hi, my ead/ap combo expires 01/26/2013. I am travelling to India on 10/25 and coming back in 1st week of december and intend to use AP while returning. Is it a good idea to apply for renewal now or after coming back? I have been proven so much unlcky that I started thinking what if my ead/ap renewal application gets rejected while I am in india? If rejected can I enter USA using the existing AP (which expires on 01/26/2013) , does it invalidate the exsitng AP ?

Kumar - I have never heard EAD/AP renewal rejection. But even if so - that shouldn't invalidate existing AP. The only way existing AP and EAD will be invalidated is if the underlying 485 is rejected.

But regardless of all that .. be fearless my friend. Too much fear will suck the life out of you. Best wishes!

Kumar - I have never heard EAD/AP renewal rejection. But even if so - that shouldn't invalidate existing AP. The only way existing AP and EAD will be invalidated is if the underlying 485 is rejected.

I don't think you will get any definitive answer and even attorneys seem to differ in their opinion.

For example, I did see that Ron Gotcher felt that APPLYING while the person was out of the Country was OK.

What everybody agrees about is USING an AP that was approved while the person was outside the Country - that is not allowed. A person can't leave the USA on a valid AP and then try to return after expiry of that AP on a new AP that was approved while the person was outside the USA.

So regardless, you wife would have to return to the USA before January 26, 2013 to collect any new AP before it could be used, assuming she has no valid H4 visa to use.

As for just applying, it probably comes down to your personal risk tolerance and depends on the urgency of obtaining the AP or EAD renewal.

When is your wife planning to return to the USA?

I don't know how EAD/AP combo renewal process works but make sure you also apply for AP renewal if you had a combo card that's expiring.

Purpose of Form :
To be used by an Applicant or Petitioner who can file their application/petition at one of the three USCIS Lockbox facilities, and who wishes to receive electronic notification (e-Notification) that their application has been accepted.

So say when you send your I485 package to the lockbox facility and also file G-1145, you will get notification when the application is accepted at the facility.

i think that the process of entry itself is no more or less easy on AP vs H1. But I think what the lawyer means is - use H1 rather than EAD to maintain your status in the US. H1 ensures continuinty in your stay in the event of 485 denial which the EAD doesn't.
As per my attorney and per my understanding reentry using h1 is far more easy then AP.
Please help if my understanding is wrong.

My EAD/AP will expire on 03/01/2013. I need to visit India urgently from December 15th 2012 to Jan 7th 2013. Can I apply EAD/AP renewal before my trip and enter using existing AP? Or only after re-entry I can apply for EAD/AP renewal? I do not have H1 status any more, as I changed job using EAD.

I am confused because, friends telling that it is necessary to stay in US between the time you apply for EAD/AP combo card, and getting approved.

Druvraj,
You are planning to renew your EAD anyways. Why not renew AP as well? When you actually re-enter the US again, you will have a choice to either use your valid H1 (duly stamped) OR your AP.

From this forum, I understand that using your AP does not automatically switch you to EAD mode as far as the "employment status" is concerned.

I have not used AP for re-entry as yet, so I am not the best person to comment. However, if you are worried about the delay at the airport because of AP, then I feel that that delay beats the hell out of the stamping process for H1B.

If you do not have to stamp your H1 before you come back, you could use H1B at the port of entry. I would suggest get AP renewed regardless.

My renewal is in process at NSC (RD:10/25, ND:10/29). My EAD/AP expires on 01/25.

I am going out of country from 12/29-01/04. My attorney said I should get the EAD renewal before I leave. If I don't, as long as I have a valid EAD/AP and the renewal receipt notice, I should be in good shape..Could someone please confirm, what the actual rule is?

Secondly, any ideas about the processing times for EAD/AP renewals at NSC and TSC??

Apparently, you can leave the country while your application is pending, as long as the biometrics have been obtained. You have to be in the country when you file the I-131.

Yes. My attorney confirmed this. If you return, while your current AP is valid and the renewal is pending, it is a routine re-entry on AP. If the AP is about to expire in a few weeks/months, the officer at POE may ask you to show the Renewal Receipt notice (which according to my attorney is extremely rare).

If your existing AP is expiring while you are outside the country, you have to specify the Consular Post location abroad, where you want the new AP to be sent to, in your I-131 renewal application. USCIS will inform you when the AP is available at the Consulate/Embassy and you can pick it up from there and use it for re-entry.

Folks who have received their EAD/AP renewals : Could you please share the details about the duration of the process?

