Dear All -- I received my green card yesterday. It's still surreal, but I am slowly starting to feel relieved.
I did have to seek help from my congresswoman. It took about three weeks since then to get an approval. Except, USCIS only approved my case, but not my wife's. So I won't celebrate quiet yet. We were also near the very end of a house sale/an out-of-state move from Cambridge MA when I received USCIS' approval notification; the timing meant that it was a bit too late to separately seek help on my wife's case from the MA congress rep. Now we've asked for assistance on my wife's case from our NY congress rep. I am just hoping that USCIS approves my wife's case without any hiccups (and soon).
Meanwhile, I have emailed my attorney a set of questions regarding the terms of employment tied to the green card. I'd love for your thoughts on these, please:
1. Can I go on an unpaid sabbatical for a few months? If not, how long would I need to wait to do so (in order to satisfy the intent for AOS)?
(An unpaid sabbatical for a few months would reduce my base annual wage below the offered base wage stated in AOS. I would be an employee of the firm and avail benefits but not a wage)
2. Am I still bound by the intent to hold full-time job at the firm or can I reduce my hours for few months at reduced wage below the AOS wage?
3. Does a promotion to a different title and wage affect my AOS intent if such a promotion were to happen in about 6 months?
4. Are there risks with any of these? I am concerned about the risks to the terms of my GC or when I file N-400 in five years.
5. Is there anything else I should be aware of? I do understand the GC residency requirements.

Congratulations LOTG! Had a question for you if you are ok with answering. Your RD is Aug 2020 which would be within the 30 month "normal" USCIS processing range. How were you able to get your Congressperson's help for that?

USCIS' "normal processing time" range dictates when one can raise a service request. It has nothing to do with you, as a constituent, requesting services from your congress rep. Your congress rep's office will anyway temper your expectations by telling you that while they can request an update on your case from USCIS, they cannot guarantee a favorable decision or even a substantive update. They will have you complete a Privacy Waiver Act form. You can explain in it that your priority date has been current since xx day, and that you are requesting an update on your case. My congresswoman's immigration coordinator told me that all reps and senators use the same liaison to coordinate with USCIS. Your request gets sent to USCIS via this liaison. Then it's up to USICS. In my case, it appears as though they approved my GC, and then got back the next day to my congresswoman.
If you've waited for 8-10 months since filing your AOS, I'd consider reaching out to your congress rep/senator. Good luck with everything!

Congrats mcmilers! Folks, Quick question! Are interviews even happening anymore for EB GC applicants? Asking because I see many straight up approvals and some chatter about the interviews getting scheduled at the same time. Is there a reason why we are seeing both of these things happen?

Replying to my own post so that it can be helpful for others, My case was updated to "New Card is being Produced" yesterday (May 17) and today it changed to "Case Was Approved".
Many congratulations ! Must come as a great relief. Life won't change much but for sure you'd sleep better every night.

Thank you for all the warm wishes. It is a big relief for sure. I would say the 20 years is not all USCIS's fault, I didn't seriously start looking into applying for PR until 2008. So some of it is mine too.

A quick question to those that were approved. I received my approval notice with the card en route by mail. But the approval notice doesn’t “welcome me to the US” nor provide any of the information that new permanent residents are supposed to receive. All mine says is that my application was approved and that I might have to submit for biometrics and they will contact me if they need my biometrics. Since the card is already en route, I presume there will be no biometric/photo needed.
But I am a little disappointed in not receiving a “welcome” notice. After over a decade of waiting, I was looking forward to that.
What has been your experience? Did you get a similar approval notice?

Thanks all for the wishes. It felt different for a few minutes after that life and emotions are business as usual, I wondered why I had such a short excitement after waiting for more than a decade for this decision.
Others who got their approval recently was your excitement short lived, how did you feel after getting the card in hand and how did you celebrate?

I did not celebrate at all, didn't feel the excitement.
I just put 6 of my EAD cards and bunch of H1 packets and tons of USCIS letters in a box and stored them away. I'm happy and relieved though.

