Guys:
Received mail from USCIS tonight abt my 485. I hope its an approval. I did a basic search on ADIT processing and seems like its the usual and that its an approval. It was little weird, I received 3 mails in 4 hr period for the same case no:, the first was saying status as "card production", then the last one reverted the status to "Decision" with below text. Also, I didn't receive anything for my wife yet.
Your Case Status: Decision
On February 14, 2012, we mailed you a notice that we had registered this customer's new permanent resident status. Please follow any instructions on the notice. Your new permanent resident card should be mailed within 60 days following this registration or after you complete any ADIT processing referred to in the welcome notice, whichever is later. If you move before receiving your card, please call our customer service center at 1-800-375-5283.
Is it normal for the dependent 485 to be processed separately. I didn't even see any Soft LUD on her case (LUD: 12/13/2011). Her 485 was filed along with mine. We both received EAD/AP together. Her EAD receipt was missing, but the FP carried her EAD receipt number, so didn't bother to open any SR. I googled to see if its normal for the primary's 485 to get approved and dependent's 485 pending. I see some horror stories, where ... in case of separation, the wait time has sometimes been greater than 2-3 years.
Anyone was or currently in same boat? How to handle this. How long should I wait ... say before calling TSC/opening SR/Infopass/contact congressman. I don't how my lawyer would handle this. Will send him mail, sure it will be around next week that I will see a response from him.

Congratulations! You have been greened - there is no doubt. About the dependent case, it is not unusual for the dependent case to take a couple days longer than the primary. Wait for a week or until you receive the physical card and if nothing has happened by then, then you can start going through the usual route of infopass etc.

Y'all received the Receipts one by one or 6 together? Ours is one missing still.

Usually the receipt numbers are consecutive. So, based on your sequence determine the missing receipt number and check the status on USCIS.
If you are missing the 485 receipt and if you can check its status online, then dont worry about it.
If its the 765 or 131 receipt and if you want them ASAP, then SR is the way to go. Kindly wait atleast two weeks (about 10 business days) from the day you received the other receipts.

I called USCIS and Level1 officer told me to wait till my processing time become current. Right now they are processing March 24 2011 cases.
I asked to transfer to Level 2 to find out more details about case and I am concern that I may have RFE but not able to know since I can't track online. I was transferred to Level 2 and was told that I 485 is under review and haven't made any decision yet. They are reviewing and everything seems fine with application. Hope Level 2 can see step by step progress like Docs ok , All Checks ok .. etc.. Hope to hear back soon.

And, 2 from Andhra-Pradesh have seen activity in their cases (1 approved & 1 RFE) while the other 2 from Tamil Nadu are still waiting in limbo.

A copy of RFE will also go to your lawyer - so you will not miss it because of post issues.

Well... it's finally come down to this. Any November filers from Tamil Nadu got GC approved? As I've mentioned in my previous posts, 4 of us with same PDs applied in November. And, 2 from Andhra-Pradesh have seen activity in their cases (1 approved & 1 RFE) while the other 2 from Tamil Nadu are still waiting in limbo.

I called FBI # given in this forum and confirmed that on the very next day of my FP completion FBI send the results (FP) to USCIS. What else???
I am sure I am lazy to dig the forum to find the answer for above question

Not all will qualify. Some will be stuck in RFE, some in background checks, some will be stuck on I-140 approval for concurrently filed, some will slip through the cracks, and so on. And I think some QSP per month also being given by CO, else it would be just 3,600 visas for EB2 each month, not enough for such huge approvals. You are correct though, as soon as huge approval numbers begin hitting DOS, CO might start frowning.
man I hope this year is it for me, so close yet so far, I will die out of craziness.
Thanks for the response. I totally get what you are saying. It's the principle of the thing... after the waiting for years, the 485 dragging on for months is just annoying.... I know I'm supposed to be focusing on other things, but it's hard to get out of 'waiting' mode. :P

You're done with FP and you've received your EAD/AP. There's not much else to do but sit and wait now.... I don't think there is a way to track the stages the application is going through, or we all would have done it :) Luckily, you are from NSC. Since they list their processing time as 4 months, you can call them after that time frame.

