By looking at the pace at which TSC is updating its "Processing Times", it'll probably only be "May 2011" by this May (2012). In the last 4-6 months, it has moved only once and it was a 1 month move. So, by the time they update the date to Oct/Nov, it'll probably be next year.

I called the uscis and all she said is my case is pending and I would be notified if the background check is cleared!!!! and said to wait and call back outside 4months.


The guy I spoke to was not exactly friendly and I am not sure if he is the guy always responsible for my file. I told him that all I needed was if the FBI check and name check went through okay. He looked it up in the system and said he cannot see both of them . Whereas when I spoke with FBI they said the fingerprinting stuff was sent on same day ,was legible and okay.

I am not sure if the lower level officer would hold off putting in the FBI check untill the name check arrives, not sure too many variables.

You are right !! But what puzzles me is this,a few days back saw Aug 2011 on the processing times for TSC.Today when I look at the link it shows April 2011 for TSC.

Check with your lawyer how your PERM was filed. Consultancy companies usually mention that employee will need to work at various client locations across US.
In such case PERM location is HQ of the company.

Typical consultancy companies its very rare that PERM will be filed for client location as no one knows how long the current contract will run.

Usually one needs to file PERM/LCA when the client location changes by more than 50 miles, even consulting companies are doing now due to increased audits.

In case of H1 sure one needs to file new LCA when client location changes. In case of PERM it would depend upon how it was file and may not be necessarily be refiled if client location changes.

Congrats billu. Yep, same situation here, I got my approval but my wife's status kept showing up as Intial Review for a couple of days. After that it turned to Request for Evidence. I hope that doesn't happen to you. We are still waiting on the RFE mail. Haven't received it yet.

PS: Saw the same thing with a couple of posts on trackitt. Primary gets approved but dependent's status shows up as RFE after 1/2 days. Good luck!

It is normal to take a few weeks for receipts to become active for some of the recent filers. I heard from my attorney that there is a glitch somewhere in the USCIS systems and they have acknowledged the same. My own receipts are still not active yet - been almost 3 weeks since I got them.

I was surprised to see online status changing from "card/doc production" ( 5th circle) to "Post decision" (4th circle)
I thought if card/production = card sent, then status would remain there only.

Drawback of Early Walk-In?

My EAD has now been pending for 8 weeks while the people who filed after me got their approvals. So as I am a worrier and keep thinking all sorts of things that could ahve gone wrong, I finally called USCIS today to check the status.

They told me that my background check was initiated along with my finger prints check. Since my EAD file was not touched before I went for my FP, I now have to wait for the Background check to come through for my file to be looked upon. If the EAD file is looked/touched before the applicant has done FP, it is approved earlier (provided all other things are fine).

So I wonder if I had waited for my FP Scheduled date of 2/21 and not walked in earlier on 2/10, I might have had my EAD/AP approved by now.

Ok...so now even the CPO email cannot be relied upon!! This is plain torture...so sorry for you guys. Hopefully, its someting simple and you should be approved shortly after submitting the evidence.

Thank you guys....well the CPO mail can't be relied upon for sure...not untill you receive the actual green card in your hand......it was very unfair of them to send us the approval mail and then a day later an RFE......

Don't worry, enigma. NSC has been slow in sending the FP notices when compared to TSC. kanmani's service center is TSC.

Just to add one more point to Nishant's post.It is 180 calendar days from RD date that will allow the applicant to get AC-21 protection and shift jobs .Also job title need not be same.NOC code however must be same.USCIS nowadays is giving an hard time to applicants to justify equivalence of positions ( NOC code/Title/Responsibility etc ...)

One would be safer waiting for the GC.

I don't think so. Some of m yfriends changed jobs after 1 month of getting their GCs. But, I read somewhere that if you immediately change job after getting GC, USCIS will ask about it when you apply for citizenship! Nobody ever verified it, it could be a rumor.

I am really not sure. But that's what I was told this Morning.

Also I can't think of any other reason why some EADs with same RD get approved earlier than others (for GC there can be many reasons, but not sure what other type of checks are done for EAD). That's just my 2 cents.

Plus, kids (under 18) don't apply for EADs and still they get FP notices. So, I don't think FP clearance is absolutely requires for EAD.

Congrats billu. Yep, same situation here, I got my approval but my wife's status kept showing up as Intial Review for a couple of days. After that it turned to Request for Evidence. I hope that doesn't happen to you. We are still waiting on the RFE mail. Haven't received it yet.

PS: Saw the same thing with a couple of posts on trackitt. Primary gets approved but dependent's status shows up as RFE after 1/2 days. Good luck!

Man, you were dead right. Just now spouse received additional evidence RFE e-mail from NSC. Did you get yours or do you have any idea what others got? Does the lawyer get the RFE or us or both? (cases filed by company lawyer and we filled out G-28).

