Folks, I got my CPO email yesterday evening. :)
This forum has been incredibly helpful, not only in terms of learning about the process and understanding exactly what is going on thanks to top notch analysis, but has also been a place to share our experiences and go through the GC journey together (and vent when necessary (which has been often!!) )

With regards to my applications, I've given up hope that I'll see any change to their status any time soon. I feel that USCIS has some internal target to complete atleast X% of applications from every month and move on to the next month. Maybe, if & when dates retrogress, they'll go back and work on the remaining (100-X%). We'll see how it goes. Thanks for your wishes.

Many congratulations to you and your family. It was quick for you post RFE response review. Enjoy the moment. For me and Tackle it’s really our luck now, we need our officer to look at our cases more than anything.

IMHO no one know how or in what order the applications are processed. This pretty random, I guess.
It's frustrating to see the finish line and just not able to touch it.

This link was posted sometime back , but I am reading it again and again for better understanding. Below given para explains why some application takes long to get approved.
from adjudicator's Q and A
There are storage shelves in each section of the building that house the boxes full of applicant's files. These shelves are continuously replenished as boxes are removed by the officers to be worked or turned in to be further processed after being approved. This resupply as it were is handled by the CIS contract employees.
So as a Adjudicator/officer I would go and get a box of case files every morning, scan/wand each file into the system under my user ID # (so people could track who had it) and then begin to adjudicate the cases. A box might hold 50 case or so
So, your number of files vary at any given time during the day. Officers who did the work form home I spoke about earlier would come in to the office maybe once or twice a week, scan in all their new files (to their ID), then scan in all the approved files they were returning back into the system (from their ID) and take the multiple boxes back home with them to work. Enough to last a few days or so.
The reason for some hanging so long could be several. One could be an RFE and while the officer is waiting for the response he is working more current dates. In other words more and more applications are getting in front of the RFE'd application. Another reason could be that the boxes that are staged on the shelves are chosen at random by the officers. For some reason a box of files might sit longer on the shelf than another. Usually not more than a day at the most though. Or the officer could be hording a box at his desk (for some strange reason) and then goes on vacation and doesn't scan them out of his name and back into (return) them to the system so they can be picked up by someone else to work. So it sits for awhile.

So weird.
At the least, RFEd applications should be given priority over untouched ones.
So it all depends on which adjudicator the file goes to. If he/she is well organized person then its all fine and quick.
Else take some files and go on vacation and no one else notices it.............. grrrrr

Thank you all, later yesterday the status changed from CPO to Decision and again back to CPO few hours later. Thanks to the forum I did not panic as I read its normal and happened to many of us here.

Just wanted to share my FP experience.
FP was scheduled today at Austin,TX ASC which is in the Lakeline mall off 183. It is part of the strip mall and is located to the left of the Bed Bath and Beond store. Appointment for me and wife(primary) was scheduled at 8AM. We had no problems taking our toddler along. the process was pretty straight forward. We had to wait about 30 minutes for our turn. Fingerprinting took 5 minutes each. There were 2 stations doing the fingerprinting. FYI, people doing the FP were contractors and had no idea if FP was tied to EAD/AP approval or not.
I was a little concerned about FP as I had incurred a nasty fingercut last friday. Thankfully, babying the wound for the last 5 days with bandaids/kailasjeevan etc helped heal it so that it was acceptable for FP.
So thats another thing checked off the list. Now waiting for the EAD/AP approval and cards. I am eagerly waiting for these goodies as I moved to H4 in Jan because of 6 year limit issues. There are some good opportunities right now which are being gated by the EAD/AP. Hoping for the best :)

Tackle, I sincerely hope that is not the case, but how they are processing the cases is certainly bewildering. :confused:

Now waiting for the EAD/AP approval and cards. I am eagerly waiting for these goodies as I moved to H4 in Jan because of 6 year limit issues. There are some good opportunities right now which are being gated by the EAD/AP. Hoping for the best :)

Hello everyone in the immigration blogosphere. I wanted to thank you for keeping me well informed and educated about this arduous painstaking process.
I just received my CPO email almost 3 (very very long) weeks after and RFE response was received for a minor Flu shot, at NSC no less.
Funny thing is I actually called this afternoon, received same recorded message saying that it was still within the 60 days etc, and 15 mins after I hung up had my CPO email.