Guess they knew you are already in US with AOS application and hence skipped the Welcome letter. :-)

Great news. I'm sure the drama is pretty much done and over with, at this point.
Out of curiosity, did you end up sending SuppJ along with the RFE response? And at least anecdotally it does look the previous administrations memo for requiring interviews for all AOS applicants is not being followed. Hopefully the current administration formalizes that approach with a written notice.

Thanks. Yes, I did include the SuppJ (for job change) as part of the RFE response. That was the part that took the longest for the response packet to be assembled....working with HR and lawyer. The SuppJ filed in Oct as part of AOS package got approved today as well.

Dear All -- I received my green card yesterday. It's still surreal, but I am slowly starting to feel relieved.
I did have to seek help from my congresswoman. It took about three weeks since then to get an approval. Except, USCIS only approved my case, but not my wife's. So I won't celebrate quiet yet. We were also near the very end of a house sale/an out-of-state move from Cambridge MA when I received USCIS' approval notification; the timing meant that it was a bit too late to separately seek help on my wife's case from the MA congress rep. Now we've asked for assistance on my wife's case from our NY congress rep. I am just hoping that USCIS approves my wife's case without any hiccups (and soon).
Meanwhile, I have emailed my attorney a set of questions regarding the terms of employment tied to the green card. I'd love for your thoughts on these, please:
1. Can I go on an unpaid sabbatical for a few months? If not, how long would I need to wait to do so (in order to satisfy the intent for AOS)?
(An unpaid sabbatical for a few months would reduce my base annual wage below the offered base wage stated in AOS. I would be an employee of the firm and avail benefits but not a wage)
2. Am I still bound by the intent to hold full-time job at the firm or can I reduce my hours for few months at reduced wage below the AOS wage?
3. Does a promotion to a different title and wage affect my AOS intent if such a promotion were to happen in about 6 months?
4. Are there risks with any of these? I am concerned about the risks to the terms of my GC or when I file N-400 in five years.
5. Is there anything else I should be aware of? I do understand the GC residency requirements.
We heard back from our congressman's office on my wife's I-485 application. First, USCIS' NBC notified that the case was under the jurisdiction of the Boston field office. This was about a month ago. Today, the Boston FO responded that it is "awaiting the arrival of a relating A-file, and when that arrives, the case will be assigned to an officer for review and final determination".
I am not sure I know what a "relating A-file" is, but my attorney posits that it's the I-485 application itself and that it is in transit to the FO (apparently all this is normal). Perhaps it is. But wouldn't that mean that the case was transferred to the FO at least a month ago, and as of yet, the application is yet to arrive at the FO? Weird.
Not sure we have any options but to wait. After all, they have up to 29 months from last August to noodle on our application.
One question: My wife's EAD/AP expires in January. She has her own H1B, which needs to be renewed in November. Her employer is going to do that. But we want to also have a valid AP as we expect to travel later this year. Is the renewal process for EAD/AP simple enough for us to do it on our own or do I need to work with an attorney (I could likely have my firm pay for it; they did it the first time for the both of us)? If it's a routine application that we can file ourselves, I'd rather go that route.

I hear mixed reviews about it. I think changing jobs within the same employer should be just fine while changing employers also tends to mostly fine but some people had questions during naturalizations from what I understand.

The RFE response was mailed to the local field office on July 1st. Quick turnaround in less than a week.

Ace, I am loudly thinking about the exit strategy and a GC for Oct 2020 filers. The processing time for I-485 in TSC is 25.5 months (2 years) to 50 months (4 years). This means that you cannot open a Service Request next year for expediting. It is crazy. Don't know how you guys are going to push for a GC next year. If the application went to a local center, then Newark, NJ has 18 months mean processing time (I had to look in grenncardly.com for a friend). The applications that went to local ASC's should get approved before Oct 2022 for sure. Don't know what the TSC guys with downgrade are going to do.

