Hi Chirakala,
this is what I did.
1 Get the non-availability certificate from local muncipal office.
2 The non-avl cert is in local language, so get it translated into english.
The translated cert should "look" in tersm of format same as original.
3 Get the affidavit from translator that this is correct translation and he/she knows local language and english.
4 get 2 affidavits from parents or relatives that you were born on xxx date at XXX place.
I got the affidavits notarised on 100 Rs Stamp paper.
* * My PD is not yet current.
Thank you very much. Too much work to get done. Even my PD is not current (04/18/2008) but trying to be ready and get the docs in place.

gcsseeker, we are unnecessarily worrying about this issue and confusing others. Rules are pretty simple, what you stated/listed above is correct and there is no scope for confusion there. Read last two pages of the same thread if you are still confused.

I used http://www.epassportphoto.com/ all the time. Only paid once at CVS - 7 dollars or so.
6 photos with better quality for 19 cents in less than an hour.

Folks..
Need your inputs on my case...
My case:
I work full time in a fortune 500 company and work in my company's office. My current H1B expires in Feb 2012. I have a H1B approval from Feb 2012 - 2015 (after 6 years - approved 140 3 year extension).
I have a new passport and my current H1B visa is in my old passport.
I am planning to go for H1B visa stamping in Nov 2011. Returning back in Jan 2011 (before my current Visa on passport expires)
Few Questions:
1. I think I will get the new Visa till 2015, even though the new petition is effective Feb 2012. is that correct?
2. Is there any chance I will get 221(g)?
3. God forbid if there is a denial, can I come back on my current visa before it expires? (or do they revoke the current visa as well)
4. God forbid if i get 221(g), can i request my passport back and come back to USA on my current Visa? (Old passport has visa stamp and new passport has nothing).

I believe if the existing visa is valid you will not need to go for stamping if you plan to enter before its expiry. Even if you want to get it stamped in the new passport they will not do it.

There is always a chance for a 221(g). The best way to mitigate is to take all backup documentation and to call/email ahead to gets PIMS verified. Usually big name companies are not issues and if you are long time employee its even easier. I've done my yr 7-9 extension with an approved I-140 in the Bahamas. No issue whatsoever.

to answer your question on 221(G)
--221(G) cases have increased a lot since mid 2010 and many I know have got it recently too.
Since your old visa is valid you don't have to go for stamping for the new visa and thus avoid 221g risk. At the port of entry you can show your new I797 ending in 2015 and your I94 will have that latest date of 2015

If you are talking about your appointment with consulate then your issue can be explained at the counter and use the correct passport instead. Basically consulates use the passport number at the time of registration to authenticate you. Please remember to use your correct passport number on the Visa application that you will submit at the consulate. But, you MUST be using new passport number everywhere. Old one is just to carry along, just in case if someone wants to see the old passport as well.

If the December 2011 bulletin announces EB 2 movement to March 2008 and further movement in the next two months, what kind of movement do you guys anticipate in 2012? Its possible that the porters from EB3 to EB2 will slow down EB2 considerably in next two years or even cause retrogression. Thoughts, guys?
Also, in the interest of saving this forum another post, can you please explain what a pre-adjudicated case means and how do I know is mine is pre-adjudicated?

Hi Self.Coach, First couple of posts on this thread are frequently updated with the information that you are looking for. That said, since lot of the information that we are seeing now is speculation( could turn either way), it's hard to predict one way or the other without seeing this month's vb and demand data. By and large, over the course of entire 2012, first couple of posts will hold water. Because, irrespective of how CIS allocates visas, they got only 140K to allocate.

What was the reason cited i 221(g)?
Problem is I do international travel a lot for my work.. so if I do not get stamping now, I will have to get it in 1 or 2 months when I go out of USA (not to India.. but some other country).
I had 6 months of valid visas and went for stamping with new I 797 and got 221(G) and stuck there for a week. If you have at least month in visa validity and not planning to travel soon , may be use old stamp.

You are right..I know the policy of not asking when our priority dates are due. I think I should have asked what my main concern was directly - wanted input on the chance of Eb3 porters clogging up Eb2 to an extent that Eb2 slows down or even retrogresses considerably.