The thing is I am super hiper active..and I can't sit idle..Since the day I complete my FP and picking up fights with every one..bcaz I don't know what else to do!

In addition to the 2 of us from TN, I also know that one of my other friend (from TN) who applied in Oct (PD: May 2007) is still waiting for some kind of activity on his application. So, I was just curious if any of the Nov filers from TN actually got their GCs approved or received RFE. I found from my friend that in addition to FBI NameCheck, there is also a IBIS check that might require local officials to respond to name-check queries.
I'm just trying to find some kind of reasoning behind so many OCT/NOV filers on Trackitt are still waiting in limbo while DEC filers have started receiving approvals. In my opinion, I don't think the approvals are random (in the sense that some USCIS officers are more efficient than the others). I'm sure this is due to some internal process that USCIS is following.

They are going by alphabetical order for the Indian states. :)
Here is the SQL order by clause
--ORDER BY PD,INDIAN_STATE
Relax man, it will come when it has to come. Data Analysis is good, but making derivations and assumptions out of co-incidents doesn't help much. We are all waiting here and its indeed been a frikkin long wait.

yes, something similar happened to me (and my dependent).
Email alerts on 2/10:
9am: Card Production Ordered
11pm: Same email
11:45pm: Decision email ("we had registered new permanent resident status" is the summary of one paragraph, and another para with this confusing text:
During this step the formal decision (approved/denied) is written and the decision notice is mailed and/or emailed to the applicant/petitioner. You can use our current processing time to gauge when you can expect to receive a final decision. )
Yesterday's email alerts:
3pm: we mailed the new card directly to the address we have on file
midnight: Decision email (same email as the last email on 2/10).
SMS alerts also came corresponding to each email alert (SMS msgs just say that case is updated). Actually, couple of extra SMS alerts overall.
Online status is currently showing the status as "Decision".

What do the experts think? Will the demand from Jan filers be met by Q3 quota or do we need to wait for the beginning of Q4? I'm assuming that the agencies will be busy processing Nov and Dec filers for the rest of this month and all of next month (Mar).

I have been noticing a trend with TSC . The FP completion is mattering a lot.Roughly 2 months from FP or about 40 days from FP most of the Jan2008/Feb2008/March2008 PD guys have gotten greened from TSC.
My application reached TSC just a few days later compared to yours however the FP appointment was literally given end of Jan ( probably due to CA centres being logjammed) .
Atleast with TSC...PD is irrelevant right now within the short window of Nov/Dec Filers.

Hmmm... I am from TN too. One of my friends from MH with PD 06/07 (PWMB) is still waiting (TSC). I think luck plays some role here.

I don't think TN is a special case here. I am from North India and let me assure you when it comes to corruption and lazy bureaucrats, all Indian states are pretty consistent :-)

I am not an expert and I don't claim to be one. But as far as I have read, only for CP cases you need clearance from your local police station (in India). For AoS you don't, as you are already a US resident.
Background check when you take up a new job is different. Several companies will verify with your prior employers abroad too (again depends on the Co. and the position).
But like I said, I am not an expert :)

I noticed from your signature that you filed an I140 amendment (SOI), how long did it take for you to get the I140 amendment approval? I work for a management consulting firm which got merged with a larger company and i was required to file an 140 amendment - just wondering how long does it take to get this approved? I am a Nov filer with Sept'07 PD.

basically if your case status says mail picked by USPS, you directly call customer service, and say you need tracking number. They will verify your case status and redirect you to higher level officer who will verify your name, date of birth, address and provide you the USPS tracking number.
If your case status says card is ordered and should get within 30 days, the customer service person will ask you to wait for 30 days to be over, and depending on your luck may redirect you to higher level officer.
This is applicable only to "cards" , EAD/AP or Green card.