Friends......We are greened today :-) Got the CPO email at 11.45 PST but I was late checking it. Thanks to fellow members, one and all for all your views and jokes that kept this forum very lively. From the day of filing I don't remember a single day I missed to read the forum, good luck to every one waiting for their GC's.
I am glad I am home today and was able shout out my happiness....went to my wife's office and conveyed the message by gifting her green flowers. She just won the weight watchers in their office and my news just made her uncontrollable. Very relieved and now we can just focus on our next month trip to India after 4.5years.

Folks, I've been a silent follower of this blog. I've a question, I've a 14 year old and my attorney had applied EAD/AP for him as well. But we've got our EAD/AP but my son's receipts are still not showing up online.
Just wondering, if kids get the EAD/AP or not? Anyone in this forum that has got children born in India and have got their EAD/AP, can you pls throw some insight?

I will let people respond with first hand experience but i had documented this in the faq(see first post of the thread) based on the general understanding of the group,
Can I apply for EAD for my kids?
EAD can also be applied for children regardless of age. If you aim to apply SSN for children, you should submit
EAD form for children as well. Of course, if you anticipate getting GC soon then there is no need.

Actually my I-765 RN was recognised on March 7th. So Mar7- Mar11th Initial review. I didnt see the decision message stage , It straight away showed the last stage CPO, then showed the previous stage post decision activity.

ss - My RD and SC is the same as yours and imdeng. I called USCIS on Friday, 3/9 and spoke to an L2 officer. He basically said that he had access to a different system than an L1 officer. Looked up my receipt nos on his system and said that the FP notices have not been issued yet. He asked me to wait for a couple more weeks before trying to inquire again.

That's good to know. I have the the same SC as you, ss and imdeng but a later RD. it looks like NSC is pretty slow with the FP notices but the notice comes along with EAD/AP. Please update the forum when you see some movement on your cases.

We are well within normal operational times so there is no need to call right now I think. NSC is issuing EADs in around 50-60 days so another week or so will make things clear. FP notices it seems are dependent on the congestion at your local ASC as well.
Its all cyclical - a couple months back NSC was roaring ahead and all TSC folks were grumbling - now its our turn unfortunately.

Eg its safe keep, do we need to carry it all the time or can it be kept in safebox in bank(which i dont suggest because in case of an emergency if we need to travel we should have it with us). I came aross this on the inter-web(i think colbert says it this way)..on wikipedia;)

I always thought that as long as you had a valid drivers license or State ID you were good to go as it is based on the status in the country.

Guys,
I have a question.. Is the EAD dependent on pending H1 status at all? I have a pending RFE on my H1 (which I haven't responded to yet). AOS Application was received on 2/1, FP done on 3/13 ..... there is no sign of EAD....even the receipt numbers don't work. Tried calling TSC today and was told by L2 officer that EAD is still pending and it takes upto 90 days to process it. The issue here is that I have a 4 page RFE and I think it will be hard to survive simply because there are too many places where things are open to interpretation. I work in a legit E-V-C setup through a consulting company and wanted to wait for the EAD to be processed before responding to the RFE so that there was a fall back option. I do understand that there can be difference in timing of processing but it just occurred to me that there may be a dependency...or maybe not. Does anyone know anything about this?

this is my strategy.
I made color copy of the GC, front and back, cut it out, and stuck them back to back to make a fake card, and then got it laminated at fedex kinkos for $1.25. I carry this with me. Of course if needed to, you should present it as a copy, do not claim it to be real GC, that's obvious :)
If I go near border places (like San Diego), or if I will be making a trip far away from home, like say going to NY, or Seattle, or visiting grand canyon in AZ, I will carry actual GC with me.

