Dear Friends, My AP was approved on 02/17 but no LUD or change of status for EAD. I was trying to find out if anybody had similar experience. EAD is still showing initial review. What could be the possible reason? I thought EAD/AP is issued on a combo card these days.

Application is at TSC. Any advice?

Same situation as you for derivative EAD. A P was approved on 2/18, two days after primary EAD/AP approval. No update so far on the EAD, but hoping its not an issue since its a combo card

As per Kanmani , you will be in trouble if your spouse "opens" your green card packet!!!!!!!!!

I completely agree with your lawyer on this, once your green card is approved, highly improbable that you will be denied entry either with or without card,,,,,


Alternate solution from my Lawyer. Unlike AP...GC can be hand carried to India by either the spouse or somebody else. Also when one travels using the AP,one is understood to not have abandoned the gc process.The very purpose of an AP is to allow you to travel without risk to the gc application ( the I-765 approval document says as much ) .

You can still use AP to enter after the I-485 has been approved.At the port of entry CBP can check the system and they will find your approval and they will mark it so in the passport. If you get somebody to hand carry your GC back to you in India,you can enter using the same as well.

Of course one can be extra careful and can go for the immigrant visa stamp at the consulate as well.It is not necessary though.

The truth is, Immigration Officer has the right to deny entry into the U.S. for various reasons unless otherwise you are the citizen of USA.

Another interesting truth is the next counter immigration officer can overthrow the earlier denial at his own discretion, but usually that doesn't happen.

Issuance of a visa from the U.S. Department of State or visa waiver nationality/ even permanenet residentship is not a guarantee that the immigration will permit the entry.

I am aware the CBP has a lot of power.However it can also deny the Immigrant visa citing the same reasons ( abandonement etc...) . Also there is an huge amount of documentation required for an immigrant visa which can be applied only in Delhi or Mumbai.One will also have to obtain detailed police records.

As per my knowledge from trackitt, I remember some people came back on AP after approval of GC ( Not sure if they were lucky), what happens if one's green card is approved after they boarded flight?? will they be denied because of that travel?? Purpose of AP is to travel safely, if they have all these bs rules, CBP/USCIS should consider above mentioned scenario.
Any one who is travelling should consult very good attorney before making travel plan (or) before boarding return plane.
As suggested by kanmani getting stamping should not be a problem as GC is already approved and probably better way.

Kanmani , you are correct in your representation of the process. The immigrant visa concept is similar to Canadian Permanent residency which will require you to first have the immigrant visa in the passport to enter the country . However, while the process does get thrown off when there is 485 approval on transit in to the USA. Here there is a clear collision of the immigration procedures. Either way if one does get 485 approval while being away on an approved EAD with AP , it should be good enough to enter POE with out a hassle. Coming to the point of not being allowed entry at POE , the US constitution grants the IO discretionary powers to deny/delay the case based on credible circumstantial evidence/or potential violation concerning national security. Typically good keeping professionals with GC do not have any issues. Infact one time when I was travelling in to country , the IO literally grilled me over my extended vacation for 2 months questioning the credibility of my employment for such extended periods of absence from employer, however toward the end he was nice enough to tell me that they on a daily basis track lot of fraud with immigration docs and lot of people even mis-representing their identity which is why based on certain circumstantial situation they are forced to take certain stances. Just thought I wd broaden this talking point with all due respect my friend.

Me and wife got our EAD/AP approval emails on 02/04, we both got our approval letters( physical approval mails) on 02/11. While wife got her physical EAD on 02/09, I still did not received my physical card, status shows post decision activity but not moving to card production( even though I got couple of emails on 02/04 that they ordered for my card production). Is it normal? did any one of you experienced this kind of scenario?
Previously Soggadu said that it might happen, but when I see some trackitt scenarios, many of them did not get their physical approval notices but mine is the case were I received approval notice.

It is not uncommon for the status changes to move back and forth, after the approvals. I think there is some bug in their system. As long as you got an approval email once, you should get your approval notice and card soon and you are good. In your case, it has been a while since you got your approval email. You can now probably call and talk to their representative.

CBP Procedures for Permanent Residents

If one is a permanent resident (green card holder), but does not have proper proof of that status, the CBP officer has several options. The CBP officer could waive the documentary requirements and allow the individual to enter as a permanent resident. Alternatively, the CBP could allow entry into the U.S. physically on a grant of parole, for purposes of a deferred inspection. This does not require possession of an AP,as it is a parole that is granted at the discretion of the CBP at the POE.

