Last spring in 2012, did people "miss the boat" even after getting reply either by SR or other way (including congressional inquiry) that their case is assigned to an officer.
I am trying to interpret the congressional inquiry reply as best I can, can I hope that there sure will be an adjudication since its "with an officer for review" or else are there any cases in the past where it has been assigned to officer but never adjudicated for various reasons?
Yesterday and today the pace of approvals have slowed down dramatically.
we have only 10 business days left in the month and after that there will be another 7.3K cases added and I am not sure whether the IO's will try to finish the cases already assigned or else will go for the "fresh fruits".
I am pretty confident that you will get the approval this FY year itself. I know that you have some concerns regarding your current job, but you will be fine since you have already replied to the EVL RFE. I know 2 people who got their GCs after they were fired by their GC enployers in 2007 and both of them recently became US citizens, without any issues. So I do not think you will run into any problems because of job change.

( at this moment choosing the latter)

I would suggest to go head on with ur employer. Certain folks just need to be kept in check by periodic taps on their head so that they even will let u live. worst case they fire you and just be ready for that possibility. I would suggest be ready for anything- job in different state/ city, any remote part of the country etc. Anything would be better than this.
My recommendation is that u assume that u wont get GC in the next few months and plan and do what u have to do. If it arrives sooner u can change ur plans any day. (or go on vacation for couple of months). If you are unable to do that, take a sick leave for few days till end of month hoping to get GC (Find some chronic condition like back pain, neck pain etc where if you say you have pain and they diagnose they will definitely find something :) u r a doc. i dont have to tell u more). And during this time, find a new job in next couple of weeks.

As seattlet said - if it comes to that - screw the employer. I don't want to be insensitive - but to be honest - if it comes to that - screw the green card also - your own dignity and peace of mind is 100 times more important than any green card or citizenship. Just don't let that jerk have you do something illegal.

thanks for your kind words, last time even though I had concurrent H-1 , I left the old employer with whom I had 1-140 just couple of months before GC and by the time I got new PERM and I-140 the dates retrogressed and I was just able to file for 485 in April 2012. Now that I am current I am putting up with BS/ swallowing up my ego ( or I should call it self-respect) hoping that the usics will adjudicate in coming days or couple of weeks, I spoke with a Pilipino friend ( we both started on H-1 our first jobs but now he is on his own ) who offered to give a EVL should I lose my job immediately. even though technically I could sue my current employer ( if he fires) as he has to give me 3 month notice before terminating , he can always show some reason to justify firing and unless I am able to prove that he is biased ( which is very difficult as the rest of the staff mostly hourly waged staff in the office or other doctors will try to keep their jobs and not say a word) its very difficult to sue ( courts usually give employer / entrepreneur the benefit of doubt).
a dentist fired his employee as " she was too hot for the job" and she lost in the court even though she worked for dentist for years.
My last resort is to open a LLC and plan to work on my own but in case of RFE, its difficult to answer as I wont have anything but just a LLC ( without any ability to pay etc. ) as it takes months to get on insurance plans and get hospital privileges.

I think its best to stay put at the job. I am surely less educated about all the details but had heard that people generally stick around with the employer even after getting GC. I do not know if it is true but had heard that 6 months is the minimum time to hang around after getting greened.
About the multiple H1, I have read conflicting information. Some forums like Murthy have explained that it is not in the best interest to be on multiple H1s at the same time. I currently work for one of the big software firms but also had an opportunity to work for a startup which was ready to hire me part time on a separate H1. However, researching the topic I did not feel comfortable to hold multiple H1s. If uscis is willing to give you permission to work under concurrent h-1's you can ( as a physicians I can do 2 full time jobs at the same time). you cannot apply for new h-1 or H-1 transfer and work for both.
secondly once I get GC, there is no rule as to how long somehow has to stay, I recently spoke with a physician who stayed for 1 month after GC and just got citizenship. 5 years from now the mood in general of the country will be pro-immigration so I expect them to be more lenient. More ever once I get GC I can work the way I want ( which is what all physicians should do- look out for the patient , not greedy employer) , if employer terminates then even if it 1 week from the time of GC, still I will be in good shape or may be he will learn to kiss my "you know what" for duration of my stay.
By the way in most forums the opinion of most people is not even worth a cent., here spec and others take extreme caution in providing links and evidence on everything they say.( uscis website, memo's , prior cases ) ( even though I have Guru under my name , I am not one , I got it without my knowledge perhaps for a amount of blogging I guess)

You might be correct and you surely have more knowledge about the details of concurrent H1's.
When I was going through the option of multiple H1's, I remember reading that it is not logically correct to say that I have multiple H1's (both full time) because of the employee-employer relations requirement that requires an employee to work in the employers office. If both are full time then how can I potentially be in two offices at the same time for the office hours ?
I also remember reading that in the I-129 application there is a box for concurrent H1 and that once the box is selected in the application then the jobs better be one part time and another full time. But again I do not know much about it.

you need not work in an office, moreover you need not work the same hours, many doctors work well beyond 100 hours,
I am one of them and I was given concurrent H-1's by uscis, I didn't work for both employers for very long

Good to know that this is possible. I got contrary advice when I was figuring out whether a person can work for multiple employers on different H1s. Just out of curiosity, why did you not continue working with both and file two I-485s. If working for multiple employers is possible then I suspect that filing for GC with both is also possible. This can increase a persons chance of getting the GC.

