I received combo card and can track both status. Spouse received a combo card and can only see EAD status and no AP status.

Online status thing is crazy. As long as card is received; that's what matters!

Gurus - I have a Quick Question. "Taking Infopass will delay the I-485 approval process?" More than one said that their attorneys told not to go for Infopass appt. and that is not advisable... Gurus - pls share your experience ...

BTW, i am the NSC - dec filer still waiting for the approval and thought of going for infopass this week ... Its already more than 108 days ....

Just called USCIS to check for my reciept number. I told them my wife (dependent) got the EAD/AP approval and combo card last week and I am still pending.

She said she is not sure why that would happen - someone must have pulled the wrong file from the shelf..our normal processing times are 90 days and it is too soon that she got her EAD/AP considering that the applications were received on February 2nd.

What should I make of this?

It only means you need to wait. Ther is not way they will revoke wife's EAD. But I am a bit puzzled - even if wrong file was pulled .... I would';ve thought that primary and secondary are all together. Apparently not!!

RFE:

Got a text for an RFE on my case/primary. Text says additional evidence and no alerts on my dependents. Puzzled what it can be ... my company lawyer had submitted a letter from company mentioning mine and dependents 485's are being submitted but it was not an EVL ... could it be that. I am more tensed then before ... anxious to see actual text.
I live 45 miles from my service center ... hope i could go and collect the letter myself :-)

It's a blessing in disguise. You got a RFE but it means they are working your case. Usually it's pretty straightforward to address an EVL issue.

viz is right.... now until may 01... people are lucky if they get an rfe... for sure their case would be worked on before they close the gates...

Background checks take 30-45 days to complete. I don't know when the clock starts ticking (and I asked this question before). If you are a Jan filer, its going to be touch and go before may 1.

It took 6 days for me to get the RFE details by physical mail. Received RFE alert on Sat Feb 11, RFE physical letter was received on Feb 17th.

longgcque, it could take as short as few days to perhaps a week or so. Personally, I got an RFE alert on a Thursday and got the letter in the mail on Monday and my lawyer got it on Tuesday. Try to submit the docs asap after you get the letter. Are you NSC or TSC? NSC folks get faster responses...

Mine is NSC. I am expecting to receive/see the letter on Saturday 3/17 .. as alert came on 3/21 .. so 3 business days from there should be good enough for me to receive a letter .. I hope it is not a tricky RFE for me and I will respond back asap.
I have 3 dependents on my case .. they had no updates as of now .. what does that mean? Are there cases OK? Have there files been touched and are OK ? I had not so perfect NABC submitted for my wife alongwith affdavits/school docs etc .. so just want some opinions on that ... I understand no one knows for sure when they can open a rfe for any case but just looking at the pattern so far.. is it ok to guesstimate that dependent files are ok if only primary gets rfe ...

Thanks for the link. I called the FBI FP check at 304-625-5590. I had my FP done on 01/26/2012 and they said result was sent to USCIS the same day.However they gave me a different number to find out about Name Check and Background check which is 202-324-2399. But when I call this number it just tells me to check the website www.fbi.gov and frequently asked questions.So no luck there.
Is there anything else I can do to see if Name check and BG check is done??Please help.

Today, we can see my wife's EAD/AP status online and it says cards mailed. I still cannot check my EAD/AP status online. Any estimates about how much time it takes to approve a spouse's case? Or, are they treated as two seperate cases and approval of one has no bearing on the other?

My wife's EAD arrived last week and my case's status was updated to "Card production" today stating that the card was mailed yesterday. Yesterday the case status was not searchable/found on USCIS website.

Going by my experience, I can say that the applications are probably not tied. Best of luck. Hope you get yours in a week's time like I did.

I assume if you go overseas and return on AP, you still get an I-94. Is the I-94 even relevant?(If this is wrong then no need to read further :D )

In such a case, the I-94 would probably be valid till the expiration date of the EAD card. Now, when you renew the EAD/AP card, do you need to leave the country and return to get a new I-94 ?

