notices, considering the holidays? At what stage should I start thinking about opening a SR?

Given, same number of available visas and same number of applications with similar PDs ready for approval, EB1 and EB2 are SAME. However, we all know that there are more number of applications in one bucket for the same PD than the other. So, there will be some probabilistic advantage in favor of EB1.

Correct me if wrong.
Are EB1 applications given priority over EB2 during AOS ?

Thanks buddy! I hope you and everyone else gets approved fast. Since a large range of PDs are current at the moment; I have a feeling there will be a lot of approvals in random order (PD wise) - which ever file is taken up by an IO first will be tagged a visa number if they are approvable - till retrogression hits again and narrows down the PD range. Just my guess...

There may be some lucky ones much beyond Oct filers that could get approvals in next month or two. Be optimistic and Best of Luck!

Yes, hoping 485 is approved before any slow down of processing; Not expecting the cut-off date move to any earlier than April'08 even if any retrogression happens.

It all depends on lawyer's workload and speed. I would say matter of same day whenever lawyer gets to it. Have u signed or not yet. If not signed and this is just questionnaire n docs, lawyer will send to u for signing. So that back n forth will take couple days.

My lawyer's policy is to wait for RFE. He believes that amendments and additions get lost and anyways you get RFE. And sometimes what we think important they overlook and us sending stuff complicates matters. Also a RFE very specifically points what they want.

Hi, guys, finally my employer filed 485 for me and my wife. I already got 485 receipts. I noticed one problem. My priority date is correct, but my wife's priority date is Dec.29, 2011, which is the received date. Could I contact USCIS to correct this issue? I noticed some other guys also found the same issue. I wonder whether we should all contact USCIS to correct it.

This is completely fine, i have lready checked with my lawyer. Dependent application is always tied to the primary, once primary gets approved, the dependent applciation will also get approved. Congratulations to you for getting your receipts.

6. G-1145 (email of receipt when they get apps), is an optional form.

Based on your answers to questionnaire, he will fill out above forms, and will send them to review. Once you both are satisfied that all information is correct, you have to sign them at places mentioned by attorney. And then attorney signs in places mentioned for him. After this, he will add the initial evidence, which will contain sealed envelopes of form I-693 medical exam, a cover letter, proof of status, employment proof, marriage proof, birth proof, and others as applicable to your specific case.

In my case, attorney is local, I just went to his office with family, reviewed forms and signed there and then, but many times attorney overnights fedex or courier to you, you sign and again overnight courier to him, so that takes a couple of days more.

i know exactly what you are going through. I had sent finalized signed docs on the 6th Dec and my app was mailed on 16th Dec, and this when the dates hadn't even moved that much. Took them 10 frickin days for EVL and checks from the company which they knew they would need like a month before. From what I gathered some lawyers have target dates for filing (mine had decided to file before holidays), and thats the date they meet. It kept me awake and angry for a few nights. All I can tell you is no point in bothering them.

what you can do is ask your HR if EVL and checks have been sent, that will cover atleast all requirements from the company?

I need to travel to India sometime in March I want to get this finger printing done. My child is in India. Need to go get her, but I am kinda stuck. Crazy you know

Who receives the FP notice, EAD and AP cards? The lawyer, company or individual? Do we have to check on anything specific in the G1145 or G28 to ask USCIS to mail the docs to my husband?

Because I was traveling overseas for the company I could not file in the month of Dec. Will that have any effect on my application?

Druvraj, from what I see on signatures in this thread, on an average, FP notice comes up about in 3 weeks. The appointment date on that notice would be another 1 month away. You can try pre-poning it or go in for an early walk-in explaining your travel plans.

Filing in Jan will not affect your application just because you missed the boat in Dec.

I am trying to do that but no response.
She is described as dependent because in dec she was not current.
As of 1st feb she will be(pd jan 2009).
I positive thing is that if there was a confusion at the time of receipt that its a separate application, it wouldnt have been accepted as her date was not current.
May be i will be the first one of the multi-filers who can guide others.
Hoping for the best.
No EAD/AP receipts yet...of course no FP notice either.

i Just use Receipt in Hand(RIH) but its ok whatever you use, help us know the tred.