This deferred inspection means that one must return to the CBP at a later time to complete the green card processing. This procedure is appropriate for an individual who will be able to show the CBP the green card soon after reentering the United States, because it simply needs to be retrieved from home or another location. This might also be appropriate for one whose I-485 was approved during travel, as the physical green card generally is issued within a couple of weeks after approval.

We at the Murthy Law Firm have seen instances in which CBP officers simply allow such entry on AP or in H or L status for individuals who obtain the I-485 approval while traveling abroad. This does not alter the fact that the foreign national has been approved as a permanent resident. S/he should receive the green card in the mail following the I-485 approval, and should use that document for future work and return travel into the United States, otherwise complying with all requirements applicable to U.S. permanent residents.

I just did not want others to think travelling on AP will be a huge problem after I-485 approval.I was told the same by my lawyer and just wanted to share it.Thanks for also digging into the murthy link.It does show the CBP officer has multiple options with or without AP. With AP one should not have much hassle in being admitted back into the US.

The immigrant visa might be an better option for one who desires that additional mental peace.Also on that related note ,if you could post the link for required documentation for an Immigrant visa might be helpful to others. Since all the links I have seen require detailed documentation ( All the links seem to have common documentation for CP cases and Immigrant visa ) .

gcseeker, I am not against your point. I agree with you that CBP allows entry with AP. But as per Murthy , CBP is allowing us not with the AP document in our hand instead they are allowing us with their own decision seeing the GC approval in their computer.

Which is why the Lawyer had suggested hand carrying the GC by the spouse which will constitute proper proof of status and there will be zero hassle at the POE.

With AP too it should be fine...Without AP discretion of CBP if they can pull it up on the computer.

Can things go wrong ? As with anything there will be some risk ,be it immigrant visa/AP in hand travel/Gc hand carried to India travel.


Anywaz like you said,let each one decide on his own the amount of risk one is willing to take.

Thanks mysati, status changing back and forth is fine but mine is stuck at post decision and never got email that usps has picked my card. Probably I need to give a call, but on approval email and approval letter they asked to wait for 30 days to receive card.
BTW, mysati did you received your EAD/485? yet

Can you please share info like which state you live in, where did you go for FP and did you go for FP on 02/14/12 or did early walk in. Any LUD on I485 since ND.

Sorry for the delay with long weekend I was out. Anyways I am from virginia and I got my biometrics done on the scheduled day (no walk-ins). Immediately after FP, I guess they approved my I765 and I131. I am yet to receive the actual notice/card but as soon as I do I will update everyone. All the info I have is from the USCIS website. Hopefully the website isn't wrong because the lawyer also did not hear anything yet(Do not know if they do).

Wow .. the system does not recognize any of my receipts .. we are pretty close on the RD and ND. Don't know what it depends upon .. may be some officers did not bother to update the online systems in some cases.
Just realized, you are with NSC .. that probably makes some difference ..

makmohan, your case gives me hope .. :) I called them up today ...and after a wait of approx 30 min. the L2 officer told me that I was in the system, but the status check could take about 4-6 weeks to show up online. Will watch out for FP notice this week.. hopefully it comes along..

mak, we are both TSC filers .. that may have something to do with it..

I believe TSC folks are having problem with online tracking but are receiving FP notices early. NSC folks are not having problems with online tracking but the FP notices from there are late. Feb people have not reached EAD stage yet, but based on Jan filers experience, TSC used to be *really* slow in EAD/AP issuance, but they have now caught up to NSC and might even have exceeded them in EAD processing times.

I am in the same boat. See dates in my signature. I did checkw ith my attorney and seems like this is fine and as per him this has been acknowledged by USCIS. He did say it would take 2-3 weeks after receipt before I can check the status onlibe.

I am long time ardent follower of the blog and really appreciate the analysis and feedback on the forum.

My spouse (primary applicant)'s PD is Sep 17th 2009. We applied together through his company lawyers around 1st week of Feb.

I got all three receipts last week (14th Feb 2012) with RD- 7th Feb 2012, and FP fee cashed date of 9th Feb 2012 at NSC. My spouse/primary hasn't yet got any of his receipts yet. His lawyers haven't also received his receipts yet. Am worried about the 3 receipts for spouse which haven't yet been delivered. Has there been any similar instance of this before?

My status is updated in the system and the various forms are either at intial review or acceptance stages.

Both the checks were cashed? If yes - then thats positive.

Wait for another few days and then ask your attorney to contact USCIS. It is possible that they did not recognize that there were two sets of applications and only saw one (although it is strange that they picked up the dependent and missed the primary, it seems more logical for the reverse to have happened).