With H1, you get the I-94 with the I-797 approval notice but with EAD, you don't.

How does this work?

I had the same experience, my spouse's EAD/AP were approved on 9th March and he got the physical cards on 15th March. I could finally see my case status online yesterday for EAD. So it was around 10 days after my spouse got approved. Looks like the cases are being processed randomly.

I don't think the AP/I-94 has an expiry date when you are paroled inside the United States other than admitted under any visa category. In this case the I-94 marks only the arrival of the AOS beneficiary . So, in my opinion there shouldn't be any end date to the AP/I-94 as long as I-485 is pending.

Unfortunately, I don't really know the answer to that... :( typically if dependents were to get RFE, it seems like they get it at the same time as primary. There are cases where primary is approved and dependent gets an RFE a few days later. If you don't see any update on their case for RFE in a few days, maybe they are ok??

IF the dates do retrogress prior to your PD (07/31/2007), u can still come back on EAD/AP (if you don't want to go for visa stamping). Also I strongly believe that the dates will not stay retrogressed (at least until your PD) before this FY is completed - pd's in 2007 will be history and that dates should move to somewhere in the 1st quarter 2008. This has been adequately discussed by the gurus in the past.

Good luck though, I sincerely hope you get your approval before your India visit.

On my notice it was 485 and 765. For my kid we did not apply for EAD and her notice had only 485. But interesting thing is we received our cards today (FP was on 3/8/12) and both cards did not have any finger printing - it has a small holographic image with 'FingerPrinting not available' marked on it.

It doesn't matter. You don't need FP for EAD anyway. I've seen notices written both ways. I think it is a service Ctr thing.

Essenel, I think you are right. I have seen couple of my friends who got RFE's and their dependent's didn't get any. Once, these guys were approved, their dependent's got approved as well. I got an RFE on Feb 7th, which I replied on March 19th and my wife didn't get any RFE so far. I hope, everything is fine with her documentation.

Kumar, even if the dates retrogress, CO has said that "he will likely retrogress India and China-mainland born Employment-Based Second Preference priority dates to around August 2007". So it looks like he is not going to retrogress to before Aug 2007. Retrogression of dates may not affect you. You will need to go to the CS again with the package, get the flu vaccine, CS will give you the package with updated form and you submit it as RFE response.
If it's just flu vaccine issue, there's no reason for not approving the case after submitting the appropriate response.

You will need to go to the CS again with the package, get the flu vaccine, CS will give you the package with updated form and you submit it as RFE response.
If it's just flu vaccine issue, there's no reason for not approving the case after submitting the appropriate response.

I didn't have Flu shot. I got my EAD/AP card yesterday. Even if I get RFE on this for 485, I won't be worried too much.

Point 2 is not a problem. Even if you travel by air they don't take the I-94. I travel once a month to Canada and my lawyer request me to retain I-94. There something called Automatic Re validation and this is legally allowed

Update from me:
I can see spouse's EAD/AP approved since 3/22
I can see my EAD/AP approved since 3/24.
Our RD was 2/2/2012 and ND was 2/6/2012. PD was 4/1/2009.
FP was done 3/14(Not Early-walkin).
Service Center was TSC
Receipts Nos. are in the SRC1290144XXX range if anyone is interested:)

Did anyone hear of any 2009 PD getting a GC yet? What are the odds that before the retrogression kicks in there will be some outliers from 2009 who will sneak in. I was skimming through trackitt data and looks like approximately 1 in 5 of Jan filers have been processed to one degree or another approximately all the away upto end of Jan receipt dates. Theoretically, if the retrogression happens in May bulletin it would only kick in from 1st May so there are still 35 days left for anyone who has filed to have a fair chance, especialy if FP/BC get completed without any issues. Just trying to see if there any believers who think we might see some of 2009's getting lucky. Any thoughts?

Theoretically, if the retrogression happens in May bulletin it would only kick in from 1st May so there are still 35 days left for anyone who has filed to have a fair chance, especialy if FP/BC get completed without any issues. Just trying to see if there any believers who think we might see some of 2009's getting lucky. Any thoughts?