Guys need urgent help. My EAD/AP expires on apr 19/2013. i am travelling to India 1st week of Jan and returning on Jan 28th. before leaving to India, applying for EAD/AP. I dont have H1 backup, i need my EAD to be renewed before 4/19. ( I can apply only after Dec 19th , 120 days rule).

is biometrics must for EAD/AP?Or Biometrics only required for AP?

I might not need my AP immediately, i need EAD though. Shall goahead and file only EAD renewal and apply for AP renewal once i am back?

pls suggest.

I applied for EAD renewal and got the new combo card with incorrect validity. It has validity start date as 12/13/13 instead of 02/13/13. My old card is expiring on 02/12/13.

I need information on how to get a replacement card. I don't want to pay the fee for this as it is their mistake. Also in EAD instructions it is mentioned to send the replacement application to the service center that approved the case, not to the regular filing address. Please let me know what is the filing address for replaement card if it is approved by Texas service center.

Champ, I filed for our EAD/AP renewals on 10/30/12 (almost 120 days before expiration) and got the approvals in exactly 17 calendar days!! Apparently, the renewals are being processed pretty fast.

UPDATE - Just wanted to add that the validity of the renewed EAD/AP is 2 years, whereas the original was 1 year.

It is giving general list of addresses. It does not give any address for replacement EAD card. Any one has experience with applying for replacement EAD. Please reply.

That is awesome.. I recall from a personal experience last year that TSC was a tad quicker than NSC, in issuing EAD/APs and Biometrics Notices.. My employer said with NSC, the average is around 45 days for renewals and I should be expecting renewals by the end of this week or mid-next week. I'll let you guys know, once I receive mine.. Ya'll do the same..

EAD/AP renewal took just over 3 weeks for me. Applied somewhere around 7th or 8th of Nov and got the approval emails yesterday. So super quick if you account for the Thanksgiving holiday.

I also got my H1B renewed which took about 3 months. Don't ask me why i got the H1B renewed. The company wanted it done and I wasn't going to complain if they were footing the bill.

Your status is AOS pending.

If you do not file AC21 then check with your lawyer whether your PD from EB3 can still be transported to EB2. Good luck!

I am renewing my and my wife EAD & AP this week. What shall I say on i-765 form our current immigration status (Q.15 Current Immigration Status (Visitor, Student, etc.))?

My EB3 PD got ported and USCIS had issued me new I140 with EB2 category and EB3 PD date.


Your status is AOS pending.

If you do not file AC21 then check with your lawyer whether your PD from EB3 can still be transported to EB2. Good luck!

My EAD/AP is going to expire on feb10th 2013, so, I applied fot the renewal on October 24th through my attorney and we got it approved and got our cards on 28th Nov.

My worry is that we do not have finger prints on our new EAD/AP card. Is that ok?

No fingerprinting.

Fingerprinting was needed for AOS (485) not for EAD.

I doubt if FP expires. I think it will be on case-to-case basis. I had a friend who had to go for FP 2-3 times. I think he had job change/AC21 etc.
Just my thoughts. No direct experience...

When did you send your packet in? In my case, both my wife's and my applications are in initial review (we sent ours Dec 10th) , but my wife's receipt notifications came through exactly a week before mine (Dec 13 vs Dec 20). We had to send them into different lockboxes (my wife's went to the Phoenix lockbox and mine to Dallas - surprisingly, Phoenix lockbox got the application to the Texas Service Center a week sooner than the Dallas lockbox)

Lockboxes depend on address on record. My wife and I live in different states. Hence the different lockboxes.

Now in Jul 2012 (right after 180 days) I left my harassing employer and started using EAD. I recently filled for EAD/AP renewals and got them last week (within 4 weeks of applying).

Now my question is regarding I-94. the I-94 we got when we entered in Apr 2012 on AP (as a Parolee) was valid for 1 year. So how do I get a renewed I-94? In order to renew my DL as a Parolee the state requirement is to have a valid EAD and I-94. Please advise.

That DMV system seems broken to me. Why doesn't DMV have proper access to status info of non-immigrant visa and EAD holders...

Once an SSN is issued, it stays the same for life, so getting the GC won't alter that fact. After GC, you can ask for a replacement that does not have the DHS legend on it, but that is not absolutely necessary.

Using the EAD to obtain an SSN is not the same as using the EAD for Employment Authorization. It has to be the basis for an I-9 to do that.

Even if your wife were to use her EAD for employment, it would not alter your H1B status - only you using your EAD for an I-9 would do that.

The SSA will need to see a valid basis for your wife to obtain Employment i.e. a valid EAD to be able to issue an SSN to her.

After obtaining an SSN, your wife should also inform the IRS to use it and link it to the ITIN she previously used for tax purposes.