Completed fingerprinting this AM. Went in a couple hours earlier than the time listed, but there wasn't a big crowd so we were taken in immediately. They took at least 20 prints from each angle for both my spouse and myself. Just the index finger for my 7 year old :) We were in and out in 30 mins.

Well... it's finally come down to this. Any November filers from Tamil Nadu got GC approved? As I've mentioned in my previous posts, 4 of us with same PDs applied in November. And, 2 from Andhra-Pradesh have seen activity in their cases (1 approved & 1 RFE) while the other 2 from Tamil Nadu are still waiting in limbo.

Why do you think you got the RFE? Did your BC not have your name or your mothers name on it? Or not have a full name for the mother or have something misspelled? There are many folks here who have BCs with just first name of mother and some missing the newborn's name altogether.

I noticed from your signature that you filed an I140 amendment (SOI), how long did it take for you to get the I140 amendment approval? I work for a management consulting firm which got merged with a larger company and i was required to file an 140 amendment - just wondering how long does it take to get this approved? I am a Nov filer with Sept'07 PD.

well from what I have learnt ..every SOI case (the organization) is different...It really depends on how the new company is taking over or buying or merge
in my case it was a partial merger, and Fragomen was the attornary..that guy stadied situation for 6 months before filing the case..after filing SOI the approval came in 134 days.

Following this forum for over a year taught me so much.... I made sure I included a couple of affidavits along with my BC (late registration) even though my attorney said that would not be necessary.
Good to know that the RFE was about a trivial thing.... you will be greened soon....

I have a question post EAD/AP. Can I do any kind of job I wish to....
For matter of debate, can I work on 2nd job while on full time with current employer, as a PLUMBER if I wish to? or does that 2nd job while on EAD/AP has to be related to my current occupation or similar field?
No speculations please, I'd prefer someone who has more than "I think" answer. I am sorry. I know an attorney would be best choice, but just wanted your views.

I'm thinking it may have been misplaced.my bc had all names and fully spelled. It was taken within 2 months from birth too. So no additional proof must be needed.

What do the experts think? Will the demand from Jan filers be met by Q3 quota or do we need to wait for the beginning of Q4? I'm assuming that the agencies will be busy processing Nov and Dec filers for the rest of this month and all of next month (Mar).

In my opinion, this mainly depends on the location and the number of moles that the applicants have. Another important factor is how the stars are aligned with respect to the applicants zodiac. </grumpy>

Probably not. But I think you can at the very least hope that you don't get RFE for fingerprints that were not clear. I've seen cases where applicants received RFEs asking them to get their fingerprints taken again. For BC this is what my attorney told and I found on uscis form instructions
(1 ) Child name should be full , FirstName MiddleFullName LastName
(2) Both parents name should be full.
(3) Birth date and date of registration should not be far apart , date of registration should be before child turned 18 years. Sooner is better.
If you have all these there will not be query on BC. my lawyer mentioned that some of his clients were not able to get BC in this format when filling window was short and they submitted as it is few got RFE , few did not , He asked me same when we were submitting ours. This way if affidavit needed and parents are not in USA and if you think it will take a while you can get it done once filled I 485 and be ready for RFE if ever arise.

I am wondering what exactly happens since my Finger Prints are not yet avble for them to process.
Bottom line, is there any BC for EAD/765 thus shortening the time for actual I 485 process? Example a Name check is independent of FP right?

I just mentioned all dependents and marked as not filing and didn't attach my kids birth certificate. I think this is not of any concern.
Also worst case, RFE comes in and send the copies of birth certificate and will be cleared in 2 to 3 weeks.
Simple RFEs are not a problem and not a concern also. To me it doesn't matter if I get GC 2 to 3 weeks later so do not be obnoxious about RFE unless its a complex one. :)

You don't need it for US Citizen. If sone got RFE may be because they have one kid born in India and other here and officer overlooked country of birth.

Yes, I agree with u completely.
Another thing, if asked to prove bonafide marriage, child BC is useful. Mostly such RFE is only for recently married folks, in which case anyways a child may not be present.