Just like many who registered - I have been an ardent follower of this blog. My heartfelt thanks to all the contributors. I have got lots of information out of this. Wanted to update on my situation - finally got the GC for me and my wife. We both got an RFE and I wanted to post about that, in case, it helps anyone.

RFE Details:

Birth Certificate - We had submitted initially, but we still got it.
RFE Status on Website - Additional Evidence (so I think it depends on what button they chose to hit)
RFE Response: Included a copy of BC, Translation (for my wife as it was in hindi), 10th grade marksheet (neither of our BC had father's name in it), standard affidavit from Mother and Father for both me and wife on plain paper and notarized.

Issue with Wife's BC:
Wife's BC had extra spaces in Father's and Mother's name - e.g. First Name vs
FirstName- this is actually correct. But we had incorrectly filled G325 without spaces.
the translation had a typo on the father's first name.
Birth Registered after 18yrs


Issue with My BC:

My BC only had initials for Father's and Mother's name.


I checked with the lawyer about the BC issues and he advised me to include a couple of sentences in the RFE response explaining these. We did that and thankfully did not cause issues and got approved 1 days after RFE response was received.

As far as employment, i work for a small desi consulting company, been with them for past 7.5 yrs, and worked E-V-C model all the time.

On March 3, 2012, we mailed a notice requesting initial evidence in this case. Please follow the instructions on the notice to submit the evidence requested. Meanwhile, processing of this case is on hold until we either receive the evidence or the opportunity to submit it expires. Once you submit the evidence requested and a decision is made, you will be notified by mail.

A request for evidence is made when an application/petition is lacking required documentation/evidence (initial evidence) or the officer needs more documentation/evidence (additional evidence) to determine an applicant's eligibility for the benefit sought.

first in a vendor company for 3 years worrying when they will send me back to India, then caught up in 2008 recession for 2.5 months with no contract in sight, then travelling 125 miles when my wife was pregnant, then later on anxious along with Nishant hoping to be current and now finally a GC.....

I moved to Q's forum from I V a year ago and have a lot of peace in my mind here, seriously its nice to be in midst of great folks here

FP is not needed for EAD/AP... Many cases where EAD/AP granted without FP done...
FP is only needed for 485 stage processing...

Trackitt information - Someone called USCIS customer service for updates as the Receipt number was not recognized under online status. He spoke to L2 oficer as he claims, was informed that the Data bases are maintained by Private parties and they were already alerted reg this.

So what I believe is USCIS is not working in the weekends, but their data bases are updated accordingly even in the weekends.

But I am not sure about this .... just a thought .

Since the appointment center a little far from our residence, we will have to leave at a time when the Childcare center is not open.

1) Take along 1 form of government issued photo id (second one is good as a back up) and your finger printing notice.
2) Here in Phoenix the DL is accepted as a form of id, as long as it was issued in Arizona. My NY license wasn't accepted, but I had my passport with me.
3) I saw a couple come in with an infant and were allowed to take him along. I also saw an old woman who came with her adult son (as a translator) and he was not allowed in.
4) What happens: a) You stand in line, b) show them your FP notice and id, c) put your things through the Xray machine, d) walk through the metal detector & get frisked if necessary, e) walk into the finger printing waiting room, f) fill out a form and hand it in, g) get a number, h) wait to be called into the finger printing room (my center had about 6 fingerprinting stations and 4 of them were manned when I was there), i) get photographed and fingerprinted, j) get your FP notice stamped certifying completion and k) leave.

Yes you can take yr toddler with you for FP. No problem at all doing so.

But you have to make sure that officer don't take your toddler photograph and FP instead of yours... :)

If the ASC is not too far then you can try. Most likely they will do it. Again for 8 AM also no one can give you a sure answer. You have to try. But if I was you I would go at 1PM and try for both. 8 AM is asking 2 favors - time and spouse.

You need to take the appointment notices and ID (passport or DL or State-issued ID). I'd also carry the receipt notices for your 485 and 765 applications.

On a personal note, I will be carrying hand sanitizer as well :)

I read it a month ago somewhere that they allowed somebody from Canada to enter USA w/o physical passport. This guy had it on his iPad and the officer at POE took his iPad; did some verification; accepted it and allowed him in. I wish they do it for everybody..that would be so cool!!!

Just venting a little bit about the relative slowness of NSC compared to TSC for Jan and Feb filers. Many Feb TSC filers have received FP notices and a couple have even received EAD/AP. NSC on the other hand has really slowed down - no FP notices for Feb filers and EAD/AP for Jan filers are also getting delayed.