Below is my take
1. What I realized is you r the only person who can asses your situation make a right decision. No one else. They may say jump the well,cuz may be they are strong to jump, but you may not.
2. Leaving employer right after gc and having intent of leaving once approved is fraud. Ppl cover that in many ways but fraud is fraud. You may face consequences. Ppl say risk is only 1%. But for me no. For 99 others it may be ok.
3. If you started the process of moving before you r approved and if you informed of the intent to uscis its not cuz its AC21
4. I'm current and unfortunately I got an offer just before dates were current. Gues what I'm doing, I'm sticking to my current employer. Rejecting the ft. Devil vs prada. Watch that movie. You are the one knows what you want.
Don't make decisions in haste. I saw you posting today to carry two ids just for the sake of it to some one else. By that I assume you are no risk taker. So my suggestion is for you is stay put. But you can throw that suggestion in garbage :-)

That is a problem between you and your employers. USCIS doesn't care about that. However USCIS does require that the candidate be paid for 40 hours of work. So there is am implicit requirement here and I would imagine that USCIS will object to a third H1 because it is indeed difficult that in a week one can work 120 hours.

On August 13th, status changed from RFE response review to Initial Review. Based on various forums, this seems to mean they opened my file and took some action. Does this mean a decision will be made soon? Like either a decision or RFE to follow?

First of all, a big thank U, to Q,T,S,M,In,Viz,Ped .. been following Q&T from ** days and never dared to post :).. only read tons of healtly Info, predict,agremnts/disagremnts.
I have been expert in my Group of friends and always quote 'Q immi' - google search where I get and trust the Info.
As S put the figure of trackitt Approval of 5K for August - would like to know if there's ever a std. process/Memo of selecting I485 cases by CIS, pretty obvious that CIS doesn't follow any when approving 485 cases-
As Indiani and others I am also worried if my case gets picked up next month, short summary of my case, PD April 2008-EB2I, I140 revoked by Employer Late 2011 (Bcos I left Employer)- went back to Employer and used the same Labor(PD Apr 2008) to re-file I140 + 1st I485(April 2012)- I140 approved Dec 2012. Now concerned if my I485 gets picked up as someone on Trackitt said that CIS goes by I140 Approval Date while processing I485 - could be trash Info.
Also I1485 filed on April 2012 shows PD as the received date and 2nd approved I140 shows PD as Apr 2008.
Any sought of explanation will help -
1. for PD differing on I485 versus I140 and
2. CIS reason of picking the 485 cases one versus Other-
I do understand that approving 8-12 K months would have some approvals of easily approvable cases and there would be cases pending even being current for 2 times-this will be devastating on some of 2007 Eb2 filers.

Hello All,
I'm a new user. My priority date is Oct 2007. Received RFE and replied on July 2013. The status is still "Request for Evidence Response Review". Any idea when my application will get picked up for processing? I see that lot of applicants are getting approved however there is no pattern in which they process the application. Does it happen that an application will never get picked up even when its current? I'm worried that it might happen to my application.

23 primary approvals today so far ( by late tonight might turn out to be 30 for today )..overall Good day.
If the pace stays this way hopefully 9k+ might be approved even though that leaves almost 3-4K for next month.

I have been using historical numbers, but they may no longer hold.
Until now, most approvals have been from the "old school" Trackitt users who initially filed in 2007 and put their case on Trackitt a long time ago. The numbers that don't update their cases is reasonably well known.
Now we are seeing the "new breed", who only put their case on Trackitt last year or earlier.
They appear to have added cases at a greater % than the "old school", but the % that will update the case status on approval is unknown.
It's quite possible that a lower % are updating the case status, which will result in a higher number of actual approvals.
A better estimate can be made once we know the actual number of approvals for FY2013.

I have read a few profiles on trackitt from Nov ( pending approval total 63, excluding new filers) and some of them even though appeared as pending but have posted last year that they got GC in message section, moreover some have never posted anything or updated after last year. so of all the unapproved we just know how many of them really are unapproved and moreover the conversion rate is also very difficult to predict considering so many variables.
The rate of approvals per week looks almost constant with some minor variations. I hope this year at least they will make an effort to "process all cases" before closing for the fiscal year.

With folks becoming current in Aug and Sep bulletins, many of us may be considering scrambling to open Services requests, Infopass appointments, etc. in an effort to make sure our cases do not get left behind.
To that effect, I found this interesting article on Avvo written by a immigration lawyer regarding why Infopass appointments don't work. I assume the same may apply to SR's and potentially inquiries made via congressman's office too. Just something interesting to read. Moderators, if you feel this is not relevant, please remove or move to another thread.

With folks becoming current in Aug and Sep bulletins, many of us may be considering scrambling to open Services requests, Infopass appointments, etc. in an effort to make sure our cases do not get left behind.
To that effect, I found this interesting article on Avvo written by a immigration lawyer regarding why Infopass appointments don't work. I assume the same may apply to SR's and potentially inquiries made via congressman's office too. Just something interesting to read. Moderators, if you feel this is not relevant, please remove or move to another thread.

All valid points in the article. But for an applicant who is dying to get his / her case resolved, he/she has to check every possible option to get an answer. Even if the chances of success are low, i know I would do it (probably not my first option though). Speaking to a L2 is probably more effective.

viz, I completely agree. I am in the same boat. My date will become current in September, and will likely have only that month to possibly get approved before dates retrogress (externally or internally). So depending on how things go, I will certainly consider all options. Worst case, if I miss the boat this time, I don't want to have regrets about not trying everything I could.
Also, to your point, when can we ask for an L2? Is it only when we open an SR over the phone, or can we ask for an L2 during an Infopass as well?

most senators/congressmen won't entertain a request from someone outside their constituency. There is no incentive to them as you are not a future voter. Besides letters don't make any difference in general. Their office would need to do the work/follow up for it to have any impact.
If you are lucky enough to have your Sentor/Congressman on any relevant Committee (immigration, homeland security, judiciary), use them to the fullest extent possible.