For EB3I applicants between 2004 and 2007 PDs (dates that are current for EB2 already) the difference between the 6 to 12 year wait they are looking at from now to get their GCs (very quick and dirty math) is already significantly worse than if they ported (current), so this recent move will make no difference. For folks from 2008 to 2010 PDs, they were already looking at 20 + year wait on average, so they too would have already been super motivated to port without the recent moves. So, the bottom line is, people from EB3I outside the 2002/2003 range that are not porting are not doing it for a reason. Either they tried and can't, or have other reasons to not want to (not keyed into the GC process at all, really love their jobs, are counting on their spouses filing under EB2, looking at returning anyway, etc). The recent EB2 movement is not a variable that will change any of these, in my opinion. The only variable I think that can change the equation is if the economy improves, and people can find alternative jobs more easily. Until then, I don't expect the porting number to go up from the 2K or so estimated recently.

Thanks, I was concerned after reading somewhere that Eb3 folks were paying 25-40K for porting to consulting companies (not sure how genuinely true it is..theyre from another forum). While I say that, just want to add a note I do hope the best for Eb3 folks, and I totally empathize their situation. If they do port to Eb2 may God give them GC fast, as they deserve it as much as Eb2 folks.

Man this one I couldnt resist chiming in. The point made by the korean body is totally BS, you are saying you cant wait additional 2 years when similarly qualified people wait for much larger years. The argument doesn't hold merit.
Koreans are really eating away a lot of the EB2 visas anyways, since their family based is less.
Very intersting though was the read that IEEE USA supports this. In the past they have really hammered H1 and other employment based avenues of us getting in. This is a now or never thing in my opinion. This bill: This is it.

If you are asking about the fluctuation in number of 'Upgrades'( EB3 to EB2 ) this year over last year then: IMHO, upgrades would be less this year compared to last year. Simple reason is, people who are eligible and upgrade-able would have already upgraded in flocks by now. The remaining folks who would become eligible this year and waiting would be less, because they will have to quit their current jobs and find another one to file EB2. In any case, fluctuation and it's impact would be minimal on SOFAD, if that's what your concern is.

I disagree. The coming soon on the 1st of the month itself as well as CO's intent to move majorly forward in this holiday ended month, both indicate a release on friday the 4th, 10% chance of monday the 7th

I was planning to go to Bahamas in June 2011 ..booked my tickets/blocked my interview in Nassau Bahamas..for some reason i called up US embassy in Nassau and they told me they are not doing H1 B extension stamping..Once i got confirmation I cancelled my interview ...and cancelled tickets(loss 300 bucks because of change fees which airlines are ripping common people)..By the way i did do once extension in Nassau in 2007 and it was piece of cake and it is close to my place Tampa...So please check back with them and then go!..Good luck..

Hello Guys,
Pardon me if i am interrupting the flow of discussion.
I was convicted of a DUI in New Jersey in 2007. I have completed all the formalities and also have the court disposition letter. I have these questions:
1. Do I need to include the original court disposition letter (with the court seal) in my I-485 packet or is a notarized copy enough? Its not a big deal to get that letter, it costs about $20 and I can get it in 2-3 days.
2. I plan to include copies of the police report, court documents, course completion certificate, receipts and the disposition letter. Do all these documents need to be notarized?
3. DUI s not a criminal offense in NJ (At least it wasn't in 2007). I was not finger printed. I have my lawyer's letter that states this. Do I also include it in the packet?
It was a big big mistake in my life and I want to make sure that it doesn't have any adverse impact on the GC process. Are there any other steps that I need to take?

I'll try to answer.
Q1) Please keep a minimum wait of 3.5 years assuming fairness act will turn in to a law. Remember 140K visa limit annually is not changing . So really hope for SOFAD to spill over to EB2 besides the fairness act guaranteed numbers.
Q2) I would be a little doubtful if you will qualify for EB1 . EB1 these days is under intense scrutiny and your employer should be big enough to have international engagements and your role should be broad enough to be an international executive . Most importantly your employer should really go all out to support your case to make it EB1 . Per my knowledge of EB1 cases , typically many dont qualify , however depending on how flexible their organization is pushing it for you , it is a great option if you can .

I just wanted to open up the topic of Demand Data, for discussion. IMHO the cumulative demand data for India and China (prior to 1 January 2008) should atleast remain the same (if not decrease) from the number of 2675.

I just wanted to open up the topic of Demand Data, for discussion. IMHO the cumulative demand data for India and China (prior to 1 January 2008) should atleast remain the same (if not decrease) from the number of 2675.
What do you folks think?
I agree with you. Unless he is doing any QSP allocation.

Nishant, just my 2c of brotherly advice. You are way over invested and over obsessed about this bulletin - I would say to the point of being unhealthy. It will arrive in due course and it won't change anything that matters in your life - your family, your friends, your self-worth, your memories etc.