Should It take that much Time. FP is for FBI to process fingerpeint and name check. Quote from FBI site: The majority of name checks submitted are electronically checked and returned to the submitting agency as having "no record" within 48-72 hours

That is not an indicator of whether or not BC is done. That doesn't mean that is hasn't been completed.

kramacha, your RFE response goes back to the same officer who was adjudicating your case, so the officer does not need to re-verify everything. When the RFE response is received, you regain your place in that officer's line, so adjudication after that usually happens quickly (generally couple of weeks or so).

I guess this does call for a little panic since USCIS updates the 'card delivered' message after a considerable amount of time (anywhere from 12-24 hours) after it is actually delivered. You might want to call their 1-800 number to check up on that.

You can call USCIS to get the tracking number for the EAD delivery and check the delivery status.

"I have a follow up a question. Applied for my wifes SSN and recieved it. She is moving from ITIN to SSN. During tax filing when using her SSN to efile (turbotax) asked me for last year AGI. I used the AGI from last year for both but got my filing rejected. I googled the issue and some indicate that they used $0.00 for spouse AGI and Last years AGI for self and it went through. Others indicate that they still got rejected. Does any one here attempted to e-file after switching from ITIN to SSN? How did you address this issue."

I'm actually happy that they are retrogressing the dates. Hopefully, at least then, they'll process applications of all those that are left-over in the previous months. My only question is why not retrogress the dates in April? They could have very well done that. Apparently, TSC is still processing applications from June 2011. So, when there is such a bad back-log and limited quota, I don't see a reason why they didn't move the dates in April. They recognized that the movements/approvals trend was unsustainable and yet decided to keep the dates at the existing level instead of retrogressing them.

This exact same thing happened to me. I just set it as 0 for my wife the second time and it went through. By the way, I was using TaxAct.

Did you file "married filing jointly" this year and last year? If so, it shouldn't ask you for two different AGIs ? If your wife is switching from ITIN to SSN, you can put "0" as AGI for your wife. I'm not a tax accountant but am very familiar with tax code.

As a separate matter, you should go to the local SSA or City Hall and make sure that the ITIN and SSN are linked properly. This drives credit history and stuff.

Indian consulate BC is not recognised and also your's is late registration.... i would say get 3 affidavits each and send them along with old BC copies you have already submitted...
Take a letter along with 693 from doctor mentioning the same reasons you mentioned... might be they didnt accept your BC's which caused them to issue RFE for other age related vaccines... my 2 cents...

i always encourage all my friends and everybody else to put 3 affidavits in all cases... it wont hurt...

BTW I was talking to my attorney today and he said it is not completely impossible that you will get your GC by Apr 30th. It seems now it is totally luck - who picks your file, how straightforward your case is etc etc.

He also said that since I applied on 1st Feb and haven't heard back from them so it implies Background check, name checks are all fine.

Generally you need the same pin to exile next year but you can always get a new pin with the SSN and AGI. IRS has a micro site and TT will take you there.

Dont Worry Buddy, My sons AP was delivered to my attorney Yesterday. They callled me and informed that they recieved it. No news on mine and Spouse. Check with your Attorney. It will be with them...

So I finally got my EAD in hand. *throws hands in air and shouts yayyy* Ahhhh what a relief. The super smart mailman had put my card in someone else's mailbox. I got hold of him today and asked him to open all the mailboxes and check !! He did that and found it in the neighboring mailbox. Felt like giving him an earful but controlled myself as all my future mails are in his hands :) Though I have a valid H1 and dont need EAD to work, it has been stressful for the past 3 days, calling up USCIS, lawyer, going to USPS, tracking down the mailman. Glad its over. Now I hope I am the lucky one to get the GC by April 30 as a compensation for this lol.

Sorry guys, have been tied up with work in the past week or so...so less activity here. I have been checking my 485 recepits everyday twice and so far there is no movement there. With reachme_s's progress I am starting to have hopes of it working sometime soon; although, as a lot of people have pointed out, luck is going to matter a lot on who gets in in these last 33 odd days left before the retrogression kicks in. i dont think you will get a new card per say... but the restrictions on your existing card would be removed in the system...

time will tell but if not in April then you will get it in the summer. Won't have to wait till Oct.

