Very happy to update that I got CPO emails yesterday for myself and spouse.
I would like to thank Q for starting and maintaining this site. This site brought much needed sanity to the wait, dont know how much more frustrated I would have been without this site and the wonderful folks here.
Would like to thank Teddy (I've some posts of yours saved in my local machine, I used to read those when I was down and frustrated like "I believe if the next intake happens in a timely manner there is a good chance that everyone in 2007 will have their GC in hand by Sep 2012, " you were bang on target but for USCIS issuing GCs to people in 2008 before 2007 folks, no hard feelings to 2008 folks though) , Soggadu ( your posts brought lot of humor and made the wait bearable), Spec (for the impeccable calculations), Nishant, Veni, and last but not least Pedro who said two days back that I dont have to wait for another year. Your words came true Pedro, all the best to you and I wish you get yours very soon.
We have a wonderful bunch of folks here, would like to continue discussion on topics of interest in future.

My congresswoman's office received the following response from Congressional Liasion, Texas Service Center regarding my pending i-485 on 26th Aug 2013 (posting it today since the actual letter was received by me earlier today):
In regards to your inquiry for above individual's i-485 application (SRC07262XXXXX) has current FBI fingerprints and name checks as well as a current visa available. I have requested the file from the file room and once I receive the file, I will assign it to an adjudicator for review. Please allow 45-60 days for a decision or other Notice of Action for this i-485 application.
My question is:
- How much time does it take to retrieve/receive file from File room? Anybody who got a similar response earlier?
- Can I expect a decision in next 15 days or so? Planning to travel back to India after approx 4 years from 15 Sept-30 Sept since my wife did not have an EAD till few days ago. I know that I can travel using EAD/Advance Parole and even if I get an approval while I am outside US, I can mention about my GC approval while talking to immigration officer at PoE. My concern is that if I get an approval email by say 13 Sept, but do not receive the physical card, can I travel using Advance Parole in such a scenario?
Any thoughts or feedback will be highly appreciated.

when you enter you can tell officer that your GC is approved, have AP just in case

the last week has been painfully slow, my guess is 8k might have been approved, considering last couple of weeks the actual approvals were like 25/day average on good days but trackitt was updated by 15 average ( both numbers for primary)

Nik - your case is most likely preadjudicated. So the moment your file is fetched and assigned to an adjudicator ... there won't be much to do. I believe you should receive GC even before you leave.
But regardless you can travel since you seem to have a valid AP. (EAD is not for travel and reentry.). If you get a GC meanwhile when you were travelling ... then the IO will let you in even without AP!!

Thanks as always for the quick response :o. Yes, my case is already pre-adjudicated (confirmed by L2 on 5th July 2013). When I mentioned traveling using EAD, I meant EAD/AP combo card - my bad, I should have explicitly mentioned AP.
Regarding traveling using AP, my concern is regarding a scenario where I get my approval email before leaving US but do not get the physical card in hand.

You are welcome Nik. I wouldn't worry too much about that. You can always tell the CO that you didn't receive the cards until you left for India. As I always say the US is quite kind to its own people!! With GC - don't know if you know this but you become a "US Person" - not a citizen yet ... but a "US Person" in the eyes of the government.

I'd agree that is in the ballpark.
That would mean 10.5 - 11k have been approved for the year to date.
A similar performance in September will probably be close to using the number of visas available for FY2013.
To me, that means several thousand cases within the September COD will fall into FY2014, which doesn't bode well for movement next year.

Stuck in backlog for 4 years
Filed for 140 and 485 in July 2007
Spouse filed for EB3 in July 2006
2012 Spouse filed for EB2 labor in 2012, and got 140 approval and date ported to July 2006 for 140
Jun 14 2013 , got RFE for spouse, RFE response status by July 02 2013
August 1 2013, EB2 dates are current so her lawyer filed request for her EB2 application to be linked to mine
I also spoke to Level 2 who created SR and by August 2, they informed that application is in EB2 category
Case status change from RFE response review to Initial review on august 13th
Also spoke to congressman who got response on August 19 that request has been sent to I485 supervisor and I should get decision or notice of action in 30 days.
I also have Info Pass appointment for September 06
Honestly I am getting close to believing I might not be getting GC this year. Because if it has gone to a supervisor then not sure whether it will be decision or RFE.
Just wanted to check with gurus if there is anything else I can do except waiting....

I aint a guru by any standards :), but based on everything you mentioned above, you should be getting the GC this year (hoping numbers will still be available). IMHO there's nothing that says, your file will go to a supervisor ONLY to be scrutinized closely. Hopefully you will get the good news soon. I agree and understand that these are tense moments....hang in there, you are CLOSE....
And yes, you can pray while you wait, I did the same :).