Also - confirm with your lawyer that both sets indeed got sent. They are known to make a mistake. The usual standard is to keep the two in two different envelopes and then keep both envelopes inside one large envelope. Ask about your arrangement.

Thanks imdeng for the detailed reply.. Will wait till Thursday (almost 12 working days since Feb 7th) and follow up again with the company attorneys.

No clue if the fee payment wrt his application was cashed since it was sent by the company attorneys. The FP fee cashed date of 9th Feb (in case of dependent) was given in the online status for my I485.

It is not my document - somebody else is maintaining it. You can have your info entered by sending an email to the address in the header of the document. Trackitt is a good place for such documents because of the volume of people there.
PS> It takes just a couple minutes to create a trackitt account - you don't have to disclose all info to create an account.

Hello wantgcnow,

Dhruvraj and I are in almost similar situation. I am thinking some batch run went wrong on 02/17 or 02/18. I received similar update but ONLY on AP and no change in EAD, even though now a days they are issuing combo cards. I've noticed majority of filers get their actual cards within 3-5 days. Let us wait and watch. There should be something in the mailbox today or tomorrow.

I am Feb filer. I got my FP notices today for all of us - self, wife and daughter but their appointment date is different than mine but I guess I can do early walk in with them.

Was anyone able to go for a Walk In to Elizabeth ASC for fingerprinting? I got my FP notice and was wondering if it is better to call them in advance to check if I can come early or should I just walk in sometime this week? Anyone?

My suggestion is to avoid FP early walk-in if possible. It is purely based on your luck, the workload of the office at that time and finally the type of person you have to deal with.

My friend who is based in Florida had a very bad experience. Though he ended up getting his FP done he went through horrible 40-45 minutes of waiting. Be prepared to tell one compelling reason why you can't come on the schedule appointment day.

As per my friend it seems the Supervisor (a Lady) told him that it affects their day to day schedule (they have to squeeze one or two extra appointments just because you walked-in early). The last thing you want is an unhappy person doing your biometrics improperly. You don't want to get an RFE 2-3 months later to redo it.

I've read here that lot of people have walked-in without any issues but as I said its purely based on luck. I know you could get your EAD and perhaps your GC faster but having waited this long the extra 10 days wait is not a big deal - At least personally for me.

Note:- If you are not in a Big City and if the FP office is generally not very Crowded it may be OK - I don't know.

That is a smart move, though they could still turn you back at the service center even if they say okay over the phone. There was someone on this thread from Elizabeth that got turned back. It's all luck of the draw. Check out the trackitt googledocs for Jan filers (look at the TSC tab). Quite a few folks from that ASC but only one has walked in early. Not sure if that means the others did not try or tried and were rejected. On the whole, there are a bunch of people who have walked in early, just none others at Elizabeth.

Friends, I am overwhelmed by all your wishes.

I am right now in almost vaccum state, my mind is numb. One distinct memory of my childhood has been my parents talking about how after 4 months, there is danger of money running out and having nothing to pay rent and eat. By God's grace, things went for better after that culminating in this date today.

I am not going anywhere, this forum is in my DNA now, like my friend Teddy, whom I would specially mention here. Him I followed on **, and originally vdlrao got me started. Then I came to Q, and Q, Spec, Teddy and Veni blew me over with the intellectual academic discussion.

I learnt a lot from this forum. Not to judge people, to not share your bias or prejudice and help someone in his own way.

We attempted a walk-in (husband travels and I have an India trip booked at the time). Was very much embarrassed by the lady officer. Do it if you have absolutely no choice.

My husband ended up cancelling all meetings that week and I spent a bunch of $ to re-book my ticket. We are going on the scheduled date. Not worth the look from others on the line at all. Its pretty humiliating.

Think about it.. If you just want to get it done, there is no difference for Feb and Jan filers what so ever since it will be at least another 2 months by the time Jan filers records are picked up

My BC had only my first name, mother's name had only first name with "ben" attached to it, wife's BC was registered late and had a english translation certified by my friend. My medical forms had a problem too.

For BC, I had prepared affidavits etc, but lawyer said, don't send unnecessary stuff, only if they ask for something in RFE, we shall send. Similarly 15 days after sending, the doctor called me to provide new sealed envelopes with corrections to the forms, he had screwed up in one place, but lawyer told me to hold onto those and only send if RFE. Lawyer was correct, no RFE, direct approval.

Thanks to all of you my friends. It is a very overwhelming moment.