I was asked by my attorney to submit a copy of our US born child BC, but he clarified that it was more of a secondary evidence to prove bonafied marriage (other than MC) because it has both parents names on it.

I submitted my birth certificate along with an affidavit signed by both my mom and dad. If I get an RFE asking for secondary evidence, will a copy of the secondary evidence suffice? That is, if it is something I need to get from India, can I just ask my parents to scan it and send it to me?

my lawyer had asked me to submit secondary evidence on top of the affidavits from my parents. I ended up getting it from my uncle and from my grandfather.
Since they ask for copies, i am sure a scanned copy should suffice.

I dont think the USCIS requires any originals with the filing. They might ask for it later but that too is very rare..... atleast to the best of my knowledge.

I dont think the USCIS requires any originals with the filing. They might ask for it later but that too is very rare..... atleast to the best of my knowledge.

@gc500, yes. In some cases, you need to check with your employer first, if they are ok with it. To make sure there's no conflict of interest and you are not actually using employers time to pursue other interests. All big companies have this listed, when we sign employee forms.

USCIS notifications are broken as well all know.
We completed our FP yesterday morning, and at 6:00 pm in the evening, I received emails saying there was 'post decision activity' on my AP and another one saying EAD had been approved and card production had been ordered. No emails were received for spouse's and son's AP/EAD approvals. Online status also shows updates only my apps; dependents' apps are still under Initial Review. No SMSs were received as we did for the Receipt Notices.
Based on issues reported by other members, is it safe to assume that the dependents' approvals will follow soon and there is little cause for concern?

Hey folks, yet another birth certificate question.....
I submitted my birth certificate along with an affidavit signed by both my mom and dad. If I get an RFE asking for secondary evidence, will a copy of the secondary evidence suffice? That is, if it is something I need to get from India, can I just ask my parents to scan it and send it to me?
I've BC issue too. So I got affidavits from India and sent the original affidavits with my application. I guess if you've to send affidavits from your relative then you should send the original affidavit but if the secondary evidence is a school leaving certificate then a photo copy may work. (confirm with your lawyer)
Aside --Congrats to all those who got their freedom (GCs) and Best of luck to all who are preparing to reply for RFEs. Thanks to every one for all the helpful info being provided. My application was received today by USCIS , so now the wait starts. Brief Info: I came just before Y2K...both of us have masters from US univ. So f1 and multiple H1s... but I work E-V-C model so let's see how it goes

I used this format for BC on a 100 Rs stamp paper. You can get affidavit from one of your relative

This is the exact message my attorney gave when I asked about Birth Certificates
Affidavits from parents are not really acceptable. We can submit them as secondary proof. You need to get one more – from aunt, uncle, grandparents, neighbors, cousins (14 years old at least at the time of your birth), family friends, etc.

Yes Sirisha, you can ask your parents to scan it and email it to you. make sure it is clear and readable. Once they email you the copy, ask them to snail mail or courier you the original for your records.
One affidavit as a secondary proof from Uncle/Aunt, relative is good enough. Make sure the affidavit is in english even the rubber stamp or signature or anything on that affidavit should be in english.

My original BC has my first name only, full names of my both parents, date of birth and date of registration - within 17 days of birth & hospital and place of birth. Everything is in English.
After I showed it to my attorney, she asked to either get affidavits or have the BC reissued. She suggested a reissued BC would be preferable if I am able to get it. The reason being the BC needed to show my full name. This was last year.
Thankfully, last Fall I was able to get my BC reissued with my full name. This one is bilingual but thankfully, it is obvious so I don't need any translation. Has anyone used a copy of reissued BC? Did you encounter any problems yet? Did you submit a copy of the old BC?

RFE are random. So do not worr much. My BC had full names of parents and mine. It was in English registered after 33 days of birth. I still got RFE for BC. There was no other reason mentioned.