In my opinion USCIS has done reasonably well till this point. I know there are few friends on this forum yet to be approved but I am pretty confident they would be cleared soon. Also judging by trackitt threads initial fears of too many people being left behind seems to have vanished ( have not looked at numbers because IMO they just provide overall higher level picture. Guessing actual numbers based on trackitt numbers..well I would not go there..too many variables).
As for next year, I think we knew all the way that some numbers are going to be carried forward, so not really a surprise. At this point I would not worry much about how it will affect next years movement. Its too early. Till recently we were thinking that this year would be 'not so good' year for the movement ...but as we all know dates have moved much beyond 'most optimistic scenario'.

agree with haripathi, the message has only positive news, 90% chances you will get GC in 2 weeks from now

If I have a concern, it would be about the overall demand/supply equation for FY2014 as a whole.
I've noticed that EB2-WW and EB1 approvals are holding up quite well - that squeezes the number of SO visas available to EB2-I this year.
I have been surprised at the number of new EB2-I applications submitted in August, with a 2007 PD. They won't hit the Demand for several months, but they will constrain total forward movement in FY2014 when they do become preadjudicated.
Without FB numbers, EB2-I might receive around 16k in FY2014. Even if all cases before 15JUN08 were approved and there was 3k additional porting, that only allows all cases around the end of Q1 2009 to be approved in FY2014. If 2k are left behind, that goes back to mid Q1 and 4k pushes it back to the very beginning of 2009. The dates would probably actually move somewhat more than that.
The odd couple of thousand has quite large effects.
I do agree with suninphx that it is too early to have a good handle on the numbers, but people are going to speculate anyway.
As for FB numbers, I hope there will be some, but I don't expect the 18k seen this year. The 5k seen in FY2012 is probably more realistic, which would add about 3.5k visas to the number available to EB2-I.

Spec - i concur with your post. I don't expect actual dates to move beyond Q1 2009 and backlog clearance somewhat less than that. I think we'll see a similar situation where 2-4K will carry over to FY15.

I would like to see dates clearing through FY 2008 primarily in FY2014. FY2009 being light in terms of demand (unless porting changes it significantly)... FY 2015 will bring up multiple possibilities.

Then the chips may fall wherever they will. DoS / USCIS do not necessarily aim to reduce immigration backlog to certain dates by certain dates.

I would think primary goal for FY2014 is to clear through FY2008(and earlier) EB2-I priority dates. FY2009 being light in terms of demand (unless porting changes it significantly)... FY 2015 will bring up multiple possibilities.

I wouldn't say that anything in your post is impossible.
I think the picture will become clearer as more data becomes available to fill in the blanks between now and the end of February 2014 (assuming the DOS Visa Statistics are published in January again).
I assume "multiple possibilities in FY2015" would refer to dates moving sufficiently to clear the existing Inventory?

I would like to hear your comment on date’s movement in FY 2015. I think some people might laugh at me because there is no FY14 yet and I’m already asking about FY15. I knew it’s too early to predict anything.
I will post this question again next year around the same time to get a better sense. My PD is Aug 20 2010 and EB2I. With so many bad lucks in GC processing we have faced, finally I settled with this date.

Coming back to the topic, I think EB2I would get about 18 to 20K visa’s this FY. With that, I would guess 14K (~ 8k from June to Dec + new filers + left over’s + porters) will be left in 2008. As of today, we knew there is 14K demand in 09 and 5K till May 1st 2010, this adds up to 19K, if we sum up the big figures here which will be 33K. I am going to assume that we are going to receive similar amount (18K) of spill over in the next FY, with that assumption, 15k will be left over at the end of next FY.I need to add few thousands to this as there will be new filers and porters, so the new number in Jan-15 would be about 18K.
My question is with this much inventory entering into the FY15; is there any possibility of DOS going for early date’s movement in FY15 and reach my date to collect a new inventory? Without FB numbers, EB2-I might receive around 16k in FY2014. Even if all cases before 15JUN08 were approved and there was 3k additional porting, that only allows all cases around the end of Q1 2009 to be approved in FY2014. If 2k are left behind, that goes back to mid Q1 and 4k pushes it back to the very beginning of 2009. The dates would probably actually move somewhat more than that.