Eg its safe keep, do we need to carry it all the time or can it be kept in safebox in bank(which i dont suggest because in case of an emergency if we need to travel we should have it with us). I came aross this on the inter-web(i think colbert says it this way)..on wikipedia;)

Below is the extract from above link , which has the discussion, I think its law to carry identity.
t's law to carry the proof of residence, irrespective of a permanent or temp resident. I was stopped (whole road was blocked and every vehicle was checked) in NY (upstate) and I had DL and not passport. The officer was pretty good and he told, that I have to carry proof of residency by law and can be arrested and deported for not carrying one. He said he would let me go.
Not many would take it seriously to the point of deporting. If the officer wants to give you trouble by going exactly by books then it is a big trouble. Especially when you are traveling long distances.

This is what we do when cross border between CA and AZ where there invariably an inspection happens.
But honestly I have crossed the border so many times (2-3 dozen or even more) and only twice they actually asked for documents which once we didn't even carry any documents and they said that they could deport us for that. I apologized and said will carry next time.
So in nutshell the officers are quite lenient - however - better safe that sorry. What nishant says makes a lot of sense to me.
this is my strategy.
I made color copy of the GC, front and back, cut it out, and stuck them back to back to make a fake card, and then got it laminated at fedex kinkos for $1.25. I carry this with me. Of course if needed to, you should present it as a copy, do not claim it to be real GC, that's obvious :)
If I go near border places (like San Diego), or if I will be making a trip far away from home, like say going to NY, or Seattle, or visiting grand canyon in AZ, I will carry actual GC with me.

This is what I had copied from one of your posts last year and used to read it whenever I was frustrated, seeing you mentioning that folks till Mar 2008 will be cleared used to give me lot of peace of mind.
Friends its a little early but lets analyze the current situation.
Realistically I think we may get 30K SOFAD instead of 33K. Iam expecting minor movement only in September.
Now with this said ~ 5K preadjudicated cases will be left. In addition to that there will be 6K porting and 4K PWMB.
So even upto the point of 01-AUG-2007 there is 15K demand. Now since there are 5K preadjudicated cases there maybe no urgency to move the dates early on in the year.
The next intake may happen anytime after end of Q1 to as late as May 2012.
One point to not however is that the guiding principle of any intake would be this year’s SOFAD, so if it is 30K the next intake will not be in the excess of 35K.
Now we know that 15K is ready there till 01-AUG-2007, so realistically till the end of 2007 they will get 15K with Q1 2008 serving as a buffer.
I believe if the next intake happens in a timely manner there is a good chance that everyone in 2007 will have their GC in hand by Sep 2012,
Q1 2008 folks are a little borderline right now because we may see 30K SOFAD instead of 33K so this effectively translates to a deficit of 6K.
However let’s wait and watch and see where exactly the September bulletin lands us. I don't think that fresh intake will happen in September 2011.
If the timely intake happens next years range will be 01-JAN-2008 to 31-MAR-2008.

From my direct friends experience it is not legal to make laminated copy of such documents (like green card/ ead). I might be wrong..
Here is the situation:
This happened couple of year back. He was flying to his job location like every week and during security check he placed his wallet in the bin and forgot to pick it up and left towards gate. Security people kept the wallet aside. When my friend went back and asked for wallet they said they want to talk to him. They suspected that he some illegal alien as he has laminated GC. Finally he called his family and sent few documents (not sure what docs) and security people let him. This took almost 3 hours for him.
Lesson that my friend learnt that day is not to laminate the docs like GC. This happened with my friend so this not a friends- friend story..i am not sure if all the TSA people at airport are so strict.

My case transferred from TSC to NSC where my primary spouse got approved 485.
Now latest status shows , my 485 is processed at a USCIS office .... dont know if this means a local office or the service center . Anyways, after spending 3.5 months already at TSC and then being transferred , not sure if my clock starts again. Hoping for the best .