Original had dates, parents' name, etc. hand written and in local language.
About 2-3 years back, my father went to our Municipality and got new one with my name and everything. It is computerized and bi-lingual(Eng/local).
It has my original registration date but also has issued date as the current date. And it says Certified Copy and not the original.
Did had any problem.

Website mentions that EAD card production ordered but says nothing for AP. I know that these are combo cards but just want to make sure since we waited to travel. Does it really take 30 days to receive the cards? The website also says that for AP the notice has been mailed but not for EAD.

Yeah, I was pleased for sure. My uncle who lives near my birth town had to make a few trips, explain a few times why it was needed, show a copy of my passport etc. The funny thing is they have now put my record online so that I can ask them to reissue it and mail it to me any time again just by clicking a few times sitting right here in the US. It is simply amazing.

If I-140 file is with NVC and one has field for CP to AOS, does USCIS need to get that file back inorder to send FP notice or for processing EAD/AP. Is it possible to get EAD/AP approval even though file is not yet transferred back to USCIS.

what they ask in BC related RFE seems to be random. I submitted my BC along with affidavits from mom and dad separately. BC was registered sometime after 2000. I think that is what most others would have done too.
Got flu shot as per civil surgeon's list. Looks like those who got RFE for influenza are due to civil surgeon's goof up.

The rule is that when you are going to your home country its fine but while you are coming back you may need to have the transit visa if no stamping. Best to go by one of the direct flights if possible if you are going over the Atlantic.

This is exactly the same RFE, that one of my colleague received and this is what he did.
He got a School Transfer Certificate from his High School (Class X) with all the details, which are present in the Birth Certificate.
A ration card with his father's full name, his mother's name (but no last name) and his name along with date and place of birth.
He submitted them along with 2 affidavits from his father and uncle.

Nishant mentioned earlier that I can use Form 102 to get lost I-94 card.
Do you guys have an idea, how can I get a lost I-94 card for may 2005. After that I never went out of US on H1, so that is last I-94 card and I had 4 H1's after that and all of them are with the same company.
I came back yesterday and they issued me a new I-94 card, which has Advance Parole stamp on it.

ontheedge, it is very common to have one's EAD approved and not for the otherhalf... give it some time and you can always raise an SR once you are over 75 day mark...

If you are currently living within the commutable distance of the same international airport, which issued that specific I-94, you can visit the CBP and request them for a copy of it (Customs and Border protection - where the parolees' are interviewed - not the immigration counter)

While filing our Attorney didn't ask for his 140 approval. So on his 485 reciept PD is set as Feb 9th - Receive date
Is this common? I have read that if dependant have their own PD then it will be used? Should I be concerned?

Its interesting USCIS is asking for your old i-94. Because all your subsequent H1 extensions would all have the same I-94 number (in the bottom right portion of your approval notice) as the one issued to you at the airport back in 2005. I would not worry about it too much.

1 week for receipt and plus 1 week for FP notice had been a consistently successful estimate.
My application was mailed on Feb 8th. I tracked it on FedEx. It was accepted Feb 10th. ND is I am assuming Notice Date..How/When should I expect to know the ND?

You seem set. However, refer to leo07's note above as to randomness of the RFEs.
I'm surprised you managed to get the BC reissued with the full name. The Brihanmumbai Mahanagar Palika flat out refused to add my mother's and my last names to my BC. Nothing could convince them otherwise.

Yeah, I was pleased for sure. My uncle who lives near my birth town had to make a few trips, explain a few times why it was needed, show a copy of my passport etc. The funny thing is they have now put my record online so that I can ask them to reissue it and mail it to me any time again just by clicking a few times sitting right here in the US. It is simply amazing.

what you have seen is common, but in my case we provide i140 for my wife and me with her A# from her I140. the receipt had her PD.
You should be ok but talk to your lawyer once. Its new to them too, ine user on this forum had a lawyer who knew that this change had been recently made.
since his priocessing will be with your case no need to worry actually.

Thanks pdmar08. His 485 receipt does have the correct A# from his 140. I will talk to my attorney and see if they have any insights on this.