RFE was asking for an EVL. Recd on 3/26, responded on 3/27, status changed to RFE Response review by EOD 3/28.


Mine is NSC. I am expecting to receive/see the letter on Saturday 3/17 .. as alert came on 3/21 .. so 3 business days from there should be good enough for me to receive a letter .. I hope it is not a tricky RFE for me and I will respond back asap.
I have 3 dependents on my case .. they had no updates as of now .. what does that mean? Are there cases OK? Have there files been touched and are OK ? I had not so perfect NABC submitted for my wife alongwith affdavits/school docs etc .. so just want some opinions on that ... I understand no one knows for sure when they can open a rfe for any case but just looking at the pattern so far.. is it ok to guesstimate that dependent files are ok if only primary gets rfe ...

Of course your wife can use her EAD without any issues to the application but again being on EAD means that you both are solely relying on the I485 app to maintain status (unlike being on H1-B to which you could fall back on if something happens to the 485 app). But the answer to your question would be Yes.

Guys, My PERM application indicated that my job title since June 2008 was Software Engineer, but the I-140 application indicated that the job title has continuously been Product Manager.

I got EAD card this week. If I want to switch jobs after 6 months and invoke AC 21, will I have to go back to the PERM title or can the title be the one mentioned on i-140?

I hope I can take the latter title because I have not touched software development since Dec 2008 and am kind of out of place in that.

Thanks Bloke, the link that you mentioned is for the other site, it gets asterixed here, but I got it. Also got some useful info from murthy site. You can come back on AP and work for H1 employer but your status wil be parolee. You can still file for H1 extension and after the extension approval you are back on H1 status. Hope this helps.

:-) Good question - considering that this year was our first Big Ten Championship after some 16 years, I am happy regardless of the postseason results. Losing to Ohio sucked, but I don't mind OSU in FF - I like Sully especially - although I think your coach had no business losing to MSU at home and losing to us in Ann Arbor - you should have won B1G outright without much trouble with all that talent.

The Department of State (DOS) provided the Murthy Law Firm with confirmation today that, effective March 23, 2012, the EB2 cutoff date has been retrogressed internally to August 15, 2007. This means that the USCIS will not be able to approve further EB2 I-485 cases with priority dates that fall on or after August 15, 2007 at this time. Theses cases can be processed, but not approved, without visa numbers available.

AFAIK - they don't mean anything once you have your GC. Your status changes to Permanent Resident and both EAD and AP become redundant/not-necessary. You don't need to specifically surrender it - just file it as a reminder of all the pain and waiting I guess.

I think it is just a matter of couple days for you guys. They are issuing EAD to Feb 1/2/3 RD for last 2-3 days as per trackitt. Just today couple applicants with 02/01 RD got EADs issued.

This is an ODD situation. When your 485 get approved Your H1 is Over and her H4 also. Unless her 485 is approved or RFE issues she si out of status. COnsult your attorney. MOstly her 485 is approved, but not showing the status...

Theres no way they know how much SOFAD will happen this year at this point in time and I mean REAL numbers as opposed to forecasts. So they will wait until Q4 to really get a sense of SOFAD. The calculations by the gurus indicate that we will land in Q1 2008. Since we are not there yet, I assume there is still SOFAD left.

The status thing comes into play only till an application is filed with USCIS and as long as the case is pending, there wont be any out of status issue.
Also mostly dependents cases were approved along or with in few days. There is no reason to reject a dependent (unless fraudulent marriage etc) when primary is approved.

According to the Rep the EAD paper approval copy was sent along with the EAD card (but as a separate mail - regular mail). Similarly AP paper approval copy was sent thru Regular mail on 3/3.

The thing is i received the card but not sure how all 4 approval copies (2 for my EAD and AP, 2 for my wife) got lost.