First, at this time it does not look like we will get the same amount of spillover next year - in fact it might be significantly less.
Second, I think the number going in to FY15 will be more than 18K - probably between 20-25K to start FY15. I think FY14 will most likely clear another 12-15K. So you'll have most of 2009/partial 2010 + new porters + new filers.
The issue will moving dates is thats it not just about building inventory but its also issuing GCs for that period. So to begin the year with 18K (your number), it is very unlikely that there will be movement. I expect the movement to be around June or so of that FY. That'll help build inventory but not leave enough time for those new apps to be approved in FY15.
PS: I just want to add its way to early to even get a good read of FY14 let alone FY15. So the above is just based on critical thinking and I'm sure there will be contrarian opinions.

It's really only a rough guesstimate (with no extra FB visas) based on the lower usage of EB1 being the new "normal", EB5 using all visas and EB2-WW providing some Fall Across since they are returning to a "normal" year.
There are so many factors that can influence that (DOL performance to name just one), I wouldn't even be able to say where it is in the range (although maybe mid to lower end).
As vizcard has pointed out, the uncertainty over how many actual cases that SOFAD might be applied to is just as important.
Unfortunately, time is what is needed for the picture to become clearer on both sides of the equation. I'll probably not speculate in public for a while because of that. That's somewhat frustrating, but probably for the better.

I agree (and have mentioned before) that EB5 is currently experiencing some difficulties with the "tenant occupancy" methodology, which USCIS has redefined.
In fact, despite encouragement for the program politically, USCIS seems hell bent on making it as difficult as possible.
Even if numbers of new investors declines, the backlog will take care of numbers for a couple of years.

We have also seen errors from USCIS in approving cases that are not Current.
There have been other cases that appeared to be 2008 approvals, but by trawling through their profiles and posts , I was able to find the real PD or Category and charge them accordingly.
The 3 cases shown (iamindian (http://www.trackitt.com/member/iamindian), tanjore (http://www.trackitt.com/member/tanjore), neerajn76 (http://www.trackitt.com/member/neerajn76)) have no contradictory evidence.

In my opinion, its almost certainly "user error" by whoever created that entry. Most likely its a country of chargeability issue.

They are all fairly recent approvals and all are within the PD range that became Current in September. It is impossible to distinguish USCIS error from User error and USCIS have made several similar errors recently.
Had they not fit those criteria, they would have been placed into my "Don't believe" bucket.
Ultimately, 3 out of the total numbers won't make any appreciable difference.

If there were 128 approvals prior to August then that should correspond to at least 2500 as the annual limit is ~2800. Having said that we can say that 1 trackit approval corresponds to 20 real world approvals.
If we use the same translation for Aug approvals then 517 would translate to 10050. Do you think that Aug approvals would be roughly 10k ?

The number of active pending cases( individuals who have updated the profile atleast once in the last two months) in trackitt is really high for PDs before Jan 01, 2008. Also there will be cases categorized as EB3 in trackitt who have ported and waiting for approval.
I hope the approvals speed up and there is no wastage of visa.

I do not see how it can be of any concern if there have been 9k approved in Aug instead of 8k. It is actually good news as we do not have to worry about wastage.
I do respect your opinion and you are the best person on this forum when it comes to numbers.
I feel that most of the people before Jan 2008 have gotten their GC and many interfilers also have gotten it. It might also be that most of the people before June 2008 get cleared leaving behind a small number like 1k for the next year. Lets hope for the best.

Did FP yesterday as per appointment. Got emails for the derivative applicant on status update for 485 and EAD but nothing for the primary, We did not change the address.

On September 4, 2013, your address was changed relating to the I485, APPLICATION TO REGISTER PERMANENT RESIDENCE OR TO ADJUST STATUS that you filed. During this step, USCIS initiates the background checks of the applicant/petitioner and identifies issues that may need to be addressed either during an interview or by asking the applicant/petitioner to submit additional information or documentation. USCIS reviews the applicant's/petitioner's criminal history, determines if there are national security concerns that need to be addressed, and reviews the application/petition for fraud indicators.
If you have filed an I-485, I-589, I-751, N-400, I-90, I-821, I-131 or I-765, you can expect to receive an appointment notice to appear at an Application Support Center to have your fingerprints and/or photographs taken. The timing of your appointment is determined by the number of applicants ahead of you that also need a biometric appointment. We try to schedule biometric appointments as quickly as possible and in most cases you will receive your appointment notice within 30 days of submitting your application.....

EAD & AP will definitely be processed per RD. For AoS (I-485), it depends on a lot of different factors and so, there is no way we can tell. Three of my colleagues have the same PD as I. Two of us (including me) sent our applications on day 1. One sent a week later & one sent 3 weeks later. And the one who sent his application the last got approved first. Then, within a span of 2 weeks, the other 2 got their applications approved. And, I'm still waiting.

