I lost my I-94 card thats pinned to my passport but luckily i have copy of it . Do we need the original I-94 card to file 485. My priority date is Jan10th 2008.

You don't need original to file. But:
a. If you leave country meanwhile, you would have to give I-94 back when exiting. So stay put, don't travel!
b. If called for an in-person interview for GC, you might be asked to show originals.
Further, as per http://www.cbp.gov/xp/cgov/travel/id_visa/i-94_instructions/filling_out_i94.xml the I-94 is only for non-immigrant visa holders, so once you are on GC, it should cease to bother you.
I believe this calls for a lawyer's advice. The question is should you apply with this I-94 or get new one issued and apply with that.
It is possible to get new I-94 and that too in same day. But then it was 5 years back and in Los Angeles. I had got it done for my wife. In her case, they had put wrong date of birth in their system based on I-94. The I-94 date of birth, in that 9, they somehow read as 5. So DMV did not give license to my wife and said, there is mis-match in date of birth. So we took appointment with USCIS office, big guarded building in Los Angeles, the first level officer could not understand our problem, so I asked to be able to speak to supervisor. The supervisor sent us to some floor upstairs, wherein there was some high level officer (he had a uniform on, like police, or port of entry CBP officer, he even once kind of scolded people waiting for talking and asked them to be silent), he made us fill out a form, and he issued my wife a new I-94, and after that we again went to DMV, and this time, they did not have any problems.

in US one rarely needs originals in most cases. In this case copy should do per my knowledge.

I thought once i get H1B extension the I-94 stapled to passport is no longer needed and the I-94 from H1B extension will replace the older one. From what I know, the I-94 stapled to passport is what matters.
Sorry to put you in any tension, I am just always over cautious.
Again, this is just based on what I feel, I am not lawyer!
Hopefully someone else may have better idea or correct me.

Most recent I94 is what you need. In your case if you lost your 4 years old I94 and have received 2 new I94s (H1B extensions), the most recent is what you need.
I had similar situation. I extended my H1 twice and received a I94 both times. So I had 3 I94s. When I went out of US, I gave the 1st (stapled to passport) just to be safe and the last I94 (that was most recent). The I94 in the middle is still with me (even today).

From my understanding it is the most recent one that matters. If you never left the country and got new I94 with H1 extension, it will have the same I94 number with different validity. When you leave the country you should give the one that isn't expired as it proves you left the country you were in valid stay or to say you didn't overstay.
Again that is my understanding and believe it's correct. :)

What is stopping you from extending your passport when you are so uncertain about applying with it?
Not sure about Chinese consulate but extending India Passport is a one day stop at the consulate.

We (Indians) cannot apply for renewal no more than one year before the date of expiry of the current passport.
. I dont know about Chinese consulate rules.

I have been waiting like you and was going to apply for extension if my PD hadn't become current. Now I will wait for another month or two. Oh I still have 10 more months to go.

Renew your passport under tatkal. If you got the Indian consulate taht has jurisdiction, you can get your passport the same day (most cases). Since your passport has expired you may have to file an affidavit explaining why you did not renew your passport. But going to the consulate will definately help things quicken.

Passport is only required for travel purposes. I do not see any problem .You can use the AP/Recepit for travel . The only scenario which might have an problem is if you have chosen Consular processing and need to travel to India .

Another point to prove, At port of entry your I-94 is limited till pasport expiry. But when extend H1 here in US, I-94 expiry date could be beyond your passport expiry date.
I don't think its a serious issue since your status in US is determined not by your passport but by an authorization that the government issues. In this case your I-94 seems to be valid so your should be ok.

I plan to renew my passport. The chinese passport takes 1 month to get renewed. I think it's a good idea to get ready for next VB. Although my chance is 30% or less, I want to make things ready.

One related note,
At POE,they limit I-94 till passport expiry. If you renew your passport, you may have to reapply fro Non immigrant visa, as CBP at airports is not giving out I-94s, atleast wherever i live.
In 2009: my wife passport expired, once we got the new passport , we went to CBP office at OMAHA airport, they issued new I-94 until H1 expiry.
In 2011: My daughter got I-94 till 2014 with H1 extension, but went to India in this April, at POE, my daughter I-94 is limited till Nov,2011( till passport expiry). We renewed her passport and contact near by CBP, they said they stopped issuing new I-94.Our attorney said either we can go out of country or apply fresh H4 to get new I-94. So we did the second.
I plan to renew my passport. The chinese passport takes 1 month to get renewed. I think it's a good idea to get ready for next VB. Although my chance is 30% or less, I want to make things ready.

I am in the same boat , passport expired on May 16 and yet to renew. I am in Houston and can be at the consulate. Should I do tatkal in order to get it before six months after expiry i.e. Oct 16 ?

