A quick note. Sometime in last couple of hours this thread surpassed 300K views. What's interesting is we had passed 200K just on 24th May. So the next 100K came in just 22 days!

Our source is greened. He just received the card production notice. He is very thankful to this forum and to all of you. He will continue to help us in future. So dont be alarmed about anything.

One of the many interesting facts about him is he never had any lawyer EVER. Not that I would recommend that to anybody.. but its interesting that people do that. We wish him the very best and thank for his continued support!

Got green cards in the mail this evening.

Contacted the senator on 28th June, she confirmed that the card was approved on 1st July.

I strongly suggest that people who are current contact the senator this really help.

I was greened on 7/7. I called customer service and talked to a second level rep who confirmed that both my and my wife's cards were approved. EB2-I, Dec 2006 PD. Filed in Aug 2007. This is the best immigration related blog out there. Thanks for all you contribution.

Congratulations to Q and others who are current now. Our optimistic scenarios have not materialized - but at least we still have positive movement. There is another VB to go before the dust settled on this FY and I hope more people will get current. My PD is too far for the VB of today to have made much difference as long as visas are not being wasted. I was hoping for a pipeline intake so that people get at least EAD/AP relief and we get some visibility regarding demand after 07/07.

Isn't it sad that this FY we received the highest SOFAD ever and still the dates have moved less than a year overall.

On another note I just want to thank everybody for their positive attitude on this site. Some people may have noticed that our thread just passed half million views this morning. It means a lot to me given that we started from scratch. I was not sure if we would be able to serve as many people as we are serving today. But I was unhappy enough about IV that I took the step of going aware from it anyway. Today I feel happy that we had 385 users hitting the site at teh same time. Just yesterday there were 26000 views. I am sure it was more than what IV received today and yesterday. I do wish them well. However, I can't and don't want to hide the pride and joy of this.

More than numbers, whats important is that people do it by and large in a cooperative and respectful manner. Some people may be thinking that its my personal quest or business enterprise or whatever. And I wouldn't deny that. I don't know where this will go. But I am confident of one thing - that I derive happiness out of helping and sharing and so do a lot of other people on this site. And while we have done that ... we have also donated more (literally) than we have earned through advertisement. So all in all its all goodness. I really appreciate eveyrbody;s support and contribution. Even if you have made a single post ... you have contributed positively to this forum. So thank you just for that.

What does this mean? Does it mean my case has been approved?

"On July 14, 2011, we ordered production of your new card. Please allow 30 days for your card to be mailed to you. If we need something from you we will contact you. If you move before you receive the card, call customer service at 1-800-375-5283."

Thanks guys - I had to pinch myself twice when I got the text which I was driving home. And then, the same text came again at around 11 PM. Its still sinking in; there is still wait for my wife to get approved (as dependant), but this one hurdle crossed seems like 200 lbs off my shoulders.

I am praying that EVERYONE irrespective of category and country get greened soon, so that we can all get on with our lives. I would be more than happy if they will hand over this card to a Mongolian student who is setting his foot in this country for the first time on the first day - this wait is unbearable. Good luck to all.

victorian congratulations on being current and thanks for the offer. Honestly currently we don't do anything that requires donations. This site and hosting and all is really affordable to any one of us. But thanks again for the offer and best wishes for getting the cards next month ASAP.

Will the surge in I-140 approvals have an impact on the latest predicitions of 4-10K visas for Sept?

The dashboard seems to more of a front-end for management reporting. We saw a document that showed the I485 approvals / completions were more than the receipts while I140 it was the opposite. So looks like they focused on I140 more after that. Essentially 50% of EB2 ROW and EB1 are filed concurrently if I140 processing rate goes up then most of these cases will see approval in FY 2011 This will reduce the SOFAD this year but make it a little better next year. Essentially the backlog of Eb2 ROW and EB1 will get cleared if it gets done sooner than in the current year we see less SOFAD else next year. Recently one of my friends got his I140 approval in 3 months so not all cases are taking as long as the processing time on the site.

Based on my understanding, Mr.Co said 7k will be applied to EB2 China/India.

qbf - to be honest while I do believe its possible - I doubt CO will say it so clearly. In terms of disclosing useful information he is only next to Alan Greenspan.


The SOFAD figure below is for India alone and represents the average amount EB2-I receives over the years. It is based on a demand of 16,000 a year.

Spec ... a very interesting statistic I will tell you ... if you look at the historical (i.e. 2000 till date) EB2I approvals and add the 2011 backlog of EB2I. The total number comes exactly to 16K per year. So it means while demand is 16K per year, EB2I also sees approvals of 16K per year over extended periods. So EB2I will most likely never be current as a category but the great news is they will always get GC in 4-5 years start to finish as long as no other category's demand increases in a fundamental manner.