I am eagerly awaiting EAD/AP for a job change situation - and it seems like I still have a few weeks of wait.

imdeng - I can empathize with you. I am an NSC Feb flier with the same RD as you. The LUD on my case is 2/14 as well. Nothing since then... The google doc that the trackitt folks are maintaining for Feb filers shows a 1:3 ratio for NSC vs TSC filers. But still TSC appears to be processing the cases much faster than NSC (at least w.r.t FPs and EAD/APs). Not sure what the hold-up is at NSC :(

Nope... atleast none for me. My EAD/AP had the last LUD of the day when the case status became visible in the system. It went from that LUD directly to today;s with the approval.

My personal opinion is that 6 weeks should not be a problem as you have a valid H4 as well (in case 485 gets denied for some reason). You run the risk of GC getting approved while you are out of country - there was some discussion that in that case you would need to get an immigrant stamp in your passport before returning.

Will keep you posted. On EAD I would agree with imdeng on the 40 day mark for TSC. Most people I know who applied prior to us got it in about 5 week time frame. Also the recent trend on trackitt seems to be right around that ballpark and there are outliers which are less than 30 days too.

Kumar, regarding Q1, decision after responding to RFE can take anything from a few days to a few weeks. From a look at recent trackitt cases that had RFE and were approved, approval time was generally less than 2 weeks, but some waited for over 2 weeks, even a month. So, it's a wide range.

1.It took roughly 18 days for me. I have seen the spread to be between 3 & 30 days.

2. No, each application is different.You don't have to update your employer about secondary ever. Even on primary, you must update your employer only if you had signed a paper with them that you will not work any where else but for the employer. if not, you don't need to update even for primary applicant's second job.

I want to ask if for filing the tax for FY 2011, do I have to wait for SSN for my wife (we got the EAD approvals yesterday and plan to apply for SSN as soon as we get the cards in hand) and then use it or can I still use the existing ITIN?

You can still use ITIN if you want, as she dont have SSN yet. And then later on, when you get SSN, you just go to local IRS office, with ITIN letter or a copy of your tax returns with wife's ITIN on it if you have lost the original ITIN letter, SSN card in original, passport, any drivers license or state ID if your wife has, and they will merge over her ITIN records onto her SSN. This is fool proof way of doing it.

Alternatively, you can apply for SSN, and then file tax returns. You still have to inform IRS about SSN and merge over though. It does not remove that step.

Nope, no difference. SSN made difference only for getting stimulus money 3 years back for something Obama had given out. Otherwise, no harm in applying with ITIN. There is no stimulus money to be gained this year.

Absolutely, I want Teddy to get GC this week. I must admit mine was a very complicated case, not just because of the amount of papers that I have thrown at CIS over the past 14 years and the number of applications filed with them. But also because I switched companies and been through acquisitions 3 times. It's a library of applications for a individual reviewer to look at. In that respect, TeddyK's is a very easy application. it just need to get to the reviewers hand to be approved.

If you had SSN last year, you were still in the time window to file for amended tax return for 2008 to get the stimulus money, that's what some CPAs are doing. that's as far as I know.

This message is appearing in all my 6 receipt notices(3 for me and 3 for my wife). I am not sure if this is an issue in my case or if this is a problem in the site Other feb filers, can you please check you status.

Update : After seeing this status, I opened my mailbox and I received FP notice for me and my wife. In summary I received my Receipt Number and FP notice to my current address and the status in USCIS is still showing above. Confusing !!

The status in the USCIS site seems to be incorrect. I opened my mail box and I received my FP notice. My FP date is 26-Mar. I will check with my attorney to see if we I need to call.

This is a specific and clear situation. For some reason (wrong address most likely), USPS could not deliver the receipts hence the message. Remember that any federal mail does not get forwarded. Your lawyer should have received his/her copy of the receipt notices.

AFAIK, no other case like yours was posted on this forum.

Was the address correct on the notice? Let your attorney know - I guess a call to USCIS will be needed. It did take a while for the notice to reach you - so perhaps USPS could not deliver at first, sent the undeliverable notice to USCIS and then figured how to deliver them.

It's 285 N Broad St, Elizabeth (in same building as unemployment insurance department). Your notice will have 285 N broad street. Some people go to USCIS site and they don't have right address there. do check your receipt.

The address was correct in my Receipt and my FP notice.
I got my Receipt few weeks back. I got my FP notice today. The address I have in 485 is my current address. I did move few days before filing 485 and I filed AR 11 as well. So it is kind of confusing. I will reach out to my attorney as well

Thanks for the response. I didn't think about the stimulus from 2008 because other than that there is no difference in the tax returns as far as I know. People need to be carefull with the CPA's (especially desi CPA's) as some of the things that they tell you to do may be border line shady and in the end since you certify that the return is based on the information you disclosed you are responsible for the consequences (which can be a real pain).

Call them up and check. Speak to a Level 2 agent and explain the problem. In our case the apartment number got truncated on my spouse's application and we got a similar status message online for him (it was for his initial receipts though and not FP notices which we are still awaiting).
The level 2 agent my spouse spoke to was very helpful & was able to quickly identify and resolve the issue.
