Payroll During While 140 is under process

Hi Gurus,

I am currently on bench and my 140 is under process. is it mandatory to have payroll run when 140 is under process? I mean is it is mandatory not to have a break in payroll.

I would wait for other Gurus to confirm this, but I think it may not affect your I140 processing. It will,however, affect your current working status (H1B/L1).

It is important that your employer continues to process your payroll if you are using the work visa to be here legally. If there is ever an inquiry from the USCIS, your employer gets in real trouble too.

IMHO - It is not mandatory to be on payroll during GC processing. However it is mandatory that you be paid if you are on H1.