I think it is quite important for your wife to obtain an SSN while she can. Much of American life assumes a person has an SSN an having one will make life less complicated. If your wife ever decides to work, she will need one. Also, without an SSN, it is virtually impossible to build up a credit rating. Many DMV will ask for a letter from the SSA stating the person is ineligible for an SSN for license issuance and renewal, if they do not possess one.

I'm sure there are many other reasons as well. Suffice to say that there are no downsides to having an SSN. Conversely, it can certainly be a pain in the proverbial not to have one.

Similarly, when I came to US they gave SSN to us so that we could legally work in the US for 20 hours as students. SSN itself didn't constitute work authorization but that was a critical precursor to work authorization. So I am surprised that they issued an EAD without SSN in the first place.

Anyway just go and apply locally and you should receive it based on pending 485.

Regardless whether she gets a job or not - her status is H4 with AOS pending. EAD and use of EAD doesn't change that. It will be changed if she reentered US with AP. Then she won't have H4 anymore.

There is a new systems called SAVE (Systematic Alien Verification for Entitlements). My EAD approved last year had not hit this system yet so they can't issue DL. The renewal approved few weeks ago also not there. My wife's both EAD records were not there. Any one had such issue? My DL expires in couple of days. :(

Hi Spec- I had a question and hoping you or Q or someone would be able to answer this. It is regarding EAD/AP and travel while renewal. Based on the discussion on this thread and the USCIS site it has become clear, that you need to be in the US while applying for renewal (i guess almost everyone is applying for ead/ap combined renewal), and can travel while the application is pending. However, if the AP is approved while out of the country, it cannot be used to enter the country and the person must enter before the current AP expires or risk not being allowed entrance.

I understand the above as it pertains to the use of the AP.

However, my questions is the following:
If AP renewal application is sent while in the country and then the applicant leaves the country. Lets assume that the AP application is approved while the person is overseas and during the time overseas the current AP expires. Again, i understand that the applicant cannot use the new approved AP that was approved while overseas. However, can the application still use the H1-B visa that has always been used to enter and once in the country and then in the future after being the in the States use the new AP for future travel if required. The application has never used the AP card- the current one while entering or leaving the country and has just been maintaining the AP card as a back up.

The essence of my question is whether AP approval while overseas invalidates future use of that AP after entering the country though the H1-B route. Of course, it does invalidated if tried to use the first time.

I hope this is clear. Thoughts would be greatly appreciated.

If she doesn't have a valid H/L visa to return on, she MUST return before the current AP expires or risk being denied entry at a later date and abandoning her I-485.

2. There is no requirement to be in the USA to apply for an EAD (to my knowledge).

The new 1-131 instructions say: “If you travel before the advance parole document is issued, your application will be deemed abandoned if (1) you depart from the United States.”

We would like to confirm that abandonment of a pending advance parole application does not occur if the foreign national is otherwise authorized to depart and return either because the foreign national (a) already possesses a valid I-512L and returns before the 1-512L expires, or (b) has an 1-485 pending and is re-admitted as an H-1, H-4, L-1, L-2, K-3, K-4, V-2, or V-3.


USCIS: (a) If a foreign national

(i) already possesses a valid, unexpired advance parole,
(ii) applies for a new advance parole while he/she is present in the U.S., and
(iii) then departs the U.S., the foreign national must return to the U.S. during the validity period of the current advance parole already in his or her possession.

If the foreign national returns timely, abandonment of the pending advance parole application would not occur.

However, the foreign national may not remain abroad after the initial advance parole expires and then seek to re-enter at a later time using the subsequent advance parole that was pending adjudication at the time the person departed the U.S.

Thanks Spec- I would interpret it to mean and in particular to answer my question that i would be able to use the advance parole document not the first time when i enter the country (as it was approved while i was away and in any case i will be entering with h1-b), but in the future when i don't have an H1-B (current one might expire, employer not chose to renew it etc etc whatever the reason), but at that time I will be able to use the advance parole even though that particular advance parole document was approved when i was not in the country.

Is that what you would think is the interpretation?

Yes.

If the AP was pending when you left the US and you are re-admitted in H1B status, then the AP is not abandoned and is available for future use.

They seem like pretty basic forms and something we can do ourselves. My lawyer who has been great so far is charging $250 to file those forms. I did however have a couple of questions that would like answers to.

AP

1) Part 1- Class of admission- what exactly needs to be put over here? I am currently on H1-b. I dont know what to put over here.

2) Part 3- date of intended departure and expected length of trip- I assume we can just put any reasonable dates here?