I haven't gone through the process personally but my guess its an over the phone type thing.
Others who have gone through the process may be able to help better.

I got my green card on July 27, 2013 even before my priority date became current (Aug 01, 2013). Today I got a notice from USCIS that my application was approved in error. They are asking me to return my green card so that they can make corrections. I don't know what it means. If I think positively then they should just issue a new card by correcting the effective dates on that card but with USCIS you never know -:( I am going to return it and see what happens next. This madness would never end....
Anybody else got similar notices ?

Congrats... 2008 was a good year for Montelena cabs. If you get older vintages even better... 2008 is still pretty young for my taste :) I would also recommend an 2008 Jean Louis Chave St. Joseph.. slightly on the expensive side but its excellent!

Response to attorney's office from uscis today ,
paralegal sent an e-mail on august 1st reminding them that PD is current for me.
I have applied concurrently 140+485 in april 2012 ( with request to retain old PD nov 2007 which was on old-140) , so this attachment doesn't make much sense as the 2nd and latest 140 and the one and only 485 are applied together .

The trackitt unapproved cases data appears more unreliable the more closely we read it.
just now I went through many profiles in November 2007 who are pending approval in august, some just posted message that they got GC but never updated, some have never updated their profile in more than a year.
Overall the people who are left are perhaps few (3-4) thousands total at the max.,
with 8 business days left (+ some Saturday approvals), I think we just need few good approval days to finish almost all cases.

During this step the formal decision (approved/denied) is written and the decision notice is mailed and/or emailed to the applicant/petitioner. You can use our current processing time to gauge when you can expect to receive a final decision.

Was wondering if SR is required as my company immigration lawyers are going to send USCIS a letter to process my case in sept when I will become current. Will this be like a SR? I called USCIS and opened a SR as it has been 60 days since my case status changed to "RFE Response Review". I was told that the SR will be assigned to an officer within 15 days and I should expect a response within 30 days. I have no hope.

I think it is normal, i too received another decision email after getting the usps tracking number.

I believe pessimism is a natural reaction keeping in mind that no one in "that" organization follows a standard process. I have been fighting with myself to stop thinking of what if scenarios as I have no way to know what is going on

I think it is a bug in their system and don't think manual intervention is there in the process. I actually got six emails with various statuses going back and forth after I got my approval email. It even went back to 'Initial Review' and I panicked a bit but heard several people got similar emails as well. For all practical purposes, you can just dis them. You should be getting the physical cards almost a week after your approval email.
BTW, I even got an email about my EAD approval six months after I got my GC. :)

I am thinking about taking appointment as congressional inquiry/ speaking with L2/ attorney's email request all have been exhausted and the Para-legal some how thinks that info pass can help as she has seen one approval after info-pass. ( perhaps a coincidence but for her to make a conclusion one case was enough ..LOL).
slowly the possibility of having to wait another year is sinking into me, I will wait till last week of September before using AC21 unless October dates will stay the same ( which I think is extremely unlikely but as Q thinks there is a small chance they might stay the same as September)
addendum: just took an info-pass appt., surprisingly there is only one day - September 4th morning available and I have to pick a time within 2 hour timeframe.

There's a thread on trackitt listing applicants that are current in Aug but haven't received their GCs yet. There are 80 people on the list. If we assume that list is 50% complete among trackitt users, we're looking at 160 trackitt users that are still waiting, and if we throw in a 6% conversion ratio, it could be about 2,700 applicants still left over. Of course, if only 20% of trackitt users had populated that list, that number would be 6,700.
Another way to look at it would be to compare the tracker # of approvals (about 80) with the # still waiting on this list (also 80). That tells me we only have half the approvals, thus far.

I counted all Nov 2007 august approvals listed trackitt and also all approvable cases waiting ( not accounting for people not posting their approvals due to various reasons)..
My final impression: overall looks like anywhere between 30% to 50% left out so far , that translates to 4 to 6 thousand are still waiting.
My main concern is that the rate of approvals aren't picking up pace overall which I expected.
In September even if 4K are added to 7.3K= 11.3K
If they are able to process 8K this months, they wont be able to process a whole lot more next month as the limiting factor if the personnel and time.
Finally as I mentioned few days ago I expect about 4K approvable cases left away ( I hope its somewhat lower)

About 400 have been approved in August to date and there certainly could be the same number to come again with a PD prior to 2008.
There are only another 7 working days in August after today (which has seen quite low approval numbers for the second day running). The final total for August might be around 600, which is about the maximum USCIS has adjudicated in a month.
In September, somewhere between 600-700 further Trackitt cases will become Current with a PD earlier than the Cut Off Date.
Even accepting that not all September cases will ever be updated, it's a bit worrying considering the current processing rate. We have Labor Day coming up, so the start of September may well be slow as people tag days on each side of the the extended Holiday Weekend.
If a couple of hundred are still left from August and September cases require another 400, then USCIS would have to approve another 600 updated Trackitt cases in September.
It might be possible to process all of them, but I think USCIS would need the whole of September to have a chance of doing so.

Just thought of sharing my InfoPass experience in Manhattan/NYC Downtown office on 20 Aug 2013. I unfortunately was directed to a pretty nasty woman officer (based on token number) who refused to give me any information other than asking me to send a mail to Texas Service Center regarding my case status and getting a response from them in 90 days.
She refused to let me know if my application is being adjudicated under EB2 or EB3 category (though Fragomen already sent me USCIS response on 13th Aug that my application is being considered under EB2). When I asked her if my application has been assigned to an officer, she bluntly suggested that she does not know. She went on to state that I do not even fall under NYC Field office and I had no business to come to NYC office to check my case status.
Icing on the cake was when she insisted that my EB2I PD (12/12/2006) is not even current in Aug 2013 :mad:, but will be current starting 1st Sept 2013.