Apart from the documentation you have to fill G325A form for each of the applicant, sign it and send it along with the rest of paperwork. All other forms would be filled by your attorney and should be reviewd along with you. For medicals Doc office asked me to showup for the tests and they would fill everything, I will just review my personal details and confirm they are correct.

Based on trackitt data, i see one 485 approved on 11/1 and one 485 approved on 11/2 from India EB2.
May be CO does not have enough visas for this month. Any ideas?

You will be able to apply the 485 between Dec 1 - Dec 31 only if you are current in Dec VB.

No you don't have to file anything extra yourself. That's the reason you have attorney, to do the work for you.
or may be you should be more specific what made you ask this?

I re read on murthy's site and found this.
"There is a possibility that the EB2 cutoff date in December could be even more favorable than March 1, 2008. Since cutoff dates are based on estimates of demand, the DOS will use data regarding early November 2011 adjustment-of-status filings (Form I-485), prior to establishing the December cutoff date. The cutoff date movement in the November 2011 Visa Bulletin permits a large number of individuals to file for adjustment of status as of November 1st. The DOS monitors the filings to determine whether anticipated demand matches the actual demand for visa numbers."
If that is the case then they will wait for more time to get idea. Or they can go up to March 2008 this month and in Jan they will use nov filling as pivot point to decide how many they will get in Dec.
They can't use oct since that was most favorable date in 2007 and only give them PWMB .. but Nov can give them full idea of average demand per month.
Lets see what he does.

I believe Nov demand will impact the Jan and Feb VB rather than Dec. Personally, I don't expect dates to move ahead until April anyway (the next QSP) - after Dec VB.

So far the approvals have been extremely lukewarm at best. Pardon me if i am interrupting the flow of discussion.
I was convicted of a DUI in New Jersey in 2007. I have completed all the formalities and also have the court disposition letter. I have these questions:
1. Do I need to include the original court disposition letter (with the court seal) in my I-485 packet or is a notarized copy enough? Its not a big deal to get that letter, it costs about $20 and I can get it in 2-3 days.
2. I plan to include copies of the police report, court documents, course completion certificate, receipts and the disposition letter. Do all these documents need to be notarized?
3. DUI s not a criminal offense in NJ (At least it wasn't in 2007). I was not finger printed. I have my lawyer's letter that states this. Do I also include it in the packet?
It was a big big mistake in my life and I want to make sure that it doesn't have any adverse impact on the GC process. Are there any other steps that I need to take?

Champu bhai.... on this one, please dont listen to anyone other than your immigration lawyer experienced in these situations... i wish you all the best and darne ka nahi....even with DUI, lot/almost all get their GC's....just need a good eligible experienced lawyer....galtiyan sabse hoti hein bhai... tension nahi lena ka....

Guys with out my fault and because of my employer's mistake back in 2009 , I was out of status for over 2 months . My employer withdrew my visa and didnt tell me . He told me 2 months after he did it and I rushed to apply for h4 since spouse on h1b and h4 got approved , got an h1 with a new employer and then about 1 year transferred h1 to my current MNC corporation. I have an M.S from a reputed university and about overall 3 h1b's and 2 h4s all approved. Now as my spouse primary is readying to file for 485 next month ( if current for Dec PD 07 Ind) , jitters running through thinking about those 2 months of out of status. I had already put this question to this forum earlier and Q was kind enough to answer. I'm fearful of any rfe since that year I did not have payroll run for few months and dont have pay stubs if proof is sought. Since that incident I have no t left the country or traveled outside . I confronted my ex employer and he said since I'm not the primary applicant I should be ok . Any thoughts from gurus ? Now I'm also wondering if in the form somewhere I should accept that I had been out of status or not .

She just replied that she needs only Pay stubs and W2. Not the tax return copies.

I was asked for the recent W2/Tax Returns/Latest Pay Stubs. Again it depeneds from lawyer to lawyer. Go by what your attorney is comfortable with.

The whole experience was a nightmare when it happened. Tab g**d fati thi, lekin uski wajah se kaafi positive changes hue life mein.. I had stopped thinking about it, but when I'm preparing the docs for filing I-485, yeh gadaa murda ukhad aaya.. Dimaakh mein Jagjit Singh ki ek ghazal (main chahta bhi yehi tha, woh bewafa nikale) ka ek sher constantly chal raha hain..
"Kitaab-e-maazi ke panne ulat ke dekh jara..
Na jaane kaun sa panna muda hua nikale"..

