View Full Version : Need advise: Waiting to file I-485 / Employer is loosing business

Hi All,

Details: EB2, PD is Nov 2007, 8th year on H1B, I have approved I-140.

My employer is a very small company in IT services business and not doing well lately. Soon, I need to figure out what my options are to survive/get the GC. Here are the options I see as of now. Please give me suggestions/risk factors/chances of getting rejection on I-485.

1. Change the job and reapply, I know Nov 2007 may become current soon.
2. Stay in the current company and work as a sub contractor to bring in revenue. I can ask him to run payroll till I need it. Though I would be the only employee in the company.

The risk seems quite high and you yourself seem to know it. It would be safer to quickly come to terms with your situation and change jobs.