Friends finally at 12 PM EST received the CPO mails for me and my wife. Finally this is the culmination of a very long journey. Gives me a great happiness and relief in reaching this milestone which until a few years was just a dream.
My sincerest thanks and deepest gratitude is due to all of you for your wishes and kind words especially in the RFE phase. Immigration forums started for me as a place of learning and it still is only difference is that it is a part of life now; really good since it has introduced me to so many friends and given me a truly great opportunity to interact. All .. a quick question regarding FP:
My wife has all her documents (IDs) with her maiden name on it. While applying for 485,765 and 131, our lawyer mentioned that we could use her married name to get the documents. We agreed and all her receipts are now with her married name.
At the time of Finger Printing (scheduled on 3/22), would there be any problem if we just carry her IDs (with maiden name) and our marriage certificate?
Anybody has any exp. with this kind of situation?
Any input is greatly appreciated.

I would say take a color photocopy, cut it into small rectangular piece and mention the word COPY on top of it. I have heard that's the best way to deal with it.

From my direct friends experience it is not legal to make laminated copy of such documents (like green card/ ead). I might be wrong..
Here is the situation:
This happened couple of year back. He was flying to his job location like every week and during security check he placed his wallet in the bin and forgot to pick it up and left towards gate. Security people kept the wallet aside. When my friend went back and asked for wallet they said they want to talk to him. They suspected that he some illegal alien as he has laminated GC. Finally he called his family and sent few documents (not sure what docs) and security people let him. This took almost 3 hours for him.
Lesson that my friend learnt that day is not to laminate the docs like GC. This happened with my friend so this not a friends- friend story..i am not sure if all the TSA people at airport are so strict.

You may want to look in to changing the DL. I'm not sure what you need for that (new SSN card or H1/H4 797 with the name on it, etc.) but it probably makes sense. The alternative is to call the ASC or your lawyers and ask them.

They need the 797 of the current status along with I94 ( = H4) .. Shows her maiden name. I think it may still work, because that will show her to be here legally and marriage certificate will show a valid name change.

Her passport does not have my name in it..... I have been teasing her about this maiden name business for a long time..:) we were just too lazy to get it done.. mainly on her passport. I hope it does not delay our GC adjudication with an RFE .. anyways.. one step at a time..

Charles Oppenheim, Chief, Visa Control and Reporting, provided this information at an AILA conference on March 16, 2012. Mr. Oppenheim projected that it will become necessary to retrogress the EB2 date back to approximately August 2007.
The EB2 cutoff set in the April 2012 Visa Bulletin, which is May 1, 2010, is not changed by Mr. Oppenheim's announcement. The changes will occur in the May and/or June Visa Bulletins. We will provide further analysis in an upcoming

It will affect you , if you dont get your greencard before retrogression. incase dates retrogress to Aug 2007, as mentioned in the article in May bulletion. if you dont get GC by april 30th. you need to wait till you date becomes current again to get the GC....

I doubt it. I feel that the left over applicants from Oct, Nov and months before will get their applications processed only when dates retrogress (and when the PD becomes current again of course). This is just a guess.

I agree. Up until April 30, it's going to continue being a free-for-all. Im slightly pissed off at Fragomen for sitting on my file till Jan -end when I everything good to go by the 10th.

Our attorney mailed my wife's I-485 RFE response yesterday. He said 50/50 for chances of approval this FY (at NSC). I was just curious about how they allot the visa numbers ,especially now that they dont foresee any spilldown and very few visa numbers are supposed to remain for this FY. Is there any monthly allocation, like 9% or so? In that case, wouldnt they have enough visa numbers still left? (54% or more for this FY?)

Mak - Anyone can get approved while they are current. So that's why you are seeing approvals for later in the year. They will constrain that to only those with earlier PDs by retrogression. That's why CO is going to retrogress to Aug 2007. He wants to make sure any visas in hand right now are given to the earliest PDs. Then when he gets a greater handle on SO, he will keep moving and its a matter of numbers. The other constraint is not wasting any visas.
Based on calculations, there will probably be just enough to satisfy the demand up to Mar 2008... not guaranteed but most likely. That's why gurus are saying Mar 2008.

Got my 140 amendment approval yesterday. Took 3.5 months in my case. Same situation as yours - company got acquired just before I was eligible to file my 485.