With a Feb 2011 PD, I expect to survive the pandemonium happened after May 2011. The dates are current, kid protected by CSPA, EAD cards on the way, I am taking each and every things happening as it comes.
All I am hoping for is good health for us and near and dear loved one back in India. I have seen many of my friends and extended family losing their loved ones and the stressed travel times. Hope for pandemic to get over.

From my experience its usually the median processing time (or sooner) for EB AOS applications as far as FOs go. So good luck!

Charlie mentioned yesterday that he is not expecting any retrogression until Aug/Sep 2022. The FY 2022 SO should be good enough for October 2021 fillers.

Thanks all for your wishes. Finally I'll be able to shred the big box full of paperwork that I've been carrying with me like shackles that was getting longer and longer with every passing day. And now that I've tasted freedom with the "Welcome to the United States" message that I received in mail today, let me share my story while trying to stay anonymous. Hope it will help some of the GC hopefuls who are still waiting in this seemingly never-ending line.
I first came to the US 21 years ago with my first job abroad, after leaving college with an engineering degree and with just under 2 years of work experience in the field of Information Technology. I always aspired to live and work freely, home or abroad, and this seemed like the perfect opportunity for me to live my dreams. My H1B visa was sponsored by a small startup company in the California Bay Area that was still riding high on the Dotcom bubble, never to imagine what would happen next. And then the unimaginable happened, followed by 9/11. Many got laid off and many decided to move back to their home countries. I was one of them who got disillusioned by the instability of the job market, took a job with a big tech firm in India, and decided to move back in May 2003, exactly 3 years from the day I first landed on this Land of Promise.
Then I got married, bought a house and was about to permanently settle down in my hometown when the project I was assigned to required me to move to UK on a short term. So I made my way to UK where our first and only child was born, and we lived there for about 2 years before the project ended and we had to move back to India. This was the time when I started getting the 3-year itch with my job ? I felt dissatisfied with the overall work environment in India and how folks in IT were made to work like high paid laborers and being asked to move from one place to another on a short notice. Also, from my short stint in the Indian job market it appeared to me that spending long hours at work and making friends with the right people, and not necessarily work either hard or smart, is the only way to move up the Indian corporate ladder.
So in early 2007 I made a long thought out decision to try and move back to US. I took phone interviews with few of the consultancy firms who were still sponsoring H1B visas, picked one and decided to go for it. Fortunately, I got picked in the visa lottery and my NJ-based company invited me to work for them starting in 2008. That was when I took the plunge for a second time, got into a long term project contract for a large Life Insurance company, and settled down in New Jersey with my wife and my 3-year old daughter.
The very next year my company sponsored me for my Green Card and that was the beginning of my GC journey that lasted 12 long and arduous years, with some respite in 2012 when our dates got current for a brief period to allow me switch to EAD. This change of status presented me with a unique opportunity to join a Fortune 20 Big-Tech firm, where I stepped into a Manager of Data Analytics role that I am still enjoying to this date. Meanwhile, I bought a house and moved into a good neighborhood, of course at the expense of high taxes and living costs.
All these years, being in Adjustment of Status, I was more or less free to travel abroad with an Advance Parole without worrying for visa stamping at local consulates. It also allowed me move freely in the job market and make full use of my market value. The only thing that has handicapped me is the fact that I was unable to apply for in-state tuition in NJ due to my non-permanent resident status. Similarly, getting student loans was a hassle which required a guarantor in the form of a PR or a US citizen. Nevertheless, I decided to pursue an MBA degree and got admitted to a top school in the region. Of course, the immigration system was never fair for us Indians who were, and still are, suffering the most due to the per-country cap. Waiting 12 years in line for a permanent resident card is insane for any immigration category, and it is more so when you are in a high-paying employment based category that requires an advanced degree and/or other highly specialized skillset to qualify. In my mind a country?s immigration system should be fair to all and it should reward high-skilled workers by making immigration easier for them in order to attract the best and the brightest from across the world irrespective of their race, religion and culture.
Would I make the same decision of moving to the US if I had the crystal ball back in the year 2000? Absolutely! As I explained, I did go back and tried to settle down in India, but failed to do so. So however long it took, I do not repent this decision for a moment. Does it pain me to see my near and dear ones getting old and vulnerable, and some even dying in a far-off land while I am busy with my career? Sure, and even more so in the post-pandemic world where your life can change in the blink of an eye. That?s the reason why I get on video calls with them every other day just to see them and hear them talk. But even with the close ties that I have with my parents and my family back in India, I have learnt to live and enjoy this way of life like any other first generation immigrant who are here in America for a better life, not just for themselves, but for their kids and their future generations.
I am looking forward to the newly found freedom of being considered a ?permanent? resident, and I wish to make full use of it, whether in paying for college tuition, in refinancing my mortgage with better rates, or by traveling freely to other parts of the world, including more frequent travels to see my parents without the pain of waiting in line for immigration checks at the Port of Entry. At a social level, I would like to get more involved in day to day life in the USA, speaking up for an inclusive culture and for a free and fair immigration system in any shape and form that I?m able to, while hoping to become an American Citizen some day in the not too distant future!