I see only few cases after Jan 2008 are processed by TSC. I would say they are looking at them but at a very slower pace. Some one has to dump a big number of case files on the IO's desks to let them know all these cases are current as well.

It's a matter of TSC approving low hanging fruit (straight forward cases) first.

I hope you are right. Come tomorrow, it will be 15 days since I raised the SR. When they raised the SR as my case was outside of normal processing times, I was told that the SR will be assigned to an officer within 15 days. I plan on calling them tomorrow to ask if my SR was assigned to an officer.

Thank you for attending my post. Please see my comments in-line to yours. Your comments are in Italics
First, at this time it does not look like we will get the same amount of spillover next year - in fact it might be significantly less.
I do respect your comments but I beg to differ.
I still believe EB2I get about the same spill over in coming FY. If we look back at this time last year, most of them thought that EB2I can't cross 07.
Second, I think the number going in to FY15 will be more than 18K - probably between 20-25K to start FY15. I think FY14 will most likely clear another 12-15K. So you'll have most of 2009/partial 2010 + new porters + new filers.
If EB2I gets 18K spill over in FY14, effectively we will only see 15K inventory in Oct -14 as porters and new filers may not show up until Jan / Feb -15. I agree with you that chances of moving dates early in FY15 are bleak at this point of time.
The issue will moving dates is thats it not just about building inventory but its also issuing GCs for that period. So to begin the year with 18K (your number), it is very unlikely that there will be movement. I expect the movement to be around June or so of that FY. That'll help build inventory but not leave enough time for those new apps to be approved in FY15.
I agree, moving dates is not simply getting new inventory, it's actually clearing the Q too. I guess time will give more answers.
I'll leave this topic here and will post the same question at the same time next year.
Last year at this time we didn't know about the 18K FB spillover. Without that we would barely have crossed in 2007. This year we know that even if we do get FB spillover its not going to be 18K. I hope we do get the same amount of spillover but chances are very slim.

I called USCIS today and was told that there was no way for me to verify that my Service Request was assigned to an Officer. I was simply told to wait for 30 days to get a response and call back if I hadn't received any response by then (which would probably be the case).
Well, I called again and was told that the SR was assigned to an officer yesterday and the officer sent out a response by postal mail yesterday. The agent (L1) was nice enough to read me the contents of the response that was sent. So, the response was something along the line of "Your case has been requested. Please wait for 60 days and if you don't hear anything by then, call again".

You have to ask him a question he cannot answer. At which point you can request to be put through.

I asked him "are you confirming that the response of the SR will be specific and not generic" at which point he backed down and said he would put me through.
Please be advised I was very polite during the conversation.

From my research on trackitt, apparently L1 officers can not confirm your address. That is what I used to get to L2. I told them i'd changed my address several months ago and sent in the requisite forms but never received a confirmation that they had changed the address on their records (all true, except that I know they have my correct address because they mailed me an I797C related to my transfer from TSC to NSC to the correct address). That got me through. When i got to the L2, as a part of identifying myself, I had to confirm my address anyway (so asking them if they updated my address was moot) so I went straight to my other questions.
It looks like from the SR they're telling you that they haven't yet assigned your I485 case to an officer. If so, you need to get that information to your congressman asap. What the hell have they been doing for 36 days!

I did change my address recently (08/14) and called L2 to confirm it. Funny thing..L2 guy took about 20 min to pull my file. May be that wiggled my case.
Also, I looked up few cases around case number and they were all approved long time.
Thank you for all the wonderful work you guys are doing on this board. You definitely helped me along the way. For those who are still waiting, hope for the best prepare for anything. Good luck people !!

Sorry, my comment should have been directed to tackle. I saw your earlier post. I'm confident you'll hear back within a week. If tackle hasn't had his case assigned to an officer yet, that's worrying and he needs to take action.

If they are churning out so many approvals in a day, then the review time of a file should be in hours and not days. What do you think?
Do we have to wait for 45 days to take InfoPass appointment after opening the SR?
When I am trying to take Infopass appointments it's giving me following message:
Case Services follow-up appointment - If it has been over 45 days since you contacted NCSC and have not received a response to your inquiry. You must bring the Service Request ID Number related to your inquiry to the appointment.