Thank you for your wishes. I'm considering reaching out to my Congressman for help. I know since the dates are within processing times at TSC, it might not be of any help. But I think if I'm going to try and ask for help, now would be a better time as dates might retrogress in next bulletin.
Should I first talk to my lawyers and get their opinion before writing to Congressman? Anyone here at Q has experience with this?

I agree with you on this imdeng... i know people around me who are in sep 07, dec 07 who are not getting any updates and people from dec 08 getting approved... while we are happy for them... it is bahut na-insaaffi for those who are waiting...
April 2007 -- Only 75% approved and the next months the trend is even more dull with oct being 59% and Aug and Sep in 50%'s... hope the process corrects itself and gives relief for all those who are waiting...

Has anyone had any experience with service center transfers. I got a uscis notice saying they have transferred to speed up the process.
I'm gravely concerned if I'll get approval before end of april before retrogression .
Dec 07 PD ; Dependent 485 : Transferred
My application has clocked 3.5 months before transferred to NSC . Does it mean any potential rfe issues checks have been completed .

My wife and I got FP done yesterday. Of the two Reciept Numbers (i765 and i485) each for myself and my wife, I just found this status for my wife's i765 i.e. EAD application. USCIS website cannot find the other three receipt numbers.
Post Decision Activity
On March 14, 2012, we mailed you a notice that we have approved this I765 APPLICATION FOR EMPLOYMENT AUTHORIZATION. Please follow any instructions on the notice. If you move before you receive the notice, call customer service at 1-800-375-5283.
Update: On Friday 3/16 we recieved EAD card for my wife. My reciept number is still not searchable on USCIS Case Status website.

Is the "Name check" and "Background check" initiated after FP or are they independently done? My guess is that it's done after FP but I'm not sure.
The FBI website says that most Name checks are completed within 30 days. But 30 days from what?

Since i am a Jan filer also did some extensive research on this few days ago, will forward the memos later but will summarise my understanding,
1. IBIS check done same day, takes as little as hours to a day tops ( similar to the POE check by an IO)
2. Name check , Uscis sends to FBI bathes of name checks on a magnetic strip ASAP after receiving ideally, contrary to popular opinion it doesn't wait for FP. This takes anywhere from 30 days to years for FBI even though majority done in 6 weeks nowadays.
3. FP check, usually finished in 2 days for FBI to report back.
Take into account different level officers trying to update the system and u r file is picked for adjudication only after all the updating,,,,hence randomness in approvals,,,

AFAIK, biggest hurdle for a faster/ slowere BG clearance is the length and commonness / higher hit name. If the name is longer system tries to jumble u r first middle and last name and search.
Your last 5 years of residence is a starting point for check and not the end, they check from the second you entered the country even if u lived here for 50 years,,,,

The IBIS check is the background check. The FBI Name check is to see if your name has come up in Federal Investigations either as a primary (main) or secondary. I think IBIS and FP are really quick. Name checks can be a pain if something comes up the first time around. This is where having a common name hurts you.
Length of time in the US shouldn't matter much although the more I read the more it seems that the longer you've lived here the greater chance of an issue in the various checks. Bottom line is that if you've got nothing to hide, then its really up to chance as to when you will get approved.
Theoretically, if all is well, one should get a GC 45-60 days after RD (assuming one is current). But that's not usually the case as we are seeing with Nov and Dec filers.

Friends finally at 12 PM EST received the CPO mails for me and my wife. Finally this is the culmination of a very long journey. Gives me a great happiness and relief in reaching this milestone which until a few years was just a dream.