Update - I got all the receipt notices in the mail yesterday. MD - 2/3, RD - 2/7, ND - 2/10, NRD - 2/16.
My attorney mailed the AOS applications on 2/3 and I am waiting for the receipt notices at this point. Will update once I receive the receipts (hopefully sometime next week).

One of the ways may be ask your parents to do an affidavit and present it to them for changing the record. I think Maharashtra Municipal Law allows that.

I had to correct the spelling of my father's name on the report, so I did get affidavits and a bunch of other stuff. They took their time but corrected his name (his full name) on it. What they refused to do was to add my last name or my mother's last name. Nothing i said would move them on that issue. If I get RFEd for it, I'll provide affidavits from my parents (which my lawyer asked me not to attach to the original packet, and keep as RFE response material for the future).

This is exactly the same RFE, that one of my colleague received and this is what he did.
He got a School Transfer Certificate from his High School (Class X) with all the details, which are present in the Birth Certificate.
A ration card with his father's full name, his mother's name (but no last name) and his name along with date and place of birth.
He submitted them along with 2 affidavits from his father and uncle.
I received an RFE to submit Non Availability Certificate, which I applied through ESEVA and as per them it will take 15 days to issue.

I did some case status search for 3000 SRC numbers. The Image attached shows results . Based on the above data i extrapolated the data for 30,000 Dec filers.
Totally 8360 485 Applications Were Received and 800 are approved.
Totally 10280 765 Applications Were Received and 8620 are approved.

I have a question on different note. I have submitted 3 affidavits(mother/ grandmother and uncle) during 485 application in dec as my birth certificate has my parents name wrong, DOB wrong and does not have my name. I have seen some entries by others they are being issued even with affidavit. Is there anything I can do ahead of receiving RFE to substitute the birth certificate as I have almost given up on birth certificate correction battling with the issue since november.

Teddy did not receive one, his own 485 filing receipt, he opened SR for that, and it has still not come to him, though he has already got RFE on his 485.
Nishant I have really given up on that receipt. The L2 officer did confirm the number to me on phone and the same is on the FP and RFE notices. So if anyone is missing a receipt best is to call the USCIS 1800 number and just confirm.

I have been a regular visitor to this forum the past two months. The collective knowledge of this forum is mind blowing and I admire the the mature way in which discussions are held here with the ultimate objective of helping people like me. Hats off to the gurus/moderators here!
Now, some really good news. We(myself + 3 derivatives) got greened yesterday. We received our I485 approval emails at around 4pm yesterday. This was a pleasant surprise but I would be happier if all the people here receive their green cards soon.
This is end of a journey but the beginning of another one.

Received mail from USCIS tonight abt my 485. I hope its an approval. I did a basic search on ADIT processing and seems like its the usual and that its an approval. It was little weird, I received 3 mails in 4 hr period for the same case no:, the first was saying status as "card production", then the last one reverted the status to "Decision" with below text. Also, I didn't receive anything for my wife yet.
Is it normal for the dependent 485 to be processed separately. I didn't even see any Soft LUD on her case (LUD: 12/13/2011). Her 485 was filed along with mine. We both received EAD/AP together. Her EAD receipt was missing, but the FP carried her EAD receipt number, so didn't bother to open any SR. I googled to see if its normal for the primary's 485 to get approved and dependent's 485 pending. I see some horror stories, where ... in case of separation, the wait time has sometimes been greater than 2-3 years.
Anyone was or currently in same boat? How to handle this. How long should I wait ... say before calling TSC/opening SR/Infopass/contact congressman. I don't how my lawyer would handle this. Will send him mail, sure it will be around next week that I will see a response from him.

quick update.... Got the cards in the mail today.... as pdmay08 mentioned before, i should have gone for finger printing in suit and all... but no complaints... couldnt have asked for more...
oh ya... for the statistics... i was born in telangana but raised in andhra... dont know if that helped my case ;-) .... Just kidding... I wish all of you get GC asap... Jai Ho...

what they ask in BC related RFE seems to be random. I submitted my BC along with affidavits from mom and dad separately. BC was registered sometime after 2000. I think that is what most others would have done too.
Got flu shot as per civil surgeon's list. Looks like those who got RFE for influenza are due to civil surgeon's goof up.