I'd received receipt notices, fp appointment notice without any issues...Really surprising....I've not changed addresses too

Can anyone think of something else?

We received the approval notice 10 days later. I recommend you to call the customer service. If this is the first time you can follow this short cut otherwise ignore.

Call 1-800-375-5283;
Press 1 to continue in English;
Press 1 for immigration services;
Press 1 to check the status of an application;
Press 2 if you don't know your receipt number;
Press 2 to connect to a USCIS representative;

In my opinion speaking with L1 is a waste, they speak like worn out cassette tape.

The most obvious reason could be, it was put in someone elses mailbox. I would try to get a duplicate. I know you can but don't know the process. Perhaps the customer service chaps can help with that.

Just wanted to update that I have physically received my EAD/AP card in hand today :).

This puts an end to nearly a year of uncertainty and anxiety. Last year, around this time, my most-recent employer announced they will be shuttering local offices by March 31st 2012. I was in a peculiar situation where most-recent employer had gotten 1 year extension to the H1B based off previous employer's PERM filing (I had not waited at previous employer till I-140 was approved). The most-current employer did not file PERM on time because of which futher extension of H1B was not possible. I was facing the prospects of having to leave my family and US and work in India for a year before coming back on fresh H1B. I was getting ready to leave in February to join an employer in India and resigned from my most-current employer, but Jan bulletin was a relief where wife got current and we were able to file I-485. For us, getting EAD/AP was more important than the Green card itself. I want to express my heart-felt thanks to all the members in the excellent community. While not a contributor by any measure, I have been an avid reader since the last 4 months and information gleaned from here has helped us make the right decisions. Again, thanks to all members of the community. I shall go back to lurk mode now.

Congrats! Just one thing...check with your lawyers at your new company. You may need to refile parts of your 485 IF you are the primary. Good luck in your new job.

I received my physical EAD card and I got an email that my wife's EAD is approved as well. When I verified my EAD card found that the card has my details but it has my wife's photograph and her signature.

It looks like I need to return the card and file the EAD/AP form without fees. Can some one confirm it?

Also if I file this does any one know how long it will take to get an EAD.

I appreciate your help. Looks like our friends in USCIS are quite busy :)

I am 90% confident that once you have an approved I-140, that's your bible. You don't refer to PERM again.

As per the below law, they cannot use more than 27% of the visa numbers in ONE quarter of the FY:


Immigration and Nationality Act Section 201(a)(2) employment-based immigrants described in section 203(b) (or who are admitted under section 211(a) on the basis of a prior issuance of a visa to their accompanying parent under section 203(b)), in a number not to exceed in any fiscal year the number specified in subsection (d) for that year, and not to exceed in any of the first 3 quarters of any fiscal year 27 percent of the worldwide level under such subsection for all of such fiscal year

So, can we safely conclude that they have not used MORE than 54% of the visa numbers for EB2I/C for the FY? Does that mean we can see some approvals for EB2I/C in April?

This recent new of internal retrogression puts many of us who have their RFE's reviewed in an uncertain spot or in a very stressful situation.
I responded to my RFE 1 week ago and am still waiting. What happens now? Am I assigned a visa #? Why ask for a RFE if my application doesn't have a visa # assigned to it yet? For Pre-adjudication? Will they ask for another RFE later (such as employment verification ?)

This is such an ambiguous region. Any insights would be great!

I have exact same question as my case is in RFE response review for last few days. When RFE is issued, do the case get a visa number assigned ? As I understand, they can use a max of 30% of yearly quote in any quarter and not more than that. So till end of march/Q2, they should have used max 60% and so its kind of wait n watch for next 3-4 months and in last 1-2 months they/CO will have a clear picture on how much visa #'s are remaining and can be spilled over to I/C EB2 ... This recent new of internal retrogression puts many of us who have their RFE's reviewed in an uncertain spot or in a very stressful situation.
I responded to my RFE 1 week ago and am still waiting. What happens now? Am I assigned a visa #? Why ask for a RFE if my application doesn't have a visa # assigned to it yet? For Pre-adjudication? Will they ask for another RFE later (such as employment verification ?)