A quick update - the company lawyer mailed in today confirming that they have received the receipts for both my spouse and me leading to great relief. Both our statuses are visible in the system...

:) yeah man frankly speaking all theories eventually fail with USCIS.

Anytime now. Only factor against you is your ND is late, meaning your RD also might be late. Right now they are seeming to be dipping into December first week around.

Really, the entire decade is flashing by. Near my present home, there is a train line, not very near by, but enough that at night, you can hear trains going by at a distance, the sound of the whistle, a bit. It's kind of nostalgic, I don't know how to put it, but that noise takes me far back into the days of India, into the daily commute of 4 years I did for engineering via train.

Yeah, I have a similar timeframe as yours with MS and work. It's hard to forget all those events in the journey. Hopefully after getting the precious in the hand we wont forget how much this moment meant for a long time.

I received two 485 approval notices (I-797) too, within a week apart. Both came after GC reached and it has a line "...we will soon mail you a new permanent resident card..". They really need to fix such simple things.

Yep, got two mails as well but had a little different case status - corresponding to the last statuses shown in online case status. I believe decision and post decision.

Dhruvraj and I are in almost similar situation. I am thinking some batch run went wrong on 02/17 or 02/18. I received similar update but ONLY on AP and no change in EAD, even though now a days they are issuing combo cards. I've noticed majority of filers get their actual cards within 3-5 days. Let us wait and watch. There should be something in the mailbox today or tomorrow.

We attempted a walk-in (husband travels and I have an India trip booked at the time). Was very much embarrassed by the lady officer. Do it if you have absolutely no choice.

My husband ended up cancelling all meetings that week and I spent a bunch of $ to re-book my ticket. We are going on the scheduled date. Not worth the look from others on the line at all. Its pretty humiliating.

Think about it.. If you just want to get it done, there is no difference for Feb and Jan filers what so ever since it will be at least another 2 months by the time Jan filers records are picked up

I don't know why people all ways wants cut the line!!

What is this mystical line that you speak of? Is it the I-485 line where people are waiting in order of their PDs to get their green-cards? Or, is it the EAD line where people are waiting in order of their RDs to get their EADs?

What you said is the right thing to do; the only reason why I was interested in getting this out of the way asap is that I am in a bit of precarious situation due to a 4 page query on H1 asking for everything under the sun ......literally. The fact that I work for a body shop and at a client that is not very cooperative doesn't help at all....been around here for too long so there is a lot at stake for me. Anyways...appreciate you taking the time to respond.

My suggestion is to avoid FP early walk-in if possible. It is purely based on your luck, the workload of the office at that time and finally the type of person you have to deal with.

My friend who is based in Florida had a very bad experience. Though he ended up getting his FP done he went through horrible 40-45 minutes of waiting. Be prepared to tell one compelling reason why you can't come on the schedule appointment day.

As per my friend it seems the Supervisor (a Lady) told him that it affects their day to day schedule (they have to squeeze one or two extra appointments just because you walked-in early). The last thing you want is an unhappy person doing your biometrics improperly. You don't want to get an RFE 2-3 months later to redo it.

I've read here that lot of people have walked-in without any issues but as I said its purely based on luck. I know you could get your EAD and perhaps your GC faster but having waited this long the extra 10 days wait is not a big deal - At least personally for me.

Note:- If you are not in a Big City and if the FP office is generally not very Crowded it may be OK - I don't know.

Thanks for your response. I had figured that by now our kin would would have driven the folks at the ASC crazy with all sorts of "compelling" reasons to "do this early" and thats why wanted to make sure that I didn't end up all embarassed (especially infront of my own kids) by showing up there out of turn. I do have a genuine reason to get this done asap due to h1 queries but I think I will wait for a couple of weeks....certain things are just not worth it I guess.

We attempted a walk-in (husband travels and I have an India trip booked at the time). Was very much embarrassed by the lady officer. Do it if you have absolutely no choice.

My husband ended up cancelling all meetings that week and I spent a bunch of $ to re-book my ticket. We are going on the scheduled date. Not worth the look from others on the line at all. Its pretty humiliating.

Think about it.. If you just want to get it done, there is no difference for Feb and Jan filers what so ever since it will be at least another 2 months by the time Jan filers records are picked up

For BC, I had prepared affidavits etc, but lawyer said, don't send unnecessary stuff, only if they ask for something in RFE, we shall send. Similarly 15 days after sending, the doctor called me to provide new sealed envelopes with corrections to the forms, he had screwed up in one place, but lawyer told me to hold onto those and only send if RFE. Lawyer was correct, no RFE, direct approval.