Then I got married, bought a house and was about to permanently settle down in my hometown when the project I was assigned to required me to move to UK on a short term. So I made my way to UK where our first and only child was born, and we lived there for about 2 years before the project ended and we had to move back to India.

One question to you and may be other.. could you not assign the country chargeability to your child who was born in UK? I am not sure about UK Immigration if someone born their is a citizen by default. But was checking if the dependent's country of birth can be used for chargeability and visa counted against that?

Unfortunately, no. You cannot apply cross-chargeability for parents to the country of birth of their dependent children. At least that is how my lawyer had interpreted the law to me.

cross chargeability only applies for spouses not children. For children derivatives thus their own country of birth means nothing. They only get approved when primary is approved.

Sri - my understanding is that cross chargeability applies regardless who is primary and who is dependent. In fact my guess is it applies even when only one spouse is applying. You don't need your spouse on your application to benefit from cross chargeability.

Off topic. Happy that you are in NJ. In the last few years there have been few people moving from NY/NJ to "warmer climates" (NC, TX, FL, etc.). I tell them that in NJ you guys live a dream life (except the morgage, taxes and weather) with so many stores and accessability to everything in minutes. When you move away to other parts of the country, you will have to compomise and adjust. Maybe the first thing one needs buy is a bigger refrigerator. Cheers!

You are correct Q. From the Service Manual.
In practice, cross-chargeability is used where the preference quota category is backlogged for one spouse's country of chargeability but is current for the other spouse's country of chargeability. The principal applicant may cross-charge to the derivative spouse?s country, and the derivative spouse may cross-charge to the principal's country.
Derivative children may cross-charge to either parent's country as necessary. Parents may not cross-charge to a child's country. In other words, the principal applicant or derivative spouse may never use their child's country of birth for cross-chargeability.

We still cannot believe it... 11 years wait after first I-140 suddenly came to an end.
Thank you so much Q, idliman, and all others who helped me make decisions over last year... For Indian immigrants suffering in the backlog this forum is just indispensable. I hope it continues for a long time.
I have read pretty emotional responses here over last years, never thought I would be in the same position, it felt like we hit rock bottom especially since 2018. There's just no justice, fairness in America's EB system. I am pretty amazed how fellow backloggers (that I know) just ignore these problems and continue being passive. This is probably only forum to seek help. I hope it evolves into something which can help the EB community with legislative steps as well.

I am also seeing good approvals from Newark, NJ field office. My neighbors from Feb 2011, March 2010.. both EB2 got approvals too.