This is curious. Now, my status has gone back to "Decision" from "Document/Card Production"

Here is the text -

On August 2, 2011, we mailed you a notice that we had registered this customer's new permanent resident status. Please follow any instructions on the notice. Your new permanent resident card should be mailed within 60 days following this registration or after you complete any ADIT processing referred to in the welcome notice, whichever is later.
During this step the formal decision (approved/denied) is written and the decision notice is mailed and/or emailed to the applicant/petitioner. You can use our current processing time to gauge when you can expect to receive a final decision.

I guess this means that my case is still not approved? Anyone have any insight?

Many congratulations to you and thanks for sharing the good news with all of us. This movement of status is normal, I read on Trackitt the status going back to document/card production means that your GC is in the mail These days they send it by priority mail you should have it by the weekend. To be sure about the address you should call USCIS and get the USPS tracking number that the card is going to the correct address. Rest assured that you are approved.

My employer has not given my PERM and I-140 documents. Intially they said my PD is XX-XX-XXXX and now they are saying different date. How can i get my documents copy.
If I am not wrong we can use G-639 form to get information from USCIS. If yes please let me know to which address we need to send this form.

Q, I have been reading old IV posts, the original EB2-EB3 Predictions thread. I kind of wanted to see the legacy and how this blog took birth. A lot of things make sense to me now.

Thanks for making this a safe haven for fellow aspirants, to freely, speak their minds, and understand this intricate process. To not fear asking questions. To not burn anyone on the stake.


Nishant, sometimes I just feel plain lucky that people liked objective analysis and then they felt it worthwhile to join hands and actively contribute. Many from the beginning continue to participate. Especially Teddy, who still runs a great thread on IV by the same name and of course is our Guru as well :)

Congrats. The work that you (and others too) have done on this blog is great. This blog has brought all of us together and though we dont know each other in person feels like we know each other well. And most important its very sane which is a testament to you and other gurus. Sit back for a moment and reflect on all the years, or go to the nearest border crossing and make the first U turn aross the border and come back....just for kicks.

I had a question/suggestion, can we have a separate thread that will help people with things to prepare for filing I485. I can find resources that will provide list of documents and all somewhere on the internet or from mylawyer but my concern is around getting medical records etc. I talked to my friend and he suggested i get all my medical records and have them handy along with vaccination records. Now i m not sure if my parents or I have these and what do others do.
Since we have a forum here of people who have recently gone thru the same(or may be not recently back in 2007) or would be going thru it now it might help others. My time is still far away. But i feel it might also give a reason for poeple to come back to the blog.
If something like tihs already exists can you point me to the same?

First of all congrats Q....have a blast today...your approval changed moods of many of us today

now i am not able to login with my userid(mesan).....logged in 5 times with wrong password...had tough day at work...didnt count how many times entered wrong......

i tried the process of reseting the password after 15 minutes, i get the password, even i enter that i am not able to login...

Guru's unlock my mesan account and let me know the steps i need to follow to relogin ....:(

I am a bit surprised as I did't submit my medical tests during the Aug'07 rush (I would have missed the deadline had I waited for the medical tests) and was expecting a RFE. Can USCIS ask to do the medical tests (like fingerprinting) after I485 approval or during ADIT processing?

My journey in US so far:
1998 - 2003 (MS + Phd)
2003 - 2005 (Employer A)
2005 - 2006 (Employer B)
2006 - 2009 (Employer C) --> filed my green card through this employer
2009 - present (Employer D) --> switched jobs using AC21
I probably should have applied earlier for green card but all is well that ends well. Looking forward to seeing more approvals and advancement of PDs in near future.

Thanks for the note. I think I am partly responsible for this delay as at the beginning I wasn't sure of staying in US for that long and wasn't too serious about applying for green card. Most of my fellow classmates have become US citizens quite a while back but well, that's life. Thankfully this long journey had a happy ending!

.... a point my lawyer always says to me: He says that people who have done masters education here in a good university, and have a clean straightforward full time job history, USCIS just rubber stamps the approval, they don't scrutinize much at all. He thinks it will be a piece of cake to get approval once dates get current.

Nishant your lawyer is 100% right. I NEVER had any difficulty whatsoever during GC or F1 or H1. In fact during one of my H1 stampings at Mumbai (oink oink) consulate, I didn't even have proper documentation. But the guy kept talking with me about phoenix weather and stamped it anyway.

Fyi, This what I did after getting current in October:
Oct 3: opened congressional enquiry
Oct 6: got response that FBI clearance done, visas available, give them 30 days .
Oct 13: opened SR with L2 officer.
I don't know if doing any of above helped, maybe the approval was just random.
But I suspect that it was the SR and not the congressman that might have helped because when I talked to the L2 officer, he didnt indicate that the files were with an adjudicating officer. He just said that the cases are under review and pending and visas are available.