I don't know if this is co-incidence for me or not. It very well could be because on 8/15 several TSC applicants mentioned getting magic email around 9:30am like I did. But for what it is worth, here is what happened to me.
Like you and others on this forum, I was anxious about getting my file picked up (EB2 I, July 2007 priority, Nov 2011 filer). I called L2 on 8/5 and spoke with a lady. She didn't provide any useful info, only said I should wait 8-10 days and call again. So, I called again in 9 days on 8/14. I spoke with another L2 officer. I told him that I was asked to call back this week to see if an officer can provide with any better status on my case. This L2 officer took my info like birth date, country of birth, address etc. and put me on hold for 5 minutes. He came back and said case is in the system. I tried to probe him a little bit. Then he said, he could have USCIS send me a letter stating I should wait for 90 days. This sounded to me like he was going to create SR. Sensing that, I told him I don't want to create any SR. My purpose was simply to understand status. I also told him not to bother with SR as I didn't want to put any burden on IOs because I know they are busy right now. The call ended there. Next day, I got the magic email for me. My wife got RFE which I'm waiting to receive.
Not sure if the L2 was doing something to expedite my case while I was on hold for 5 minutes. Or this must have been a total co-incidence. Also, the second L2 officer was a latino guy, greeted me in Spanish. I greeted him in Spanish when I ended the call. May be that helped, I would never know. This may sound warm and fuzzy. But, I know you're very anxious due to your job situation.

I counted all Nov 2007 august approvals listed trackitt and also all approvable cases waiting ( not accounting for people not posting their approvals due to various reasons)..
My final impression: overall looks like anywhere between 30% to 50% left out so far , that translates to 4 to 6 thousand are still waiting.
My main concern is that the rate of approvals aren't picking up pace overall which I expected.
In September even if 4K are added to 7.3K= 11.3K
If they are able to process 8K this months, they wont be able to process a whole lot more next month as the limiting factor if the personnel and time.
Finally as I mentioned few days ago I expect about 4K approvable cases left away ( I hope its somewhat lower)

Tricky situation?
My PD is OCT 2006, EB3 --> EB2 case, actually on july 11th uscis issued RFE's to me and dependent..We received copy of dependent ref thru old attorney but not mine...thru my new attorney we submitted dependent ref docs and requested my ref details on July 23 rd...Surprisingly I have received my ref details thru my other attorney (submitted ac21 thru him) on 1st Aug and sent ref docs on 2nd and uscis received on 5th morning.
Both cases approved on 8th Aug. and received green cards on 14th Aug.
But on 6th Aug usics issued Rfe my case and after receiving it on 9th Aug we came to know that it is duplicate rfe (same old rfe)...I am thinking that since my new attorney requested a copy of my ref uscis issued on 6th and for safe side my attorney re-submitted copys of ref.
Here is tricky part on 14th Aug 4:15pm my case status changed to USPS delivered green card exactly after 1 hr (5:15 pm) it changed to 'Response review status' .....since then my case status stuck there....so day by day i am getting worry about my case status ..Gurus pls adivise...

I never wanted to think about info-pass until I spoke with Para legal to discuss the response from uscis and to see if there is anything left to do, at that time she suggested info-pass but I think info-pass officers are not in any better position than L2 ( which we can do fro home/ our office based on convenience as they speak for less than a minute anyway).
for me taking morning off might be difficult especially with my job situation. even though I took appointment for September 4th, I might just cancel it next week as I don't see any logical scenario how it will increase the chances of my GC., it will just remind my employer that I still am going through this GC stuff as I need to inform them before taking half day off as I am in the clinic ( sort of ) these days.
Thanks for sharing your story, when there is no accountability and no incentive to provide good service or more service , it just turns out to be pathetic service.

once they have approved your GC ( as long as there is no error or fraud), they can't cancel your GC, its illegal, you can sue them if they try to take it away.

I don't think you need to worry about anything. You have the green card (do not return it), you've responded to the RFE, twice before the GC was received, so you're fine. I'd ask your lawyer to follow up to close the loop with the USCIS so as to resolve confusions on their end.

Thanks for the kind words. Unfortunately, people in NYC are a bit rude as compared to other places in the US. It doesn't make too much sense to feel bad about it - may be the USCIS officer had a bad day, was frustrated and took it out on me.
I feel happy that I have tried everything I could do to ensure that USCIS looks at my application - from interfile to asking FDBL to use Streamline process to opening a SR to asking my congresswoman for help. Need to just wait and watch. Hoping to get greened soon :).
To the contrary, my experience with FDBL has been nothing but pleasant (much better than 2 law firms I have dealt with earlier - my old company's lawyers and law firm used by my wife's hospital for her H1). I had read about all the bad experience you had with them and was pretty concerned, but they(FDBL) have gone out of way to accommodate all my requests. The reason for this could be that forced my HR to ensure that I communicate directly with their Client Services Manager instead of stupid paralegals (who all think that they are more qualified than US Attorney General ).

An update on my case. I received the magic email yesterday for both me and spouse.
PD Dec 2007, RD Dec 2011. Missed the boat in 2012. Although I came to this forum once every other day to read but I tried to refrain from posting and checking various other forums frequently. This time around when dates were current I approached my congressman and senator both for help after 1st week( my attorney said if it cannot help it won't hurt anything). Senate office is backed up and needed 2 weeks to just look at my request. Congressman office was more accessible but they are still waiting for a response back. I can't say last few weeks were not stressful or I didn't think about GC but was trying my best to stay engage with work, family and friends and exercise, in that order.
I found this forum almost 2 years ago and has been my soul source of information. Seldom I ventured to trackitt or other sites. I think this forum has lots and lots of useful information and very knowledgeable people who go out of their way to help or answer any question.
My special thanks to gurus for all their work. Just to name a few without which this post will be incomplete are: Q, Spe, Viz, matt, veni, pedro, nishant, tackle, indiani, and others. This is simply amazing work.