Thank You Q, I have been a silent reader of this forum for quite a long time and over the years have gained good knowledge learning for the experiences of each one of you.
Also, congratulations to all who have been greened and also best wishes for the people waiting.
Just to benefit the people who are still waiting to be approved, I will share my experience, my PD became current from July 1st and I was checking the status of my application daily at least twice or thrice to see if anything got updated, and I had chatted with Emma to know about my case being transferred to FO (Newark, NJ), but last Friday (July 23) when I checked with the agent on live chat, she mentioned to me that my case has not yet been assigned by USCIS, i was very disappointed since the talks of 100k GCs getting wasted this year. So, i had lost my hopes that it get approved before Oct. But then USCIS never misses to surprise, very next day on Sat (July 24) I got the email notification saying "New Card is being produced". That's the reason i waited for couple days to make sure if this is real. But I would advice people waiting whatever you hear from live chat, just take it with a pinch of salt.

Good to know that It took about 2 months to approve your green card after they actively started working on your application (485J receipt or issuing RFE) I guess you must have submitted your medicals with initial filling and didn't receive any RFE.

I think that is the key to get your green card faster by submitting medicals with initial filing and no RFE.

Hi My notice date is: Dec/05/2020. What is the importance of that? I have no news on whether my case has been moved to a FO or not.

It just seems too coincidental that I was provided a response date of 7/29 on my SR and got my GC approved the same day. So I would say people should go ahead and open a request, worst case they will say it is still under review.

Hard to believe that USCIS is following receipt date or priority date it's just random approval and depend on the lot of applications picked by the adjudicating officer . Mine is 219020xxx series so far no luck. One thing I see that they are prioritizing based on priority date.

Wow, that is indeed something new. Maybe they have put in a check against service center processing times to bring down the number of SRs. If that is the case, people like me are to blame I guess so apologies for that! But reach out to members of Congress (anyone House/Senate but not multiple people) and see if they can move things along. Explain to them how the concept of waiting for the processing time is impractical so that they don't just accept a boiler plate response.

After 19 years in this country, I finally got greened. Came to the US in 2002 as a masters student and filed for my GC in my 6th year of my H1(another long story why I couldn't file earlier). How many sleepless nights thinking about the missed career opportunities and the uncertainty about the future. When I first came to the US, I never imagined the journey to be this way. The process made me more humble and mature though. I'm happy it all ended well. It has been almost 8 years since I have been to India. Didn't want to go through the hassle of stamping. Many of my younger cousins probably don't even know who I'm. Lots of catching up to do with my career and family in India. Now that the hard part is over(things not in my control), I can focus more on the relatively easy part.
It has almost been a ritual for me for the past few years to come in every weekday to this site and see what everyone is talking about their experience. Sometimes, it helped me keep my sanity in check knowing that I'm not the only one going through this journey.

It?s pretty normal for the case status to flip back and forth. Usually card production ordered comes first, then the approval notification, shipment notification and finally delivery notification. So rest at ease. You should get the card in hand next week. It took me just a day to get EAD card from when it was shipped.

One thing I can say for sure is that they are definitely NOT following priority date. There are still lot of 2009 and 2010 EB2 people waiting while 2011 EB2 cases are being approved (which is good at least they are not wasting numbers).
If you check the status for 21902X, USCIS started processing those around March, 21903X got started late April, 21904X probably June and 21905X recently in July.
There are definitely exceptions too with this trend - e.g. you are waiting with 902X and I am waiting with 903X - no 485J/RFE at all.

Congrats All! Its very normal for the case status to change multiple times (sometimes it will be the approved status getting updated twice and that happened to me too). Typically the card arrives in 10-15 days since the first status change indicating approval happened. For me it took exactly one week for instance and all my approval dates on the approval notices and the actual card matched with the earliest date of approval although online status showed multiple revisions to it so I guess those subsequent changes are just administrative from my experience. I sincerely hope all 2009 and 2010 back loggers are cleared soon.

I will beat him to that on the travel to back home.. been 13 years. Family travelled in between a couple of times, and parents and in-laws visited a couple of times and I never could get a break for more than a week. And still waiting for this shit to get approved.
Wow! I probably will be in the opposite end of this spectrum then, except for last year and this year (due to COVID), we have travelled home pretty much every summer since 2012 ;)

It does seem like a lot of folks getting approval, even coming out of the woodwork on this forum -- guessing this hasn't happened before in the history of the forum? (question for the OG's here). My initial thought was that maybe this is kind of normal during Q4 of a fiscal year with more approvals -- but I'm guessing since the dates barely moved last 5-10 years for India (or retrogressed often), that Q4 approvals were nothing to talk about previously over the years. So even with most of the spillover being wasted and not utilized, it does appear that EB2/EB3 India are still seeing the benefit.