Has anyone in this forum put their EAD to use so far ?

Got my EAD and am planning to work part time with a different employer.My understanding was if you used EAD then one would lose their H1B status. But after speaking to my lawyer she says as long as you meet the conditions of the H1b ( 40 hrs etc) you can technically work part time on EAD and still be on H1b????
Not sure if the information is right.

Folks please fill me up here with your inputs.....

Did you read my reason? I have an India ticket blocked and MY CHILD is left back in India due to the sudden craziness of date movement. You would know if you have a child and if she is left back 4000 miles away.

And FYI, my GC is NOT going to come any sooner because Jan filer's file is not going to be picked up anytime soon and + everything is Priority date based and I don't care much for the EAD coz we have very stable EXCELLENT jobs. No issues there too. I just need to go get my CHILD back ASAP

As far as i know we can not miantain both EAD and H1B status at the same time..here is a link from murthy site.

Attorney Murthy : A person has to receive the EAD in order to work for a new employer on the EAD. Merely having an approval notice or seeing the approval status on the USCIS WebSite is not sufficient to be able to work legally on the EAD. A person does not need to do anything to switch from H1B to EAD. Merely by working for another employer on an EAD, a person is deemed to abandon the H1B status and opt for the EAD, unless the person requests the new employer to file an H1B petition extension with the new employer, in which case a person maintains both statuses at the same time, which is legally permissible. Only after travel abroad and reentering the U.S., a person has to choose to enter as a parolee or on H1B status, but, then, as stated above, one may revert to H1B status by filing an H1B extension even if one enters as a parolee, if one is still working for the same H1B employer.

Hi,

Got two emails from USCIS on primary(spouse) I485 and I765 with similar messages. For I765 it was :"On February 22, 2012, the post office returned the notice we last sent you on this case I765 APPLICATION FOR EMPLOYMENT AUTHORIZATION as undeliverable. This may have serious effects on processing this case. Please call 1-800-375-5283 to update your mailing address for this notice to be re-sent."

As I mentioned earlier the company attorney received all six notices (3 primary + 3 dependent) while we received only 3 notices for the dependent alone at our mailing address (which is/has been the same for more than 2 yrs). We are pretty sure that the forms carried the same correct addresses so not sure why this occurred. Apart from calling USCIS is there anything else that we should do to prevent any further problems or hiccups?

A quick update - the company lawyer mailed in today confirming that they have received the receipts for both my spouse and me leading to great relief. Both our statuses are visible in the system...

:) yeah man frankly speaking all theories eventually fail with USCIS.

Anytime now. Only factor against you is your ND is late, meaning your RD also might be late. Right now they are seeming to be dipping into December first week around.

My Rd is Dec 15 and notice date is Dec 19. Also, TSC has gone super slow in the last 1.5 weeks. They were on a roll during the first week or 10 days of Feb. These last few days are really hard to get by because you know you are so close yet so far.

Btw, now you can enjoy an awesome St. Patrick's day..paint the town green

I am sorry but I disagree with you. I was not the one to start it. Again, going early for FP for Jan filers will not change a thing in processing times. Without getting the facts, it is not correct to comment.

If ASC allows early walk in, and stakes are high as is for EB2IC who live in constant fear of retrogression, and some folks have valid personal reasons too, on the whole I personally understand both sides of it, and am not going to criticize person who did early walk in.

All my life I was afraid of trying anything out of ordinary, making any special requests, staying on straight line religiously, always agreed to whatever was thrown at me. This time I did make phone calls for SR for FP, I called to obtain tracking numbers, I did early walk in, and was prepared to do anything and everything allowed to me.

As far as i know we can not miantain both EAD and H1B status at the same time..here is a link from murthy site.

I was under similar assumption that once having used EAD (even for part time) one would lose their H1B status until i spoke with my attorney.
Having had this strongly wired into my head i am a bit optimistic now after doing some more research on various forums.
It appears that one can use EAD for part time purposes and still maintain H1B as long as the conditions in the LCA are followed.
I still have to do more research and crawl through some more lawyer forums.

I did early walk-in too, and I have a couple of reasons for that...
1. We got two different appointment dates, 4 days apart.
2. The ASC is 70+ miles away and the appmt is at 9am. Given the erratic winter weather conditions and the morning traffic into the metro, I was worried that the chances of missing the appointment are very high.

To preempt unnecessary complications, I decided to walk-in on a day and time that is more convenient for me. I'm a Jan filer and with PD in mid 08 and I don't expect early walk-in would in any way benefit my case.