This means that the maximum number of applications that USCIS could have processed in Aug was 8050 and they seem to be pretty much on target as they have completed approximately 6.5k already. This is the 16th working day out of the 22 working days (I am only counting mon-fri). This translates to 72% working days and in that they have completed 80% of applications. Statistically they are ahead of time and may be they run out of cases before end of next week.
This is also good news for all those who are waiting with PDs prior to Jan 1, 2008 as most have chances to be greened.

What is the difference between I485 supervisor and officer? In some updates it is mentioned "going to be assigned to officer".
I got update from congressmen saying
" A request has been sent to the I485 supervisor for the files .. to be reviewed and your constituents should receive a decision or notice of other action in 30 days"
Is supervisor any different from officer? This seems more like a standard generic response.

That is not correct, Jagan. Someone who has applied for an EB3 I485 (so pre July 2007 PD) and has interfiled with his EB2I140 prior to Aug 1, 2013 will not be counted in demand until then, and at that point he will just get his green card, so he won't be in the demand data at all.
Only people who became current in Aug 2013 with a PD of pre July 2007 are the only ones who will not get their GC this FY.

Agreed. I stand corrected as I missed out the EB3 - EB2 interfillers. Hopefully no visas are wasted eventually but after factoring in the 4000 possible porters it looks like they need to pick up speed to use up all the visa numbers.
I am assuming that CO moved the dates considering the demand + porting (interfilers that filed in first 10 days of Aug). And further he moved it in Sept by 6 months. If he has made the necessary calculations and moved the sep date then surely there are a lot more visas available and they need to process faster.

I won't comment about your figures because I have not had a look myself.
The final paragraph assumes that all years are equally represented on Trackitt. I don't think that is necessarily true.
2007 PDs appear to have a larger % representation on Trackitt than earlier EB2 years and that those years are in turn higher than EB3, where a number of porting cases were originally shown on Trackitt.
If so, 2007 PDs need a larger number of Trackitt cases approved than earlier years to represent the same "real" number.
It's another complication to potentially deal with.

I won't comment about your figures because I have not had a look myself.
The final paragraph assumes that all years are equally represented on Trackitt. I don't think that is necessarily true.
2007 PDs appear to have a larger % representation on Trackitt than earlier EB2 years and that those years are in turn higher than EB3, where a number of porting cases were originally shown on Trackitt.
If so, 2007 PDs need a larger number of Trackitt cases approved than earlier years to represent the same "real" number.
It's another complication to potentially deal with.
It's never good to arrive at a conclusion from two different sets of data but I'm going to stand by my take-aways. I believe that a) NSC is focusing on the the low hanging fruit that are direct EB2 cases at the detriment of porters (I can't think of a good reason for that, perhaps the longer gap since they had their last IBIS check done), b) they are close to done with their August load, not having to deal with the RFEs that TSC did, and c) they will be able to get to their September load immediately without the August overhang, so they may well clear their shelves before the end of September.
Self-serving conclusions, absolutely :)

The 8050 demand is as of July 2013. The includes all possible porters that could have ported prior to July 2013.
the people who became current in Aug 2013 and applying EAD first time are anyways not going to get GC before Oct so those do not need to be counted. Hence the demand is 8050, no more and no less.
I initially thought total demand is 8k, until spec pointed out that inter filers aren't included in DD so the actual demand is 12-13K for august , only about 50-60% of it is approved so far

still waiting tracker ( was the title of the post), its hard to make a conversion rate from this number but
for me to depend on the trackitt approval rate has been frustrating as I followed the last 5 approvals messages and even after several hours not even single one entered their approval on trackitt.

slightly more than 50% of late PD's are approved so far and only 8 days left ( including Saturdays).
if 50% approved in 19 days , may be another 25% will be approved in the next 8 days and hopefully another 10% approved in September, overall 15% might be left over.

I totally agree. I don't think anyone would argue that point.
I think the question is, what is the current level that do not update their case?
I have a suspicion it is no longer the historical 80%, but it's difficult to quantify the number until after the event.
About 10% of 2007 PD cases appear to be on Trackitt (which is far higher than any other year). If you are using a 6% conversion ratio then that equates to assuming 40% do not update their case. 7% = 30% etc
I have a good feeling you will see your approval before the end of August.
PS Thanks for the link - the thread must have been way down the list last night - I see it nearer the top and obvious this morning!

So yesterdays' trackitt approvals according to the thread (not tracker) was about 35, but that includes a few dependents and a few 'friends', so i'd drop that figure to a more pure 31. The first 3 profiles that i looked at hadn't updated them yet. I wonder if people are waiting to receive the actual card before updating the tracker.
And today there have already been some brisk approvals. 5 I think so far.

According to the RFE, USCIS is asking for a birth certificate. I had received similar BC RFE in December even though we both provided BC during the initial submission. Anyway, here are my questions.
There is a slight mismatch in the "middle name" displayed on passport vs. BC. Her last didn't change as our families have the same last names. After our marriage, my wife took my first name as her middle name. She applied her passport after our marriage using the new name.
During the initial I-485 application, to be pro-active, I submitted her birth certificate, affidavit from her mom stating name change after marriage, and documents showing before and after marriage name.
For this RFE, I have two choices:
(1) Submit only what is asked, i.e. BC. RFE also says if you cannot produce BC, then submit secondary evidence. But, there is a danger that if they see discrepancy, they may issue another RFE for secondary evidence.
(2) Submit BC + secondary evidence like we have submitted originally.
Wanted to talk this out to folks who might have experience.
NOTE: I read in one of the older archived posts on this forum where Teddy had given an explanation why you would receive RFE to submit BC when you had already submitted it. This could because BC may have been taken out from I-485 application package and must been put together with EAD or AP application package by the officer when they first adjudicated EAD/AP. Sounds logical explanation because I too received BC RFE in December.

