View Full Version : I-765 & Old OPT EAD ....

Q, Spec, Viz, Matt and Gurus, really appreciate the great work. I learnt a lot about the workings of EB priority date movement here and has since become obsessed with the Blog :D
My priority date is current since August 1st and filed our I-485/EAD/AP for the first time (missed the boat last time due to job change).
On my I-765, in response to the question 'I'm applying for' my attorney selected "Renewal of my permission to accept employment" and for "Q11.Have you ever applied for emplyment autorization from USCIS " attached the details of the OPT EAD I had as a student back in 2003. (Actually when he sent the prepared forms for my signature, it had "Permission to accept emplyment" checked and "No" for Q11, he made a correction before sending out to USCIS, which I was found out from the copy that he sent for my reference)
So here are my questions:
1. Is this such a blatant error that USCIS might reject my I-765 application/ send out an RFE? (OR) Is this not a big deal and I would have no problem getting my EAD?
2. Would this affect my spouse's EAD in anyway ( Her's was filled out correctly) ?
3. Will this affect the I-485 processing in any manner or is the I-765 a disjointed application ?

Welcome to the forum.

I don't think it will be a big deal. At worst, you will get an RFE, although I think that is unlikely. Your attorney is correct with the answer to Q11 and your original answer was incorrect.

It won't affect your spouse's EAD application or the processing of your I-485. Each person's application is treated separately and EAD/AP are processed at a different location as far as I am aware.

Unless you have a pressing need to use the EAD, I don't think you will be inconvenienced at all.

perm - agree with spec here. It is not a big deal.

Generally speaking american system works with common sense and "FOR" the people. So more than likely these things are seen as common mistakes and they would issue an RFE (if at all).