Thanks for the wishes Sandeep.I am done with my FP and did it on the date that was assigned to me :) . I had tried for early FP in mid january but was turned away at the ASC, at that time did not know ..one could try at nearby centres. I wish had done that because that would have literally shaved off 3 weeks of background processing.

Anywaz hope TSC starts looking at Dec filers soon.

It is not a question of ascribing names . TSC has not been really straightforward in updating its processing times preventing people from generating Service requests. Also the pattern of approvals is based on early FP + RD dates throwing out the concept of PD.TSC is approving March 2008 guys leaving July -Dec 2007 guys standing.

Nishant, Congratz on your GC! Loved reading your story.

Your situation (Dec/Nov filer) is different from Jan/Feb filers. PDs were swept across a whole year (almost). As of today, ASC is still processing only November and December Filers. When my file is picked up, regardless of an early walk-in or not it would be processed at the same time. So, there is really no difference what so ever and I am not causing harm to anyone by going in early and ONLY because my personal situation demands so.

If I were allowed to do an early walk-in Feb 2nd week, is my file going to be picked up and I get a GC in 3 weeks (like you?) Honestly No because ASC is still processing Nov and Dec filers.
If I went on the scheduled appt date of Feb 27, is my file going to be picked up late? No.

So, really for Jan and Feb filers, it makes no difference + FBI turn around time is 24 hours.

I agree, there is more predictability to the beast with NSC than TSC, if we can use the word predictable that is.

NSC is going by RD a whole lot. Within a period of RD they are looking at, all the dates that are current at that moment, are "allowable" without regards to PD.

Only quick inventory making, retrogression, gradual movement in batches, can control ordering by PD, that is my conclusion. Right now is bonanza time though, and those who get lucky, are akin to have made hay while the sun shone oh so brightly for them.

With February coming to end soon; latest processing times (updated on 02/21) for NSC indicating I-485 processing times of 4 month and with majority of November filers still pending, do you think we will see a lot of approvals before the end of feb. or NSC does not care if they see a whole bunch of SRs created in the first week of march from pending Nov. filers.

per trackitt data, more than 50% of nov filers are approved, around 10% have RFE (meaning file is touched), and there is tendency of many users to add record to trackitt when they are approved. So I would like to say around 70% of files have been touched (approved or RFE), and there is still few days to go for Feb to end. I think if they get to 80% of Nov filers approved by Feb end, that would satisfy the MAJORITY of Nov filers that you talk about. And I think that's not bad.

There will always be few outliers, due to various reasons like delays in name checks, some special circumstances warranting review by supervisors, or an IO who took over some files but went out sick or on vacation. The rule about the name check is that if they dont get response for 180 days, they can issue GC, and later on they can cancel GC and start removal proceedings if derogatory information comes back in name check.

I think a Nov filer who does not get it by Feb end and is from NSC, should wait for a week more, maybe see how April VB is if possible, and then open SR with USCIS and can also approach congress or senator person. No harm in trying all avenues.

I am personally expecting a lot of approvals from NSC now till end of Feb.

As of this moment, 71 cases out of 156 filed at NSC in Nov. 2011 (as per trackitt tracker) are approved which is about 45% (less than 50%) and 15 cases are pending with RFE (about 10%), and a 70 cases (approx the same number as approved -45%) are still PENDING without any RFE. MAJORITY of cases have been touched. USCIS basically means that they will TOUCH more than 50% of the cases within the processing time released. This means that TSC will touch atleast 55% of the Nov 2011 cases by June 2012.

70 miles only ? i am in the east coast , and they had sent appointment for a west coast center :) had to do the early walk in.

it seems it all depends on the center; i went to one in Alexandria, VA and was done in < 30 minutes.

Sorry for bugging you guys so much with my RFE details. 2nd request below is still annoying me.

1. Evidence that I tried to find the birth certificate and was unable.
2. Copy of I-94 that was issued in May 2005, if you have it.
3. Any employment authorization documents that were issued for her benefit.

For the first one, I applied for Non Availability Certificate in India and will be getting it in a week or so.
For the second one, I don't have I-94 card and I am planning to send them the passport copies containing the port of entry and date for May 2005. Do you guys think, that would be sufficient?
For the third one, I am providing all copies of H1's and OPT Card. Is it enough?

I felt like this is easy to get, but now it became much more complex issue.
I applied through e-seva for Non Availability Certificate for not having BC. They rejected my app saying how is it possible that I was born in one municipality and studied in another municipality even though both of them are in the same city. My dad couldn't convince the officials saying that it is possible.
Now, I am taking different routes to get the work done. I will keep you guys posted.