When the attorney asks for the tax returns, is it only the Federal returns that we have to provide??? Is my understanding correct or do we have to give the state returns as well? I can ask questions to the attorney only after my date is current.

Hello Gurus,
I have a same problem with my wife's H4 Visa. My employer's name is miss-typed on her H4 visa.(ie. instead of "ABC", they wrote "ABNC"). Do we have to correct it? My concern is if we go to consulate they will give us 221(G) and then we don’t know when we will get her passport back. FYI, she already has her returned ticket.
Should it create any problem in future immigration process or port of entry? Please advise.

As I had posted, I am in India with my wife for Diwali. We went to New Delhi Embassy for our H1B stamping - our interview was fine and quick (I work for a large Univ in Business School and she works for a large bank). We got our visas back in 3-4 days - all fine - except - they had printed our Employer Names wrong - wrong campus in my case and National Association in her case instead of North America (for HSBC N A). They asked her to submit the passports back for visa correction to VFS with a cover letter. We did that. No response for a week and finally today we got an email saying that the passport is for 221(g) administrative processing.
This is such a shock to us. We are on H1B for more than 3 years and this was just a reissue of the visa. There is nothing in our background that will inspire suspicion. We even had the visa - it was their mistake that they printed our employer name wrong (BOTH OF THEM!) - and now we are stuck.
PLEASE if anyone has any thoughts on the way forward - please let me know. This is the first time I have ever had any immigration problem and don't know what to do. Please help.

point taken kd. Its difficult to do so though when 8 days from last cut off, but I see where you are coming from.
Just ordered a pizza hut pizza in all its glory. I have been sick with cold and fever, glad right now, so that doesn't impede me during the 485 running around.

Thanks Pedro. Except for that one blip , I dont think I have had any issues with my immigration. Are you supplying all of your spouses visa approvals or 797s or just the current one. It gives me some confidence since they had approved my h4 despite the delay. If I'm so unlucky that they zero in on that specific scenario , then not sure what kind of proof I can get possibly . I'm hoping they will breeze through . Yes I do have an attorney so let's see how it goes.

True. My Attorney asked me to submit only the most recent copies of I94, I797 and Biographic pages for my wife (I am the primary applicant).
I read some where that, if some one is out of status, they can go out and get the Visa stamped. This will resolve their out of status issue.
Moreover the back ground check revolves around the primary applicant, but it doesn't mean that they will not check the legal status of dependents.

I have a question.My H1 elapsed last month(could not extend it because of lack of ead /6 year completion/ my GC did not advance until I140 ) hence applied for H4 visa. All I have is a receipt for H4 that it is applied. My spouse priority date is feb 2008 under EB2I. In case if the dates become current for applying for 485 should I need to have H4 approval or does the receipt suffice.

A friend of mine was in a similar position back in August 2007.. He had applied for H1 extension and it was in process while his PD became current.. his lawyer submitted the receipt as a proof of his current status.. His H1 was approved about 15 days after he submitted the I-485 application. When he went for the biometrics, he carried his approved H1 and a copy of it and told the officer about it. He handed over the copy to the officer, at the time of biometrics.
He was expecting a RFE about the current status, but didn't receive any. His GC was approved recently. The officer must have updated something in the system or he could have received an RFE for a different reason (that I'm not aware of) and he updated it in the system.
I guess your situation is similar to his, so you should be fine.

Stepping in to Nishant's shoes, I can very well understand the situation. My PD is several years from being current, still when the VB comes out, its like my whole life depends on it. Now take that and exponentially increase it and see how it feels like when you are 8 days away.
I wish good luck to Nishant and all others whose PD is getting near.

Note sure if my response is too late for you. Posting here just in case, it might help you somehow or anyone else in a similar situation.
My H1 was extended, beyond the 6 year period, on the basis of a PERM that was pending for more than a year. My PERM was in audit and got cleared through the backlog reduction process only after 2 years. In the meantime, I had got my extension and visa stamping done.
It specifically stated in my extension that the reason for extension beyond the 6 year limit is due to PERM being in pending status for more than a year.

If Fragomen isn't your attorney, you are just going to confuse yourself. And believe me if the list by Fragomen and your attorney differs, you are going to be worried and tensed. Sometimes the more you know the more you will be confused.
Also each case is different based on individual's past and present circumustances. So some case needs W2s, paystubs, etc. as supporting documents but others don't. And that could be the reason why USCIS doesn't mention it is required.
So I would suggest you should stick and trust your attorney's instructions or else should hire Fragomen.