I received a combo card for my wife (she filed i-485 for first time on 1st Aug 2013) earlier today even though her EAD application was approved on 20th Aug and her Advance parole was approved on 21st Aug 2013. so far 7.5K might have been approved.

I don't think you will get a RFE on AP. Normally AP approvals are very close to EAD approvals, so should be very soon. Sometimes the online status will not change, and you will see the document in the mail box.

I'm pretty sure I've heard the EAD and AP applications are not adjudicated at NSC or TSC anymore, or it is an entirely different department.
I'm sure I've read that they are separated from the I-485 after checking for validity at the Lockbox facility has been completed and routed to wherever the adjudication is carried out. In any case, I am positive the same IO does not handle both the I-485 and the I-131/I-765 applications.

Just letting you know that our application too, my husband's (primary applicant) I 485 got approved on 22nd August, however I got an RFE. We are yet to know the details.

USCIS approval process is not a single thread batch process however a multi thread user intensive process. From what it appears that even though a case maybe in the so called preadjudicated state still the officers give it one final look before approval. Like any other place looks like statistics is if not in totality but partially a measure of productivity so yes low hanging fruits, simpler cases or cases where certain checks are complete normally likely to get completed or say rubber stamped faster. A case which is properly filed with all supporting documentation is also likely to be appeared in one shot. Last year when cases were pretty much being appeared left and right individuals whose dates were as late as Dec 2008 got approved whereas people with earlier dates either received RFE's that could not be responded in time or they had background checks that took longer or porting was not integrated in time.
I have also been following your postings and empathize with you because like you I had to put up with a terrible client at a project for the sake of having stability to be done with GC. Since your case is a porting case even though its EB2 to EB2 it seems that USCIS was not able to automatically link the 2 I140's, did you quote the A# on the fits I140 on the second normally this is how they should link automatically.
Coming to your question unfortunately come Sep you will be competing with more people for approval, in the ideal world if there are enough numbers yes everyone will get it but in reality the odds go slightly against you. I think most porting cases from the past will definitely get approved a lot of them were current even last time in Feb - Mar 2012 but could not get approved so even in the worst case if you do not get approved in September then it is fairly likely that the dates would not retrogress before your date in Oct. Sep will be a fairly interesting month of random approvals most likely as the date movement seems to be targeted towards finishing off the cap and every year the cap gets finished in early September.

"Service records indicate that your recently approved I-140 petition has been connected with your I-485 application. Further, your I-485 application is currently assigned to an officer. Although assigned, we cannot predict the date the case may actually receive review.
If you have not received a decision or other notice of action on this case within 90 days, please contact us for updates."
Like many on trackitt have mentioned at TSC the "porting cases" are bit delayed in general, even though some use the word porting for Eb3-EB2 only ( but the concept is the same)
since the case is assigned , I was hoping that the officer at least would get to the case before picking up cases assigned on September 3rd. ( considering the same officer who has my case will be given additional work load before finishing the ones the officer already has)
But as there are many officers and more than one processing center and most of the actual process is not as transparent as we want them to be, I do understand that we should see all kinds of approvals but my last glimmer of hope was that the cases which are assigned hopefully might receive approval/ review in September.
Planning of AC21 is kind of long drawn process for me as it takes a while to switch jobs in the field I am in ( not necessarily finding one), I will wait till end of September or until visas run out before making that decision.

October bulletin will release in Sept 2nd week. I dont think they will have all the numbers yet, so it has to wait atleast until Nov bulletin for retrogression. I can bet on dates not going back in October bulletin. cant bet on Nov though.

look at historic VBs.. you will see that dates retrogress in Oct itself. You are forgetting (I think) that the clock gets reset in Oct i.e. visas available are back to around 220 per month and there are legislative requirements that prevent CO from allocating more than that per month (until quarter end). As you know, there are way more than 220 applications per month.

CO has 9% of the EB total for the year available in October for all Categories. He does not have to prorate that to Categories/Countries.
The problem I see, is that if the EB2-I COD is left at 15JUN2008 in October, the level of Demand from EB2-I will be far in excess of any number that could be available.
That would demand retrogression of some sort (no pun intended).
One strategy might be to pull the COD back to ensure no further 2008 PD are approved and mop up the earlier cases left approvable in October.
Since even that might use up the full quarter allocation for EB2-I, that might also necessitate quite extreme retrogression for a period following that.
Such a strategy is not without risks, depending on exactly how many pre 2008 PD cases remain at the end of September. That is something he will have to guess at when he sets the October COD.
He also has the option of retrogressing in one go in October to a date that will consume the monthly allocation. That would allow Co to assess the demand carried forward in to FY2014.
If he leaves the COD at 15JUN08 in October, I'm 99.9% sure actual Demand through the month will far exceed the visas that could be made available to EB2-I. He'd then either have to internally retrogress the date at some point in October, or face a mini repeat of FY2011, which could include EB2-I being made Unavailable for several months afterwards, depending on the level of over consumption.
The only way that could be avoided is if virtually all cases made Current in August/September VBs were approved by the end of September. History tells us that is extremely unlikely to happen.