It's really bad timing by lawyer, but if you do your hw well, even in last 10 days he should be able to do the job.
I have not yet filed 485 so you did good by directing question to those who did!
Before your lawyer comes, you can get 6 passport photos per applicant and medical exam. But for medical exam, you need to fill out the form yourself then, if you understand the various boxes to fill out.
Nishant, i am really feeling bad for you, you just missed it by a whisker. I hope you become current in the next VB.
I have a request for Q and other friends who recently went through filing 485 - can you please post the procedure for filing 485? I apologize if it has been been discussed already. In that case, may i request to point me to the relevant thread.
My lawyer is on vacation till 20th October and i don't want to wait till he comes back. Congratulations again to everyone who have become current during this VB.

Recently we changed her passport to add my last name but not changed on visa, while filing I-485 if we write first name and last name is there any issue? by the way her ITIN and Driver License also have only first name. While entering US, the IO may give you permission to stay through the expiry of your passport rather than the expiry of your visa. But if you enter and tehn you obtain another extension to your H1, that old I-94 that IO issued is not binding anymore. The extension and related I-94 should be used going forward.

My friend had a similar issue and he said he filed a name affidavit that listed all the different names he used -like
First Name
First Name Last Name
Last Nsme First Name
Short form of First Name Last Name
Etc.
Please check with your lawyer.

I would do what 10102007 has suggested. Get her full name on the application and thus on the Green Card..It's better to get this done now.

GC can be obtained either via AOS (adjustment of Status) or CP (Consular Processing).
AOS is suitable for people already in USA and only their immigration status needs to be adjusted.
CP is suitable for people not in USA and would come to USA when they get green card to start the job being offered in GC.
In case of CP, instead of USCIS, its NVC (National Visa Center) who processes the GC. Typically when they anticipate that the applicant's PD will be current in next 6 months to one year, they send out a fee bill for processing the last stage, and the applicant has to pay fees and start the last stage process of submitting a packet of required documents etc. Once this happens, the applicant becomes documentarily qualified, and when the date really becomes current, the USA consulate in the applicant's home country, schedules an interview him, and if interview passes they grant him green card.
If you see that thread of Ron, you will see he is ill and recovering, and has as of yet, not done further work on tabulating this data and publishing to us.

I did actually mean this process but out of laziness wrote the bottomline, but yes, your point is indeed detailed and should be noted for knowledge on CP. I do feel that CP may grant you GC a few months earlier than AOS.

I would go with the attorney.. just keep in mind you may need your passport for fingerprinting..

guys who are current now and before... i understand we have to get 6 copies of passport wala photos... i inquired in walgreens, cvs and other places and they are all charging around 30 dollars for 6 copies.... not trying to be cheap... but any1 have any better ideas in getting them done, i know of epassportphoto.com...have any1 used them ?
a gujju bhai in my office always says.... a dollar saved is a dollar earned... toh batao.... the person who tells a good idea which people can use to save some dollah...will get a gift from me...

if you have AAA plus membership, you can get 4 photos free..otherwise also, the prices are reasonable.

After some recent scams(in india) where the websites promising giving copies of photo when u upload 1 used those to open fake dmat accounts i am skeptical of anything online. Not that epassportphoto.com is the same just that i m skeptical and the pictures taken urself are allowed, there are guideline for the same on USCIS site(for Visa atleast).

I alaways create passport photos at home. Use template from http://www.epassportphoto.com/ and print it at walgreeens or any other photoshop

8.99 for two copies in local Walgreens in midwest. we tried other methods for passport and visa renewals.If you can get the photo to 2X2 , printing on 4X6 sheet would give you 6 photos.It works out cheaper.
But don't want to get RFE for photo in I-485 process.

If you are skeptical about using epassportphoto.com, download photoshop passport template (google for it) and create passport photo sheet. Print it at home or any places such as Walgreens...

I have used it for H1, UK visa and my daughter's US passport.. and it worked all the time.. $0.35 cents for 4 photos (1 sheet) at walmart in minutes..

guys who are current now and before... i understand we have to get 6 copies of passport wala photos... i inquired in walgreens, cvs and other places and they are all charging around 30 dollars for 6 copies.... not trying to be cheap... but any1 have any better ideas in getting them done, i know of epassportphoto.com...have any1 used them ?
a gujju bhai in my office always says.... a dollar saved is a dollar earned... toh batao.... the person who tells a good idea which people can use to save some dollah...will get a gift from me...
Cotsco is cheaper than walgreens. it will be $15 for 6 copies. Each set(2 copies) for 4.99

I am planning to go India after filing I485 Apps. I will be filing on Nov 1st and will go to India in second week of Jan for 2 months. Do I need to worry about any thing.
To the best of my knowledge, you should be fine. I am assuming that you will return to US using the H1B visa stamp in your passport. So, you should make sure that your visa stamp is current; or else, you need to get a new visa stamping appointment at an US Consulate in India. You might also receive your AP before your travel and in that case, you can return to US with your AP (assuming you have approved AP before your travel date).

I don't have H1 B visa stamp. I will book my tickets now, but will postpone my trip in the last minute, if I don't receive my AP. I am actually concerned with 485 apps processing during my stay out of US. Do I need to come back to answer any RFE's if any or do we need to be present in US for any thing else. I am planning to go for at least 2 months (1 month vacations + 1 month work from home).