This is such an ambiguous region. Any insights would be great!

I am not expert, but my read of the law is that 54% of the EB2 category have been issued for the FY. So, 46% still remain. However, that does not mean that EB2IC has claim to much of it - we have already spent our yearly quota - how much of that 46% remaining of EB2 we will get will depend on how much of that is consumed by EB2ROW. I believe the impression already is that we might not get any more spillover from EB1 for the rest of the FY.

I don't believe that an RFE gets assigned a visa number. Actually, I am pretty certain that visa number is only assigned once RFE is processed successfully (and a visa number is available at that time).

I have exact same question as my case is in RFE response review for last few days. When RFE is issued, do the case get a visa number assigned ? As I understand, they can use a max of 30% of yearly quote in any quarter and not more than that. So till end of march/Q2, they should have used max 60% and so its kind of wait n watch for next 3-4 months and in last 1-2 months they/CO will have a clear picture on how much visa #'s are remaining and can be spilled over to I/C EB2 ... Per my thoughts, we should see some approvals in april.. for few lucky ones .. and the dates shall again move in july/aug and we should see approvals from that point onwards ...

nayekal - first lesson - if you say it so explicitely then that could become an excellent ground for cancelling your underlying 485. because then you establish the intention to change jobs even while you are filing 485 in relation to the first one. Just something you need to be careful about. Don't mean to scare you.

In general 485 EAD AP AC21 Address Change are all things where you absolutely don't need atttorney representation. In fact you don't need attorney for 140 or PERM either. Within 2 months of getting GC! However I wouldn't encourage you all for the same. Do what you think is right. Somebody posted that the 6 months (cooling !!) period starts after filing 485. That makes perfect sense to me.

BTW new employer didn't ask for 140 or anything.

I don't want to be in a position 10 years hence where I say " I should have". There might be a situation in June that I might not have an assignment. If I have to change employers I would like to do it right. My question is less about renewal and more about cooling period that I might have to prove similar to q and ur exchange above.
Though I read on murthy site I believe that only card expires and it's not like applying for Gc all over again.

Irrespective of the retrogression you should get greened this FY maybe in some months once the dates move forward again. So you may like to evaluate your decision based on that. If your attorney is a company attorney then you must definitely fire him / her by submitting a new G28 indicating either a new attorney or blank in case you wish to represent yourself. You have a very long delay between the RFE received and the response review was it a complicated RFE or just attorney or document gathering delays because it is where the timing was critical unfortunately within the last week RFE cases have frozen, my own was also just in time.

I went through the instructions they are mainly concerned about criminal activities / arrests. Documentation requirements are pretty basic. I understand your concerns stem from Lawyers and employers not sharing all information. We can probably give a shot filing these applications on our own without any attorney.

Unfortunately it’s a pain to get anything from the law firm and at times no avail even after several emails and voice messages.

You are entitled to get anything post 485 since it belongs to you. The firm must respond to you since they represented YOU not the employer as far as 485 and EAD and AP were concernd.

I made another attempt post GC to get my documents (Actual Filings) from the law firm but of no avail, so if we really don’t need these then probably I will just move on. Unfortunately it’s a pain to get anything from the law firm and at times no avail even after several emails and voice messages.

Teddy, They have asked me to get Non Availability Certificate for not having Birth Record and it took me 3 weeks to get it from India. Also, I received RFE details after a week of RFE status update. My attorney was on vacation the following week after I sent him the document.

If 140 isn't really required post GC then Ok, I remember someone told me that I can get 140 doc under information act. Not sure about the procedure but would like to give try.. just to have the document.

I got my texts early morning for EAD and early evening for AP. Emails were already in my Inbox when I checked immediately.

This cannot be true otherwise you wouldnt see Jan filers getting greened.

Whenever you join a company in US you are required to fill this for out.