3) Part 7- On a separate piece of paper, explain how you qualify for advance parole and what circumstances warrant issuance of advance parole. Include copies of documents you wish considered. what exactly have people put for this section? If anyone can send what they send it would be great.

4) For supporting documents: It asks for copy of document issues to you by the USCIS showing your present status in the United States. What exactly is this and what do we need to send for this? does it mean h-1 approval i-797 notice?

Has anybody efiled I 765 & I 131 for renewal EAD?
I have efiled & paid the fees. My PD is Aug 2009 EB2 I. My 485 was filed in Feb 2012. I paid fees for both I 765 as well as I 131. I do not see any body discussing efiling. Did I do something wrong?

However, to take advantage of the filing fee exemption, the applications must be paper filed with a copy of the I-485 receipt. An exemption from the fees is not available if e-filing EAD and AP.

You probably won't get the fees back now even if you withdraw it.

There's no reason for USCIS to reject it, simply because you did not request the fee waiver by e-filing the applications. USCIS will happily take the fees and process the applications.

Hello , can someone please provide me some guidance regarding my EAD combo card renewal. Is it recommended to contact Ombudsman or Senator to break the deadlock ?

I filed my case in January and it was approved in April , however I never got the AP approval notice nor the combo card. Instead I got an EAD card that does not serve as AP. ( USCIS mistake )

I have called Customer service many times, they keep raising SR's and different L2 officers have suggested different ways ( including waiting for separate AP renewal doc to sending back the faulty card ) . I even visited USCIS local office and was told to send the faulty card back to get a corrected one. I sent this card back 6 weeks ago and the online status continues to read as " We received your card and reviewing it ". This when I had marked the request as an "EXPEDITE REQUEST " ( as suggested by the Info pass officer )

To add to the mess, I got another response to an SR that the L2 officer had raised and the response now says, that they sent AP approval notice and it might have been lost in the email !! ( No tracking number provided, so I am lost where to look for it )

I hate to call them again and raise another SR as every time I get a different and more confusing response.

This is coming to a point where it can start impacting my ability to change employers. It has been 7 months since I first filed the case and today I am not only without valid AP, also do not have the EAD card !

I am panicking because I was looking to change jobs in next months and cannot seem to get out of this situation despite doing everything right.

Absolutely use a senator. If that doesn't help use a lawyer.

Remember you own your application for EAD / AP. So you contacting USCIS shouldn't harm your case in any way.

I am filing for my wife's EAD/AP renewal myself first time. We filed our I-485 in March, 2012. Is it true no renewal fee is necessecary for both I-765/I-131 in case I paper file these applications. My wife reneterd US on advance Parole last year, can you advise what has to be filled in Q.14 How much is the EAD renewal fee under category (c)(9)? and 15. You can find old material from USCIS website stating 120 days, but those are outdated material by a few years.
To the best of my knowledge, there is no definite answer for you from USCIS other than "Ask Emma" tool.
Q: How early can I apply for renewal of EAD Combo card?
Emma: To renew a work authorization and advance parole combo card, you must file the Application for Employment Authorization, Form I-765, and Application for Travel Document, Form I-131, concurrently, and at least 180 days before the combo card is due to expire. For additional information on how to renew your combo EAD/AP card please access the links provided.

You can renew EAD 180 days in advance. If your I-131 is a combo EAD/AP card you can apply for EAD/AP together. Many have done it in 180 days window and got approved. I recently filed EAD+AP renewal in 180 day window and had received receipt notices. The safe way will be to apply for EAD @180 days and AP @ 120 days. But then your will more likely get a 1 year paper based AP and not a combo card. To me EAD is more important for 180 day window. If the AP is rejected for applying early, you can apply again immediately.

Take the plunge and apply for combo EAD/AP card in 180 days window. Keep both applications in same envelope.

My EAD/combo renewal is still pending (85 days and counting). Since the automatic 180-day extension applies to my current EAD (category c-9), am I allowed to raise an SR after 90 days? Thank you.

I am working on EAD since 2012. When I filed my 485 in 2012 and till early 2019, I lived in Georgia. So I have been filling EAD/AP renewal at Texas service center. I recently moved to California and I will be filling EAD/AP renewal soon. Based on my new location, should I file the renewal at Nebraska service center? My 485 is pending at Texas service center, will that affect EAD/AP renewal?

My renewal was also due Aug 2020 (C09), i filed in Jan mid (Nebraska) to account for 6 months its taking for approvals.
I stopped looking at the tracker , thinking it will be delayed further due to pandemic closures.
I was pleasantly surprised when i got new card produced message for both me an wifey yesterday.
1-131 is still i process , I am more than satisfied with just the EAD for now :).

