View Full Version : EAD renewal applied, job offer now - what to do?

I am on EB-2 and my i-485 status is in the signature. My EAD expires March 2013 and H-1B expires September 2013.

My current company "A" (that has applied for my i-485) has requested to start the EAD renewal now. I just interviewed for another company "B" and have an exciting job offer which is compatible in terms of position (AC21 portable).

My questions:


Should I apply for EAD renewal with company "A", switch to company "B" while EAD renewal is pending, and apply for AC-21 portability after joining company "B"?

Should I apply for renewal with company "B" instead, and apply AC-21 along with EAD renewal?

If I am given an option for a start date at company "B" - what is the ideal date to start? Should it be as soon as possible or should I delay as much as possible?


I have used AP card for travel once (H1 Visa stamp has expired on the passport) - in case this matters. I want to use AC-21 portability and not H-1 transfer.

self.coach - I think it doesn't matter. You can take any path and you should be ok. AC21 and EAD can run parallel. Porting of AC21 doesnt invalidate existing EAD nor applying EAD is tied to a particular employer at all. So go ahead and do what you prefer.

I am in the same boat as you and somewhere in my head i still worry about any kind of hassles doing so. My company "A" who is sponsoring my GC use Rajiv Khanna(immigration. com) , when I contacted them, they mentioned there is no documented legal issues while using AC21 .. see immigration.com FAQ on AC21 portability (http://www.immigration.com/faq/adjustment-status/ac21-portability-changing-jobs-after-180-days).. They are charging me 1200 to file AC21 and take care of any legal responses after math..