They cant do much after you got GC. Anyways you can wait till the date of current H1 approval (which should be in I-9).
Also maintaining I-9 is the responsibility of employer, they will get back to you when your H1/EAD is about to expire

You don't have a choice in HR-related matters. When you joined, you absolutely filled out an I-9 and used your H1 credentials as work-authorization. Typically, when your current "status" is close to expiring, HR will ask you to fill out a new I-9 with supporting evidence of work authorization. This can be H1, EAD or GC.

The moment you got your GC, your H1 and EAD are no longer valid. Therefore, it might be incumbent on you to inform your employer that the documentation used for your employment previously is no longer valid. Check with HR. This is employment law and goes beyond signing contracts.

I believe, that is only for processing times and if the case has been processed, stll the case will stay in the same status until the PD becomes current. When the PD becomes current, they can approve the case. This is same 4 months processing time for NSC for I485 without an RFE, but will not approve the case until the PD is current.

One question on spouses working on EAD..Me and my family got H1/ H4 stamped till 2015

I read that the moment they use EAD for working their h4 status ends..so if we need to go out of the country and come back, would it be like I enter on H1 and she using AP to enter?

It looks like a weird situation as AP is only for an year.. Can she enter on H4 in someway?

After several attempts i got the very good officer today and he told me that my case has been pre-ajudicated on Mar-26 ... What that means??
Is all my bg,namecheck everything completed and ready for approval? I mean my appln. is waiting just for visa number now ??

Thanks for your response. For I-485, you can open SR if your application is outside of their normal processing time. For NSC the processing time is 4 months.

Does one get tax exemption for a mortgage on a home owned abroad? What if we have mortgage on both home here in USA and in India?

Folks - finally got the EAD Approval today. I have been waiting for it - NSC took its own sweet time. Now, I am going to put the GC process on back burner until Jan 2013 when I expect my date to be near approval again.

I think the norm so far has been a 1 year EAD. I certainly would not begrudge a 2 year one - but considering that the renewals are free and relatively hassle-free, I am okay with either.

Thanks. I think the link between FP and EAD is co-incidence. In NSC, the 55 to 65 days time period for EAD approval seems to be holding and FP appointments are usually falling around that.

Ramcha, most likely you will have to wait till new quota visas are available for approval if your PD is no longer current .

Since dates were moved till 2010, they got a overload of 485 applications versus the available visas. Now if they process using received date, then it could happen that applications with later priority dates get visas before applications that have an earlier priority date: As an eg. Lets say an applicant 'A' has a priority date of Jan 2008 but this application was received on Feb 2012 as his attorney was busy with other things. Meanwhile other applicant 'B' with priority date of Jan 2009 has a received date of Jan 2012. In this case 'B' would get a VISA and A will be waiting.
If this is a one of case then its fine, but if this is an overwhelming scenario, then in order to process according to priority date, they would have to retrogress the dates. Even if ample VISA numbers are available.
This is just my feeling. The Gurus here can comment on this please.

If the PD stays current for a while immediately after applying I-485, then B will get GC before A. If the PD is retrogressed and later brought current, then A will get GC before B. In both the cases USCIS processes applications purely by Received date only. Retrogression plays no role during the phase of Pre-Adjudication.

Yes once application is received, it gets processed using received date. In a normal processing scenario, the application window is extended only a couple of weeks. This makes sure that even though the applications are processed by received date, there is some semblance of an order given to their priority dates as well. But this process gets broken if the application window(priority date) is extended by couple of months or years. Which had clearly happened when priority date was made current till 2010.

One of the objective was to get in enough applications so as not to waste VISA numbers. Having achieved that, now USCIS wants to restore the processing order.

Don't worry - there have been instances of mixup between USPS and USCIS - essentially USPS providing "undeliverable" for your address to USCIS by mistake. Since you already have the GC, in my personal opinion, there is not much risk in you calling up USCIS and getting this cleared. Search this thread for the last case of similar "undeliverable" message - I remember that it was resolved without any problem.

CPO for spouse EAD/AP after long time, My son AP got approved in Mid March, Mine EAD/AP (Primary) on March End and now spouse got EAD/AP . Best possible in current scenario. Can visit INDIA after 4 and half years....