Today I talked to our attorney friend and asked him his views on statement made by Mr. Oppenheim about future movements within EB and FB category and what information they have across their law firm regarding EB2- IC
Here is his feedback as per information floating around the firm.
"Mr. Oppenheim did make those projections for EB and FB category. All the stated projections did came from Mr. Oppenheim himself. Everything other than "01 March 2008" for EB2 IC was explicitly stated. During addressing everyone in meeting Mr Oppenheim mentioned that significant movement as big as 3-4 months is expected in December bulletin with follow on movement in Jan- Feb 2012 based on demand. I(attorney) am not sure if specific date of '01 Mar 2008' was given to specific group of people later on but was not mentioned in our presence. On asking about excessive backlog in currently released inventory and it's repercussion on the stated projections, Mr. Oppenheim mentioned that he is not aware of released data from USCIS and will look into it later. Nevertheless, he still made it very clear that some significant movement for EB2 India and China is necessary to generate demand for fiscal year in order to keep cases adjudicated for processing at USCIS later in the year.
Based on released inventory it may be that Mr. Oppenheim will rethink his projected movement for EB2 India and China. I(attorney) believe this would mean bigger movement than 3-4 months for EB2 India and China in December and early retrogression than projected in summer 2012 in such case. Is it a rule that VB is done 1-2 days after Demand data? I maybe wrong but I thought I noticed an instance (maybe last month or 2-3 months back) where the Demand data was either released same day as VB or even a day after.

There's lot of information and mis-information put together in different piles, depending on whom you ask. This could go into either of them. If at all, you may be adding a drop to the infinity (confusion), so no worries :)

Lot of comments on need for Tax return or not.
Found this paragraph in instructions section. This may explain why some attorneys have asked for W2 and tax returns.

Ok qbf, and all others, this is my take. Today was no probability of VB anyways, it was only for demand data maybe. Last demand data was dated October 4th for data collection, the third working day of october, and today was the third working day of the month Nov 3. They published demand data on October 5th, the fourth working day of the month, tomorrow is the fourth working day of the month. They also released VB the same day.
Probability of VB releasing on the 4th, 7th, 8th, 9th and 10th is the same for now, and with each passing day after tomorrow, the probability of VB release on subsequent day will keep on getting higher!
I say the VB shall be released tomorrow. I know it has never happened, so early on the 4th of a month I think, but I am asking for it :) The demand data IMHO is not significant for this VB, it won't matter. Whatever CO wants to do, he will do. This VB he is the God, next VB on, USCIS and other reasonable factors too, shall affect and cloud his hands.

Receipt should be fine. With Receipt your status is legal upto 240 days, if it is not approved until that time.

Thanks to all the helpful advice, I am happy to report that the 221G for correcting the employer's name in the H1B visa has been resolved. We received our passports back today, just in time for our flights back next week.
For future reference, I am documenting my experience here. My H1B visa stamping was done in New Delhi Embassy. When we received our passports back, we realized that the employer names had been misprinted (a different employer with a very similar name, somebody selected the wrong option on a drop down, I am amazed that there is no data validation for this critical step!). We contacted VFS and they asked us to submit the passport for visa correction with a cover letter and a small change fee. We did that on Oct 19th. We did not hear anything back for many days - so we sent emails to VFS and they told us that our case was in 221G processing. We duly freaked out and reached out to people here on the board - we received many informative replies with the common theme that 221G is a blanket umbrella term and since the visa is already issued, this is a minor case and it should not take much time. A 2-4 week typical turnaround time was mentioned. Today, its around 2 weeks and we got the corrected visas today. The old visa was stamped with "Cancelled Without Prejudice" and new visa with the correct employer name was printed on a new leaf. VFS staff mentioned that it took a little longer because of Diwali etc or such cases are usually done in a matter of days.
So a happy ending. Thank you again to all the posters who took the time out to share their experiences and advice. I hope my experience will be helpful to other people in similar situations in future.

Since they have not asked for any documents, I am just going to keep my fingers crossed, check my email like a maniac, inform my company of the stupidity, call VFS with the regularity of going to the loo after having golgappas* and finally, send laddus* to all of you once I land back in US.
*PS> QBF - golgappas are a street food in India that are sure to give you diarrhea (although I have avoided the fate on this trip) - but they are so tasty that you can not resist them. Laddus are a kind of sweet - usually distributed on occasions of celebration.