Soni, It probably means ,it's at the adjudication service area pending review by a officer.Nothing to worry about in my opnion. I have read on Trackitt different L2 officers also give different stories. Were you able to open an SR with the L2 officer..?

I dont know if I spoke to L2 officer but she said to wait for 2-3 moths. So I was unable to open a new SR.

Soni, another thing you can do is a Senator/congressman enquiry. It's very easy to do and quite effective. If you look at Q's posts in this thread, he had done the same.

Thanks to PenguinA on Trackitt, I gathered the following info to help me decide which congressman/ senator to chose:

The very best and effective way to get a congressional inquiry is to go in person to their local office and meet the MAIN immigration caseworker who would be working in your case. Do not call ahead, show up unannounced. Have the release/privacy form ready( If one is not on the website, you can get one at their office ).Take your I-140 and I-485 copies. When you get there, just tell them you are a constituent and that you need to talk to their immigration caseworker to open a congressional inquiry with USCIS
You have to pick among YOUR congressman/congresswoman and the two senators, see who is your representative: http://www.contactingthecongress.org/

Once you see who represents you, look them up on the Antis website for their grades, the higher the grade, the more anti-immigrant, so try to go with the one who has lower grades: http://www.numbersusa.com/content/my/tools/grad...

For eg ....They especially gave Sen. Carl Levin an F- because he did NOT vote to "Reduce Unnecessary Worker Visas." Meaning Levin supports EB skilled workers, and more visa numbers for us. So, he is definitely on our side. ..... the higher the grade your congressman/senator, the more anti-immigrant, the lower the grade, the better.

That's what I am planning in the next couple of weeks; going to Tijuana with my next door neighbor so that I can officially claim to have visited Mexico. Another relief on not requiring a visa to travel to Canada as I have a trip planned in Nov. On a different note, mine is one of the very few I485 approvals without medical tests (this can be my claim to fame) even though I had 3 fingerprints!

Soni, If the Congressman and Senators in your area are not very pro-immigrant, maybe you can say something like this to the immigration case-worker , that "you want to open a business and buy a house and you cant do that unless you have a GC etc.." Be extra nice and polite and thank them for helping you out.
Go to their office un-announced (without any appointment) and take copies of your I-140 and I-485. You have nothing to lose. It will not harm you in any way and if it works you might get approved soon.

Some people asked me about Congressional enquiry and SR with L2 officer. As a FYI, I'm posting here what I did and the response I got. I don't know if doing either helped me or not....but the response to Congressional enquiry atleast put my mind to rest that my file was not buried somewhere. So, here it is :

Oct 3: went to local Senator's office and asked them to open an enquiry( take copies of your I-140 and I-485, as it's very important for both to be linked).
When I didn't hear back, called them again on Oct 6. The immigration caseworker said that he had contacted them on Oct 3 but hasn't heard back. So,he contacted USCIS again On Oct 6 and got the following response :

Good Afternoon xxxxxxxx,
USCIS electronic records reflect that on 8-16-07, our office received the Derivative Employment Based I-485 application referenced above. To date USCIS electronic records do not reflect that final action has been taken on that application. Please note that our office does not expedite the processing of Employment Based I-485 applications. Therefore, I cannot request that the I-485 application referenced above be considered for expeditious processing. However, since it appears that our office has current FBI Clearances for that application and since it appears that as of 10-1-11, a visa is again available for that application, today, 10-6-11, I forwarded that application to the NSC Employment Based I-485 Adjudications Customer Service area so that an adjudications officer can adjudicate that application as soon as possible. Please allow our office up to 30 days from today, 10-6-11, to take adjudicative action on that application.
I hope that this information will be of assistance to you. At this time I am closing your inquiry on this matter.

Now, I dont know if they actually gave my file to an adjudicating officer or it was just kept in the Adjudications Customer service area, waiting to be picked up by an officer.

On Oct 13, I called USCIS and the L2 officer said that my file is "under review and pending ". He opened an SR for me( He asked me to give him the I-140 no, so that he can link it to the I-485. I think it's very important to do that. So, if you open an SR, make sure you give them the I-140 no. also )
Oct 17: my case got approved.
So, I don't know what really helped me: the senator or the SR.

Lesson leant : If you decide to go the Congressional enquiry way, choose someone who is pro-immigrant (that is very important) and follow up with them after a day or two, to make sure something is being done. Be persistent. Also, ask them to e-mail you the response they get from USCIS. That way you will know first hand, what is being done.