For me it took more than 4 weeks from RD and I got EAD/AP approval email a day before I got my FP Notice.

Anyone else with NSC have not received the FP notice? I have not..

EVL = Employment Verification Letter i.e. Letter from employer that the job is still available for the salary they promised while filing I140.

No I dont think that letter is the same. This is a letter to state that the job is present at the minimum PWD salary. checks are the fees for processing the applications if your husbands company is paying for it.

1) Not sure of way around but I think it's kind of not mandatory. Just provide whatever docs you have related to your student status. See if you have opt card.

1) Can you contact your college? Hopefully, they have a copy?

(1) This is required as per the attorney. I had to jump through lot of hoops, contact my old schools and get my I-20s. My attorney told me if I couldn't find, there's nothing we could do and file our app with what we have. But, in the end I was able to find. So, bottom line is, try your best and leave the rest.(Gita?? :)) Contact your schools and your old employers there might be a way you could find a copy of it. If you don't find the I-20, you'll at least make some contacts which could help defend an RFE, if it ever comes to that.

(2) Most recent I-94 is what's needed. Your record of last entry into USA.

Hi Guys- had a couple of questions. Hope someone can answer these pls. I tried to look on the blog but didn't find an answer.

1) For filing AOS form, i see that they want a copy of the I-20. I have been out of school for over 9 years and no way i have a copy of the I-20 that I had when i was in college. Anyone have similar issue? what is the way around this? pls advise.

2) I-94 form- we only need to send a copy of the most recent I-94 card right? again, we as get a new i-94 card everytime we enter the country and give it back everytime we leave, i didn't make copies of every i-94 i have ever got. Any thoughts?

She is described as dependent because in dec she was not current.
As of 1st feb she will be(pd jan 2009).
I positive thing is that if there was a confusion at the time of receipt that its a separate application, it wouldnt have been accepted as her date was not current.
May be i will be the first one of the multi-filers who can guide others.
Hoping for the best.
No EAD/AP receipts yet...of course no FP notice either.

"We will inform you as soon as your documents arrive. AP usually comes to our office about a week to 10 days after approved. EAD approval notices and the cards should go to your home

I thought it will be a combo card or both AP and EAD will come to my home. any comments

It depends on what your attorney had filled in as the 'delivery address' for EAD/AP. In my case, just as yours, it reached my attorney and they FedEx'd me for next morning delivery. So, nothing abnormal here. Yes, it's a combo card.

They are giving out EAD with 2 yr validity now ins't it? ( In fact heard its a EAD/AP combo card)

sun, this is rule of thumb they follow:
1. if you are current, they give 1 year EAD
2. if you are not current because of retrogression, they may give 2 year EAD. This would mostly always apply to renewals, unless your dates kind of retrogressed the next month itself after you applied.

Typically lawyers represent[we authorize that on form G28] us so these go to both places. Good to be in constant touch(not to the point of irritation) and in sync with lawyer.

Thanks for sharing. This is news to me, I did not hear the same from my attorney though.

Guys, in simple words, this is my understanding as well as my lawyers. My lawyer is not a big shot like fragoman etc, but he is very nice person and has really good knowledge, and has always obtained success for me.

- just legible clear photocopies of birth certificates, marriage certificates, passports and so on
- affidavits or any sort of certification (like translation certify) must be "wet" in form and signage, meaning original and signed by applicable parties in original
- anywhere you are providing an application or form to them, and you or lawyer are signing, the signatures need to be "wet" signatures, no photocopying of forms

Right, I completely agree @ the officer level, they go by a memo. I'm thinking there would be a internal memo as to when they should start giving out a 2 year EAD/AP.

I just spoke to my attorney,my earlier question to him was whi will get FP notice the answer to that is both. I also got AOS receipt.
Apparently EAD and AP receipts only went to my lawyer.

Risk as I see it is obvious:), if you lose the primary job you are in a soup. because EAD is valid only for 12 months. If your employer revokes your 140??

Can the employer revoke I-140 and stall the GC even after the 180 days rule?