So far the approvals have been extremely lukewarm at best. The 11/02 approval is EB2 ROW the guy is from Germany and the 11/01 approval is from someone with a Sep 2006 PD who had an interview so must have had a cap number reserved for his case kind off when his interview was scheduled. Besides that I read of another one which is again ROW - Cross chargeability. It’s still early days however if we do not see many approvals then it is indicative of numbers not being allocated. There were still 2.5K cases available by the last demand data. QBF what’s the news on MITTBS.
Friends approvals on Trackitt are fairly silent. 3 cases approved yesterday 2 of them are EB3 ROW and 1 is EB2 India. So so far 2 EB2-I cases approved this month.

If the same trend( slow down of approvals) continues for next 3 weeks, Jan VB will not pose good news for EB2I.
That said, this slow down will not have any effect on December VB, which btw must be just waiting to be uploaded.

Teddy, approvals for the applications with PD beyond July 15th will be delayed right, just they are applying, it takes some time to get the finger prints, verification,... Correct me if I am wrong.

Now this is indeed a very great observation. I totally agree with you. Especially if they dont release today, then it might be just till tuesday, as on monday they would need to grab stuff dropped off on the weekend.

CO has to monitor the incoming applications in NOV to decide the PD in Jan VB but not the approvals, correct me if I am wrong. This movement is mainly for the inventory build up.

Finally got the approval email today for myself and my wife.
EB2 India Priority date 5/30/07 Texas Service Center.
I contacted Senator's office on 10/4/11. I received a reply from Senator's office on 10/11/11. The reply stated that my category was EB 3 India and priority date was August 17, 2007 and that there was no visa number available currently.
I sent a follow up inquiry via Senator's office on 10/12/11 with I-485 receipts and I-140 approval notice. I received a reply back from Senator's office on 10/19/11 that USCIS has forward my application for further processing based on the information I provided.
Opened a service request 10/24/11. Received a reply on 10/31/11 that the application is being processed and I should hear something back within 60 days.
Sent an email to tsc.ncscfollowup@dhs.gov on 10/31/11 requesting the status of the case. Finally I received the approval email this morning.
I am sure if I had not gone through the process of contacting the Senator's office, my case would still be pending... I think if you have been pre-adjudicated, it is advisable to contact USCIS via Senator's office as soon as your priority date becomes current.

Teddy got it, I see 2 EB2-I approved with PD 07/27/07/ and 07/31/07 in trackitt, that means CO allocated good number of visas to EB2-I for the November Month.

Basically, he will have to look at visa number in hand( A) and applications that a ready to be approved (B) and decide how far he can move the dates. B will not include all incoming applications, just the ones that could consume visa. As 'A' dwindles, his ability(reason) to move dates farther goes down. yes, date-movement is to build pipeline, but also must meet the legal-framework as much as possible to avoid ruckus.
CO has to monitor the incoming applications in NOV to decide the PD in Jan VB but not the approvals, correct me if I am wrong. This movement is mainly for the inventory build up.

I don't know if we should exactly call it quarterly spillover because it’s happening well before the quarter end but he seems to be moving by some monthly rule of allocation and so far the supply is sufficient to meet demand. There is also a possibility that the I140 denial rate is higher than what we have been used to.

Teddy as per Q, the QSP can be applied anytime during the quarter, at the end of the quarter (for first three), no category should exceed 27% of total allocation possible. I am not sure about law verbiage behind it, just citing from Q's posts. Maybe Q should re-affirm this statement.

Also the 4th sounds very early, almost a hack job, I did random clicks on previous years bulletins, and really none were this early.

Nishant thanks; I did not know that QSP can be applied anytime in that case it is actually happening. This will bring early relief to all. So definitely it’s QSP or its variant or avatar but it’s something good happening for sure. The real test will be when we start to see PWMB approvals for those who filed last month.

friend, murthy is late, people on this forum already pounced it on long time back.
I will tell you what murthy article doesnt say. The inventory shows big year over year increase in backlog for EB1 and EB2ROW, pointing to decrease in SOFAD by at least 8k for this year. But that assumes:
1. 140 approval rate is what we think it is, if it is lower, the backlog reduction will reduce the 485 but in terms of denials, not approvals
2. this year's incoming demand for EB1, EB2ROW will remain the same. It may get lower, which in case may balance the backlog reduction
3. USCIS will indeed to backlog reduction effort. they may or may not. if CO does QSP, then only in the quarter or next few they do this effort, we would be impacted, not throughout year. So I hope he does QSP.
As far as cut off dates, I have always mentioned, CO should look at past trend and grab minimum that plus buffer, and disregard the backlog kind of factors for now. He like us does not know future, and has to be safe side.