Looking at receipt #'s closer to mine ,not an exception ,expect an approval soon.

I think it is luck. We applied for my wife's EAD/AP renewal in last week of January and we received the approved combo card on Saturday. That is less than 2 months of processing time! Mine was applied in end of Feb. Let's see how long that takes. We had applied to NSC as well.

If your combo card was expiring on March 17th, 2020 then the earliest you can file for renewal would have been Sep 17, 2019 (6 months before the expiry).

I know someone who got approved in 2 months time at TSC. However, I would advice you to file extension ASAP. Try to file it as soon as your 6 month renewal window starts. My 180 day clock just started and I plan to send my paperwork within a week.

Please approve the above mentioned applications with a two-year validity period since visa numbers for my category (EB2-India) has retrogressed and is unavailable for my priority date, according to the most recent Department of State Visa Bulletin.

I agree on the last line part of my cover letter; it's from 2014 and I'm so lazy to change it LOL.

What matters are the docs that we send and that all important bar code mailer - I don't think USCIS looks at anything other than the bar code.

I'm almost 4 months and 10 days out out so hoping to get the renewal. It will be my 6th card.

If the extension is filed timely, the EAD only ( not AP ) has an automatic extension of 180 days for C9(p)

If your AOS is pending(or filing for the first time), you apply your EAD in C09 category. As per current rules, if you file your EAD renewal before your current EAD expires, you will get an automatic 180 days extension. Hope this helps.

If your AOS is pending(or filing for the first time), you apply your EAD in C09 category. As per current rules, if you file your EAD renewal before your current EAD expires, you will get an automatic 180 days extension. Hope this helps.

Yes that is right. C09 gets an automatic 180 extension. My lawyer confirmed it too.

That’s fantastic news. My renewal date is nov 25, stuck in TSC. Last update April 17 saying “fingerprints approved...”

Do you know how long it took you from this point to get approved?

I remember that it used to be the case that if you are working on EAD and your renewal is pending; you can continue to work even though current EAD expires. I would imagine that it is still true. Somebody please speak with your lawyer and confirm this.

Yes Q. That’s accurate. We get automatic 180 day extension. Mines already expired but lawyers confirmed I’m good for 180 days. But just worried if this EO impacts the renewal. Painful as impacts ability to renew drivers license. As well as uncertainty of if they will even process applications timely.

I did not see that transition in my case and its taken about 10 weeks from the time it was filed( filed at NSC ) . The last time my AP renewal took ~7 months at NSC. It was filed in May and got approved in December last year.
Was TSC shutdown during the the pandemic , I believe Nebraska was not .

I just found out my EAD renewal was approved. Applied for renewal on basis on pending AOS. Applied on 3/31, approved on 4/30 at Nebraska SC. My wife's app was submitted to same SC on ~3/15, it is still in pending status!

What is C9P ? Can someone throw light? I am confused when you all say you used c9p for the first time. I am going to file my EAD renewal and wanted to know if this is new.

When you apply for renewal of EAD, you need to mention the category. A lot of categories are eligible for EAD (e.g., Refugee A03, Asylee A05, TPS A12 and Adjustment of Status Applicant C09). Most of us here in this thread are applying for renewal based on pending I485. Hence, when you send in the renewal form, you will mention eligibility criteria as (c)(9). This is also presented in I-765 instructions PDF from USCIS website. It goes without saying that for the category, you will send proof (attachments) to the adjudicator.

Now the discussion above was whether you need to use (c)(9) or (c)(9)(P). The additional (P) denotes a combo card application (along with I131 / Advance Parole). I have been renewing using just the (c)(9) code since 2012 and had always got a combo card. There is a document in USCIS website, that says you need to mention (P) if you want a combo card. Definitely there is a disconnect between different versions of documents in USCIS.

Based on my search, I can see that most attorneys say put in (c)(9) and USCIS will decide whether to issue a combo card or not. We people who are waiting in the backlog for 10+ years, don't have anything better in life to discuss other than to add (P) or not to add (P). IMO, this does not matter. So there you go.

TSC Lockbox RD is 17APR2020. No receipt notices or SMS or email yet. I am expecting something after 4th or 5th week based on recent trends from trckitt.

I am thinking of a theory that FedEx mailers get receipt notices faster. I sent in my packets via USPS next day to LockBox PO Box address. Atleast one other person to sent via FedEx to TSC (goes to an address). They got receipt notices in 4 days or so.

Did you use FedEx or USPS?