USCIS software is case status portal is glitchy off-late for I-485 status. If you like you could call USCIS live agent on phone and get status from them.

Thank you, Q, Spec and other members of the forum, it was very useful your guidance, especially the data/metrics you used to predict visa bulletins and date movement, and of course in-depth details about immigration issues.
It was so useful last 12+ years.
I missed I-485 filing by 2 months in 2012, also missed in 2015 due to Visa bulletin fiasco :), watching closely all Visa bulletins and forums anxiously, rest you can imagine :).

Finally! We got our cards delivered today.
The wait has been excruciating to say the least but as they say its not the destination but the journey that counts. Got married, have 2 wonderful US born kids and buying a home on H1B has been one of the best decisions I've made. Just like many, there have also been quite a few sacrifices but I look forward to the future now.
I want to thank Q, Spec and every other person who has ever posted on this forum because you have made this place an information goldmine when it comes to US immigration. This forum has been my escape from the long AOS wait for the last so many years and has kept me going.

We received our cards today, 19 years after coming here. Completed Masters, was na?ve as many and started the GC process only in the 5th year of H1... But all this time I have never felt the need for a GC until now. It had just became a routine process (H1B Renewal, H4 & H4EAD Renewal, Visa Stamping and back to H1B Renewal in 3 years). Then came the pandemic which resulted in closed consulates, dropbox visa renewals requiring appointments, scarcity in dropbox apppointments, travel bans, visa stamping delays, delays in H4 & H4 EAD etc... And as I feared, had a family emergency and traveled to India late last year needing a visa stamp and due to consulate delays, had to re-schedule travel back multiple times... This was the only time I actually thought about GC. Raising a family here and parents in India, GC to me is a travel pass and sincerely hope no has to go through travel / visa issues when a family member needs you back in India. Best wishes to all.

Here is my journey to GC:
This was a long ride with so many ups and downs- Stressful times through recessions, layoffs, firm closures and also Covid. I arrived here in the US in Dec-2005. If Dragomen would have not messed up my PERM in 2008, I would have got GC back in 2012. There are things I could have done differently for sure. There are things I didn't know when I started the process. But almost 16 years later I received GC. 8-10 years ago, this news would been really exciting. Now I am just relieved for sure. I am also grateful. There is feeling of joy. I will celebrate.

Q or Idli, I have seen multiple threads here on Post G C steps or life after G C, but couldn't get a grasp on things that one need to do right after reeving G C. Appreciate if you provide the list.
Few of them I got to know are.
1. Inform employer to update I-9 form
2. Visit SSA office and submit SS-5 form for replacement of SSN card.
3. Driver license update - optional
4. Update Banks \ Credit card company's....- optional

Also appreciate you recognizing many different contributors.
On the question of Post GC life - drivers license, banks, the employer, school / university etc seems pretty exhaustive. But I would say just take a breathe of freedom. Everything else will happen when it will happen. On becoming citizen my bank asked me for more information. I didn't even respond. I mean - a lot of this is just unnecessary stuff being forced upon us by the anti immigrant forces. I comply where required by law. Elsewhere I ignore.

Glad that your file is now picked up for processing. Hope they start working on MSC21902* and MSC21903*.
Was your status though "Fingerprint fee received" or "Fingerprint taken" prior to Interview update? Also assuming you had submitted medicals with the initial filing?

I received 485J receipt notice in March with typo error (Employer name misspelled). I contacted Attorney and they said , informed to USCIS for correction. I dont have any communication after that and not received any corrected 485J receipt notice. Couple of times contacted Attorney and they said we need to wait.
Live agent told me that my file with NBC and not yet moved to FO.