Kanmani this means that CO is allocating numbers to the batch for the Nov VB it’s a very positive sign that numbers are being allocated freely. We know that most of the preadjudicated cases before Jul 15th are approved already. I believe that if the approvals keep coming like this it is some kind of spillover or excess allocation as they have crossed 6K (I+ C Allocation). Note China’s Jul 2007 inventory is higher than India and EB2 I +C inventory excluding PWMB’s for Jul 2007 is more than 3K.

I believe 6k has been used up for sure, its upto CO to account for them as either as 6K totally as annual allocation or 30% of 6K + Spillover as per some rules in the first 3 quarters only 30% can be used. Either way it’s very good news for all of us. We now need to see PWMB approvals to strengthen this theory.

Yes definitely otherwise all these cases would have had to wait till the last quarter, but let’s wait for more to happen. Iam basing it on the fact that 6K has definitely been used up. We need to be cognizant about the consumption as well now not really for intake purpose yet but from the annual SOFAD perspective.

This can be done very easily from CO point of view.

Although not to further increase hopes, I think I am already guilty of that a bit, I have seen bulletins get released around 2 PM PST.

Also note that May, June approvals of I140 were very high. I have noticed one thing that whenever CO announces that huge numbers are available like in May even USCIS goes into high gear on 140 and thereby diminishes the actual movement that CO would have done as he is bound to go by USCIS input at that time.
- CO commented in the bulletins about the heavy EB2 ROW and EB1 demands.
- In 2007 the reverse had happened the cap numbers were allocated to the cases when the date became current actual approvals came months later, here however the cap numbers cannot be legally allocated to the case as Apr 15 - Jul 15th were not current in the last 2 months of FY 2011.
- Even now there is a very high number of people in the inventory for both EB2 ROW and EB1 and with I485 processing fast these cases can be virtually made ready for approval in a month’s time.
- For the last 2 years USCIS has been announcing in early September that numbers are over this means that they did a neat job.
- In the inventory published on Oct 01 the demand for EB2 I/C for Apr - Jul is present in full and not reduced strength.

All these points strongly indicate that the cutover from 2011 to 2012 was a clean one and all the approvals that came in Oct 2012 are from 2012 cap. I hope all these factors are convincing enough that these are indeed 2012 numbers.
Most likely IMHO these are all from the 2012 cap.

Today alone I saw more than 20 approvals on MITBBS. These guys have PD after 7/15. Looks like they are approving all the cases between 7/15-10/15.

Thanks, it maybe 30% of 6K which is legally allowed and QSP which was always legal and never done. using numbers from the previous year may be completely against he law. He may have a tough time in any audit explaining that.

maybe some IT guy in USCIS removed the I/C filter in the internal application by mistake, so they removed the restriction b4 HR 3012 is passed :)
at least 20 primary applicants got green and that translates around 40 visa numbers. all of them are between 7/15-7/31.
I think they are approving now. A huge wave of GC is coming.......

I don't think CO can guesstimate the demand based on Nov 1st to Nov 10th. So many people are in hurry to apply as the doors are opened after a long time, many would make sure their application reaches there by Nov 1, at the same time several people are not ready with their docs(birth certificates etc...).
The lesser the number between Nov 1st and VB release date the more the chance of Advancing the date >Mar 1st 2008.

I don't think it will be zero. As CO wants to play safe game by having some documentarily qualified IC demand. Otherwise he would be questioned why he did not open the doors earlier.

A lot of people in that group have had FP done. Some PWMB cases in the past have been approved in 2 months. So at this rate we might see some pwmb approvals at the end of this month.

I think its not to estimate total number of applications, but maybe to make sure, that the trend they are expecting is holding. for example, if they receive 12k applications from Nov 1st to 10th, and their expectation for the total move was 10k in Nov VB, and 10k in Dec VB, then they may extrapolate that the Nov VB will in fact be getting them closer to 15k, and they only need 5k from Dec VB.

If he goes by demand data, with these many approvals there will be very less demand left to process. All these newly filed cases from Nov 1 are not considered under demand. Future demand + Left Over Demand+Buffer > Available VISA Numbers. This is what he should think now.

Bieber I just filed on Nov 1st don't have anything yet. The current trend does point to a consumption of 6K last month and 2.5K this month if no PWMB’s get approved. Basically looks like all preadjudicated cases are done. What remains is pwmb for last month and Nov filers. I think they must be gauging the numbers at the lockboxes the receipts come later; most likely they will get 80% of the applications by Nov 10th.