I applied for EAD/AP combo for me and my family (total 6 applications in single envelope) through FedEx at Texas Service Center. FedEx delivered it on 4-May-20 and I received receipt numbers via SMS on 6-May-20 (two days after delivery).

Has anyone had an experience with C(9) EAD AP renewal where 1 member got a 2 year EAD/AP validity and another member within the family got a 1 year validity. Did you live with it or attempt to have the EAD/AP corrected. Sadly the correction process suggests errors and I am not sure this is an error.

This adds additional complexities to a lot of things including driving license validity, travel etc ( if and when ).

FYI : The current one we received couple months ago has a 1 year validity for me but for the spouse it has a 2 year validity. I did not call USCIS or my attorney and talk about it.

Yep. I have the exact problem. My EAD is valid for 1 year and my spouse's is valid for 2 years. This is our second EAD. The first one we both got 1 year validity.

My spouse got two approval notices for EAD. One had 1 year validity and the second one (and the card too) had two years validity.

I don't think these fall under error category.

Update to my status regarding I765/I131 Renewal: RD 16APR2020; SMS 12MAY2020; Physical Receipt Notices 16MAY2020;

Almost all applications (I765 or I485) that went to TSC lockbox in April took nearly 4+ weeks to get receipt notices. Some I485's originally sent to TSC were redirected internally to NBC Missouri and got MSC* receipt numbers. My guess some kind of load-balancing or temporary shutdowns happened at TSC lockbox due to COVID.

Don't be alarmed if your receipts are taking 4+ weeks.

I was also able to get feedback from my I-485 attorney and she said that the dates are at the discretion of the officer. So nothing can be done. So we just have to live with it. Its sucks, but it is what it is. Atleast there is no separate paper AP like some people receive.

Do let us know what the RFE is about when you receive it. Sorry about that though. Even if it is trivial, it might delay the renewal in these troubles times.

I am in a similar situation having PD Feb 2010 and applied for EAD/AP renewal last month. No updates on the case after the receipt was sent.

Very sorry to hear that. Mine with RD of 15APR20 has no status updates yet. Hopefully, the RFE is for a silly reason like a passport photo or something. The only criteria for (c)(9) is that your I-485 should be pending. I wonder what can they dig-up in an I765/I131 renewal.

Well I wrote it using a marker pen on the back this time. Seriously, the entire thing is a set-up. Recently I read an article about the Trump admin rejecting the asylum applications. They rejected for reasons such as did not pencil A# on the back to not writing "NA" or "None" in the fields that are not applicable anymore. It takes completing these forms to a new level. smuggymba is the first one to receive I765/I131 RFEs from TSC recently. Hopefully he is not the start of a new trend with TSC.

We will have to wait and see. Please keep us nervous folks posted.

I'm pissed everytime I see that RFE email from USCIS...apparently they don't have people/resources so 25K visas will be wasted but they have time to pick on renewals.

FWIW, they didnt even use the picture we had submitted for the most recent renewal in early 2020. They used the ones from 2012. I'm not complaining, I look much younger. They really don't even give a hoot about the pictures I think.

It seems like they used the original photograph that you submitted at the time of I-485 submission back in 2012? Is it somehow an indication that they are touching/opening your I-485 application after all these years? Is there a possibility of you being pre-adjudicated? Now this RFE for smuggymba can also point in that direction...who knows? Or I may be reading too much into it! It will be interesting to see what the RFE says.

You don't even have the reason for the RFE. Then, what makes you think USCIS is at fault? You didn't have any mistakes in the past 5 renewals doesn't mean your sixth application is mistake-free. Just saying. Past performances are no guarantee for future successes.

It means SOMETHING. If you look at your past EAD, it is probably without the fingerprint. The new EAD you will receive will come with the fingerprint on it and they will probably use your old photograph that you submitted at the time of original I-485 application submission.

Are they doing this to avoid the work of scanning the latest photograph into file? Are they suddenly trying to be more efficient?

Maybe it was the only option during lock-down when the USCIS offices were closed. Maybe now that the offices are open, they will start scanning the latest photograph...who knows?

That is so odd and annoying. On my second renewal, I forgot to even send them my photographs. They simply used the photographs from my AOS photo/fingerprint appointment. They never complained. Perhaps because the picture was only 1 year old.

But I already had brand new pics with my application nicely attached to the forms with two paperclips. I even put a small piece of postit where the clip was touching the pic so it doesn't damage it. Well whatever. I'll send new ones.

One suggestion is to also validate the head size/margin as per the instructions. We may forget to do that trusting the guys taking the pic to do it right.