Hey guys, has anyone travelled to India via London recently. My H1b & Visa is expired but H1B extension applied. I also got EAD and will be travelling on AP. Wondering is EAD/AP sufficient to travel via London? Do I need to get transit visa?

Yes. Any transit via the UK needs a transit visa. That's why I avoid flying Virgin or American/British Airways.

A valid US visa is required only for return journey. Generally speaking to travel through London - you need visa for your destination - whatever that destination is.

Is 13k actual demand in august or slightly low ? ( I just know the interfilers are few thousands 4 or 5K, I am not sure.)
Is the current usage approximately 7.5K? ( I understand b'cos lot of people aren't updating on time , its difficult to accurately assess)

That's my understanding as well, even though the person would clearly be able to enter India due holding an Indian passport.
Despite that, the DATV is needed for both outgoing and return legs from other posts I have seen.
I don't pretend to understand why.

Ghost - I am surprised. I just checked and you are - almost right - there is one exception for Indians though.
If you are travelling from US UK Aus and NZ back to India - you dont need transit visa IF you were on a return trip from those countries with duration of less than 6 months.
So bottomline is - in some cases it could be possible. But I would skip Heathrow. There are n number of options elsewhere.

What the hell? That same thread shows a Feb 2008 PD EB2I approval (user: tanjore) . Looking at his profile, the timing of his I485 application seems right. Also, he appears to have a Nov 2012 PERM application. I can't understand why he would need that if he already had an EAD at that time associated with an EB2I 485.
I'm leaning towards user error right now, althought it's certainly possible the USCIS jumped the gun.

Distinguishing user error from reality is so difficult.
The other case showing as a 2008 PD (sunnybms) actually has a December 2007 PD.

I am filing my I-485+I-131+I-765 first time in Sep'13. As per the instructions on these forms, each form requires 2 photographs i.e. 6 photographs in total. But my lawyer is asking for just 2 photographs. He is saying that earlier they used to ask for 6 photographs but not anymore, and now just two photographs are sufficient. Photos for combo-card for EAD/AP will be taken at the time of FP.
I have to travel to India in late Nov and don't want to take any chance regarding EAD/AP. But even if I send 6 photos, lawyer is going to use only 2. So not sure what to do. Can you please weigh in?Can anyone answer this question in the September VB thread?
I've highlighted it here because by the time it was moderated, it got lost in the other posts.

i believe, that requirement has to do with, if the person does not clear immigration of the country he/she can be sent back to the country of travel origin. ( i have read somewhere that ) international flights can not start outbound journey until all inbound passengers have cleared immigration.

You had the right feeling jagan at 4:00pm I received the " case update" TXT / CPO email.
I am thrilled to see so many people rooting for me and want to thank everyone for the support ( which I needed badly) , Mondays have been usually good approval days as they are sending emails from 7:45 am onwards ( in fact most of them got the approval emails at this time) from the case adjudications from the last week's Friday/ Saturday.
My guess is by the end of the month they might be able to approve between 9-10 K leaving about 3K to be added to September, which should be a manageable goal to approve overall 18K , leaving only cases which needs security clearance or someone who are unable to reply to RFE on time. I know its a wishful thinking but it appears to be an achievable reality.

You do not need to worry much as most people believe retrogression is not coming until Nov and ur date is 2005 so even after retrogression you would still be current...

I think porters ( including me , even though mine is EB2 to EB2) are being considered last as they might find our cases to be a bit time consuming or some other reason, at least at TSC the porters are considered later than straight EB2.
I think they might achieve a target of close to 10K this month and even the 2-3K that are left are already assigned to officers so unless there is security clearance issue or last minute RFE you have very high chance of approval mostly in coming 4 days, if not in September 1st week/ 2nd week.

I think receiving so many congressional inquiries might have made USCIS more vigilant in what they are doing as they probably didn't want many unhappy constituents complaining about USCIS.
But I don't think they have helped any individual case as it is a sheer co-incidence that some have got approval after congressional inquiry.
If I were to give an advice I will ask anyone who have waited even a week after its current should contact their congressman ( I prefer over senator as their offices have to deal with less population)

Thanks and I agree with you , USCIS hopefully will "clean up" at least 10K cases before Friday, I think the approval rate will peak over next few days and this might be the highest approval week ever.

as mine was EB2 to EB2 retention of priority date ( one attorney told me that word porting is reserved for Eb3 to Eb2) , it took longer and moreover my RD was April 2012, I suddenly found myself in a rather unpleasant work environment so my eagerness to get approved sky-rocketed but for everyone getting approved probably will be a day to remember forever.
It was 2001 when I got my F-1 visa approved and I still remember that day ( I was very young in those days...12 years ago)

Thanks..LOL...Tomorrow, the office staff will see "Rajnikanth" and soon the employer will get a sense of reality and learn to be respectful of others ( even though as H-1 employee we are "supposed to have equal rights" but that's rarely the case)
Even though AC 21 porting to self-employment is an option under EAD I know of only one friend who did it but in general I don't like the idea of ever being "employed" so I will slip into the self-employed position be a "good employer" soon..

Congratulations to you and your family. Must be feeling very relieved now. Enjoy the moment you have been waiting for. Iam sure your employer's tone is going to change on hearing the news. First and foremost ask them to file an I9 with GC this way you can record that you worked with them post GC and then its really up to you how best you can demonstrate the goodwill intention to stay with him and make a graceful exit. Believe me a lot of people have gone through this agony of waiting for GC in a terrible work environment, now that its done Iam sure you will be over it and gain strength out of it and move on to the next chapter of life towards a rewarding career and a job that you like.