Also I believe now that the inventory shows even those I485 cases (Concurrent filing) where I140 is not approved otherwise if the I140 were to be approved for these there would be absolutely no reason not to approve them. I140 is the bottleneck for EB2 ROW and EB1. Good luck to you, you maybe greened later this month itself or worst case before the end of the year.

I am trying to formulate a theory to support your last part Q, as well as credit to Teddy on a conversation I had with him earlier today, and by this attempt to formulate a theory, try to explain the incredible phenomena of the Oct VB in which people are also getting green cards, not just date movement. Assuming by law, DOS
can only give 27% (is it 30%?) of all visas available in a category in the first three quarters max., following would be availability:
EB1: 10810 or 3603 a month
EB2: 10810 or 3603 a month
EB4: 2683 or 894 a month
EB5: 2683 or 894 a month
Total: 26986 a quarter, or 8995 a month
233 a month is already the normal quota for EB2IC.
Each month USCIS fails to produce adequate demand of non EB2IC, the unused numbers are given to EB2IC. This is monthly spillover, not even quarterly spillover, lets call for argument sake. Or at least if quarterly only, then each quarter, similarly all remaining is grabbed onto EB2IC. What has happened this FY 2012 so far, however, almost looks like monthly spillover, it is not QSP.
Now say DOS wants to always maintain a inventory of 20k (assuming 7k approvals of non EB2IC as worst case) to always remain ahead of the curve of 27k a quarter, hence the intent of keeping on moving dates. Anytime USCIS presents a substantial non EB2IC demand, or DOS feels they obtained 30k inventory, which is higher than the 26986 max a quarter, they pause or adjust the pace of the movement, cleverly done and based on amount of non EB2IC demand presented by USCIS, they might not even need retrogression. This way EB2IC keeps moving, inventory keeps getting built up, and based on non EB2IC demand by USCIS, adequate congestion control is done, any bursts of non EB2IC are accommodated and when the bursts go away, again same EB2IC picks up steam. It is a fair system IMHO. Visas are not wasted, current categories remain current, laws are followed, there is no mad rush anytime, EB2IC is not penalized for USCIS's failure to process other categories backlog consistently and then by them making up for it suddenly in last quarter like they did in last FY August. If they are applying this to EB4 and EB4 demand then keep in mind, this also takes away the possibility or at least reduces by great deal the quantum of EB1 backlog reduction cannibalizing EB5 and any possible EB4 SO from coming onto EB2IC.
this idea may be totally not right, but there might be some form of at least QSP in play to explain. only those who try, may fail, tear apart as you like :)

You are right with this one. That is the reason, I was thinking(assuming) that CO might have allocated visas for these apps even before FY 2012 commenced. But again, the numbers don't support the assumption, plus there is no reason for CO to not move the dates in September itself if he was prepared for this movement.
He may have a tough time in any audit explaining that.

The current events are simply amazing. However couple of things still needs to happen. The numbers are being allocated like the free flow captain cook salt (Remember the ad from our school days). For all non Indian folks, Tata salt had a monopoly however it would get damped up, then this brand came up which would not dampen that easily, right now looks like free flow is happening to the visa numbers.
- PWMB batch from Oct is still waiting we may start to see their approvals later this month at the current rate. The dates if at all they retrogress should not go behind Aug 15th as there is nobody left there except for the PWMB's now.
- The Nov batch is actually far bigger I believe it’s a little early to say how this would work out unless we see the previous batch PWMB's being approved.

I do not think so CO will ever try to game the system or do anything out of box unless he has approval from higher-ups. There is already some controversy about if DOS should even be allocated right to issue visas. As per HSA Act of 2002, DHS was supposed to have final approval over visa issuance and DOS was just suppose to work on their recommendation. In 2003, consensus was achieved among two departments and power were bestowed on DOS. After Dec 2009 Xmas plot, this was relooked into if DOS should be issuing visa numbers and is still in radar of many congress members. So CO will be careful about making any such exceptions which are against law that can ultimately cost him his job, as no visa issuance power with DOS means no job for him.

This article will also tell you how failed Dec 2009 XMas Plot to attack NW airline changed some bestowed powers that consular officers now have in consulate abroad. This is were all 221(g) started happening. Now officers at consulate can reverse any approvals made through USCIS that too with no question asked.

it takes USCIS at least 10-14 days to sort things out and send a receipt number, so until that time there is no way they can communicate to the DOS/CO about demand for NOV, also from statements attributed to the CO, it seems he really does not care what the numbers are and will advance the dates anyways.
That makes it very surprising, they did not release the VB tonight, should we read anything to it?