Not sure I understand low hanging fruit theory. I have a MS in US, been with same employer for 8 yrs.. 3 h1's, no RFE's, No 221g's....the time is near. Clean tax, dmv, no-felony or misdemeanor....Also have one of the most unique first and last name.
Status online still shows not found.
Checking Trackitt, here and egov 10-15 times a day...
We'll see. The time might be near.

Congrats and thanks for sharing.
Folks, wanted to share with the community that my wife and I got our GC notification email today ( Yes Saturday!!). The card/document production date reflects feb 18th.
My friend had turned me into this site in September, and i have been an avid follower since then. Special thanks to the many folks who provide instant info, advice, empathy, humor and rendition of songs :) on this site.
I am not sure of the differences between RD and ND.. but here goes my info:

That seems manageable Teddy - hope you get this sorted soon and get through before any retrogression. Did you not have an EVL in your original submission?
Thanks, unfortunately no EVL in my original submission based on the lawyers advise he said that recent paystubs are sufficient. Now definitely EVL has to be submitted. Hopefully the response will go out by next week.

This is a case of lawyers not following simple instructions. The 485 instructions from the USCIS specifically asks for an EVL. Its not an optional item. Hopefully, this doesn't delay your process too long.

Sandeep, as per trackitt advanced filter search by me, on the whole, still December filers approvals are an exception rather than norm. Very few percentage of folks have got approvals, a vast number of people are waiting.
I think TSC is out on a hunt now to meet a particular target of visa usage, and is picking low hanging fruits (meaning file all ready to go, they have an advantage that they did FP earlier than NSC for many applicants). NSC seems to be focussing on EAD/AP in first major half of this month - I saw a lot of NSC approvals for EAD/AP coming in steadily for Dec filers - this is the third month for Dec filers and they need to give them EAD/AP this month, but just like January, I fully expect them to pick up steam in approvals in second minor half of the month. And for December filers, the main months will be March and April.
NSC has been advertising processing time of 4 months since a couple of years, and they will be getting lot of calls and SR after elapse of that period. Note that however, only now has the situation come wherein many applicants have applied recently as well as will be current, in the past they had no pressure from EB2IC. I hope they dont renegade on their promise of 4 months upon seeing customer service calls and do the TSC way of dismal processing time advertisement.
If nothing till April 1st week, I will call USCIS to make SR. If nothing till end of April, I will ask lawyer to contact ( he told me beyond 5 months, he will be more than happy to contact appropriate parties), as well as go to the senator/congressman.
It ain't over until it's over, we deserve our due share!

You might be right that TSC is trying to meet a target. I saw a bunch of Dec filers from TSC getting approved Friday and Saturady and was wondering whats going on with NSC. Just hoping that we get into the Feb (remaining 11%) quota....
Relaistically March/April might be the best bet for us....

My sister has the same exp' received 131approval on sat 2/18, online case status for Ead is still initial review.

Hopefully your prediction of NSC having a rocking second minor half of feb. comes true. Just 7 working days remain in this month and hopefully we will see a bunch of approvals for Nov filers starting Tuesday. If not, NSC will see a lot of SRs ,come March 1st.

Friends my sincerest thanks to all of you for your solidarity and support. I hope that the RFE response gets sent out this week. Lawyer’s way is clearly not correct he was adamant that the old EVL submitted 4 yrs back for 140 + tax returns + recent pay stubs + I134 would work; I and my HR manager did suggest submitting EVL. I just hope nobody else goes through the same thing due to the attorney’s mistakes or plainly ego issues. Also I feel Ron’s theory of BC RFE’s seems to be correct his idea of submitting 3 copies sounds perfect and that may well be the issue of the BC RFE for me and my wife, not sure if my attorney did some mess up here as well. Hopefully this will be my last dealing with this law firm.

i looked through the first 25 pages or so of this thread but didn't get a clear answer. So I'll post it.
What happens if you are overseas when you 485 gets approved ? I plan on going on vacation during mid-Sept to mid-Oct. Based on how things are going and my PD (Aug 2008), I may be in that zone where my 485 gets approved. Any insight would be appreciated.