Glad to hear it was for a silly reason. Please take a new photo and make copies. Don't use the old photo and give them a reason to send it back.

Now a days I take it at home, use ePassportPhoto or other "google it" websites to make 4x6 sheet and order it online. Usually you get it within a week. Because, it is an RFE, you may have to stop by CVS or Target or Walmart to print it. One 4x6 sheet makes 4 photos.

I guess someone at lockbox took it out for scanning and somehow lost it? I don't think this RFE can be logically explained.

I always use a small transparent ziploc bag to send the photos to USCIS. You can clip that bag easily to other documents. When I had my AoS interview last year, I noticed they had my photos sent with 485 application in the same ziploc in their file. Photos are much safer if sent that way.

I have been making my own pockets by sealing an empty envelope and cutting a 4" length on each end to make two pockets (one for EAD and one for AP). I also write the name and A# on these pockets stapled to the main application.

Lately I realized that they advise you to puch holes at the top so that it is easier for them to file. I am not familiar with top hole file system. So have not tried that.

My guess is TSC changed address and left it there OR someone just misplaced it so it's easier to just ask for a new pic rather than spending 5 mins to look for it. Put the burden back on the applicant. Anyway, I took new pics from costco again and already send it this morning.

My RD was 17th April and ND was 7th May...so they did touch my application. The main thing now is whether they can approve it before going on furlough...we barely have 2 weeks.

I thought you could raise an SR only after 120 days? Also, if your local congressman is not a Republican, you can ask his/her office to look into it.

I live in a very Trumpy district with both Republican state senators. I have no one to turn to.

you can apply six months in advance of the expiry date (to be precise 180 days). You should be able to send it over now. I dont think the memo has any impact on the EAD/AP renewals.

Yesterday I have received approval messages for both I765 & I131 (Primary), bust still dependent approval is pending...

I am hoping to get approval for 2 years otherwise I may have to start after 6 months again (if it is for 1 year)...keep you guys updated.

I thought you could raise an SR only after 120 days? Also, if your local congressman is not a Republican, you can ask his/her office to look into it.

I live in a very Trumpy district with both Republican state senators. I have no one to turn to.
I called them today (98th day). The representative could not raise a SR as it has not been 5 months. So I told them to create a request for a typo in eligibility category. It was printed as C06 (J1 Visa) instead of C09. Hopefully this will make something happen.

I did not want to raise SR on economic loss or other emergency as burden or proof is on us. C09 has a 180 day automatic extension eligibility. So no worries other than extending Drivers License.

Did you receive your EAD card? My application was received on April 28, and approved on July 28 (3 months). But the status to "card in production" hasn't happened yet.

Just a quick status update:

My EAD was approved today (Aug 3; R/D of May 21). It was processed at TX Service Center. The status quickly changed to “card production”. Now the status shows that “fingerprints were applied to my case”. I don’t remember seeing that during the last 5 renewals.

Anyway, my wife’s EAD was approved a week ago but her status still says “approved”: it hasn’t moved to card production yet.

My wife's EAD has been at "approved" since July 28; mine showed "we have ordered your card" briefly on Aug 3, but it is now back to showing just "case approved".

No cards have been received; only approval receipts came in the mail--which is worth naught (legally).

There was a lawsuit which USCIS lost and the judge forced them send out the cards within 7 days, but I don't know if everyone benefits with the ruling. The appeal is being heard today:

Almost 20 days from card ordered to Card in hand...so hang in there.

It completely depends on the officer. Whether its intentional or not, the most recent EAD validity for my spouse is 1 year and mine is 2 years. We ofcourse had applied 120 days prior. So essentially the extension is barely for 6 months.

Update to my case: Card in hand today; details below:

My r/d was May 21; status changed to approved on Aug 3; the status changed back and forth between case approved and card ordered; card ordered date was Aug 4; Card mailed on Aug 14; card received today Aug 15.

A curious incident: The USCIS used the original photo that I had sent with my I-485--over 8 years ago, even though I had sent them recent photos. I don't even look like that anymore.

My RD was 15APR2020. Case stuck in "Case Was Updated To Show Fingerprints Were Taken" since 07AUG2020. 126th day since USCIS receipt. Lots of applications after me have been approved. I randomly looked at a few receipt numbers before and after me. Very few CPOs near my receipt number.

I could not use 180 day auto extension as USCIS mistyped my eligibility category (as C06). Opened a service request to fix that, but they never sent me new receipt notice (they had promised). I applied on 175 days or so before expiry. Card production takes 3 to 5 weeks after approval now a days. So I don't have much time left.

I am knocking at my congressman's door in this round of EAD/AP renewal.