I got following two messages for I485 at separate times today, what does the second message means. Appreciate your QUICK RESPONSE on this.
1. On October 2, 2013, we ordered production of your new card. Please allow 30 days for your card to be mailed to you. If we need something from you we will contact you. If you move before you receive the card, call customer service at 1-800-375-5283.
This step applies to applications that result in an applicant receiving a card (such as a "green card") or other document (such as a naturalization certificate, employment authorization document, travel document, or advance parole). Applications will be in this step from the time the order to produce the card/document is given until the card/document is produced and mailed to the applicant. You can expect to receive your card/document within 30 days of the approval of your application.
2. On October 2, 2013, we mailed you a notice that we had registered this customer's new permanent resident status. Please follow any instructions on the notice. Your new permanent resident card should be mailed within 60 days following this registration or after you complete any ADIT processing referred to in the welcome notice, whichever is later. If you move before receiving your card, please call our customer service center at 1-800-375-5283.
During this step the formal decision (approved/denied) is written and the decision notice is mailed and/or emailed to the applicant/petitioner. You can use our current processing time to gauge when you can expect to receive a final decision.

Congrats Vkkpnm, You could go to a local USCIS office and get GC stamped in your passports, just show them the travel plans with tickets etc..

it is very well feasible. Check for I-551 stamping, and is considered as temporary evidence for GC ( valid for one year). if the USCIS officer at your local office is convinced, it can be done. I am not sure, whether you require an infopass appointment for I-551 stamping. Your travel details and tickets may be good enough to make your case. Previously I-551 was a common practice, and these days USCIS officers are strict in issuing the same. But there is no harm in trying it out.

Spouse got her CPO email today.
Mine was approved in August with PD of Oct 07.
Spouse received RFE same day for birth certificate.
We got it fixed from www.meeseva.gov.in (State of Andhra Pradesh).
Hope it helps someone who has birth certificate issues.....

You are correct at pointing that out. Many on this forum believed that the approvals will take 4 months for the first time filers. It doesn't look like that. Approvals have started for the first time filers and this changes the predictions for FY 2014.

It does not take 4 months time frame to get approvals. Same thing happened in 2012, some of the applicants who applied on Jan 1st 2012 got approvals around March 1st or 2nd week of 2012. It all depends on when the finger prints are completed and all the background checks are completed. If the officer happens to see the file again, he can just complete the approval process right away.

I got CPO text notification on my case at 5:30 PM today. Received Email notification around 5:45 PM. Still waiting on my wife's approval. It is still stuck at "RFE Response Review".
All it took was 2 RFEs, 1 SR, Senator & Congressman Inquiry. Now, I'm worried about my wife's case. I opened SR only on my case. I kind of assumed that dependent cases will be bundled along with primary and so didn't bother opening a Service Request. I'll wait until tomorrow and if nothing happens, call USCIS and raise a SR for her case.

Congratulations!!! Usually if they are together in one file the dependent approval follows shortly in a few minutes to hours.

My wife's I-485 is pending. My case was approved really quick, 30 days. RD = 8/6/2013 Card production email date = 9/6/2013. But my wife's case is still in Acceptance status. I mailed both applications together in a single package via UPS. Got our finger printing notice, EAD& AP Combo card all together except I-485 approval. Since it has not been 4 months (I-485 Processing time) from RD, I am not sure what I can do.

I got CPO text notification on my case at 5:30 PM today. Received Email notification around 5:45 PM. Still waiting on my wife's approval. It is still stuck at "RFE Response Review".
All it took was 2 RFEs, 1 SR, Senator & Congressman Inquiry. Now, I'm worried about my wife's case. I opened SR only on my case. I kind of assumed that dependent cases will be bundled along with primary and so didn't bother opening a Service Request. I'll wait until tomorrow and if nothing happens, call USCIS and raise a SR for her case.

I have been waiting for last 68 days with PD Dec 2006 (EB3->EB2). Tried everything from eSR, SR, talking to L2, using congressional inquiry etc. My case has been lying with an officer since Sept 03 2013 (as per response to SR received on 6th Sept 2013) , but no updates since then.
The only good thing is that TSC Congressional Liaison office had asked congresswoman's office to wait for 45-60 days on 26th Aug 2013 and tomorrow 45 days would have passed since their last update, so my congresswoman's office will contact them again. I just hope that USCIS does not run out of visas again (if they decide to use monthly quota ONLY). There is already some chatter on Trackitt that visas for this month are over :(

To our knowledge, the USCIS has no mechanism for applying monthly quotas. The DoS sets that through the visa bulletins and the USCIS is guided only by quarterly quotas. The vast majority of Eb2I applicants pre-Jun 2008 will get their GCs this month. I suspect that once your congressman's office follows up, you will receive your GC in days.

I hope your words come true :o. Never thought that this whole approval thing will get pushed to October 2013.
Also, thanks for clarifying that there is no concept of monthly quota as far as USCIS is concerned. The monthly quota makes more sense for DoS while determining CoD.