Dear Friends, My AP was approved on 02/17 but no LUD or change of status for EAD. I was trying to find out if anybody had similar experience. EAD is still showing initial review. What could be the possible reason? I thought EAD/AP is issued on a combo card these days.
Application is at TSC. Any advice?

I went to India on vacation, got an RFE and came back to US with out any problem.
One of my colleague went to India on vacation, got an approval and came back with out any problem.

3. Any employment authorization documents that were issued for her benefit.
For the first one, I applied for Non Availability Certificate in India and will be getting it in a week or so.
For the second one, I don't have I-94 card and I am planning to send them the passport copies containing the port of entry and date for May 2005. Do you guys think, that would be sufficient?
For the third one, I am providing all copies of H1's and OPT Card. Is it enough?

Nayekal, the 2nd point clearly says provide copy of I-94 "IF YOU HAVE IT". If not, then just tell them you don't have the copy. If you still want to give them something for your peace of mind then just give any evidence you deem fit.
By any chance do you have I797 (H1B or H4) approval notice issued with same I-94 # from May 2005?
For 3rd point. Just OPT copies are enough.

gc5000, Yes, I have all the copies of I797's that were issued after May 2005 and I believe, they have the same I-94 # as I never traveled outside the country.
For the 3rd point, I thought OPT card is fine, but some of my friends are telling me to submit all H1's along with OPT card and I-20's. In fact, I have submitted all of them to my attorney, not sure why they are asking me once again.
May be this is triggered by the fact that I didn't submit the I-94 for May 2005, which is the last and the most recent one for the port of entry.

I am in the same situation. Initially received approved emails for Both EAD and AP and after 2 days I 765 Receipt moved back to Initial review. My 131 is still in approved status and I haven’t received any AP copy so far. I am Dec filer and opened SR for Both AP non delivery and EAD pending status, Got response saying we are still reviewing EAD case and please contact USCIS after 4 Months, they haven’t made any decision regarding I131 Non delivery.
I am primary applicant and Derivative received combo card.

I have applied for AOS and for me and my wife. Prior to applying AOS our H1/H4 were about expire, we go it extended till 2014 for me and H4 for my wife. On Nov 2011 she got her h1b approved with a consulting company, but she was not getting paid till we applied for AOS. Due to the same reason our lawyer put her current status as H4, even though she have an approved H1B. We were told her valid status would be H4 as she is not able to produce pay stubs. Now I'm thinking is it going to be ok? if we take the last action, it's H1B approval. Will this create any issues at the time adjudicating our AOS. Please share if anyone have a similar experience.

If that is the case why do one need to maintain his/her H status ? as it leads to a potential threat rather than a safe harbor.
Looks like it better to make use of EAD and AC21 than maintaining the H status.

We are in same boat. I called last week and was told case under review, so far no rfe. Case is with in processing time. L2 could not check detail status like name check etc...
Not sure if it is same as online status like initial review or they can detail steps , l2 was not friendly so did not ask much.

Alternate solution from my Lawyer. Unlike AP...GC can be hand carried to India by either the spouse or somebody else. Also when one travels using the AP,one is understood to not have abandoned the gc process.The very purpose of an AP is to allow you to travel without risk to the gc application ( the I-765 approval document says as much ) .
You can still use AP to enter after the I-485 has been approved.At the port of entry CBP can check the system and they will find your approval and they will mark it so in the passport. If you get somebody to hand carry your GC back to you in India,you can enter using the same as well.
Of course one can be extra careful and can go for the immigrant visa stamp at the consulate as well.It is not necessary though.