Getting to a L2 immigration officer can be difficult. The L1 officers don't transfer the call and some convincing needs to be done. Here are some ways that other people were successful:
"It looks like there is problem with the System status updates in NSC. I found from a friend that he called in and found he got approved while online status shows "Initial Review". Can you please Transffer me to Second Level IO and get status on my application"
"the cases after mine are being approved and hence would like to speak to the L2 officer, as the information with the L1 is what I can see on the USCIS website. "
" say you want to verify your address", L1 cant do that and will transfer the call to L2
you can also say, "So and so officer said this info, I dont know why I didnt ask this ,but I am not sure why etc. and agent will transfer to officer."
"tell them right away that you want to know if your case has been pre-adjudicated and request them to transfer you to Level 2 officer"

The trick is to be nice and polite but persistent with L1 and confuse them a little bit, by using heavy words like " pre-adjudicated" etc...something that the L1 has no knowledge of. That's what I did. The first time, the L1 just would not connect me. The second time, I totally confused the L1 and he was like "what.... educated? " and I was like "No..... adjudicated" and after a while he gave up because he didnt know what adjudication was.

Keep trying as these call are not recorded and don't harm your case.
Also, different L2 officers might give different stories and if one officer does not say anything, do not get disheartened. Call again and hopefully, you'll get a better officer who can give more details on your case.

It has been recommended to pick one route : Congressional enquiry or SR and stick with it. USCIS doesn't like multiple enquiries. Also, multiple SRs are not recommended. I was really desparate so I opened the SR also, after Congressional enquiry.

PS: There are many people who don't do anything and still get approved early. So, it's something you have to decide for yourself.

I am getting ready to file my 485 in November.
I had a couple of questions.
1) What is an SR?
SR means "Service Request".When your case is outside normal processing times, You call USCIS and speak to a Level 1/ Level 2 Officer. You can request them to open a Service request for you or they offer to open one. This request is transferred to another officer who looks at your file to see what's delaying the case and what action need to be taken.

2) Why/When/How does one open one?
Why? : You want them to take a look at your case and take necessary action.
When? : If your case EAD/AP/I-140/I-485 is outside normal processing times
How? : You call the USCIS no. on your receipt and follow the automated instructions. You will be connected to a Level 1(L1) officer who will ask your details, they usually dont have more information than what you see online on USCIS website. Level 2(L2) officers have more details of your case.

3) Are these necessary or should you wait a while before attempting an SR?
This is not at all necessary. If you think that your case is being delayed unneccesarily or is outside normal processing time, then you can do a Congressional enquiry / SR. It's something you have to decide for yourself.

4) What is the whole Congressional inquiry all about?
It's similar to SR, but in this case you seek your Senator/Congressman's help. They have immigration caseworkers who have their liasons at various USCIS service centers. It is rumored that these liasons actually take your file and put it on an officer's desk and ask them to take necessary action. Also, sometimes they give a detailed response explaining what stage your case is at. eg. FBI clearance done, Finger printing needed etc.
Congressman/Senator can help their constituents with any Federal Agency and USCIS is a Federal agency.

5) How much do these expedite your case?
No one knows for sure. There are some cases where SR / Congressional enquiry helps. But there are many more people who dont do anything and get approved faster too.

I had opened the enquiry on Oct 3. The immigration caseworker did contact NSC on the same day but they didnt respond. So, I asked the immigration caseworker on Oct 6 to contact NSC again and then in the afternoon of Oct 6, got the following response :

That is absolutely correct Leo. There is no hard and fast rule as such other than that. From my conversations with L1/L2 officers, they are always like.."oh.. so, looks like your case is outside posted processing times, I will therefore open a SR for you "
Also, about 4 months back, I had applied to renew my EAD and AP and thought that I might get a new FP notice because of the renewal. I thought they might send me a Finger Print notice while I was in India, so I wanted them to send one asap.( it later turned out that people get FP every 15-18 months for I-485 and NOT EAD/ AP renewal). So, I called and the L1 just opened a SR for me (even though my EAD and AP were within normal processing times of 3 months) and I got my my EAD/AP within 10 days.

Gosh ! I'm a Pandit now.. LOL !

FP results are usually sent back by FBI within 2 days. Most people dont have LUD after that. So,no worries there. Next is name and background check which can take a couple of months. Right now,on Trackitt....some July,2011 filers are getting approved esp. at NSC. So, I'm assuming they are clearing FBI/ name / background check etc within 3-4 months.

1: You can return using AP without stamping.
or
2: You can go for stamping and enter using with a valid visa stamp.

My PD is Nov 2008 , EB2, Got EAD & AP about 20 days back. I got my FP a month back. Any idea how long does it take to get decision on 485 ?