Regarding I-94, I went to airport and requested them. The official politely refused and told me to use form 102.
I sent the stamped copies of my passport for that date when the I-94 was issued to my attorney and looks like it is good enough as per him.

Called Level 2 again today and was told that its pending review. Looks like no one has looked at file. Since its same status since last week , I believe if they had looked at it it will not take more than couple of days to approve or issue RFE. Will call again in March first week.

few days after my status went to Card/Doc produced, the status changed to Decision this morning with the following message. Is this something to worry about, am i still greened? I searched on G , and the ADIT refers to some additional processing before the GC is actually sent, however ,would like to confirm with others here. Any idea how long it would take to get the actual card in hand?

If you are talking about receiving email/sms notifications after submitting your applications, once you receive the receipts for your applications, you can go to https://egov.uscis.gov/cris/jsps/termsconditions.jsp?contextType=CU_EN ; create a new account; add your receipt numbers to your "portfolio" and subscribe for sms/email notifications. Once you've done that, you'll receive notifications on important updates to your case.

I'm not sure if there is a different way to do this.

For getting email/sms confirmation of your application *reaching* USCIS, you need to include a Form G-1145 with your application. After acceptance, you need to follow what tackle said below to get email/sms for any updates to your case.

Thanks Sandeep for your wonderful words, By seeing your post itself I was very emotional. Hopefully I will be greened very soon( But I am from TSC, hopefully TSC picks up like NSC).
Finally called Customer service to report that I did not received my EAD even thought i received approval notices couple of weeks back, she had taken all my info (including address, phone, email) and sent out Info that I did not received my Card. Later I asked her to transfer to IO, she did, but she was not sure about L2 officer. IO said that my file is processing fine and no issues till now, I am not sure if she was able to see all info on file but said she cannot tell if my Name Check is cleared or not.


grnwtg, if i guess right you should be greened today or tomorrow. Hang in there and you will have your magical moment.

a couple days back, my 3 year old daughter, dropped a toy in her bathroom and flushed it. since then water is clogged. I will have to get plumber, probably replace toilet, expenses maybe 400 dollars and lot of headache. I at first got frustrated and bit upset. But as soon as saw daughter's face, forgot all of it. I remembered all the mistakes I did in my life, and as much more grown up than her. What then to blame a 3 year old child, your own child. I will just do the needful, get it repaired, and remove all small toys from the bathroom replaced with the big plastic rubber type bath tub toys

few days after my status went to Card/Doc produced, the status changed to Decision this morning with the following message. Is this something to worry about, am i still greened? I searched on G , and the ADIT refers to some additional processing before the GC is actually sent, however ,would like to confirm with others here. Any idea how long it would take to get the actual card in hand?

Just checking if anyone else from the forum with a RD of early Jan still waiting for EAD/AP? I believe that the norm of NSC is generally 45 days for EAD. I am now at 50 day mark and no activity for our applications. I am now starting to worry and agonize.

My RD is 01/04/2012. Received EAD and AP On Feb 16th for both me and my wife.

Service Center : TSC

We did not receive FP notices yet. Created SR regarding the same on 02/08/2012 and they asked me to wait for 15 days and call back. I did call back today again. They said it is not scheduled yet. They suggested me to send a email to some tsc email about this SR.

Not sure whether to send the email to them or not. Does it slow down any of the processing. I am seeing Feb filers also getting FP notices. Is it normal.

btw guys, if you notice carefully, the blue status circles on the status message screen, they have a de-facto meaning. for eg, Acceptance if you mouse over, it shows the meaning, same for initial review, decision, post decision etc, and hence in your detailed status message, it always ends with the de-facto status meaning, the main thing is the text before that. Hence a Decision status is always going to have the paragraph about during this status, formal approved denied etc will be mailed. No need to worry about that.

RC, I can understand buddy. We have not been to India for 4.5 years now and have/had planned avisit to India in Mar last week/Apr. Every mail/SMS i am like... is this it???? Lets hope we all get atleast the EADs soon, as GC for us JAn filers is still a distinct dream.

For your toilet problem.......go to Home Depot, buy a heavy duty plunger (hockey stick shaped with a handle at one end which has a steel wire attached to it that passes through the hockey stick like hex tube) and follow the instructions. Same thing happened to us right after buying our house and the plumber came and did exactly that and charged a fair bit for it. The plunger is about 50 bucks and is for life and works like a charm. Usually you can break the plastic toys with it (done it multilple times now - have 2 boys who always end up sticking something or the other in there) and flush them away.