You had the right feeling jagan at 4:00pm I received the " case update" TXT / CPO email.
I am thrilled to see so many people rooting for me and want to thank everyone for the support ( which I needed badly) , Mondays have been usually good approval days as they are sending emails from 7:45 am onwards ( in fact most of them got the approval emails at this time) from the case adjudications from the last week's Friday/ Saturday.
My guess is by the end of the month they might be able to approve between 9-10 K leaving about 3K to be added to September, which should be a manageable goal to approve overall 18K , leaving only cases which needs security clearance or someone who are unable to reply to RFE on time. I know its a wishful thinking but it appears to be an achievable reality.

Thanks..LOL...Tomorrow, the office staff will see "Rajnikanth" and soon the employer will get a sense of reality and learn to be respectful of others ( even though as H-1 employee we are "supposed to have equal rights" but that's rarely the case)
Even though AC 21 porting to self-employment is an option under EAD I know of only one friend who did it but in general I don't like the idea of ever being "employed" so I will slip into the self-employed position be a "good employer" soon..

I'm hoping I don't miss the boat again this year. I called USCIS last thursday and opened SR as it has been 60 days since the status changed to RFE response review. I was told that the SR will be assigned to an officer within 15 days and I should get response within 30 days.
I have also sent requests to my local Congressman and my Senator. I haven't heard back from my congressman's office yet. However, I did receive a reply from Senator's office (postal mail) saying that they'll be working on my case and that by law, federal agencies have 30 days minimum (:confused:) to respond to inquiries from Senator's office.
I just hope one of my initiatives would at least get someone at USCIS to dust-up my application and take a look at it. I just want to know what is holding up my application. Should have been a straight forward case. I've been in the same city since 2002. Straight EB2. Working at the same company (formerly Fortune 500, now Fortune 1000) since 2005. Have had no trouble with the law. So, I'm just not sure what is holding my application up.

I am trying to figure out if USCIS is done processing most of direct EB2 folks from 2007 and if most of the people who are still waiting to be greened(after becoming current on 1st Aug 2013) are EB3-EB2 upgrades like me. Also, do you think USCIS will be trying to finish pending applications with priority dates earlier than 1 Jan 2008 before approving new applications which will become current in Sept 2013?
I understand the logic for USCIS officers going for low hanging fruits (i.e direct EB2 folks) to increase their productivity/bonus/other incentives.

As you might have already seen, approvals are pretty random. There is no order to it. Yes, I'm still waiting and its frustrating to have date being current and not getting approval. I'm getting worried that I might not get it this year. If the dates dont go back in October I might have 1-2 more months open window.

I don't think you'll need to wait that long. Most SR responses seem to say that if your application is with an officer, you should hear back within 45 days. Assuming your application is with an officer (and that it got there before Aug 15th), you should see your card before the end of September. And in any case, I think the 45 day timeframe probably includes a huge cushion. The only potential problem would be if they issue an RFE when they finally process your application.

I have a quick question for August approvals -- did almost everyone receive the June 14th RFE for EVL? I was chatting with my attorney a few days back, and he'd mentioned that the % of EVL RFEs is still pretty small - less than 10%.
Curious to know that the general consensus/experience has been on the forum.

Indiani you had mentioned that probably they are approving direct cases first and porting cases later. These porters that you are talking about are they
1) Interfilers that became current first time under EB2 ? Meaning the pre-2007 EB3s that ported in the last year
2) Interfilers who had I-485 with EB2 but somehow did not get it last time and later ported to a new company in the last year
3) People who are porting and have never filed I-485 before (I think these ones might not be getting approved but just confirming)

Its not part of regular procedure or rule.
This year as it has been retrogressed for so long they decided to do for TSC ,
simple answer: no one knows if they would send next year or not IMO

My friend got his GC approved this month. First filed under EB-3 (PD 2006) and then did interfiling and became current under EB2 in August. He got a weird RFE the last week of July asking him to send a hand written letter saying that he wants to interfile (:confused: ). He sent the letter and got approved the next week. His application was processed at NSC.

So after no approvals yesterday, the trackitt thread for Aug 28th is starting to show some approvals. I counted 4 so far across 2 threads. Hope that picks up for our Magnificent 7 that are still standing.

Total SO that could be applied to India in august+ September = definitely less than 20K ( my guess is approx. 17K )

EB3I shouldn't receive any spill over this year, although it may receive more visa numbers than its annual quota, because of underallocation to EB3ROW. That isn't strictly spillover. And those visa numbers are different fromt he figures indiani had mentioned in his post.

We approached Month end. I think USCIS several officers are already on long week end. Good luck to every one for the next month approvals. Eagerly waiting for September 3rd.

with exception of Monday, the approvals have been modest for 2 days and none on Tuesday, there may be good chance that the earlier prediction of 9K might not even be reached by tomorrow.
So as many as 5K ( remaining august pending ) + 7.3K ( September) will be pending which needs to be processed in 14 days ( excluding last week and labor day).
even if 500cases approved only 7K might be approved, leaving about 5K cases ( worse case scenario).
For this not to happen, the pace of approvals should be constantly higher in September and GC's approved until last working day. Of course if the dates will remain same in October lot of anxiety will dissipate

Would like to thank Teddy (I've some posts of yours saved in my local machine, I used to read those when I was down and frustrated like "I believe if the next intake happens in a timely manner there is a good chance that everyone in 2007 will have their GC in hand by Sep 2012, " you were bang on target but for USCIS issuing GCs to people in 2008 before 2007 folks, no hard feelings to 2008 folks though) , Soggadu ( your posts brought lot of humor and made the wait bearable), Spec (for the impeccable calculations), Nishant, Veni, and last but not least Pedro who said two days back that I dont have to wait for another year. Your words came true Pedro, all the best to you and I wish you get yours very soon.