I have just applied after long (10) years of waiting with PD Feb 2008. I would appreciate if you could help me with the following concerns.
1. When I filed I didn't give the copy of the OLD passport which was expired in late 2008. However, it had all the history visa and stamps since my first entry in 2001. ---- Would that create any issues? I asked our company legal rep and she said it is not needed prior to applying. (fyi..our legal reps are not lawyers, they send the work to other lawyers)
2. I have been traveling to canada by road and they haven't been taking my I-94 while leaving USA and while entering USA from canada by road US Immigration officers were allowing me back with the previous I94 ... As I understood it is not needed to handover the I94 and receive new I 94 upon entry while traveling by road or crossing border by road. -- My question is .....
I didn't put those entry exit in the filing - would that cause any RFE?
Please advise...I am freaking out ...after long wait....on the top of this there is a retogresse coming:((

I think it would be great value to add some more info to the PDF. Such as
1. days to wait before calling uscis for each stage status update or to raise SR, eg: say receipt, fp notice, EAD, status check on on 485, etc.
2. contact numbers for FBI fp check, uscis contact.
3. info needed before calling uscis, such as receipt number, etc.
Since I did not see a thread to discuss, Q & A for people who filed 485, waiting for/completed FP etc. I thought of opening one.
Any way to track our application past FP?

Not to scare you but it would have been a good idea to include copies of old passport..my lawyer was also of the same view but I insisted and got it added to my packet..better more than less. Cross your fingers, maybe your case will skim by, depending on the IO.
Or as somebody mentioned before (4 similar profile friends case), that getting an RFE is actually better, at-least your case will be moving...there is always a positive side..

The requirement is to have a copy of the passport with the latest visa stamp on it AND your latest passport. The I485 instructions don't explicitly say this but again its interpretation and mood of the adjudicating officer. So I think you should be ok.
About the entry-exit, I don't think they will be that stringent about Canada but if it does happen, its not a big deal.

Point 2 is not a problem. Even if you travel by air they don't take the I-94. I travel once a month to Canada and my lawyer request me to retain I-94. There something called Automatic Re validation and this is legally allowed

With expired H1 stamp on passport can one travel to and from India on AP. No intent to use EAD, planning to continue on H1 but do not want to go for visa interview and stamping.

Just got the CPO text msgs.... sharing with you guys first!!!! Even my wife does not know about it yet :-)!!!!!!
Thankyou all for all the compassion you showed when I shared my story. Until my I-140 was approved - I never knew anything about the immigration blogs... Started googling around and initially found a crap load of forums where the discussion was loud and noisy - with very little information. Accidentally stumbled upon Q's and never had to check anything else! This is the only forum I ever registered and posted msgs.
I wish everyone of you waiting to be greened - all the best! Will keep watching this thread to congratulate each one of you when your time comes!!!

Is it safe to assume that approximately 60% of cases filed between 1/1 and 1/15 have already been approved?
I haven't heard of any RFE for Jan filers yet...everything seems to be straight approvals...

Nope this would not raise any issues, since you are not violating any conditions.
Quick question:
With expired H1 stamp on passport can one travel to and from India on AP. No intent to use EAD, planning to continue on H1 but do not want to go for visa interview and stamping.
Would it raise any issues??

Thought of sharing this info that i just came accross at http://www.immihelp.com/immigration/rescind-itin-after-getting-ssn.html
An alien individual can't have both ITIN and a SSN. Therefore, once you receive your SSN, you will have to rescind your ITIN.
After you receive your new SSN, you will have to send a letter to the IRS ITIN unit requesting a rescind of your ITIN. The SSN will become the primary number and must be used for all future filing purposes. The IRS will void the ITIN. All prior tax information under the ITIN will be associated with the new SSN.
Send a letter to:
Internal Revenue Service
ITIN Operation
P.O.Box 149342
Austin, TX 78714-9342
Enclose the copies of your ITIN and SSN.
Additional steps:
Inform all 3 credit bureaus to import the credit history associated with your ITIN to your SSN. 3 Credit bureau web sites:

Thanks for info. Interesting to know that credit bureaus maintain credit history based on ITIN. I thought ITIN is used strictly for 'tax purpose' only.

Anybody here who received EAD/AP combo card but still not able to check AP status? I am able to check EAD online status (USPS picked it...) but nothing for AP.
Does this mean that I will getting separate AP and not EAD/AP combo card? Anybody in same boat?

I received a combo card but still no online status available for AP . You will get a combo card for sure.