I got my GC in hand of 1st Feb and was thinking looks like this is a lucky month. But so far two issues, none resolved. Wondering what's there next, as still have one more week to go for this month.

i was going to ask you after a couple of days ....do things really change?
And it might for some or many but i got a feeling that the journey over the last couple of months after filing abd before getting the gc(as long as its few months) is more exciting.
For me ...i think at times...nohitng is going to change immediatly but will surely open some options for the future. BUt i m the same guy, the worrier...i think i will find something else to worry about...."what will happen if i switch jobs before 6months from gc...what if i just quit and stay home" btw the later is a wild dream...i know i cant survive a day..but i joke often that i have mastered the art of doing nothing. :) ...ok back to work.

NSC is promising 4 months for 485 after which we can open SR. Considering that some of Dec filers have already started getting greened, I would hope to see some of the GC's trickle into the Jan 2012 filers bucket in a month. If the VB does not retrogress to a date prior to our PD's in 2008, I think we could get lucky by March end-April mid.

My RD is also 1/4 have not received FP with in a month, I called them on 2/8 same as you. I have received mine on 2/11, Also EAD/AP approved on 2/10. I was thinking opening SR triggered everything. In your case I would say email them. Is your EAD/AP approved?

I believe we have a decent enough data size for Nov + Dec + Jan filers on Trackitt that we should be able to get 95% confidence intervals of the number of days its taking to get EAD/AP/GC. We can safely assume it to be a Normal distribution :) to do the math.

My Phone beeped twice today noon. Tadan... Tadan... CPO email came u came u... I think I can see GREEN now. Its such a great relief after 8+ Years of Stress & Struggle.

BC was registered in 2008 for spouse & self. Got Lucky with that.
Been with employer since 6 years.
No RFEs, 221gs no other immigration issues.
Employer is Fortune 500 IT company.
Currently Not working in PERM location. Been consulting across states. Got Lucky with that too.
LCA was filed whenever location changed, no H1B amendments filed. Got Lucky with that too.

I wish all the folks waiting the Very Best. Hope everyone gets RFE free & Speedy approvals.

jo ho gaya woh ho gaya. what happened has gone. get your GC and let's start life afresh after that. I am hoping my parents get visa this year. I have lot of hope and positive energy now, GC has revitalized me.

a couple days back, my 3 year old daughter, dropped a toy in her bathroom and flushed it. since then water is clogged. I will have to get plumber, probably replace toilet, expenses maybe 400 dollars and lot of headache. I at first got frustrated and bit upset. But as soon as saw daughter's face, forgot all of it. I remembered all the mistakes I did in my life, and as much more grown up than her. What then to blame a 3 year old child, your own child. I will just do the needful, get it repaired, and remove all small toys from the bathroom replaced with the big plastic rubber type bath tub toys

My RD is also 1/4 have not received FP with in a month, I called them on 2/8 same as you. I have received mine on 2/11, Also EAD/AP approved on 2/10. I was thinking opening SR triggered everything. In your case I would say email them. Is your EAD/AP approved?

What I have noticed among friends who are with TSC, they received FP notice anywhere between 15 to 45 days. Some recvd their EAD/AP before FP. So, I'd say wait till tomorrow and then send them an email after checking your mailbox tomorrow.

Another update: Received EAD approval and mailing msgs today. One msg at 4:00 AM and other one at 7 AM PST. First one said Card production ordered on 02/21, 2nd msg at 7:00 AM said Card mailed on 02/23. AP was approved on 02/17 and mailed but have not received it yet.

FP: 02/02/12
EAD/AP: 02/23 and 02/17 (approval dates, waiting for actual card in mail)

I just got greened and didn't expect until late next month...Everything seems surreal to me..After 6 yrs with same company...12 years in US....

I have been lurking around this forum for close to 2 yrs now and you guys have been great (you guys are like band of brothers). Always logged to this forum whenever I felt frustrated because of immigration issues. The frustration was due to not being able to change roles from engineering to marketing or product management (post MBA - finished with $30,000 out of pocket expenses) and staying away from my wife for 1.5 years. She is in J1 visa (medical resident) in NJ and I'm in New England.

Hopefully the GC should alleviate some of the frustrations.

My PD is OCT 18, 2007

If you are in J1 you cannot get your GC unless you go through 3 year Waiver requirement or 2 year home return rule..so for now no GC for my wife....lets see what is in store for us...GC for me seems useful..but no idea what has future planned for us...:-)