Well somewhat positive news. I approached congressman on Monday (day 1). It took me 2 days to complete the formalities with congressman (initial disclosure form and USCIS specific disclosure forms). After they reviewed my request, they agreed to pursue my cases (primary+dependent x2) with USCIS.

On the third day afternoon (Wednesday) congressman office made a email request. Email request have a 3 day turnaround. Phone calls have 1 day turnaround.

I got approval emails for myself and dependent on the same day evening they inquired USCIS. No updates on AP.

I really did not want to ask congressman for help with EAD+AP. However, after crossing nearing the 180 day window and pending USCIS furloughs, I decided to escalate after 3.5 months or so. So if you are in a tight corner, asking congressman will help.

The U.S. Citizenship and Immigration Services (USCIS) has announced that (https://www.uscis.gov/i-9-central/form-i-9-verification-during-ead-production-delays-due-to-covid-19), due to delays in the production of employment authorization documents (EADs), a form I-797 approval notice that has a notice date on or after December 1, 2019 through and including August 20, 2020, can be used to evidence work authorization. The USCIS announcement advises employers that this approval notice can be used for form I-9 purposes, rather than the physical EAD, which normally is required. Employers will need to re-verify the employment eligibility of these individuals by December 1, 2020.

Unfortunately, this only applies to those with an I-797 approval notice. It does not serve to provide work authorization to a person with a pending EAD application.

Form I-9 Verification During EAD Production Delays Due to COVID-19

Due to the extraordinary and unprecedented COVID-19 public health emergency, the production of certain Employment Authorization Documents (Form I-766, EAD) is delayed.  As a result, employees may use Form I-797, Notice of Action, with a Notice date on or after December 1, 2019 through and including August 20, 2020 informing an applicant of approval of an Application for Employment Authorization (Form I-765) as a Form I-9, Employment Eligibility Verification, List C #7 document that establishes employment authorization issued by the Department of Homeland Security pursuant to 8 C.F.R. 274a.2(b)(1)(v)(C)(7), even though the Notice states it is not evidence of employment authorization.  Employees may present their Form I-797 Notice of Action showing approval of their I-765 application as a list C document for Form I-9 compliance until December 1, 2020.

THE I-797 NOTICE OF ACTION DESCRIBED ABOVE DOES NOT PROVE EVIDENCE OF IDENTITY OR SERVE AS A LIST A DOCUMENT ESTABLISHING BOTH IDENTITY AND EMPLOYMENT AUTHORIZATION OR A LIST B DOCUMENT ESTABLISHING IDENTITY FOR FORM I-9 PURPOSES.

Use "C09P" as code instead of "C09". Yes there is no fee for EAD/AP renewal for this category. You pay only for printing forms, printing photos and FedEx. Always get the mailing address and latest pdf form from USCIS website and check before sending them.

My EAD/AP is expiring on 12/02/2020, and my renewal application has been delivered to USCIS PO box on 11/03/2020. I've not got the receipt notices from USCIS yet. For work, I am not using EAD for my work, I am still using my H-1B visa for work.

- If I don't receive the receipt notice by 12/02/2020 (current expiry), will there be any problems for current/future EAD/AP renewals or current I-485 application process? (My PD is: Sept 2009 on EB3 and interview has been completed in Oct 2019.)

- Is it advisable to submit to another EAD/AP renewal application, prior to current EAD/AP expiry i.e., 12/02/2020.

- Is there anyway to find-out, if my application has been received by USCIS.

You have done your part and have renewed before the expiry. Please don't send out another application. It is just going to screw things up "bigly". Receipt notices sometimes take a long time, especially this year. Since you don't rely on the EAP/AP for work, there is nothing more to do.

If you don't receive it in another 2 weeks you could call and inquire as it should not take more than 30 days for them to send you the receipt .
As you renewed before the expiry you are fine and should not have any issues .

as others have suggested, you could call them in a few weeks to check. Sometimes chating is easier to get though. I would not be worried too much as you have a back up status. Not worth reapplying till you know for sure the previous one was not received.

looks like your GC is current as well (Sept 2009 EB3 has been current for around 4 months now). So i would think you have a very good chance of hearing regarding your i-485 adjudication before the EAD/AP approval. Many people with your date have already heard back on adjudication based on trackitt data. Which service center is your case with ? So its worth checking on that one too. Good luck.

Yeah. Many people with your date have heard back on adjudication based on trackitt data. I found the "ask Emma" chat feature useful. You can ask to chat with a live agent, and they are normally very helpful in providing additional information, especially if something is pending from your end. Good Luck.
